RN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING
$188,000. 00 FROM THE MORRIS CIVIC CAPITAL.
IMPROVEMENT FUND
STATEMENT OF PURPOSE AND INTENT
On May 20, 1991, the Common Council of the City of South. Bend.
enacted Ordinance No 8185-91, appropriating $300,000 from the Morris.
Civic Capital Improvement Fund to pay for architectural design work
for the restoration of the. Morris Civic Auditorium complex. Soon
thereafter, the City's Board of Public Works entered into a contract
for architectural services with the architectural firm of Sovik
Mathre Sathrum Quanbeck Schlink Edwins Architects (SMSQ) . Over the
course of the past 18 months, the scope of the restoration project
has grown. The SMSQ fee under its Contract was calculated to be
approximately 10% of the estimated construction cost., but allowed the
parties to fix the fee at a stipulated dollar figure after completion
of the Design Development Phase of the Contract. In July of this
year SMSQ was asked to suspend services in order that a fixed fee be
established. SMSQ and representatives of the City have agreed to
submit to the Board of Public Works an Addendum to the SMSQ Contract,
fixing the fee for all basic services, reimbursable expenses,
consultant fees, and all other costs associated with SMSQ's services
at $651,000.00. This fee is calculated to be approximately 7.65% of
the project cost.
The Common Council has determined that it is necessary to
appropriate certain funds in. the Morris Civic Capital Improvement
Fund in order to pay for the architectural, design work through the
completion of the construction drawings phase, for the renovation and
restoration of the Morris Civic Auditorium and Palais Royale complex
as contemplated by the proposed Addendum.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana, as follows.:
Section I: That the following funds shall be and hereby are
appropriated from the following accounts within the Morris Civic
Capital Improvement Funds:
