GAMMON Approved and signed by mew 19 Mayor SUBSTITUTE BILL NO. 12-93 ORDINANCE NO. 3 5"8- P3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 20, ARTICLE 6 OF THE SOUTH BEND MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 20-100.1 ENTITLED "PARKING PROHIBITED BY FIRE HYDRANTS" STATEMENT OF PURPOSE AND INTENT The Common Council recognizes that the regulation of parking of vehicles on City streets is a proper exercise of police power. More specifically Indiana Code § 9-21-1-3 authorizes local authorities to regulate the standing or parking of vehicles with respect to streets and highways under its jurisdiction. It has come to the Common Council's attention that there is an increasing number of individuals who park their motor vehicles by a fire hydrant thereby creating a public safety hazard. In the interest of promoting better public safety and insuring access to fire hydrants throughout the City at all times and especially in emergency situations, the following ordinance is introduced as an attempt to deter illegally parked vehicles by fire hydrants. �iobo, tfxrtfort, bt it rtssolioer bj tfx Common (outuiU of tfj¢ titj of 'ioutfh Vt10, Ittbiatta, as follows: Section I. The Common Council of the City of South Bend, Indiana, hereby amends Chapter 20, Article 6 of the South Bend Muncipal Code by the addition of new section 20- 100.1 which shall read in its entirety as follows: Sec. 20-100.1 Parking by Fire Hydrants Prohibited. (a)Any motor vehicle found parallel parked within fifteen (15) feet of a fire hydrant or in a designated fire hydrant no parking zone shall be fined fifty dollars ($50.00). Additionally, any motor vehicle found in violation of this Section may be towed at the owner's expense. (b) Appropriate signs giving notice of this parking prohibition shall be properly posted by the City. Section II. Chapter 2, Article 19, Section 2-213 entitled "Schedule of Ordinance and Violations" paragraph (a)of the South Bend Muncipal Code is hereby amended by adding the following provision numerically to such listing: Municipal Code Section Type of Violation Penalties Sec. 20-100.1 Parking Violation by Fire Hydrant $50.00 Section III. Cleo Washington Second District In light of the public safety concerns raised by such violators and the increased potential for liability if the City would not have access to a fire hydrant in the case of an emergency, I Roland Kelly am introducing the attached proposed ordinance for your review and consideration. Third District Ann Puzzello This Bill would specifically prohibit parking within fifteen (15) feet of a fire hydrant. It Fourth District would also call for a penalty of fifty dollars ($50.00) which is similar to the violation currently in effect for handicapped parking violators. The current penalty provision Linas Slavinskas provides for a $5.00 fine. Fifth District I look forward to discussing this Bill with you in greater detail when it is referred to the Thomas Zakrzewski Public Safety Committee for further review and discussion. Thank you.
