BEING A PART OF HIGH INDUSTRIAL PARK SUBDIVISION IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the city. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: THE STREET TO BE VACATED IS HIGH COURT FROM THE EAST RIGHT OF WAY OF HIGH STREET TO THE END OF THE STREET, FOR A DISTANCE OF 325 FEET, MORE OR LESS AND A WIDTH OF 50 FEET. BEING A PART OF HIGH INDUSTRIAL PARK SUBDIVISION IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. Hereby determines that it is desirable to vacate said property. SECTION II The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of--way, unless such rights are released by the individual utilities. ELIMINATING HIGH COURT STREET AND CUL-DE-SAC WILL ALLOW THE SOUTH BEND PARK DEPARTMENT TO ESTABLISH THE FRONT YARD PROPERTY LINE AND FRONT YARD SETBACK ALONG THE WEST LOT LINE, ALONG HIGH STREET. THIS WILL ALLOW THE PROPOSED ADDITION AND SITE PLAN TO BE DEVELOPED WITHOUT A FRONT-YARD SETBACK VARIANCE, WHICH WOULD BE REQUIRED IF HIGH COURT WERE STREET. ALL UTILITY ACCESS EASEMENTS WILL BE RETAINED. JOHN YOORDE __ d1Y CIERK Sa acun air Re: Petition to Vacate Public Right-of-Way (High Court Street and cul-de-sac) for the South Bend Department of Parks and Recreation 321 East Walter Street South Bend, IN 46614 For the following project: South Bend Maintenance Facility Addition and Remodeling 1020 High Street South Bend, IN 46601 Dear Council Members: The South Bend Department of Parks and Recreation requests consideration to vacate High Court Street and cul-de-sac on the property located at 1020 High Street, South Bend, IN 46601 (see attached existing and proposed lot plan).The existing High Court Street and Cul-de-sac is a street approximately 300 foot long that terminates into the property controlled by the South Bend Department of Parks and Recreation. There are no other property Owners that front onto High Court other than the Park Department. The purpose of the street vacation of the property is to provide a more developable site for the South Bend Department of Parks and Recreation's New Maintenance Facility. Eliminating High Court Street and cul-de-sac will allow the South Bend Park Department to establish the front yard property line and front yard setback along the West lot line along High Street. This will allow the proposed addition and site plan to be developed without a front yard setback encroachment, which would a variance if High Court were to remain a public street. All utility access easements will be retained. (2) The vacation would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. (3) The vacation would not hinder the public's access to a church, school, or other public building or place.
