REGULAR MEETING June 22nd, 2020
Be it remembered that the Common Council of the City of South Bend, Indiana met virtually in
the Microsoft Teams App on Monday, June 22,2020 at 7:00 p.m. The meeting was called to order
by Council Vice President Karen L. White and the Invocation (Councilmember Rachel Tomas
Morgan, At Large South Bend Common Council) was given.
City Clerk Dawn M. Jones announced, Good evening members of the public. For audio quality,
we will be muting everyone not speaking by default to maintain good audio quality for Council
and yourselves. If you would like to speak during the meeting on a specific agenda item, please
submit your request in the chat - directions to do so are in the chat. We ask that you provide your

REPORT FROM THE SUB-COMMITTEE ON MINUTES
There was no Report from the Sub-Committee on Minutes.
SPECIAL BUSINESS
Council Vice President Karen L. White recognized former Councilmember Tim Scott for his
commitment to the City and the First(1St) Council District.
Councilmember Sharon L. McBride expressed her thanks to former Councilmember Tim Scott
and wished him and his family well.
Councilmember Jake Teshka thanked former Councilmember Tim Scott for his service and his
leadership.
Councilmember Rachel Tomas Morgan expressed her regret of not having more time to work with
and learn from former Councilmember Tim Scott. She expressed her gratitude for his service and
gave well wishes to him and his family.
Councilmember Lori K. Hamann mentioned that he is a patient teacher and that he will be missed.
Councilmember Sheila Niezgodski thanked former Councilmember Tim Scott for his patience.
She noted how much he sacrificed in his personal life to serve the City and she wished him well.

RESOLVE INTO THE COMMITTEE OF THE WHOLE
At 7:09 p.m. Councilmember Lori K.Hamann made a motion to resolve into the Committee of the
Whole. Councilmember Jake Teshka seconded the motion which carried by a roll call vote of eight
(8) ayes. Councilmember Sharon L. McBride, Chairperson,presiding.
Councilmember Sharon L. McBride explained the procedures to be followed for tonight's meeting
in accordance with Article 1, Section 2-11 of the South Bend Municipal Code.

06-20 PUBLIC HEARING ON AN ORDINANCE OF THE
COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED 514 FRANCES ST,
COUNCILMANIC DISTRICT NO. 4 IN THE CITY OF
SOUTH BEND, IN 46617
Councilmember Sharon L. McBride,chair of the Zoning and Annexation Committee,reported that
they met this afternoon and send this bill to the full Council with a favorable recommendation.
Joseph Molnar,Zoning Specialist for the City of South Bend with offices located on the 14th floor
of the County-City Building, South Bend,IN,served as the presenter for this bill.Mr. Molnar went
over the highlights of this rezoning request and referenced a PowerPoint presentation which is
available in the City Clerk's Office.
Councilmember Sharon L. McBride opened the floor to questions and comments from Council
Members.
Councilmember Lori K. Hamann asked about the reference to a tiny house and requested more
information. Mr. Molnar replied that the site plan proposed was a rough concept and perceived the
use of tiny house to be a vague term to describe the small ancillary dwelling unit on site. He
confirmed the lot's size to be large enough to allow for such future development.
Councilmember Rachel Tomas Morgan inquired about the number of units that would be allowed
on the site.
Angela Smith, Zoning Administrator for the City of South Bend with offices located on 14th floor
of the County-City Building, South Bend, IN, replied to Councilmember Rachel Tomas Morgan's
inquiry about the number of units permissible on the site.
This being the time heretofore set for the Public Hearing on the above bill, proponents and
opponents were given an opportunity to be heard. There were none.
Councilmember Troy Warner made a motion to send Bill No. 06-20 to the full Council with a
favorable recommendation. Councilmember Sheila Niezgodski seconded this motion which
carried by a roll call vote of eight(8) ayes.

Councilmember Lori K. Hamann made a motion to accept the Substitute version of Bill No. 11-
20. Councilmember Sheila Niezgodski seconded this motion which carried by a roll call vote of
eight (8) ayes.
Councilmember Sharon L. McBride,chair of the Zoning and Annexation Committee,reported that
they met this afternoon and send this bill to the full Council with a favorable recommendation.
Michael Divita, Principal Planner for the City of South Bend with offices located on the 14th floor
of the County-City Building, South Bend, IN, served as the presenter for this bill. Mr. Divita
highlighted the key points of this legislation referencing a PowerPoint presentation which is

Councilmember Karen L.White,chair of the Personnel and Finance Committee,reported that they
met this afternoon and send this bill to the full Council with a favorable recommendation.
Dan Parker, City Controller for the City of South Bend with offices located on the 12th floor of the
County-City Building, South Bend, IN, served as the presenter for this bill. Mr. Parker went over
the key points of this bill and highlighted a few pages of the bill which is available in the City
Clerk's Office. He then welcomed any questions from Council Members.
Councilmember Sharon L. McBride opened the floor to questions and comments from Council
Members.
Councilmember Henry Davis Jr. asked Mr. Parker to define the phrase `outreach.' Mr. Parker
replied that the function of outreach is to notify minority and women owned businesses that these
resources exist. Councilmember Henry Davis Jr. followed up and asked how the City is doing that
and Mr. Parker replied that he and his team would be able to follow up with the Council in exactly
how they are committing to outreach.
Councilmember Sharon L. McBride expressed her concern about more small businesses getting
this money and she asked for more clarity. Mr. Parker replied to her concern.
Councilmember Lori K. Hamann asked for clarity on which businesses would get money and Mr.
Parker replied.
Councilmember Henry Davis Jr. asked for further clarity on how that distribution is executed.
Brian Donoghue, Director of Innovation for the City of South Bend with offices located on the
12th floor of the County-City Building, South Bend, IN, replied to Councilmember Henry Davis
Jr.'s question. Mr. Donoghue explained the process of this grant process and announced that the
fund is still open. He committed to following up with Council if he left any concern unaddressed.

Councilmember Henry Davis Jr. expressed his dissatisfaction with the Administration's
complacency on delivering actionable outcomes with budget bills such as this bill, specifically as
it relates to marginalizing the black community.

20-17 A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, ENDORSING AND
URGING PASSAGE OF FEDERAL LEGISLATION TO
PROVIDE UNIVERSAL, COMPREHENSIVE HEALTH
COVERAGE WITH ZERO COST-SHARING DURING
THE COVID-19 PANDEMIC AND BEYOND
Councilmember Troy Warner,chair of the Health and Public Safety Committee,reported that they
met this afternoon and send this bill to the full Council with a favorable recommendation.
Councilmember Sharon L. McBride, 415 East Broadway Street, South Bend, IN, served as a
presenter for this bill. Councilmember Sharon L. McBride read the resolution into the record:
Whereas, every person in the City of South Bend, the State of Indiana, and the United States
deserves high quality health care; and, Whereas, the Medicaid program comprises a significant
portion of the State budget, leaving it vulnerable to partisan budget debates and insufficient to
meet the demands of the population under normal conditions,much less during a pandemic which
results in massive layoffs and likely increases Medicaid applications; and, Whereas, many people
delay seeking needed health care due to an inability to pay, leading to a sicker and poorer
population in the long run; and, Whereas, the COVID-19 pandemic has only increased the need to
ensure individual access to preventative health care in order to protect the overall public health;
and, Whereas, Indiana, like many other states, suffers from racial health disparities, demonstrated
by both the maternal and neonatal mortality rates among black residents and the unequal
distribution of morbidity and mortality during the COVID-19 pandemic; and, Whereas, such a
population is significantly more likely to develop serious illness if exposed to COVID-19; and,
Whereas, medical bills are a leading cause of bankruptcy in the United States; and, Whereas, the
current COVID-19 pandemic has led to record levels of unemployment, loss of employer-
sponsored health insurance, a severely strained health care system, widespread illness, and taken

a profound toll on our community's mental health, all of which is placing significant demands on
the health care system and the State of Indiana's Medicaid program; and, Whereas, the ever-
increasing costs of health care, which are further elevated due to the pandemic,may challenge our
state and municipal budgets;and,Whereas, COVID-19 related treatment is likely to cost uninsured
patients tens of thousands of dollars; and;
Councilmember Henry Davis Jr., 5117 Idlewood Drive, South Bend, IN, served as a presenter for
this bill. Councilmember Henry Davis Jr. stated, Whereas, in order to equitably and effectively
address the health care needs in the City of South Bend and State of Indiana, including the
additional burden created by the COVID-19 pandemic, we must urge the U.S. Congress to expand
health insurance coverage to provide comprehensive coverage to every resident of the United
States without any cost sharing; and, Whereas, the global COVID-19 pandemic is continuing to
cause physical, emotional, and economic hardships for nearly every resident in the United States;
and, Whereas, although the United States Congress passed the Coronavirus Aid, Relief and
Security Act (CARES) in an attempt to ease the suffering of many residents of the United States,
residents are entitled to more than financial assistance during the COVID-19 pandemic; and,
Whereas, because the Health Care Emergency Guarantee Act (H.R. 6906) would guarantee all
residents full coverage for medically necessary health care without copays, deductibles, or other
out-of-pocket costs only until an approved COVID-19 vaccine is widely available to the public
and is therefore limited in its duration, a more permanent remedy is also required; and, Whereas,
the Medicare Act for All of 2019 (H.R. 1384) would provide similarly expanded coverage, but
would make that coverage available in perpetuity, and not limited to the duration of the COVID-
19 crisis; and, Whereas, other COVID-19 relief legislation packages will be and are being
considered for adoption by Congress, some of which will provide sufficient health care coverage
as provided above and some of which will not; and, Whereas, only comprehensive coverage can
assure people that,no matter what health condition is ultimately responsible for symptoms,or what
treatment turns out to be necessary, patients will be financially protected. Now, therefore, be it
resolved by the Common Council of the City of South Bend, Indiana, as follows: Section One (I)
The South Bend Common Council hereby endorses and urges federal legislation to provide
universal, comprehensive health coverage with zero cost-sharing for patients during the current
crisis, such as the Health Care Emergency Guarantee Act. Section Two (II) The South Bend
Common Council also hereby endorses and urges federal legislation to provide universal,
comprehensive health coverage with zero cost-sharing for patients extending beyond the
immediate COVID-19 crisis into perpetuity such as the Medicare for All Act of 2019. Section
Three (III) The South Bend Common Council calls on Congress to work toward the immediate
enactment of this, or substantially similar legislation, to ensure appropriate health care coverage
for all residents of the United States during the current crisis and beyond. Section Four(IV) The
South Bend Common Council requests the Clerk of Council to submit a copy of this Resolution to
the City's U.S. Congressional delegation.

Councilmember Jake Teshka stated that he is philosophically opposed to Medicare for all but also
stated his belief that this Resolution was outside of the purview of the Common Council.
Councilmember Rachel Tomas Morgan commented on the virtue of resolutions such as these and
challenged her Council colleague to think about how they would be able to bring about change at
a larger scale.
Councilmember Henry Davis Jr. thanked everyone that has worked with him and the co-sponsors
on the Resolution. He then challenged the notion that this was not within the purview of the
Common Council and he believes it is.
Councilmember Lori K. Hamann stated that all politics are local, and she believes these types of
resolutions do bring about that value.
Councilmember Sheila Niezgodski mentioned that it is the COVID-19 pandemic language that
helps her support the resolution.

THE COMMITMENT OF THE CITY
ADMINISTRATION AND POLICE DEPARTMENT TO
QUICKLY IMPLEMENT SOME NEEDED POLICE
REFORMS

Councilmember Sheila Niezgodski, 4942 Scenic Drive, South Bend, IN, served as a presenter for
this bill. Councilmember Sheila Niezgodski stated, Whereas, the South Bend Common Council
continues to be both saddened and outraged at inequality and disparity in the use of force by many
police departments which continues across the country resulting in death and injury to a
disproportionate number of people of color;and,Whereas,on June 15,2020 Mayor James Mueller,
Chief of Police Scott Ruszkowski and Michael Patton, the City's Diversity Compliance &
Inclusion Officer, held a press conference to discuss racial justice in South Bend and the progress
of local steps taken; and, Whereas, Mayor Mueller and/or Chief Ruszkowski each made
commitments to quickly take steps to implement some necessary police reforms; and,
Councilmember Rachel Tomas Morgan, 114 Chapin Street, South Bend, IN, served as a presenter
for this bill. Councilmember Rachel Tomas Morgan stated, WHEREAS, among those steps are:
releasing a revised police officer discipline matrix; releasing the recommendations for police
reform made by 21 CP Solutions after the death of Eric Logan; and cooperation with the Common
Council in the consideration and possible enactment of an ordinance creating a Citizens' Review
Board; and, Whereas, although choke holds have not been taught during training of South Bend
police officers,the Use of Force Policy will be amended to specifically forbid choke holds,strangle
holds or similar moves;and,Whereas,these are just initial steps that can be taken quickly,adequate
police reform will require much more through cooperation of the residents, the City
Administration, the Police Department, the Common Council, and all other stakeholders.

of the City Administration, the Police Department, the residents, and all other stakeholders in
exploring and implementing other needed police reforms. Section Three (III) This Common
Council pledges to continue to explore and implement ways to make America's promise of
