Bill No. 01-20- Amending Code Regarding Conflicts of Interest for Building Commissioners
Officials and Inspectors
Chuck Bulot, Building Commissioner for the City of South Bend Building Department, 125 S.
Lafayette Street, South Bend, IN spoke about the fact that Indiana State Code 36-1-27-4, now
requires units of Government to establish local procedures for reporting a conflict of interest that
prevents a Building Commissioner, Building Code Official or Building Inspector from issuing a
permit and from appointing a qualified temporary replacement in the case of a conflict of interest.
For the past twenty (20) years the Building Department has held an in-house guideline for new
hire employees that states that a new hire employee is not allowed to begin working in the Building
Department unless they have resolved any external conflicts of interest that they may have with
contractors, vendors or people of that nature. This is basically housekeeping to make sure that
there is legal compliance with what we have already been doing for the past twenty(20) years.

Committee Chair Sheila Niezgodski turned the meeting to the Council for any questions or
concerns regarding Bill No. 01-20.
Committee Chair Sheila Niezgodski asked a question regarding the portion of the presentation that
has to do with designating a qualified temporary replacement to oversee the issuance of permits,
wanting to know more about that process of selecting a qualified replacement.
Committee Chair Sheila Niezgodski turned the meeting to the public for anyone wishing to speak
in favor of opposition to Bill No. 01-20. Seeing none, Committee Chair Sheila Niezgodski turned
the meeting back to the Council and stated that Bill No. 01-20 would be sent to the full Council
with no recommendation due to there being no quorum.
