The contracts will be for a terrn of three years beginning August 1, 2020 and ending July 31, 2023 with an option for a one year renewal upon mutual agreement. Additionally, the city has deemed the need for a secure storage facility within five miles of the City of South Bend, and that the towing entities named will provide all billing services for vehicles removed and/or stored. The City of South Bend Police Department is in need of two properly licensed towing companies to provide twenty-four hour a day, seven days a week service for the removal, towing, and storage impoundment of certain motor vehicles within the city. The goals are: • Two properly licensed towing companies to provide twenty-four hours a day, seven days a week removal and storage services. • Two companies that shall maintain and have exclusive control of three recovery vehicles that are DOT registered. • Storage facilities that are within five miles of South Bend City limits, that are both secure and operate a minimum of 6 days per week. • Proper billing, storing, release of vehicles, and recording of charges for vehicle owners and services provided. • Fair and just cost for vehicle owners and indemnity of the City of South Bend for any costs associated with the outlines of this proposal. ASAP Towing (hereinafter referred to as "ASAP/The Company" is fully licensed by the State of Indiana and the City of South Bend to own, operate, and provide removal, towing and storage services for the City of South Bend and the surrounding area. The company owns and operates six vehicles, twenty- four hours a day, seven days a week, that are capable of passenger vehicle 2 and light truck removals, as well as campers and trailers. The company provides two (2) fully secured storage lots, one within the City of South Bend, and has the capacity to house two hundred vehicles at any given time. One lot withing four point five (4.5) miles of the South Bend Police department for overflow. We will provide: One properly licensed towing company for provide twenty-four hour a day, seven days a week removal and storage services. • Three recovery vehicles that are DOT registered and licensed with the State of Indiana. Our secure storage facility located within the city limits and the ability to house two hundred plus vehicles. One overflow storage facility within five (5) miles from South Bend Police Department. « Hours of operation that comply with timeframes outlined in the RFP. • Proper billing, storing, release of vehicles, and recording of charges for vehicle owners and services provided. Fair and just cost for vehicle owners and indemnity of the City of South Bend for any costs associated with the outlines of this proposal. ASAP Towing always has six (6) DOT registered recovery units in service. o USDOT-1566364IN o MC — 615223 ASAP Towing has a rolling land line at the base station office (1906 S. Olive Street) with a dedicated phone number only given to the City of South Bend/St. Joseph County dispatch center and communicates with each of the drivers via company cell lines. During evening hours when the office is not manned, calls are dispatched by the office answering service as well as a dedicated cell phone manned twenty-four hours a day by the current driver on call. Calls to the mainline land line office phone are forwarded to the answering service and calls are then dispatched to the drivers via company cell phones. • ASAP Towing holds indemnity and liability insurance under Korson, Inc., the parent company, of ASAP Towing. Liability insurance covers up to $1,000,000.00 with umbrella coverage up to $2,000,000.00 and is held by Arrowhead General Insurance Agency, Inc. - certificate #437868169, policy #CP01640181-03. o Please see Copy of Insurance for complete coverage and underwriter information — attachment 20-21 • Per the proposal request for general business references see attachments: o Gate's Automotive Group — please see attachment 17 o Tim's Auto Repair— please see attachment 18 ASAP Towing holds workers compensation insurance for each employee of the company; under Korson, Inc., the parent company, of ASAP Towing — please see attachment 19 For a list of employees with access to storage facility, vehicles, and storage yard — please see attachment 20 Copy of certificate of Insurance naming the City of South Bend as a Certificate Holder — please see attachment 20-21 • Copy of company customer complaint form — please see attachment 22-23 4 Per proposal requirements, ASAP, owns, maintains, and has exclusive use and control of the vehicles listed below. All vehicles have the capacity to tow passenger, light truck, campers, and a variety of trailers, have a one -ton capacity, and rear dual wheels. Per state regulations, each company vehicle prominently displays the name, logo, phone number and DOT number on both sides of the vehicle so it can be easily identified. Vehicle markings are in accordance with Indiana Department of Motor Carrier Services Division 49 CFR 390.21. • 2020 Hino 258 with air brakes and LCG benefits • 2018 Hino 258 with air brakes and LCG benefits • 2018 Hino 258 with air brakes and LCG benefits • 2016 Hino 258 with air brakes and LCG benefits • 2014 Hino 258 with LCG benefits LCG (low center of gravity) allows the operator to lower the approach angle of the flat bed to as little as a six (6) degree incline which allows us to load vehicles with extremely low ground clearance without damaging the bumper, valance, or exhaust. To provide cleaner and more efficient services, ASAP utilizes diesel exhaust fluid (DEF), in the vehicles listed above. DEF allows us to avoid the disadvantages associated with increasing EGR to the extreme levels necessary to meet the EPA requirement of near -zero NOx emissions (0.2g/bhp-hr). DEF is an aqueous solution of 32.5% urea and 67.5% de -ionized water. It is clear, non -toxic, biodegradable and non-flammable. The biggest advantage of DEF is maximized fuel efficiency. The higher oxygen levels of DEF provides offer more efficient combustion resulting in clean nitrogen and water emissions which are non -toxic and harmless to the environment. Additional equipment, that is not DEF compliant: I 411i1ilIDf1716V •-1:3 o Per proposal request outlines this unit has a lifting capacity of ten (10) tons, a) Vehicle Equipment —the following is included in each company vehicle —list includes but is not limited to: A minimum of four LED flashing emergency lighting. 5 i. Debris removal equipment, consisting of: Two oversized containers, a broom, shovel, fluid absorbent (floor-dri), safety chains, straps, and emergency beacons. iii. Company employees are provided with reflective uniforms, vests/jackets that meet OSHA/ANSI requirements. All employees are required to wear reflective clothing when on scene or during transport of removal vehicles. ASAP Towing as well as all employees of the company agree to and shall be available for inspection should the City make the request; and subject to random inspections to ensure quality performance. ASAP Towing currently operates a daily maintenance, cleaning, and safety check of all vehicles and the storage facility. It is the responsibility of all employees to comply with safety and cleaning checks. ASAP agrees to continue these standards to ensure the safety of both its employees and customers. ASAP agrees to report to the City, in writing, any changes, additions or deletions from the company's tow truck fleet used under this contract. ASAP Towing owns and operates two commercial properties. To better serve our customers our main lot location is located within city limits, on the local South Bend City Transpo bus line and two (2) miles from the South Bend Police Department. Our second location is an overflow lot for vehicles that are not on a police hold and over thirty days old. This location is also on the local South Bend City Transpo bus line and four and one half (4.5) miles from the South Bend Police Department. o 1906 S. Olive Street— houses the main office, indoor storage facilities, and outdoor storage. o 55303 Mayflower Road — houses outdoor storage of vehicles not on a police hold and any vehicles beyond thirty (30) days old. ASAP Towing owns both properties and does not share storage facilities with any other company to ensure the preservation and security of stored vehicles. A • ASAP Towing can house twelve passenger size vehicles withing the indoor storage facility and two hundred passenger vehicles in the outdoor lot located at 1906 S. Olive Street are surrounded by six-foot security fencing with wire. • Lot gate is electronic and can only be opened by authorized employees. • Outdoor lot and premises at 55303 Mayflower Road are surrounded by eight - foot security fencing with wire. • Lot gate is electronic and can only be opened by authorized employees. • All owners for stored vehicles are to provide proof of identification and ownership and escorted to the vehicle by an employee. Sundays, holidays and after-hours pick-up can be made by appointment and an additional fee of $50.00 • Hours of operation, as well as, after hours contact information signs are clearly posted on entry doors of both locations. 7 • Procedures for payment and release of impounded vehicles is as follows: Upon owner obtaining a release form from the police station and presenting it to ASAP, we will ask for a valid photo id. (Driver's license, passport, or state issued id) we will compare the paperwork to the release form and registration. We will make copies for our files of the release form, photo id and registration. The invoice will then be presented for payment and signature of the owner. Forms of payment for a vehicle requiring a police release will be cash and/or credit/debit card. No personal checks will be accepted. After payment is received the owner will be provided a receipt and asked to wait at the gate and an employee will bring the vehicle outside of the gate for the owner. At this time ASAP has decided to remain with the fees listed in the Board of Public Safety Resolution No. 88-2011, effective December 22, 2011, with the exception of special circumstances or victim situation, towing fees may be reduced by the company and South Bend Police Department on a case by case basis. 1. Initial tow of a vehicle including cleanup, hookup and transport: Impounded vehicles not involved in an accident $ 145.00 Impounded vehicles involved in an accident $ 165.00 Non -impounded vehicles due to accident $ 165.00 2. A second tow of the vehicle arising out of the same accident or impound, even if not on the same date as a result of the actions of the owner or driver: 2"d Tow $ 50.00 3. A storage charge per calendar day at the storage yard at the rate of $25.00 per day, outside storage, for every calendar day the storage yard is open for pick up for at least 3 s, .. �, rt 5. hours. This charge will also be made for Sundays and national holidays even if the yard is not open. However, no storage charge shall be made for the day the vehicle is impounded. Storage charge will apply to non -impounded vehicles starting the day of incident. 6. Administrative fee: a. $ 40.00 if the vehicle is unclaimed for less than fourteen (14) days after impound. b. $120.00 if the vehicle is unclaimed on the fifteenth (15) day or more after impound.. 7. If the owner requests that the vehicle be picked up at a time outside of its posted business hours, legal holidays excepted, a special pickup fee of $ 50.00 will apply. 8. The office shall have authority to authorize in writing additional charges when warranted by exceptional circumstances. 9. Vehicle owner and Tow Company are free to negotiate charges for additional services requested by the owner. 10. ASAP Towing is licensed by the City of South Bend, to operate the business of vehicle removal and storage — License #20-00007866 - see attachment 28 ASAP carries all required city and state documentations, certifications and licensures required: • USDOT-1566364 IN • MC — 615223 In accordance with the request for proposal, ASAP agrees to the following: a. The company agrees not to move or attach any vehicle until instructed to do so by the investigating officer. All company employees will complete training on policies and procedures outlined with the removal, towing, and storage for procedures for the City. b. All company employees will cooperate with the investigating officer and comply with requests made in conjunction with the removal of unsafe and/or illegally parked vehicles from the street, and in storing or impounding of such vehicles. c. The company agrees to provide clean-up and removal of all debris from accident scenes, including the removal of hazardous materials and vehicle fluids. (See equipment list for materials used) d. The company will follow vehicle release protocols outlined in the RFP and stated by the City of South Bend Police Department. •� Employees will comply with investigation officer by signing and gathering of proper signatures, on scene, for stored vehicle report. • No vehicles will be disposed of, relinquished, or released without proof of ownership, customer identification, and South Bend City stored automobile release form. e. As outlined in subset d — no vehicle will be released, or items relinquished without proof of identity, South Bend City stored automobile release form, and payment for services rendered. ASAP Towing will bill vehicle owners for services provided — No services will be billed to any city entity. ASAP Towing agrees to notify the City within five (5) business days, in writing, of any owner complaints of missing items or damage to a vehicle authorized by the City to tow. The company will abide by South Bend City Municipal Code — Chapter 20, Sec. 20-13 (C) and Sec. 20-15 (C) which outlines the release of responsibility for The City, its agents, servants or 10 employees shall not be responsible or liable in any manner for the damage incurred in the towing, storage, possession or disposition of such vehicle. g. The company agrees to submit a criminal history and set of fingerprints for each employee within five (5) business days of award of this contract and any new employee engaged during the term of the contract. Per proposal requirements, ASAP, owns, maintains, and has exclusive use and control of the vehicles listed below. All vehicles named have the capacity to tow passenger, light truck, campers, a variety of trailers, have a one tone capacity, and rear dual wheels. Per state regulations, each company vehicle prominently displays the name, logo, phone number and DOT number on both sides of the vehicle so it can be easily identified. Per the proposal request, ASAP Towing understands the importance of timely service in emergency situations. • The company agrees to give priority to all city removal requests and has dedicated, as outlined, in equipment provisions three trucks for city removal services. • The company does not participate in any other police towing contracts, or other City related contracts, nor any roadside service contracts, enabling ASAP Towing to commit fully to the City and South Bend Police. • The company will respond to all city removal requests within the thirty -minute time frame outlined in the proposal. • ASAP Towing agrees to clean-up any debris, spill or hazards from accident scenes and removal services to ensure the area is safe for continued use of the roadway at the tow site. • The company adheres to federal guidelines for clean-up and disposal of all hazardous materials. • All ASAP Towing service trucks include the following equipment to further ensure safety: o Debris removal equipment, consisting of: Two oversized containers, a broom, shovel, fluid absorbent (Floor-dri), safety chains, straps, and emergency beacons. ASAP Towing owns and operates two commercial properties. To better serve our customers our main location is located within city limits, on the local South Bend City Transpo bus line and two (2) miles from the South Bend Police Department. Our second location is an overflow lot for vehicles that are not on a police hold and over thirty days old. This location is also on the local South Bend City Transpo bus line and four and one half (4.5) miles from the South Bend Police Department. RIP) .� m 1906 S. ASAP Towing can house twelve (12) passenger size vehicles within the indoor storage facility and two hundred (200) passenger vehicles in the outdoor lot located at 1906 S. Olive Street. ASAP Towing provides twenty-four hour indoor and outdoor monitoring and surveillance of both storage facilities. ASAP Towing understands the importance of good communication and agrees to the RFP communication outline and guidelines. Under the guidelines of the RFP, the company agrees should three attempts be made to contact ASAP Towing without success, the city has the right to contact another towing company. To avoid this type of error ASAP works with a rolling land line, cell phone communications, as well as a back-up answering service in case of emergencies that could interrupt communications between itself, the city of South Bend Police Department, customers, and tow vehicle drivers. • Continuous communication is held between the dispatch office and drivers via a rolling land line at the base office (1906 S. Olive Street) and communicates with each driver via company cell lines. + To ensure all phone calls are answered, police dispatchers are provided with a separate unpublished land line phone number, our main land line phone number and a cellular phone number. • During the evening hours when the office is not manned, calls are dispatched by the office answering service. Calls to the unpublished land line phone number are forwarded to the answering service and calls are then dispatched to the drivers via company cell phones. * In case of emergency, if main office phones lines or the unpublished land line phones are down —the company has set up an automatic forward and calls will be answered and dispatched via the company answering service. 13 • Per proposal requirements, ASAP hours for payment and release of vehicles include the following times: d. 8am — 5pm Monday through Friday e. 8am —12pm Saturday f. The company and all its employees understand that any such assignment could constitute a breach of contract. 14 The company shall, always, maintain separate and accurate records in connection with the removal and storage services it provides the City and shall make all records available to the City upon request. Records to be maintained shall include the following: a. Time, date, location of tow and officer authorizing the tow; b. Make, model, vehicle license registration, and VIN number of towed vehicles; c. Itemized billing of basic tow charges, special charges, storage charges, and any special vehicle repair/care charges, i.e. window wrap, key charge, etc.; d. Signed release form by person claiming the vehicle; e. If applicable, complaint form, signed by the vehicle owner reporting any complaints regarding charges, vehicle damage, lost or stolen items from the vehicle or any other related problems. Customer complaint forms will be posted in the office in a clearly marked space. All customer complaints will be mailed to the South Bend Police Department within five (5) days of the filed complaint. Asap Towing reserves the right to act under City Municipal Code, Chapter 20, Sec. 20-13 (C) and Sec. 20-15 (C) The City, its agents, servants or employees, shall not be responsible or liable in any manner for the damage incurred in towing, storage, possession or disposition of such vehicle. 11010111=3 ASAP Towing holds indemnity and liability insurance under the Korson, Inc., the parent company, of ASAP Towing. Liability insurance covers up to $1,000,000.00 and is held by Arrowhead — certificate #437868169, policy #CPO1640181-03. ASAP assumes all risk in the event of damage, theft, fire, or otherwise, of the vehicles or any other property towed, impounded, or stored by the company, its employees, or agents. The company shall look solely and exclusively to the owner of the vehicle towed, impounded, or stored for payment of services rendered and will hold no claims against the City of South Bend for costs or nonpayment. 15 ASAP shall indemnify and hold harmless, the City, its officers, employees, including any agency department, or commission of the City for any and all suits or actions brought against the City on account of any loss, injury or damage sustained or claimed to have been sustained by anyone in connection with or arising out of the performance of this contract by ASAP Towing or any of its agents, employees, or independent contractors. ASAP Towing holds indemnity and liability insurance under the Korson, Inc., the parent company, of ASAP Towing. The company agrees to work with the City of South Bend Police Department for the period of three (3) years and that one (1) year term thereafter, upon the mutual written agreement of the City and company. We shall compare the release form, vehicle registration, and photo I.D. We will make copies of all paperwork for our files. Forms of payment accepted: cash, credit, or debit card as long as card owner is present. Owner will be presented an itemized invoice with charges for payment owner will sign the invoice stating vehicle is paid for and in the state received. Owner will be provided an invoice then escorted to their vehicle. 8.)Inspection Vic's Towing & Recovery's owners and team members agree to be available for inspection should The City of South Bend make this request; and subject to random inspections to ensure quality performance.
