The Board of Public Works, at its meeting held on June 23, 2020, approved the above
referenced amendment for additional design services for the Olive St. water treatment plant
improvements in the amount of $41,124, for a new total of $399,293.

AMENDMENT TO OWNER -ENGINEER AGREEMENT
Amendment No. 4
1. Background Data:
a. Effective Date of Owner -Engineer Agreement: June 12, 2018
b. Owner: Board of Public Works, City of South Bend, Indiana
C. Engineer: Black & Veatch Corporation
d. Project: Hydraulic Modeling Training and Olive WTP Improvements Preliminary
Engineering
2. Description of Modifications:
a. Engineer shall perform or furnish the following Additional Services:
Task 402 — Design and Contract Document Development
The Engineer will prepare, develop and provide a signed and sealed design for a
new lintel and doorjamb based a change in the overhead door size that resulted
from the value engineering phase that occurred during bid negotiations.
Task 406 — Construction Administration
Additional responses to Requests for Information (RFIs) submitted by the Owner or
Contractor. The original scope included 10 RFIs. An additional 5 RFIs are
expected to be submitted by the Contractor resulting in a total number of 15 RFIs.
Task 408 — Shop Drawing and Submittal Review
Engineer will review additional shop drawings and other data submitted by the
Contractor as required by the Construction Contract Documents. The Engineer's
review shall be general conformity to the Construction Contract Documents for the
project and shall not relieve the Contractor of any of his contractural responsibilities.
Such reviews shall not extend to means, methods, techniques, sequences, or
procedures of construction or to safety precautions and programs incident thereto.
The original scope included 30 submitals/shop drawings. Based on the Contractor's
project submittal list an additional 37 submittals will require review resulting in a
total of 67 submittals and resubmittals to be reviewed for the project.

d. For the Additional Services or the modifications to services set forth above,
Owner shall pay Engineer the following additional or modified compensation:
For professional services described under Task 4, Owner agrees to pay Engineer
in accordance with the Agreement for Professional Services on a lump sum
basis. The total compensation for Amendment 4 shall increase the lump sum
amount by $41,124 and shall not be revised without written authorization.
e. The schedule for rendering services is modified as follows:
Engineer will complete the work during the project construction period ending in
Agreement Summary (Reference only)
a. Original Agreement amount: $_76,077
b. Net change for prior amendments: $_282,092
c. This amendment amount: $ 41,124
d. Adjusted Agreement amount: $_399,293
The foregoing Agreement Summary is for reference only and does not alter the terms of the Agreement,
including those set forth in Exhibit C.
Owner and Engineer hereby agree to modify the above -referenced Agreement as set forth in this
Amendment. All provisions of the Agreement not modified by this or previous Amendments remain in
effect. The Effective Date of this Amendment is June 23, 2020
