It has two stories set upon a square plan with projecting porches all on brick foundations. There is a Porte-cochere on the west facade. The exterior walls are recently restored clapboard siding. The windows are 9/1 double hung. There are aluminum railings around various porches and balconies. The roof is a truncated pyramidal with asphalt shingles and a front dormer with a classic pediment; the roof peak has a flat roof. The porch and balcony are distinctive features with the classic portico front entry that has triple ionic columns on both front corners; bracketed entablature with a flat roof enclosed by a wrought iron fence. According to the 1977 survey card, there is a "newer frame garage with apartment of a `style that detracts from the house."' (Brian Crumlish) ALTERATIONS: COA 1991-1202 approved enclosing existing second level balcony to create a laundry room. The "guest house" was revamped with siding and new door configurations in 1995. COA 2015- 0601 approved removal of the aluminum siding and restoration of wood details and trim, and restoring/replacing the bead board porch ceiling and soffit. COA 2015-0722 approved demolition, rebuilding, and reinstallation of front porch slab and foundation; rebuilding pillar foundations; remove non -original Porte Cochere and rebuild to historic specifications, and in-kind replacement of asphalt roof shingles. COA 2016-0801 approved installation of wood storm windows and storm doors, replacement of newel posts and rails across the front porch, Juliette porch, above the sun porch, above the porte cochere, and above the front portico, and replacement of flat roof of carriage house with Gambrel roof and two dormers on either side. APPLICATION ITEMS: Replace existing asphalt driveway with a concrete driveway. Replace existing facebricked walkways (1980) with concrete walkways. Eliminate curved front walk and replace with a straight walkway from the limestone steps of the front porch to the sidewalk. DESCRIPTION OF PROPOSED PROJECT: Owner proposes to: 1) replace existing deteriorated asphalt driveway with concrete driveway. Although there is no definitive evidence of the original driveway material, early photos show it was light colored; definitely not asphalt. 2) Eliminate curved brick paver sidewalk in front of house, and replace with concrete sidewalk straight out from front steps, as is typical in other Magnolia homes and in original Sears catalog illustration. (see attached photos) STANDARDS AND GUIDELINES: West North Shore Drive Local Historic District I. THE ENVIRONMENT C. LAWNS The current or historic landscaping character of lawns should be preserved. Paving and blacktopping of existing lawns so as to transform them essentially into parking lots or spaces rather than residential lawns must be prohibited. Front yard areas, trees, and lawns must remain open. Fencing in front yards is prohibited. A fence on the Michigan Street side of lots 12 and 13 may be permitted if done in a distinctive way and is compatible with the character of the structures on these lots, with consideration being made for the high density and speed of traffic on Michigan Street. Trees contribute greatly to the beauty and charm and indeed the historic character of the North Shore Drive neighborhood. Street widening or other public developments. Street widening or other public developments calling for widespread destruction of large, healthy trees must be prohibited. Replacement of trees must be compatible in variety with those presently growing. The vacant lots must be kept as landscaped or appropriate recreational, or other similar residential development. This is not intended to prohibit the sale of such lots, nor new construction on these lots. STAFF RECOMMENDATION: Staff recommends approval. IV STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Date: February 13, 2017 Application Number: 2017-0213A Property Location: 1328 E Wayne Street South Architectural Style/Date/Architect or Builder: Colonial Revival/1925/Marcus House/H. Russell Stapp, Architect, Whitcomb & Keller, builder Property Owner: Stephen Camilleri & Erin Kennedy Landmark or District Designation: East Wayne Street Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE: This L -plan 2 -story frame house sided with wood shingles, has a gable roof with asphalt shingles. Windows are 8/1 and 6/1 double -hung with wood trim and sills, and ornamental louvered shutters on second floor windows. The house front features a central entry canopy with gable roof and round arch under gable. There is a detached 2 -car frame garage with asphalt - shingled gable roof, and clapboard siding. ALTERATIONS: Aluminum storm windows and doors have been added. An enclosed east wing was added to the house in 1937, and a 13'x19' rear addition in 1959. COA 2008-0716 and 2015-0624 both approved complete tear -off and re -roof with asphalt shingles. APPLICATION ITEMS: Kitchen remodel and second floor addition on the rear of the structure within the footprint of a rear porch that was previously added. This porch is not original to the house. The addition will include a new master bedroom and bath. Additionally, a new bath will be built in the basement. See attached document for complete description. DESCRIPTION OF PROPOSED PROJECT: The owners propose to add a second floor at the rear of house, over the existing, one-story non -original back porch addition. The ridge of the new addition will align with the existing house ridge and will not be visible from the street. The original house details will be used for the addition. On the first floor, a mudroom will be added where the exterior porch currently is located. On the second Floor, a Master Suite will be constructed over the back porch. Siding to be machine split, number one grade clear cedar shingles by Edmund Allen, to match existing painted wood shingles; painted wood trim to match existing. Windows will be Marvin Ultimate Magnum wood double hung windows with mullion, scale, and simulated divided lites to match existing windows; trim to match existing. Proposed Velux FS deck - mounted skylight to be added at southwest side of new gable to allow light to enter stair hall. Existing exterior door will be reused. Architectural shingles on the new roof to match existing roof. Eave and gable rake details to match existing house. PRESERVATION SPECIALIST REPORT: STANDARDS AND GUIDELINES: East Wayne Street Local Historic District III. NEW CONSTRUCTION New construction includes any new building or structure constructed within the boundaries of the historic district, or any new addition to an existing building. New construction should be designed considering the appearance of the other buildings in the neighborhood. A. HEIGHT AND PROPORTION The majority of structures in the district are two stories high and are square, rectangular, or irregular in plan. There are a few story -and -a -half residences. The prevalent facade proportions are between a 1:1 and a 1:2 height -to -width ratio. Reouired The height of a new structure and its height -to -width proportions shall be consistent with adjacent buildings in the district. The building height shall be no greater than that of the tallest existing structure and no less than that of the lowest existing structure of the same type in the same block. Facade proportions shall be established by permitting no structure with a facade wider or narrower than those existing in the same block. Additions to existing buildings shall be related in height and proportion to the existing structure. Recommended Contemporary designs should be compatible in character and mood to the building or neighborhood. Prohibited Additions may not be constructed that would change the existing facade of a building, alter its scale or architectural character, or add new height. Not Recommended New stories should not be added, nor should existing stories be removed, which would destroy important architectural details, features or spaces of the building. Any style or period of architecture that is incompatible with what exists should not be permitted in the new additions. B. BUILDING MATERIALS Wall materials in the district include brick, stucco, half-timbering, stone, clapboard, shingle, and metal and vinyl siding. Required Exterior materials used on a new structure shall be compatible in scale, texture and color with adjacent structures. Materials used on an addition to an existing structure shall relate to the existing or original materials of that structure. As much of the original structure as possible shall be retained so that the addition could be removed without damage to the basic structure and appearance of the building. Recommended Metal or vinyl siding may be used when it is the only feasible alternative. This siding should be compatible with the original size and style and with the materials of other buildings in the district. Prohibited Inappropriate materials such as asbestos, asphalt, molded or artificial stone, or artificial brick shall not be used. Not Recommended Glass blocks should not be used. Concrete block should not be used for anything other than foundations. STAFF RECOMMENDATION: Staff recommends approval. Maurus and his wife, Mary. Edward was a professor of mathematics, science, and engineering at Notre Dame. PROJECT DESCRIPTION: The Owners propose to add a second floor over the back porch addition. The back porch addition is not part of the original structure. The ridge of the new addition will align with the existing house ridge and will not be visible from the street. Limitations: Use on roofs with slopes greater than 2" per foot. Low -slope applications (2" to 4" per foot) require additional underlayment. Product Composition: Landmark series shingles are composed of a fiber glass mat base. Ceramic - coated mineral granules are tightly embedded in carefully refined, water-resistant asphalt. Two pieces of the shingle are firmly laminated together in a special, tough asphaltic cement. All Landmark shingles have self-sealing adhesive strips. Leeper Park West is bordered by Riverside Drive along the St. Joseph River, Park Lane to the South, Lafayette to the West, the bluff of Chapin Park to the extreme West and Michigan Street to the East. It is part of the 1911- 1915 Parks and Boulevard system designed for South Bend by George Kessler. ALTERATIONS: The duck pond was restored in 1979. The formal gardens were grown over in the 1980s. The playground equipment is not original to the Park. A Parking Lot south of the Tennis Center was added during the Madison School renovation along with lighting without COA. The tennis courts were replaced in 2007 and the "odor garden" was installed in 2008. New Playground equipment was installed 2013. A garden for vegetables, flowers and fruit trees was established by Madison Primary Center in 2015. APPLICATION ITEMS: New public ADA accessible formal labyrinth garden with an emphasis on restorative health and meditation in existing open space of Leeper Park with interpretive, education signage and benches. See Attached. DESCRIPTION OF PROPOSED PROJECT: Addition to the park of a therapeutic, ADA accessible contemplation garden labyrinth. The standards and criteria acknowledge that there will be changes to the landscape and are intended to make the changes sensitive to the historic character of the landscape. 5. Since it is not possible to provide one general guideline, the following factors that will be considered in determining whether a later addition(s) can, or should, be removed include: a) Compatibility with the original property's integrity in scale, materials and character. b) Historic association with the property. c) Quality in design and execution of the addition/alteration. d) Functional usefulness. Labyrinth: 9.4 Vegetation 3 Alteration of existing or addition of new vegetation materials and features will be considered if they do not alter the basic concept of the historic landscape design. 9. Maintenance of, removal of, and additions of vegetation materials and features should consider maintaining existing or intended vistas and spaces, screening instructions, creating new spaces where appropriate and maintaining defined areas of shade and sun. Walk: 9.5 Circulation 4. When replacement of circulation layouts is necessary, it should be based on physical or documentary evidence. 8. Alteration of existing or addition of new circulation materials and features will be considered if they do not alter the basic concept of the historic landscape design. Benches: 9.7 Furnishings and Objects 4. Alteration of existing or addition of new furnishings and objects will be considered if the alteration does not alter the basic concept of the historic landscape design. 8. New furnishings and objects should be designed using vandal resistant standards. 9. Location of signs shall be guided by a master plan. 10. Signs shall conform to a simple sign system. STAFF RECOMMENDATION: Kesler's 1915 plan shows a garden in this location, and Leeper Park drawings through 1998 confirm a round formal garden continued to exist here. Based on ancient historical referenced labyrinth gardens, this amenity will provide a new experience not only to visitors and residents to the park and City of South Bend, but will more directly serve the populations of Beacon Memorial Hospital patients, and the adjacent Madison Elementary School. The idea of a labyrinth garden is to allow introspection and contemplation while following the indicated path through the maze. The design also has been shown to loosely correspond to various areas of the brain and mental states while travelling through it, and also abstractly "looks" like the human brain. With the design based on a centuries old method and layout for the circuitous labyrinth path at the center of the garden, a 40'-0" diameter area will be surrounded by a perimeter of lavender plants. These plants were selected for their soothing and calming aromatherapy effects. An additional planting area surrounds this labyrinth core which could be planted with ornamental plants, annuals, perennials, or grasses to add to the meditative effects of the central portion. Able to mimic looks from polished marble to tanned leather. Usually are available in two options: acid -based and water- based. Acid stains: React chemically with hydrated lime (CaOH) in concrete. Once stain reacts, it becomes permanent part of concrete, and won't fade, chip, or peel away. Palette is generally limited to earth tones, such as tans, browns, terra cottas, and soft blue -greens. Water-based: Comes in broader spectrum of standard colors. No chemical reaction occurs, so the color is more consistent. Low in VOCs (volatile organic compounds) and safer to apply because they are free of solvents and acids. Advantages: • Both can be applied to new or old, plain or integrally colored concrete. • Excellent UV stability and wear resistance. • Used for walkways, patios, and vertical surfaces such as walls. Limitations: • -Enhance, rather than disguise surface. They will not hide blemishes. • Limited palette for acid -based stains. Dyes Dyes are nonreactive. The small particles impart color by penetrating pores of concrete. The particles fill the pores and are hard to remove, making them almost as permanent as stains. Can be water- or solvent -based. Water-based have more marbling and variation (similar look to chemical stain). Solvent -based appear more monotone and uniform. The two can be combined for color effects and variations. Colors can easily be mixed at the jobsite or diluted to obtain a multitude of other shades. Advantages: • Ease of use • Extensive palette • Vibrancy of color (more intense than chemical stains) • Nonreactive • No residue, minimal cleanup • Speed of application Limitations: • Like chemical stains, dyes have some transparency. They will not disguise existing flaws. • Dyes penetrate very fast, leaving little room for error in application. • Not UV stable, may fade when exposed to direct sunlight; some manufacturers recommend for indoor use only. Integral Color Rich, long-lasting fade -resistant color: Often used to produce a backdrop for contrasting accent or antiquing colors. This layering of color is what enables them to closely replicate the variegated, multi -tonal appearance of natural stone. Advantages: • Entire batch colored all the way through (like food coloring to cake. icing). Even if surface abrasion occurs, the color will not wear away. • Pigments are chemically stable,.won't fade overtime from exposure to weather or UV light. • Colors available in powdered, granular, and liquid forms. • Palette consists primarily of soft earth tones, that integrate well with most landscape architectural elements. . Dry -shake Color Hardeners Comes as powder that is broadcast onto freshly placed concrete and then worked into the surface: Unlike integral pigments which color the entire concrete. matrix; hardeners color only the top surface layer. They appear more intense because the color is concentrated at the surface. Advantages: • Wider array of hues than integral colors and combining hardeners permits greater variability in tones. • Densify the concrete surface because hardeners contain hard mineral aggregates and Portland cement.. • Result in a surface that's stronger, more wear resistant, and less permeable to moisture and deicing chemicals. • Improves strength and density of concrete, so they are a great choice for exterior slabs exposed to freeze -thaw cycles and deicing salts, and for interior floors exposed to heavy foot traffic and abrasion. The exterior walls and foundations are rough stone, with limestone window and door trim. The house has large bay windows on the north fagade, a four-story tower at the northeast corner, projecting turret with conical roof at the southeast corner, a steep gable on the port-cochere at the west end, and six stone chimneys with simple banding and cut stone caps. Most windows are one -over -one wood double -hung; there are also windows with double transoms, as well as a few Gothic windows. Generally, windows are deeply recessed and feature stone lintels and sills. At the west end of the house, colonnettes flank six windows with double transoms on the fourth floor, while first story windows are set in rounded heavy stone arches with colonettes. The front entry porch is enclosed by round stone arches supported by clusters of Romanesque columns. The porte-cochere has intersecting gables and large arched openings. The rear veranda stretches around the south and east, featuring short Romanesque columns with a variety of capitals. Doors are wood. ALTERATIONS: COA 1979-1107 to convert house into a restaurant through exterior changes listed in Appendix I (including #10: enclosing rear garden veranda) was denied. COA 1979-1217 addressed concerns discussed on previous COA to convert house into a restaurant; it was conditionally approved pending treatment of the porte-cochere. COA 1980-0219, upon review for the third time, approved conversion of the house into a restaurant and enclosure of the porte-cochere doorway openings with nonfunctional paneled wood doors. COA 1980-0317 approved construction of a stone sign south of the Washington Street entrance. COA 1980-0903 approved construction of a wooden fence to enclose area south of building to install a freezer. COA 1982-0524 approved repair of roof. COA 1988-0721 approved in-kind replacement of front steps and repair of north garden wall. Previously approved COA 1980-0219 enclosed rear veranda with 6- and 3- light casement and fixed wood windows have been replaced with new vinyl windows as proposed in this application without COA approval, in violation of Ordinance Section 21-10(0(10). APPLICATION ITEMS: "Replace windows with in kind -wood against the columns and top and bottom of the granite, as well as in-between supports. Encase enclosed energy efficient vinyl framed window with wood molding completely covering the edges and center piece of the .windows with no exposed vinyl. Idea is to mirror the look of the upstairs windows of the house. The upstairs windows are window over window, while the non -historic windows on the sun porch were made to look like 6 pane window panels. In reality, they were a sheet of glass with strips of wood attached to give the appearance. (one of the photos shows the inconsistency in the appearance). The look will reflect the overall appearance of the historic structure. Material used: American Craftsman white vinyl window with nailing flange. Solid Wood Frame to cover all vinyl, see attached photograph of frame." DESCRIPTION OF PROPOSED PROJECT: History: October 6, 2016: Preservation Specialist Steve Szaday investigated report of windows being replaced at Tippecanoe Place. (see attached report). October 7, 2016: HPC President acting as Inspector Tim Klusczinski and intern Millie Latak initiated a follow-up visit to verify the new window installation, observing the work in process. President Klusczinski spoke with the manager at Tippecanoe Place and a contractor on the job confirming the scope of the project and lack of permits. President Klusczinski documented the discarded windows, inspected the remaining original windows (not yet removed), and condition of sills; pointed out failure to apply for COA or Building Permit, and non-compliance of vinyl windows with standards and guidelines. (see attached report). Written request to Building Commissioner to issue a Cease and Desist order. (see attached letter). October 12, 2016: HPC staff meeting and conference call with Todd Zeiger of Indiana Landmarks regarding recent vinyl window installation. Indiana Landmarks holds a fagade easement on Tippecanoe Place. It was determined that the removed windows are circa -1980. President Klusczinski drafted a letter of notification of violation of Group B Standards for property owner. (see attached letter). October 18, 2016: Indiana Landmarks notified property owner of violation of their Historic Preservation Easement. (see attached letter). October 19, 2016: Building Department issues Cease and Desist Letter. (see attached letter). January 26, 2017: Building Department issues Ordinance Violation Citation. (see attached) Project: Existing 6- and 3 -light casement and fixed wood windows were removed from previously approved enclosed porch on back side of property. These windows were approved as part of COA 1980- 0219 to (Appendix I, item 10): "The rear garden veranda will be enclosed with three casement windows per bay, with heavy wood frames designed to fit around the columns." Windows have been replaced with Andersen American Craftsman 70 -Series Pro vinyl double -hung 1/1 replacement windows. Window openings have been reduced in size and the style deviates from what was previously approved. A solid wood frame is proposed to cover all vinyl on the exterior. The wood frame appears similar to a storm window, however, there is no glazing. Wood frame will be attached to vinyl windows by screws and caulked. An opening at the bottom is intended to allow water to escape. Not part of the application, a door with transom above in the rear veranda has been replaced. PRESERVATION SPECIALIST REPORT: On February 17, 2017 at approximately I OAM Director Feasel and I visited the property located at 620 W Washington. There we met with Kevin the manager of the restaurant housed within the structure. We were on site to document the window installation at the rear enclosed porch. We were told that the wood used under the windows above the limestone was pressure treated pine. We were also told that cedar was used in between the windows. The transition pieces between the windows were the same ones that existed with the last window installation but had been stripped and repainted. The new windows appeared to be vinyl replacements. There appeared to be some installation issues. -The original transition pieces were set too far away from the limestone columns and foam sealant was installed to fill the void, in most places at least 1 inch on all sides. -The windows themselves were framed incorrectly as the outsides of the windows are clearly visible with at least'/2 inch of gap between the window and the framework all around -Foam sealant was used around all the new framework in lieu of the proper caulking. The transitions be flexible not brittle after freezing. Wood and limestone expand and contract at different rates and therefore need a pliable transition material. Some original transition material was still present and appeared to be a type of rubberized caulk. -Some new caulking beads were well over %2 inch wide and stood 1/2 inch above grade We also noticed a new transom above the new screen door to the porch. The original transom window and framework were left by the dumpster and were photographed. The window was not deteriorated beyond repair. Steve Szaday STANDARDS AND GUIDELINES: Group B A. Maintenance The maintenance of any historical structure or site shall in no way involve any direct physical change except for the general cleaning and upkeep of the landmark. The Commission shall encourage the proper maintenance of all structure or sites. B. Treatment Treatment shall be defined as any change of surface materials that will not alter the style or original form. Such improvements include re -roofing, glazing, or landscaping lawns and may involve a change that can potentially enhance or detract from the character of the landmark. A treatment change of any surface whether on the landmark or in its environment may require a Certificate of Appropriateness if it significantly alters the appearance of the landmark. Although these kinds of changes may not require a Building Permit, a Certificate of Appropriateness may be necessary. The commission should review the proposed treatment for character and style consistency with the original surfaces. C. Renovation and Additions Renovation is the modification of a structure, which does not alter the general massing while an addition, is a change in mass. A modification, which involves the removal of a part of the landmark, should be considered under demolition (see demolition). Additions to landmarks should not detract from the original form and unity of the landmark and should not cover singular examples of architectural detail. Additions to landmarks should be added in a manner that does not disrupt the visible unity of overall appearance of the site. The proportions, materials and ratios of the existing structures should be carried through in the additions. Care should be taken not to change or alter the following: 1. Structure—Necessary structural improvements, where safety demands should be accomplished in such a way as to cause minimal visual change to the original style and construction. 2. Material—Additions and improvements involving any new material in the landmark should be of the same material as the original. It should be the same size and texture. An alternative material may be allowed if it duplicates the original. a. wood—all wood trim should conform with existing trim in shape and size. b. siding materials the Commission discourages the covering or alteration of original materials with additional siding. Structures already sided with incompatible materials should be returned to a siding similar to the original when renovation is considered. D. Demolition Historic landmarks shall not be demolished. When a landmark poses a threat to the public safety, and demolition is the only alternative, documentation by way of photographs, measured drawings, or other descriptive methods should be made of both the exterior and interior of the landmark. The person or agency responsible for demolition of the landmark shall be responsible for this documentation. E. Moving The moving of landmarks is discouraged, however, moving is preferred to demolition. When moving is necessary, the owner of the landmark must apply to the Commission for a Certificate of Appropriateness. F. Signs No neon or flashing signs will be permitted unless they are original to the structure. Billboards and super - graphics will also be disallowed. Only one appropriate identifying sign will be permitted per business. G. Building Site and Landscanina 1. Reauired Major landscaping items, trees, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Dominant land contours shall be retained. Structures such as: gazebos, patio decks, fixed barbecue pits, swimming pools, tennis courts, green houses, new walls, fountains, fixed garden furniture, trellises, and other similar structures shall be compatible to the historic character of the site and neighborhood and inconspicuous when viewed from a public way. 2. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings, and newspapers. Plant materials and trees in close proximity to the building that are causing deterioration to the buildings historic fabric should be removed. However, trees and plant materials that must be removed should be immediately replaced by suitable flora. Front yard areas should not be fenced except in cases where historic documentation would indicate such fencing appropriate. Fencing should be in character with the buildings style, materials, and scale. 3. Prohibited No changes may be made to the appearance of the site by removing major landscaping items, trees, fencing, walkways, outbuildings, and other elements before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped. The installation of unsightly devices such as TV reception dishes and solar collectors shall not be permitted in areas where they can be viewed from public thoroughfares. STAFF RECOMMENDATION: The Secretary of the Interior's Standards for replacing windows recommends "using the same sash and pane configuration and other design details. If using the same kind of material is not technically or economically feasible when replacing windows deteriorated beyond repair, then a compatible substitute material may be considered." Staff believes that the approved COA 1980-0219 windows satisfied the Secretary of the Interior's Standards as they were of wood construction and were designed to resemble the pattern and repetition exemplified in the existing windows with transoms on east facade and double transoms on west facade. As the new windows do not retain the same sash and pane configuration that was previously approved by the Commission, are a change of material from wood to vinyl, alters the style and original form in a way that detracts from the character of the landmark, and replaced existing windows that were not demonstrably deteriorated beyond repair, staff recommends denial. Staff recommends that if the applicants reapply for a COA with another option, the Commission request to the Building Department a hold on the Ordinance Violation Citation. There had been an enormous amount of leakage over the years on the stonework inside, which produced staining that we could only partially clean after several attempts. The previous windows were not energy efficient, which was causing much discomfort to our guest in the winter due to the cold weather elements as well as heat in the summer. Not to mention the ownership group suffering from astronomical utility bills attempting to keep the room warm or cool. Nor as we looked at the style of the windows were they consistent with the balance of the great house, window over window all around the upper stories. The previous windows were made to look like 6 panes of glass by strips of wood attached on each glass panel. This is the back ground that lead us to choose the windows and casing stated in the application. These windows are the highest rated energy efficient window and dual weather stripping creates a weather tight seal. As the ownership group, we follow an ongoing maintenance and repair program for the entire house at considerable expense each year. In this context, we acknowledge that we jumped the gun last fall, trying to replace the windows before another winter. Please consider this attached application. I went to the Building Department and inquired if any permits had been pulled. They confirmed that none were assigned to that address and they would contact the field inspector to have him "red tag" it. I drove to the property and took photographs of the removed windows, the dumpster with windows and trim in it and the new installed windows. They are Anderson Pro Series double hung vinyl windows. The openings have been downsized and altered from casement and fixed windows to double hung. Of the workman doing the work neither could tell me the name of the contractor, one said his cousin got him the job. I asked him if they were licensed and why they had not gotten a permit, his response was he was unfamiliar with how things work here. I entered the business located at the address and requested to speak to the manager. I was informed that Kevin would not be in until noon. I left my card with a request to call us as soon as he got in. I forwarded photos to HPC and to Todd Zeiger of Indiana Landmarks. Conference call with Brad at Indiana Landmarks to compare findings. Informed that Mr. Zeiger was out of the office for the day. 11A: Accompanied by Millie Latack (HPC Volunteer Assistant and Construction Specialist), I initiated a follow-up site visit to verify the status of new installations at Tippecanoe Place. Observed that new work was still proceeding. Spoke to Aaron Smith — Manager at Tippecanoe Place. Asked to see the related COA and Building Permit for work in progress. None available. Asked Mr. Smith if he had authorized this work. Mr. Smith indicated that he had not and referred me to Kevin Jakel (General Manager) who would be in after 4P. Mr. Smith then put me in touch with Steve Bognar, a contractor, involved with the installation. Mr. Bognar explained that he was not the general contractor (was only assisting). Explained that the owner's [wife's] cousin was coordinating the work. That individual's name was "Tim." Mr. Bognar addressed my questions, clarifying that the work began sometime during the prior week and ONLY involved the window replacement on the Porch — and to his knowledge, NO other projects were either planned or in -process. Mr. Bognar informed us that he has a working relationship with Indiana Landmarks and performed masonry work/cleaning (his specialty) on the structure, in the past. Asked if a Stop Work Order had been issued. Mr. Bognar was not aware of any order. Seemed to know that the Inspector spoke with "Tim" and only urged him to apply for a building permit. I asked Tim -to corroborate the details about the Inspector's visit. Asked for the name of the Inspector. The Inspector's business card was issued to Randy James. Asked about Stop Work Order. Tim reiterrated what Mr. Bognar told me: that the Inspector only asked that they obtain a building permit. Millie and I made a visual inspection of the window panels on the West elevation (which had not yet been removed). Sill exhibited severe deterioration. I assured all parties that the style and material choice (vinyl) for the replacement windows was not a"compatible substitution. However, they clarified that a Red Tag is NOT the same as a Stop Work Order and does not halt progress. They listened to my concerns and informed me that since the contractors performed work without a permit, fines would also be applied. It has a high hip roof with a gable projection on the main fagade and it is covered in asphalt shingles. The walls are aluminum sided. Some of the upper floor windows and the front fagade windows appear to be original 1/1 wood double -hung. All the windows have aluminum storms. There is an open porch with concrete block pillars and piers with wood Doric columns. The front door appears to be original. The house is situated on a very small wedge-shaped lot with a narrow front and side yard; the garage completely dominates the rear yard. ALTERATIONS: The house is aluminum sided and all windows have aluminum storms. The steel security door at the rear of the house is a replacement. The garage appears to be original. The storm door is not original. The south kitchen window has been reduced in size and replaced with a modern vinyl replacement window (1985). A south basement window has been replaced with a vinyl replacement window and the other south side basement window has a deteriorating aluminum storm and wood window. A window at the rear of the house has been removed and/or covered with aluminum siding (1985). The roof was replaced with COA 2007-0316. COA 2010-0802A for vinyl replacement windows was denied with the exception of the front third floor window, as it was determined by the Preservation Specialist that existing windows could be repaired and/or rehabilitated. COA 2016-1019 approved tear down of existing garage, and conditional approval of installation of a new wood deck and French doors (replacing windows) at back side of house; removal and replacement of existing wood windows was denied. Andersen vinyl -clad wood windows were chosen for the front of the house, visible from the street; PlyGem vinyl windows for the dining room as they are not visible from the street and face the neighboring house, which is situated extremely close to this property. PRESERVATION SPECIALIST REPORT: I arrived at the property located at 812 Golden Ave at approximately 3:30pm on January 9, 2017. The owners had applied to replace seven windows on the first floor. The owner was not home at the time. I had talked to Mr. Monis earlier in the day and he had informed me that they had enclosed the windows in plastic film for winterization. I had previously taken photos from the inside and had those on file. I took photographs from the outside as best as possible. I compared the photos I had taken earlier in 2016 and have not noticed any change in the condition of the windows that I could see. It is easier to see the gaps between the sashes and frames from the outside. As before the storms especially the ones located on the north(side) of the house are incomplete, broken, or loose. The window sashes are missing ropes and most of the upper sashes are painted shut. The lower sashes have mobility due to parting and interior stops being wom. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors painted to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and reused in place. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features, such as aluminum insulating glass combinations that require removal of the original windows and doors, shall not be installed. Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: Although this house is listed in the Historic Sites and Structures Inventory as "Contributing," previous window alterations, replacement of the original porch railings with deck railing, infill of basement windows with glass block, installation of aluminum siding, shutters and a couple vinyl windows have already altered the original appearance of the house to the point the rating no longer seems appropriate. Inspection of the windows have determined that several windows need significant repair and storms need repair/replacement. As COA 2016-1019 approved installation of Andersen Frenchwood vinyl -clad wood doors in one of the rooms where replacement windows are proposed, staff recommends approval of replacement of all seven existing first -floor windows with Andersen 200 Series vinyl -clad wood double -hung replacement windows without grilles, to maintain the original 1/1 appearance. Commissioner Anderson (Nay) - given the houses current condition and all the alternations it has gone through and financial considerations, I feel we should try to meet somewhere in the middle. Commissioner Voll (Aye) - compromises standards and guidelines. Commissioner Hertel (Aye) - according to the Riverside Drive Local Historic District Existing Structures — Windows and Doors, the original windows and doors shall be retained unless they are beyond repair, and it is believed by our Preservation Specialist that these windows are repairable; this avenue has not been fully explored by the homeowner. Commissioner Klusczinski (Aye) - applicant provided no additional evidence that the windows are reasonably deteriorated beyond repair. I stand by the Preservation Specialist's assessment from the prior C of A. The replacement options are not suggesting materials that are in-kind. It does not follow standards and guidelines for the district. I firmly believe that the windows can be rehabilitated, and I have seen far worse examples that have come back to life. Commissioner Gordon (Aye) - based on the guidelines, and assessment of the Preservation Specialist. Commissioner Molnar (Nay) - enough alterations have been made to change the appearance of the house that the rating no longer seems appropriate. The gabled roof with cornice returns has asphalt shingles. There are two pedimented dormers and one central gabled dormer on the front. The full front porch has a gabled dormer above the entrance, and six free-standing columns with balustrade. Windows are 1/1 double -hung; several bay windows are single light. ALTERATIONS: Aluminum siding, storm windows and doors. APPLICATION ITEMS: Putting in energy eff. windows, replace 2nds and 31d floor windows. DESCRIPTION OF PROPOSED PROJECT: Owner has a quote from Hoosier Siding & Construction to remove existing wood windows and replace with vinyl window inserts. Windows will be inserts, with original wood frames and sills to remain. Window styles — cottage style and traditional 1/1 double hung, casement, and fixed lite — to match existing. Grid pattern of third floor windows to match existing third floor windows, with the exception of the diamond grid in south attic window which cannot be easily replicated. Insulation will be installed in frames. Owner cites energy efficiency as reason for replacement. PRESERVATION SPECIALIST REPORT: On Friday January 61", 2017 at 3pm I met with the owners of 825 Ashland at the property to photograph and record the existing condition of the windows on the second and third floors which they are looking to replace with their COA application. Most of the windows had clear plastic on them with mini blinds down and blades angled to keep light out so I was unable to get close photographs of several of the windows. The application is for 19 windows to be replaced: The third floor has three casements and two double hung windows. The casements have dry rotted and are out of square. They feel lightweight and flimsy. The double hung window on the north side has the wrong storm sash and is leaking air. The double hung windows on the south side has a decorative diamond grid pattern which faces the house next door. There are two fixed windows facing the rear of the house on the landing between the second and third floor. These were not always fixed as the presence of interior stops and gaps are evident. The opening mechanisms have been removed and the sashes attached in place. The front of the house has a three-part window with a large operable double hung in the middle and two stationary (one on each side). The large upper sash appears to be off skew and the interior stops need to be adjusted. Most of the upper sashes appear to be painted shut. There are aluminum storm windows throughout the house operable where the operable wood windows are and fixed where the fixed wood windows are in place. Three windows on the second floor have sashes that are in need of repair. These would include repairing the wood sash as the joints are separating. I was unable to feel any of the wood to determine its structural integrity. Almost all of the windows would need glazing, most of the ropes appeared to be intact. I did not find any evidence to suggest that the windows currently there could not be repaired to reach a higher level of efficiency and use, with the exception of the casements on the third floor. 3 Steve Szaday, Preservation Specialist STANDARDS AND GUIDELINES: Chapin Park II. Executive Director Feasel stated the owners have received a variance from the Area BZA for the height of the carriage house; the project received HPC approval in August. 3. Ordinance Violations Clerk is in discussion with Administration and Finance about how to deal with any funds generated when Code Enforcement begins issuing these fines. Tickets for violations would be issued for work not in compliance with the Guidelines, specifically work without obtaining a 5 COA or work in violation of a denied COA within the City. Greetings Auditor Hamann, I am writing to you in my position as Treasurer for the Historic_ Preservation Commission of South Bend and St. Joseph County. I have discovered what I believe is an anomaly in the HPC Budget for 2017 which I was hoping that you would be able to help myself, and HPC, better understand. In the official budget published by the County, I noticed in this budget that for 2017 the HPC is allocated money for "Fica Contribution", "P.E.R.F" and "Group Insurance." These three items total to $37,551 which accounts for the entirety of the difference between 2016 and 2017 budgets for HPC. This increase is 40% which is obviously a very large number at a time when the County is attempting to lower budgeted expenses and does draw some questions. I understand that these numbers most likely better demonstrate the true cost of HPC to the County and I encourage proper budgeting by including them in the official budget. Where I, and other members of the Historic Preservation Commission, express concern is looking at other departments, it appears that this same system was not used. For instance, the Area Plan Budget - a similar in scale and function department to the HPC - does not include those three allocations I mentioned above. Again, I do not have a problem with accurately budgeting the true cost of an employee in the budget but I am curious why the HPC budget has these three line items but other departments like Area Plan do not. I had met the crew in November and discussed what would be permitted through HPC. Only one code hearing for March at this point: 721 Lincoln Way East I will be presenting the hands-on workshop at the State's Preservation Conference, April 2017 in Wabash. The topic will be wood floors. I will be having a Power Point presentation followed by a hands-on repair and use of sanding equipment.
