MOLNAR FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING PERIODIC AND TEMPORARY ALLEY CLOSURE APPROVAL FOR THE SOUTH BEND CIVIC THEATRE THIS FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING PERIORDIC AND TEMPORARY ALLEY CLOSURE APPROVAL FOR THE SOUTH BEND CIVIC THEATRE (this "Amendment") is made effective June 23, 2020 (the "Effective Date") by and between the City of South Bend, Indiana, a municipal corporation organized and operating under the laws of the State of Indiana, acting by and through its Board of Public Works ("South Bend") and the South Bend Civic Theatre, Inc., 403 N. Main Street, South Bend, Indiana 46601 ("Civic Theatre"), each a party and collectively referred to as the parties. RECITALS WHEREAS, the City and the Civic Theatre entered into a certain Memorandum of Understanding Periodic and Temporary Alley Closure Approval for the South Bend Civic Theatre dated July 9, 2019 (the "Agreement"); and WHEREAS, this Amendment is entered into to modify certain terms and conditions expressed in the Agreement. NOW THEREFORE, for and in consideration of the mutual covenants and promises contained herein, the City and the Civic Theatre hereby agree as follows: TERMS Section 3. b. of the Agreement is deleted in its entirety and replaced with the following: 2020 EVENTS DATES AND TIMES DATE(S) TIME July 6-10 (Mon —Fri) 8 am — 10 pm July 13-16 (Mon-Thurs) 8 am — 4 pm July 17 (Fri) 8 am — 10 prn July 18 (Sat) 10 am — 10 pm July 19 (Sun) IOam-5 m July 20-24 (Mon -Fri) 8am-4pm July 25 (Sat) 4pm-I Ipm July 27-31 (Mon -Fri) 8am-4 m Aug 3-7 (Mon — Fri) 8am-4pm Set 12-13 (Sat -Sun) 1 m-8 m Except for the provisions herein contained, said Agreement, including any and all Amendments, will remain in frill force and effect as previously made.
