S7'�af��Fr si STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Date: 6 November 2017 Application Number: 2017-1101 Property Location: 706 N St Joseph Street Architectural Style/Date/Architect or Builder: American Foursgaure / 1905 / "The Good House" Property Owner: Mark Zimmerman Landmarl: or District Designation: River Bend Historic District 48308-92 Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE: This two-story American Foursquare sits on a fieldstone foundation. The second story has a slight overhang. The hipped roof has asphalt shingles, hipped dormers, and a center brick chimney. The street facing side has concrete steps and stoop, an iron railing, and a corrugated metal overhang. Windows are 9 -pane fixed on the front first story, 1/1 doable hung. The dormer has a 6 -pane casement. Windows have aluminum storm windows, a wood front door with aluminum storm door. A detached one -car concrete block garage with a flat roof is to the rear of the house. ALTERATIONS: Siding is not original and predates the district designation. Large overgrown shrubs were removed from the front yard with COA # 2001-0608-2. Asbestos shingles were replaced with the current asphalt shingles with COA #200671024. At some point, vinyl windows were installed on the south side of the main floor. APPLICATION ITEMS: "Install 5 replacement windows." DESCRIPTION OF PROPOSED PROJECT: Applicant seeks to replace 5 windows with white Champion Comfort 365 windows in the following locations: in the living room on the west side, a picture window (51 %Z" x 65"); in the front room on the west side, another picture window (51 ''/z" x 65"); on the north side, one double -hung window in the stairwell ( 23 1/2" x 45"); in the living room on the north side is a 2 -Lite slider window (42 3/a" x 23"); and in the kitchen, a double -hung window (293/4" x 393/4"). PRESERVATION SPECIALIST REPORT: On November 6, 2017 at approximately 1:30 PM I visited the property located at 706 N St. Joseph within the River Bend Local Historic District. i met with Mark Zimmerman to document the condition of the windows that they, have applied to replace. In full disclosure the owners of the property Mark and Nancy are personal friends and I have performed work on the house prior to my tenure at Historic Preservation. I am familiar with the status of the front windows in particular as I had previously attempted to help winterize those years ago. The first two windows on the application are the front (west) picture windows. These were not originally picture windows but actually double hung. The previous owner of the house removed the sashes, then took the wood stonn window and installed it in the first set of tracks between the interior and parting stops, they then added an aluminum storm window to the outside. This setup is ill-fitting at best and has had different filler wood to help keep the wood storm in place. Air infiltration is prolific on both front windows as both of these have had the same treatment. The third window is the horizontal window near the northwest window. The sash itself is in good shape and has a wood storm window on the exterior. The desire of the owner is to have a window that operates since they have never had airflow towards the front of the house. The fourth windo%v is a double hung on the north side of the house at the landing of the stairs. The bottom sash has significant deterioration and due to settling and damage from nearby construction and roadwork, the window is out of square. Photographs will depict the repairs the owners have made to the plaster walls. The lower left corner of the frame has enough of a drop that outside water has blistered the interior wall. Upper sash is painted in place but is separated due to pressure from being out of square. The fifth and final window is a non -original aluminum replacement window that does not stay open and faces the rear yard of the house. Steve Szaday, Preservation Specialist STANDARDS AND GUIDELINES: River Bend Local Historic District C. windows and Doors Window and door frames are in most cases «ood. Brick structures have stone sills and brick lintels. In some cases where synthetic siding_ has been applied, window trim has been covered. i\tany structures in the district have aluminum storm windows. Some houses retain wood framed storm windows. Required Original windows and doors including sash, lintels, sills, shutters, decorative glass, pediments, hoods and hardware shall be retained or when deteriorated beyond repair, replaced with units and trim resembling the original. Recommended Wood frame storm %% inflows and doors, painted to match the original, should be used but should not damage existing frames. If new sash and doors are used, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. when awnings are used they should be of canvas material. Prohibited Original doors, windows, and hardware shall not be discarded when they can be restored and re -used in place. New window and door openings which would alter the scale and proportion of the building should not be introduced. Inappropriate new window and door features, such as aluminum and insulating glass combinations that require removal of the original windows and doors, shall not be installed. Not recommended Awnings. hoods or fake shutters made of metal, vinyl or fiberglass should not be used if they, would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: Staff would prefer to see wood Nv►ndows installed on this structure. That being said, vinyl windows are already in place on the south side on the ground floor, and an argument can be made that the aesthetics of the property would be better served by creating continuity on the entire floor. With consideration of the existing Standards and Guidelines of the River Bend Local Historic District, staff recommends approval as applied. Property Owner: Ingersol Financial LLC - Landmark or District Designation: Chapin Park Local and National Historic District, Ordinance 99574-05 Rating: N/A DESCRIPTION OF STRUCTURE/SITE: The 2 -story free classic irregular -frame house sits upon a concrete foundation. A garage space at the rear of the structure provided the foundation of an extensive later non- conforming addition. The house is encased in asbestos siding and has louvres and gable returns. The roof is hipped with cross gables and has a central chimney. The front of the house has a 1/3 -width shed with replacement baluster and support posts. The windows are 1/1 double hung with molded crowns and trim. Replacement storms encase the windows. ALTERATIONS: Asbestos. siding is not original and predates the district designation. Extensive modification of the existing garage space created additional living space prior to the establishment of the Historic District (ca. 1929). CoA 92011-0811 called for the replacement of the wood deck and railings of the front porch. CoA #2014- 0724A removed a storm damaged pine tree leaning over the house as well as overgrown bushes. APPLICATION ITEMS: "Demolition of house:' DESCRIPTION OF PROPOSED PROJECT: Code Enforcement of the Cite of South Bend submits an application for a Certificate of Appropriateness to demolish the existing structure. Property has appeared regularly at Code Enforcement hearings for the past two years during the tenure of multiple o%vners. Continuous enforcement and repeated fines have been imposed on the property owners of record. City has continued to maintain the property in the absence of an attentive property owner, including securing the building and the maintenance and care of the grounds. Continued neglect has degraded the structure to a deplorable state, and little activity by the property owner has been witnessed in multiple years. Owner of record ("Ingersol Financial, LLC" or "Ingersol Financial Midwest Land Trust") appears to have a ranging portfolio of properties in the Midwest. Although not indicative of their entire portfolio, a property in Muskegon, Michigan was declared `'substandard, dangerous and a public nuisance" on August 3, 2017; bids for demolition were requested by the cit; and the city subsequently awarded one on November 3rd, 2017 (see attached documents and news articles). PRESERVATION SPECIALIST REPORT: Ott November 6, 2017 at approximately 10 AM. I met with inspectors from South Bend Code Enforcement to walk through the property located at 805 Leland/806 Ashland. l am familiar with the property as I did a precious walk through in 2014. The property has had a number of onners by %Nay of tax salts and transfers. I have attended 6 different code hearing in regards to this property since 2014. This last owner had done a down to stud removal of Halls on the first floor. There have been numerous repairs on the rear portion of the structure and sone ceilings that were down in 2014 that are non" in place. I fowever, the ceiling on the south side of the structure on the second floor has indications of water damage and infiltration. The outside photos show an area where the roof meets the fascia and the roofing material is hangina. This is the same room that has the n iter damage inside. The rear addition uas actually an attached garage that hada second story added later on. As well as an additional story added to a lower level located at the northwest corner. Although the addition above the garage appear sound, the addition added later is " sponge%" to walk on. There was movement as I walked across the floor both from the floor and the Hall that separated the two additions. I walked through the basement and could see areas where the mortar has failed as well as some attempts to make repairs. Disintegrated mortar is in plies as a result of water infiltration. i saw from the outside symmetrical cracks on both sides of the cast wall about 12 inches off the corner. These cracks go front the siding well into the ground level. The foundation on the exterior is concrete but the interior Michigan basement is brick. Photographs will show daylight from the interior of the basement. I do not find the structure to be deteriorated beNond repair. llo%ke%er. the rear additions Nkould need to be removed as the% are not structurall% sound and add burden to the rear %%all of the ori0inal structure. The roof tine at the addition has tailed in the past as Dater marks and ceiling calve -ins have been indicatise of that. The east Halt of the basement could need serious repair and bracing. The chinme% has had stucco - applied over brick but is out of square and is leaning. Ste%e Szadav Preservation Specialist STANDARDS AND GUIDELINES: CHAPIN PARK IV. Safety and Building Codes A. Building Code Requirements Required Building code requirements shall he complied with in such a manner that the existing character of the building is preserved. Recoalntended Local building code officials should be consulted to investigate alternative life safety measures that mill preserve the architectural integrity of the structure.Variances for historic properties should be imrstigated. I...] V. GEN ERA I. A. Buildings in the district should not be demolished except i% here buildings pose a threat to the public safety, and demolition is the only alternative. Documentation of interior and exterior features of the original buildings, especially homes rated as historically significant, is encouraged. Measured drawings and photographs may be submitted to the Historic Preservation Commission for safekeeping and future reference. B. A Certificate of Appropriateness is required before nuwing any building or structure. 1 he moving a building �Nithin. out of or into the district is discouraged: ho« ever, moving is preferred to demolition. Building incompatible %N ith existing structures in the historic district shall be prohibited. V1. ENFORCEMENT PROCEDURES [enforcement of the preseration guidelines and standards for the historic district is made possible in the Zoning Ordinance of the Cite of South Bernd. ordinance No. 5565-73, as amended and the historic Preseration Commission's Preservation Plan, The Ilistoric Preservation Commission may petition the Building Commissioner to use the legal means available to hint'her to force the maintenance and'or repair ofam building or structure %%ithin the historic district in accordance %%ith the intent of this ordinance. 'I his ordinance. however, does not prevent the ordinary maintenance and repair of any building or structure mhich (toes not involve a change in any exterior feature, nor does it prevent the reconstruction. alteration. demolition or ntoN ing of any building or structure �%high the Buildine Commissioner or other official has determined to be a hazard to public safety. I...] in making its determination. the I listoric Preservation Commission shall consider three tactors: first, appropriateness of the proposed work to the preservation of the building and district; second. the detriment to the public welfare if the proposed %%ork is permitted even though it is not deemed appropriate. third, the potential hardship that the denial of the Certificate of Appropriateness would cause the applicant. STAFF RECOMMENDATION: The City of South Bend has maintained the property (to the limits of their ability and legal obligation) on behalf of the owner of record for this duration, and will incur an undue financial burden by continuing this process. Seeing, how the property owner: failed to respond to any attempts at communication by representatives of the city; failed to offer representation at Code Enforcement hearings: failed to execute the requested improvements to maintain the property to keep the structure in compliance with code enforcement requirements; and most deplorably allowed this property to degrade to its current state where it poses a threat to public safety (as determined by the Code Enforcement representatives), staff recommends approval of the request for Certificate of Appropriateness for demolition. Furthermore, this finding is based upon adherence to Building Department requirements and Chapin Park Historic District Slawhirtls & Gidelelines. We are pained by the property owner's inability (or lack ofdesire) to attempt to maintain, improve, or sell the property, and saddened by the inevitable prospect of demolition (be it through neglect or otherwise). The Chapin Park Historic District and the Cite of South Bend are both ill -served by the continued degradation of this property. The first story is brick, while the second story is wood shingle with a molded overhang between the two stories. The roof is gabled with a wide overhang; a pedimented gable and dormer is on the southeast roof face. The front of the structure has a Rill open porch with brick piers and walls. Windows are double hung. First story front fagade has wide paneled windows, second story has French doors leading to the balcony. One centrally located chimney has a brick corbeled top. ALTERATIONS: COA #1989-0118 permitted the installation of a 2"a floor porch railing including posts, balusters, and railings. The full balustrade on top of the balcony has been removed or was never installed. COA #1992-0618 permitted the replacement of existing copper lock asphalt shingle roofing with 3 -in -1 tab asphalt shingles. COA #2015-1203 retroactively permitted a complete tear -off and re- roofing with dimensional asphalt shingles, as well as the installation of new gutters. APPLICATION ITEMS: "Replaced 6 windows (exact same size, vinyl windows). Old windows were broken and really deteriorated. Painted the back stairs and porch to comply with code enforcement." DESCRIPTION OF PROPOSED PROJECT: Applicant seeks retroactive approval for the installation of 6 vinyl windows in place of previous wooden windows. Tile subject windows are on the northwest side of the structure. On the ground floor, the following windows were installed: two one -over -one windows are closer to the front of the house and one six -over -six window closer to the rear of the house. On the second floor, the following windows were installed: two one -over -one windows (directly above those on the ground floor) and a six -over -six window. For reference, multiple windows remain boarded up (and painted over) on both the first and second stories on the nortlnvest side of the house. Basement access windows are also boarded up and painted over. A single one -over -one 'original' window remains on the second story towards the rear of the structure. Unfortunately, no manufacturer information has been provided for the installed windows by the applicant. PRESERVATION SPECIALIST REPORT: I thought it best to provide a timeline in regards to my interactions on this project. •y December 3, 2015 -Work was being performed on the roof at 705 LWE without a COA/RNTE or permit. I stopped and gave my card to a worker on site. Within hours Mariana Lara was in the office and received an approved RME for roof repair. This information can be corroborated through m}• photographs and invoices. • January 19, 2017-A Code Hearing was held at RM 1307 at County -City Building. Mariana Lara was in attendance. The Hearing Officer ruled 6 months on the exterior with all necessary permits be pulled from both HPC and the Building Department. The owner agreed and no civil penalties nor performance bond ordered. • July 6, 2017-1 noticed new windows installed at the west side of the structure. (I was living in the neighborhood at that time) i left a business card on the front door and on the windshield of the vehicle parked at the rear of the address. On the back of the business card, I stated that windo�N replacement needed ail approved COA from HPC and a building permit. • July 7, 2017- 1 emailed the building department to slake them zmare that work %%as being done at 705 LNVE without the necessary permits. Later that day 1 stopped at the address when I saw sonleone parked at the location. I informed him that the Building Department would be coaling by to place a stop work order (red -tag) on the property due to a failure to obtain proper permits. I NNalked to the front of the house to see that illy card that I left the previous day %%as indeed taken from the front door. Mr. Lara was the one there at that time and was angry that we had done that and Nve couldn't make him stop although he was already done NN ith the windoN%s he was going to replace. He stated that we should have sent letters and not approached him telling him he was going to be red -tagged. I informed him that at the previous code hearing they agreed to get all the necessary permits but failed to do so. After several minutes of cursing. Mr. Lara sped off down the al ley. Three inquiries were sent via email checking on the status of a COA application prior by the Building Department prior to the Violations Letter being sent on August 16, 2017 I:mails show that a COA application was sent via email to the Lara's two weeks prior to the August 7, 2017 deadline to be heard in the August I IPC sleeting. A completed application was received November 1. 2017. BUILDING MATERIALS Required Existing exterior building materials shall be retained. Deterioration of wood materials shall be prevented through repair., cleaning, and painting. [...J C. WINDOWS AND DOORS Window and door frames are in nearly all cases good. Brick structures have stone sills and brick lintels; masonry block structures have masonry sills and lintels. In some cases where aluminum siding has been applied window trim has been covered. About half of the structures in the district have aluminum storm windows, the other half wood storm windows. Required Original windows and doors including sash, lintels, sills, shutters, decorative glass, pediments, hoods, and hardilare shall be retained or Ns lien deteriorated beyond repair, replaced with duplicates of the existing or original. Recommended Wood fi-anle storm windows and doors. painted to match the existing or original, should be used but should not damage existing frames and should be removable in the future. If new sash and doors are used, the existing or original, design• and hardware should be used. When metal storm doors are used, they should be painted anodized or coated to match the existing. SAFETY AND BUILDING CODES A. BUILDING CODE REQUIREivtENTS Required Building code requirements shall be complied with in such a manner that the existing character of the building is preserved. Recommended Local building code officials should be consulted to investigate alternative life safety measures that Avill preserve the architectural integrity of the structure. Variances for historical properties should be investigated. Prohibited Construction of new stairways and elevators that would alter important architectural features and spaces is prohibited. Not Recommended Fire prevention equipment should not danla4ge the appearance or fabric of the building. VI. ENFORCEMENT PROCEDURES Enforcement of the preservation guidelines for the historic district is made possible in the Zoning Ordinance of South Bend, ordinance No. 5565-73. The Historic Preservation Commission shall issue a Certificate of Appropriateness before any construction, reconstruction• alteration. demolition or moving of anv house or structure .within the historic district boundaries is commenced (see Appendix A). This ordinance, however. does not prevent the ordinary maintenance and repair of any building or structure which does not involve a change in any exterior feature, nor does it prevent the reconstruction, alteration, demolition, or moving of any building or structure which the Building Commissioner or other official has determined to be a hazard to public safety. The Historic Preservation Commission will accept applications for Certificate of Appropriateness only from the property owner. Property owners wishing to do or have done any wort: affecting the exterior of their building or land must apply directly to the Historic Preservation Commission on the form prescribed by the Commission (see Appendix A). The Commission will review the application and either issue a Certificate of Appropriateness or else deny the application, stating in %vr'iting the reasons for such a denial. Upon such denial the applicant may appeal to the Common Council. In snaking its'determination, the historic Preservation Commission, shall consider three factors: first, appropriateness of the proposed work to the preservation of the building and district; second, the detriment to the public welfare if the proposed work is permitted even though it is not deemed appropriate; third, the potential hardship that the denial of the Certificate of Appropriateness would cause the applicant. STAFF RECOMMENDATION: Staff is relieved to see the applicant has painted the back stairs in compliance with the request of Code Enforcement, as it «ill ensure the continued preservation of that portion of the structure in accordance with the Standards and Guidelines (II. EXISTING STRUCTURES, A. Building (Materials). The proposed (and installed) xvindows, however, are not in keeping with the Standards and Guidelines of the Historic District, and are therefore inappropriate. The foundation is random coursed stone. Synthetic siding was added in 1998. The roof is pyramidal with gables. A " front/side veranda is open with brick walls and piers, as well as round columns and a wide lintel. Most windows are 1 over 1 with projecting cornices. Three oval windows (two on north face on each floor, one on the west face on the second floor) as well as a round -arched window to the left of the main door, on the porch. The main door has a wide surround with projecting cornice and a full upper light. Other notable details include fish -scale and straight -cut shingles in the gable ends of the cross gables which also have wide returns at the eave line. There are eight small light windows in the gable ends. Also on the site is a small well house with narrow modem siding and jerkin head roof, a modern metal sided garage/bam, and a c. 1890 English bank barn with a random stone foundation (supplemented with a modern concrete block). The barn has vertical matched board siding. ALTERATIONS: COA 1997-0822 re -roofed garage and barn. COA 1998-0217 "install[ed] vinyl siding, however, significant architectural details must be retained including decorative dentil trim, oval window with modified keystone elements, gables with shingles and trim and the retain the flared skirting detail between first and second floors." Additional landscaping improvements including a water feature were added to the property sometime after 1998. COA 2014-0905B called for the "Tear off and reroof Northeast lower section with Berkshire art loc shingles (same as on now)." APPLICATION ITEMS: Add a wood fence for safety. DESCRIPTION OF PROPOSED PROJECT: Retroactive permit for the installation of wood picket fence enclosing immediate north and east yard surrounding house. Fence connects to adjacent metal -wire farm fencing encompassing tree farm to the north of the main farmhouse. The body of the house is mainly brick with a half timbering and stucco in the front gable that also has a square bay and stucco in the entry gable that has a round arched entry door with diamond pane glass and brick tabbing at the door surround. There are original windows with paired 6 light casement windows with four light fixed transoms on the first floor. There are wood replacement casement windows on the second floor. Some of the windows have brick header course sills. ALTERATIONS: Portions of the roof were replaced in-kind in 1988. There are 11 wood replacement casements on the second floor approved in September 1994. The rear porch was enclosed. The tennis court is a later addition. COA 2008-1013 approved replacement wooden fence in rear of house. Replacement of single pane windows with glass block was approved with COA 2014-1014B. COA 2014-1204 approved replacement of rear door. COA 2017-0501C approved the removal and replacement of the roof with Certainteed Highland slate asphalt shingles as well as the removal of tin components and subsequent replacement with copper drip edge and valleys. Building Site, Landscaping and Accessories Individual properties in the district are characterized by a house located in the center of a flat lawn, often divided by a walk leading to the front entrance. Several of the residences are sited on two or more building lots; however, the preponderance of the homes have been erected on a single lot. Most of the properties include a double garage, usually located at the rear of the property. The majority of garages are accessed from straight driveways leading from the main thoroughfare, while a few are accessed from the alley. There are also a few homes with a covered carport located at the rear of the property, as well as a few with circular driveways. Driveway and sidewalk materials include concrete, asphalt and brick. All of the properties have trees and most have trimmed and / or hedges. Most of the houses conform to a uniform setback line within each block. REQUIRED: Major landscaping items, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Dominant land contours shall be retained. Structures such as gazebos, patio decks, fixed barbecue pits, swimming pools, tennis courts, greenhouses, new walls, fountains, fixed garden furniture, trellises and other similar structures shall be compatible to the historic character of the site and the neighborhood and inconspicuous when viewed from a public walkway. The installation of unsightly devices such as television reception dishes and solar collectors shall not be permitted in areas where they can be viewed from the public thoroughfare. NOT RECOMMENDED: Telephone or utility poles with high-intensity overhead lights should be installed so that they cannot be seen from the thoroughfare. STAFF RECOMMENDATION: Given the continued history of the property, staff has reservations about major changes to the existing structures and composition of the landscaping of this property. That being said, the tennis court was a later addition to the property, and the adjacent lot where it stood was at one time entirely green -space. For example, at the time of Knute Rockne's funeral, the adjacent lot was filled with floral arrangements (see attached image). No record of the construction, maintenance, and/or improvements to the tennis court or surrounding fence were retained by or provided to the Historic Preservation Commission. Additionally, the fencing and tennis court were not entirely obscured from the street in its most recent composition as was required by the aforementioned Standards and Guidelines. Given these considerations, staff recommends retroactive approval of the Certificate of Appropriateness for the removal of the tennis court and surrounding fencing. Roof is side -gabled with a peak running north -south. A large gabled dormer on the east face contains fishscale shingles on the street -facing wall. The entire roof is covered in architectural asphalt shingles. The porch is full -width, the porch roof is an extension of the main roof. The windows are 1/1 wood double hung with molded entabulatures. An oval window with stake brackets is on the south side of the second story. The front door is a `salvaged' half -lite wood panel door. An alley abuts the property on the north. ALTERATIONS: It is unknown when the rear -facing two -window dormer was added, as it is not indicated on our 1987 structures report. 2015-0708 replaced front door with salvaged wood panel door from time of construction. 2015-0929 removed "a very large, dangerous mulberry tree" that was "posing a threat to the house, neighbor's property and people." n APPLICATION ITEMS: Propose to remove and replace asphalt shingle roofing and add solar panels to roof per attached info. Roofing to be architectural shingles (lifetime). From attached schematic: "There are 12 panel in this system. There will be one string of 12 going to one inverter. The panels will be mounted 5 inches off the roof flush with the roof slope. There will be Optimizers on the underside of each panel." DESCRIPTION OF PROPOSED PROJECT: Application is for removal of existing asphalt shingles, followed by replacement by Timberline HD fiberglass asphalt shingles in Pewter Gray. This portion can be considered a "Routine Maintenance Exclusion", and staff are prepared to treat it as such. The Solar panels will be installed by Solar Energy Systems of Nappanee, IN. Attached schematic indicates that twelve Neo Solar Power Mono -Crystalline Photovoltaic Module Solar Panels will be installed on the roof on a racking -system in the following positions: four (4) panels will be placed on the west side of the roof along the ridgeline at the rear of the property, four panels will be placed on the east side of the roof along the ridgeline at the front of the property, two panels will be on the south side of the gable facing the street, two panels will be on the north side of the gable facing the street. A disconnect switch will be installed near the utility meter. Eight of these proposed panels will be in view (through foliage) from the street. PRESERVATION SPECIALIST REPORT: On October 2, 2017 at approximately 9:30am, I visited the property located at 911 Leland Ave. This property is part of the Chapin Park Local Historic District. I took photographs from the west, east, and north. The areas on the front roof above the doorway is visible from the street so is the southeastern pitch of the main roof. The trees in front have lost some leaves which allows greater visibility which will be even greater when the leaves all fall. ROOFS AND ROOFING Roof shapes in the district encompass all the various designs found in residential structures: hipped, gabled, gambrel, flat and combinations of these. Roofs are covered with a variety of materials such as asphalt, asbestos, wood and slate shingles as well as clay tiles. Residences in most cases have wood fascias with gutters and downspouts. The fascias of some vinyl- and aluminum - sided houses are covered with the same materials. Required The existing shape and type of materials of the roof shall be retained. All architectural features, which give the roof its essential character, shall be retained, including dormer windows, cupolas, cornices, brackets, chimneys, cresting and weather vanes. Recommended The original shape and materials of the roof should be restored. Particular effort should be made to retain materials such as slate, tile and other unique materials not commonly found in new construction. Roof covering which is deteriorated beyond repair should be replaced with new material that matches as closely as possible the original in composition, size, shape, color and texture. Gutters and downspouts are often a necessary adjunct in order to prevent deterioration of the structure; they should be maintained whenever possible or replaced with a style comparable and suitable to the architectural period. Prohibited Nothing shall be done to change the essential character of the roof as viewed from a street by adding architectural features or large unsightly fixtures, or by using materials inappropriate to the style of the house. The roof shall not be stripped of architectural features important to its character. Not Recommended Overhanging eaves, soffit, brackets and gables should not be covered or enclosed when adding siding to a building. E. MECHANICAL SERVICES The majority of the structures within the district have oil or gas heat, and have brick chimneys through the roof. Some houses have one or two window air conditioners. Required Required mechanical systems shall be placed in areas that will result in the least possible alteration of the structural integrity and physical appearance of the building. Recommended Solar collectors and TV dishes should be placed in the rear of the property and shielded by shrubbery and landscaping. Window air conditioners and exhaust fans should be installed at the rear or an inconspicuous side window. Original lighting fixtures should be utilized whenever possible. Prohibited Holes shall not be cut through walls or roofs in areas that can be seen from the street to accommodate air conditioners or other mechanical equipment. Not Recommended Exterior electrical and telephone cables should not be attached to the street elevations of the building. The windows are 1/1 wood double hung with molded entabulatures. An oval window with wedge-shaped brackets faces the street on the second story. ALTERATIONS: CoA #2013-0924 called for repointing "brick with lime putty; replace brick in-kind and replace wood siding in the rear." APPLICATION ITEMS: "Put up privacy fence around the side and rear yard." Additional information from attached sheet: "Install 118 linear feet of 6 foot high AC2 pressure treated wood privacy fence with 1 each up to 48" dog eared pickets. 1 each 8 foot double picket gate in front 15 foot fence line over sidewalk by house. This span will also include an 8' gate to allow access to yard, and will be set 25' back from the sidewalk (per the building department, fences closer to the lot line than 25' are required to be no higher than 3'). All remaining "rear" portions will be 6' privacy fence. Portions of this fence will be `pickets out' (the south wall), while western wall will be `pickets in' because of proximity to neighbors existing fencing. A 6' high gate connecting the house to the garage will also be added (estimated to be 30-40" in length by Gustafson). THE DISTRICT ENVIRONMENT The Chapin Park Local Historic District is a particularly fine residential area located close to downtown South Bend, the St. Joseph River, Memorial Hospital and Leeper Park. This section is meant to protect and guide appropriate maintenance of the common areas of the district (i.e. visual landscape and streetscapes). REQUIRED New or different fencing requires a C of A and shall reflect the style and character of the individual property and the surrounding environment and properties. RECOMMENDED The current or historic character of lawns should be preserved. Front yard areas, common lawns and tree lawns should remain open. New or replacement trees should be compatible in variety with those presently growing. Vacant lots should be kept landscaped appropriately while vacant, and may be used for recreational or residential development. PROHIBITED Existing relationships of buildings and their environments shall not be destroyed by widening existing streets, applying asphalt or other bituminous coverings or by introducing new streets or parking lots. Signs, streetlights, benches, new plant materials, fencing, walkways and paving materials which are out of scale or inappropriate to the neighborhood may not be used. The erection of high walls or barriers which would alter the relationship of the houses, shall be prohibited. Utility poles with high intensity overhead lights shall not be used on main thoroughfares. B. BUILDING SITE, LANDSCAPING & ACCESSORIES This section focuses on individual properties and amenities. Building sites tend to be irregularly shaped, of varying topography and with different setbacks with regard to plots. Alleys are generally behind houses. Landscape accessories like fences are unique to each structure. Chapin Place represents a unique situation within the district. Applications from properties that have property lines on Chapin Place will be considered on a case-by-case basis. The windows are 1/1 wood double hung with iron railing on the second floor front and side windows. Some of the windows have aluminum storms while others appear to have original wood storms. ALTERATIONS: Limestone was installed over the wood siding in 1943. The front porch was modified in the 1940s from a full width to its current configuration with a stone wall and patio to the side of the gabled vestibule entrance. Art -lock asphalt shingled roof was replaced with COA#2010-0928 with architectural asphalt shingles. The aluminum storm windows and doors are not original to the house. COA#2016-0308 called for the demolition of the existing garage, but was not carried out. APPLICATION ITEMS: Existing 5 stall wood frame garage will be demolished save an approximately 27' stone wall on the north side. Modern 2 stall 27' x 23' garage will be constructed around wall. Scope of work is attached. Variance being required for west side of property. Project duration: 5 weeks from all approvals. DESCRIPTION OF PROPOSED PROJECT: Application is for the demolition of portions of the existing garage, followed by reconstruction. The current garage consists of two conjoined structures with garage bays on both the north and south faces. The western portion has three garage doors facing the southern alley. The eastern portion has two garage doors facing the house and two garage doors facing the alley. The western 27.9' of the north wall of the existing garage is to be retained for inclusion in the new structure to be built. The proposed garage will have two doors facing to the east. BUILDING MATERIALS Original exterior building materials in the district include brick, stucco, clapboard, wood shingles, and brick or stone masonry. In some instances, vinyl, composite and aluminum siding have been applied over the original material. REQUIRED Original exterior building materials shall be retained when possible. Deterioration of wood materials shall be prevented through repair, cleaning and painting. The existing architectural detail around windows, porches doors and eaves shall be retained or replaced by replicas of the same design when deteriorated beyond repair. Masonry, including brick and stucco structures, shall be maintained, and properly cleaned only when necessary to halt deterioration or to remove stains and shall be done in a method acceptable for the preservation of the surface: i.e. low- pressure water and soft natural bristle brushes. Brick or masonry mortar joints should be repointed only when there is evidence of moisture problems, or when sufficient mortar is missing to allow water to stand in the mortar joint. Existing mortar shall be duplicated in composition, color, texture, joint size, method of application and joint profile. V.GENERAL A. Buildings in the district should not be demolished except where a building poses a threat to the public safety, and demolition is the only alternative. Documentation of interior and exterior features of the original buildings, especially homes rated as historically significant, is encouraged. Measured drawings and photographs may be submitted to the Historic Preservation Commission for safekeeping and future reference. B. A Certificate of Appropriateness is required before moving any building or structure. The moving of a building within, out of or into the district is discouraged; however, moving is preferred to demolition. Buildings incompatible with existing structures in the historic district shall be prohibited. 9 STAFF RECOMMENDATION: Applicant has shown a desire to incorporate existing historical elements (including reusing an original window) in the new construction, and has put forth a plan that is sympathetic to the architectural standards required of the neighborhood's outbuildings.
