The foundation is raised brick; the siding is brick on the 1St storey, wood clapboard on the 2d storey with a flared string course and wood shingle on the 3d. The roof is a hip with an asymmetrical gabled roof dormer and is covered with asphalt shingles. The windows are 1/1 and 3/1 double hung with aluminum storms. A front porch has a hipped roof, square wood supports, and concrete decking and wing walls. There is a wood 2d storey deck in the rear with a small shed roof addition underneath. ALTERATIONS: A complete tear -off and re -roof with asphalt shingles, ice shield, gutters and downspouts was completed with COA42008-0115. Asphalt siding was removed with COA#2013-0805A and correction to the size of the front entry storm door. The second storey wood deck structure and stairs in the rear was added to accommodate 'an upstairs rental unit and has been replaced in-kind. Aluminum storm windows are installed. APPLICATION ITEMS: A. Replace existing aluminum storm with new. B. Addition of exterior deck. C. Reside upper portion with historical cedar shake look (vinyl siding) second level with 4" vinyl. DESCRIPTION OF PROPOSED PROJECT:, New owner originally proposed to replace the original windows but has updated the request to replace only the existing aluminum windows, in-kind; add an exterior deck in the rear with similar style as new 2nd storey deck; and add new vinyl siding to the upper stories to resemble the look of the cedar shake and wood clapboard. A. Owner will be rehabilitating the original wood double hung windows and proposes to install the new storm windows to replace the existing which are deteriorated and missing most of the glass. B. Owner proposes a new deck on the ground level in the rear that will fit directly underneath the new 2,d storey deck posts and will connect to a freestanding existing concrete stair (evidence that a landing existed here at one point). Material will be treated lumber. A rail will be installed on three sides in the same style as the upper deck. C. The asphalt siding removal by l't Source Bank in 2013 revealed the original siding as brick 1', wood clapboard 2nd and cedar shake 3rd. Minor repairs were made at that time including improper flashing and a fresh coat of interior paint to the siding. The existing siding is in need of major repairs as can be seen in the photographs. Owner has provided samples of the proposed vinyl siding. The 2nd storey to show a 4" reveal, similar to the existing clapboard and the Yd storey to resemble cedar shake but in a slightly different pattern than the existing saw tooth pattern. PRESERVATION SPECIALIST REPORT (EDITED): Upon inspection the windows are not deteriorated beyond repair as suggested by the standards and guidelines. Rather, there needs to be some new glazing applied and some new ropes installed. A number of the upper sashes are painted in place but are not fully closed. There are aluminum track storm windows on the house, but many of the sashes are missing. The siding on the second floor and the dormer reveals are the areas that the owner would like to add insulating house wrap and vinyl siding. The second floor clap -board has a varying 3 Y2 to 4" reveal. When the mastic siding was removed from this house in 2013, the contractor failed to do the necessary repairs to the clap -board as well as the transitional flashing and trim work. They merely painted the poor areas to match including the flashing and failed trim work. As a result, almost all four corners have sustained damage and rot where the mitered boards meet. There are also areas where flashing ran underneath the old mastic siding now remains and actually collects water and allows it to run under the clap -board or even roofing material instead. I entered the third floor attic and noticed daylight through many of the loose and damaged cedar shake. Although the shake itself was in a repairable condition, the transitions are loose, rotted, and would need to be replaced. The owner expressed a desire to replace both levels as the new siding would be able to transition in a way that the elements would flow more fluidly over it. The shakes would have to be removed and reinstalled with new wood transitional trim work that would consist of several "stepping" levels of trim. The rear of the house has a cement steps/landing from a since removed lean-to storage area and a set of cement steps at rear door. The owner proposes to butt up to the existing steps/landing and continue with a wood deck that will sit flush in height and sit in between the support posts of the second level deck and the house. He also suggests matching the upper deck by using the same lumber and railings on the lower deck. The current stairs/landings lack handrails and railings which the owner plans to rectify as part of the new deck. STANDARDS AND GUIDELINES: II. EXISTING STRUCTURES A. BUILDING MATERIALS Original exterior wall materials in the District include brick, stucco, clapboard, wood shingles and masonry block. In some instances, vinyl or aluminum siding has been applied over the original material. Required Original exterior building materials shall be retained. Deterioration of wood materials shall be prevented through repair, cleaning and painting. The existing architectural detail around windows, porches, doors and eaves should be retained or replaced by replicas of the same design and materials when deteriorated beyond repair. Masonry including brick and stucco shall be cleaned only when necessary to halt deterioration or to remove stains, and shall be done with a method acceptable for the preservation of the surface: i.e. low pressure water and soft natural bristle brushes. When repairing stucco, only appropriate stucco mixture shall be used. Recommended Whenever possible, the original building materials should be restored. Metal or vinyl may be used as an alternative to maintaining or replacing the original surface material when it resembles the original surface material. When used over wood surfaces, this siding should be the same size and style as the original wood. Every effort should be made to retain the original trim around windows, doors, cornices, gables, eaves and other architectural features. Ample ventilation must be afforded the structure when aluminum or vinyl is to be installed in order to prevent increased deterioration of the structure from moisture and/or insects. Mortar joints should be repointed only when there is evidence of moisture problems or when sufficient mortar is missing to allow water to stand in the mortar joint. Existing mortar shall be duplicated in composition, color, texture, joint size, method of application and joint profile. Prohibited Wood siding shall not be resurfaced with material such as artificial stone, brick veneer, asbestos or asphalt shingles, which is inappropriate or was unavailable when the building was constructed. Sandblasting or the use of harsh detergents shall not be used on masonry or stucco. This method of cleaning erodes the surface material and accelerates deterioration. Not Recommended Waterproof or water repellent coatings or surface consolidation treatments should not be used on masonry surfaces unless required to solve a specific problem that has been studied and identified. Coatings are frequently unnecessary and expensive, and can accelerate deterioration of the masonry. Mortar joints which do not need repointing should not be. Repointing should not be done with mortar of high Portland cement content, which can often create a bond that is stronger than the building materials. This can cause deterioration as a result of the differing porosity of the material and the mortar— the end result being serious damage to adjacent brick. Paint should not be removed from masonry surfaces indiscriminately. C. WINDOWS AND DOORS Window and door frames are in most cases wood. Brick structures have stone sills and brick lintels. In some cases where synthetic siding has been applied, window trim has been covered. Many structures in the district have aluminum storm windows. Some houses retain wood framed storm windows. Required ,1 Original windows and doors including sash, lintels, sills, shutters, decorative glass, pediments, hoods and hardware shall be retained or when deteriorated beyond repair, replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors, painted to match the original, should be used but should not damage existing frames. If new sash and doors are used, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows, and hardware shall not be discarded when they can be restored and reused in place. New window and door openings which would alter the scale and proportion of the building should not be introduced. Inappropriate new window and door features, such as aluminum and insulating glass combinations that require removal of the original windows and doors, shall not be installed. Not Recommended Awnings, hoods or fake shutters made of metal, vinyl or fiber glass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: Staff recommends approval of storm windows, rear deck and 2nd storey siding. Staff does not recommend approval of 3`d storey residing because the original material does not appear to be deteriorated beyond repair; additionally, the proposed replacement does not resemble the original pattern. Elicia Feasel Interim Director December 7, 2015 RE: 539 Riverside Drive Earlier today, Mr. Troy Havyzewski came to the HPC office looking for information on a property he had successfully bid on and will be closing on this week. The property in question is 539 Riverside Dr, and is located in the River Bend Local Historic District. He had expressed interest in replacing the original windows, adding some new siding, as well as adding a rear deck under the existing one. I agreed to join him on site immediately to discuss the current conditions of the windows and siding before he pursued replacement or re -surfacing. There are two symmetrical brick chimneys intersecting the gable ends. The first storey is brick while the second storey is stucco with moulded wood band course between the storeys. The side gable roof has asphalt shingles. There is a small segmental entrance roof with moulded entablatures and Doric pilasters at the corners. The windows are 8 -light casement windows grouped in fours on the first storey with soldier lintels. There are 3 - unit casements in the second storey with a pair of 3 -light casements over the entrance. There are fan lights in the gables. ALTERATIONS: The casement windows in the second storey are vinyl replacements. The sidelights at the entrance have been replaced by wood panels. The entrance is secured by plywood. The fan lights in the gables were originally segmented. A wood frame, vinyl sided garage was added with COA#2014-1201 APPLICATION ITEMS: Replace all windows with Jeld-Wen W-2500 aluminum -clad casement, double -hung, and quarter round per quote. Replace asphalt shingles with Certainteed architectural dimensional shingles. DESCRIPTION OF PROPOSED PROJECT: The owner has been restoring the house to a single family dwelling. COA#2014-1202 approved a re -roof with Certain Teed architectural shingles; the re -roof is currently in process. The COA also approved replacement of all windows with Anderson 400 Series Casement with Colonial Grid plus quarter round windows. There was a misunderstanding over the material of the windows — HPC approved aluminum clad as presented when in fact the 400 series is vinyl clad. Staff notified owner of the mistake and owner has determined the Jeld-Wen W-2500 windows to be an acceptable replacement option. The current metal casement windows are inoperable and not repairable and some have been replaced with single pane vinyl replacement windows without divided lights. The proposal is to replace all windows throughout the house including sunroom with a muntin pattern to resemble the originals. For electronically submitted application, payment must reach the HPC office within 48 -hours following transmission. REQUIRED DOCUMENTATION AND SITE PLANS The Historic Preservation Commission of South Bend and St. Joseph County cannot render judgment nor proc- ess an Application without specific documentation. Comprehensive documentation protects both the owner of the prop- erty submitting the Application as well as providing a complete understanding of the project for the commissioners and staff when rendering a decision. Problems -often occur during a project review or during the execution of the project when one or both parties are unclear as to the specifics. Applications will NOT be processed without all required fees and documentation. When an Application has been scheduled for any meeting where a review and decision are to be rendered, the owner and any architect or contractor (s) retained for the project must attend such meetings. Failure by the owner, ar- chitect, or contractor to attend such meetings may result in denial of the Application due to insufficient presentation. Documentation shall include: materials to be used, detailed written description of the project including scale, dimensions, construction methods, finished, manufacturers' brochures and specifications and photographs of the area (s) which the project will affect. Owner acknowledges that while the Historic Preservation Commission only considers Certificates of Appropri- ateness for exterior features, under certain circumstances it may be necessary for the Commission Staff to have access to the inferior of the building in order to accurately assess the condition of the exterior feature and that the lack of access to the interior may prevent the Commission Staff from making a favorable recommendation. Any work performed on a historic landmark or in an historic district which does not conform to the Certificate of Appropriateness permit, shall be immediately halted by the Historic Preservation Commission and the Building Depart- ment of South Bend and St. Joseph County. Roof is asphalt shingle. Walls are a clapboard and wood shingles. There is a partial front porch. Windows are 1/1 wood double hung with storms. ALTERATIONS: Alterations noted on survey card have been restored to original. COA#2014-1205 installed hand railings in three locations including a metal rail at garden steps, and wood rails at front and back porch. APPLICATION ITEMS: Install privacy fence along southern border of property up to area across from our basement door thus not obscuring the window of the neighboring home to the south. DESCRIPTION OF PROPOSED PROJECT: Owner proposes a 6' tall cedar 4" dog-eared picket style fence in the same location as an existing chain link and deteriorating wood fence (see diagram). STANDARDS AND GUIDELINES: I. THE ENVIRONMENT A. THE DISTRICT ENVIRONMENT The Chapin Park Local Historic District is a particularly fine residential area located close to downtown South Bend, the St. Joseph River, Memorial Hospital and Leeper Park. This section is meant to protect and guide appropriate maintenance of the common areas of the district (i.e. visual landscape and streetscapes). Required Brick streets contribute greatly to the character of the neighborhood. These streets have always been essentially passenger car thoroughfares. The appointments of the streets (i.e. lighting, curbs, horse hitches and monuments) should contribute as much as possible to their architectural, historic and residential character. Retention and maintenance of existing brick streets in the district is required. Repair work to fill voids and gaps must utilize brick paver materials and acceptable installation methods whenever applicable. When utility work dictates the removal of street sections (pavers), the original materials will be reinstalled. Brick -streets shall be patched with brick pavers. Concrete, asphalt, fillers and similar materials shall not be used. All original streetlights shall be maintained, especially the George Cutter "Park View" streetlights designed by the Cutter Company for this neighborhood. Present efforts by the Neighborhood Association and the Historic Preservation Commission to restore "Park View" streetlights to the district shall continue. Any change in lighting must receive approval of the Historic Preservation Commission. New or different fencing requires a C of A and shall reflect the style and character of the individual property and the surrounding environment and properties. Recommended The current or historic character of lawns should be preserved. Front yard areas, common lawns and tree lawns should remain open. New or replacement trees should be compatible in variety with those presently growing. Vacant lots should be kept landscaped appropriately while vacant, and may be used for recreational or residential development. When replacement of utility poles or power supply lines is necessary, consideration should be given to underground conduits or utility poles erected along rear property lines. Prohibited Existing relationships of buildings and their environments shall not be destroyed by widening existing streets, applying asphalt or other bituminous coverings or by introducing new streets or parking lots. Signs, streetlights, benches, new plant materials, fencing, walkways and paving materials which are out of scale or inappropriate to the neighborhood may not be used. The erection of high walls or barriers, which would alter the relationship of the houses, shall be prohibited. Utility poles with high intensity overhead lights shall not be used on main thoroughfares. B. BUILDING SITE, LANDSCAPING & ACCESSORIES This section focuses on individual properties and amenities. Building sites tend to be irregularly shaped, of varying topography and with different setbacks with regard to plots. Alleys are generally behind houses. Landscape accessories like fences are unique to each structure. Chapin Place presents a unique situation within the district. Applications from properties that have property lines on Chapin Place will be considered on a case-by-case basis. Required Fencing, walkways, outbuildings, private yard lights, signs (i.e. house numbers) and benches (visible from the street) as well as trees located in a yard or tree lawn which reflect the property's history and development shall be retained. A tree located in such areas shall only be removed if the removal is required due to storm damage, disease, threatened damage to a structure or for such other reason acceptable to the Historic Preservation Commission. Storm damaged or diseased trees should then be replaced with an approved species at the same or approximate location wherever possible. Fencing visible from the street in front of the structure shall be open (meaning spaces between the pickets) and consistent with the historic character of a structure enclosed. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should also be appropriate to existing surrounding site elements in scale, type and appearance. Front yard areas should remain open. (See above for information regarding fences.) Trees in close proximity to a building may cause structural damage. Owners are encouraged to remove these trees and replace (or replant) them at a more appropriate location as soon as planting season permits and upon approval of a C of A. Prohibited No changes may be made to the appearance of the site by removing trees, fencing, walkways, outbuildings or other elements before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped, nor enclosed by solid fences, chain link, nor industrial/commercial style fences. The installation of unsightly large devices, such as television satellite dishes, skylights or solar panels, shall not be permitted in areas where they detract from the architecture of a building, are intrusive to the public view of the building or are highly visibly from a public street, or ruled inappropriate after Commission review. Utility poles with high-intensity overhead lights should be installed so that they cannot be seen from a street. The Commission will evaluate all installations as well as any potential exceptions resulting from special circumstances, before granting a C of A. Nominating Committee (Executive Officers) — Chair calls for formation of a Nominating Committee for Executive Officers with all members of the Commission minus the current President per Roberts Rules and will meet between now and the December meeting to develop a slate of candidates that it will present at that December meeting for officers of the 2016 year. Brandon Anderson was invited and agreed to Chair the Committee with all Commissioners invited to join. If you do not wish to join, notify the Chair so the quorum numbers can be adjusted; right now there would need to be four members to meet quorum, a simple majority. C. Interim Executive Director — To remedy a lapse in administrative authority, Tim Klusczinski moves at the request of our Deputy Director to appoint Elicia Feasel Interim Executive Director with the authority to execute the duties of that position and to represent the Historic Preservation Commission without additional compensation from November 25, 2015 until an Executive Director successor is duly appointed and qualified with a second by Brandon Anderson. HISTORIC PRESERVATION COMMISSION PRESERVATION SPECIALIST REPORT December 21, 2015 Hello Commission! As last month's weather continued this month, we have several roof repairs, tree trimmings, and painting even so far as this past week. Although, I believe we may past the time for painting, roofs and trees will be ongoing until the snow flies and remains. There have been so many meetings in regards to next year's events and special projects my head is spinning!These include the Bicentennial, the Studebaker Fountain committee, the Park's Department master plan and even St' Joseph County parks 50th anniversary. I am happy to report that the office reorganization project is continuing under Interim Director Feasel's guidance and diligent efforts to streamline the layout and filing systems. This is an exciting time to be a part of the office and I look forward to an even better 2016! As always, I would like to thank the Commission for yet another year of "other contractual services." I feel that we have grown and have done concrete good work this year. I think of all the property owners that have come to us for assistance and have walked away educated and within the commission's approval. This request does not alter the Other Contractual Services annual budget. I have not received a pay increase since my initial 90 day review whereas $12 per hour increased to $15 per hour.. I feel confident that over the last three years I have been able to manage my allotted budget to be available at key times in an efficient and productive manner and will continue to do so in 2016. am requesting that my hourly be increased from its current $15 per hour to $20 per hour. Although this will decrease the number of total hours I can work for HPC, this will increase my ability to pursue other outside contracting projects. I will do my best to schedule those outside projects at slow times for COA applications which have been timely consistent since my tenure began. I look forward to another great year of being a part of,this wonderful organization as it further grows under new leadership and additions to the staff allow even further advancement. Steve Szaday Preservation Specialist Historic Preservation Commission of South Bend & St. Joseph County PRESERVATION SPECIALIST -INSPECTOR SERVICES CONTRACT THIS AGREEMENT entered "into effective the 1st day of January, 2016, by. and between the Historic Preservation Commission, governing body of the Historic Preservation Commission of South Bend and St. Joseph County, Indiana, organized and operating pursuant to joint ordinances adopted by the Common Council of the City of South Bend, Indiana and the St. Joseph County Council (the "HPC"), and Steve Szaday (the "Inspector"), for part time services to be performed by the Inspector: WHEREAS, the HPC is established with the purpose to preserve and protect historic structures in South Bend and Saint Joseph County, Indiana; and WHEREAS, the Inspector has the training, knowledge, experience and expertise to serve as the HPC's inspector of historic landmarks and of structures within historic districts; and WHEREAS, the HPC desires to hire the Inspector to perform certain services as more fully set forth herein; and WHEREAS, the Inspector is willing to provide those services upon the terms and conditions set forth herein. NOW, THEREFORE, the HPC and the Inspector agree as follows: 1) The Inspector will perform the following services for the HPC as needed or requested by the HPC: a) Inspect all Local Landmarks and Historic Districts on a regular basis, looking for any unauthorized alterations, repairs, renovations, removals or additions. This includes buildings, structures, natural landscape items and man made landscape items. b) Inspect properties that have received a Certificate of Appropriateness to ensure that the work being done complies with the terms of the Certificate as approved. c) When needed, assist the HPC staff in reviewing new applications for a Certificate of Appropriateness. d) Contact the Building Department to have "Stop Work Orders" placed on any projects that are in violation of proper HPC authority or a Certificate of Appropriateness. e) Document all violations in writing and with photographs, and submit this documentation to the HPC Executive Director or Deputy Director for further process. f) Keep complete records of all inspections, as well as complete time logs for services rendered to the HPC. The time logs shall be submitted on a regular basis for purposes of payment for inspection services rendered. The Inspector shall provide a monthly report to the HPC of activities for the prior month. g) Inspect designated properties for compliance with the minimum maintenance standards established by the HPC, discuss violations with the HPC staff, and, if necessary after discussion, report violators to Building Department and Code Enforcement authorities and attend pertinent Code Enforcement meetings or hearings. h) Attend HPC meetings as needed or as requested by HPC members or the Executive Director or Deputy Director. i) Maintain the confidentiality of all information disclosed to the Inspector during the course of providing the services set forth herein, which the HPC deems to be confidential, unless the HPC consents in writing to the disclosure of that information. 2) The HPC will pay the Inspector at the rate of twenty dollars ($20.00) per hour for services provided and for which the Inspector submits proper logs or records of those services provided as described above. 3) Payment for the Inspector's services shall be made by St. Joseph County on a weekly basis pursuant to funds appropriated to the HPC for such services. 4) The Inspector shall provide at least four (4) hours of service per week and up to the budgeted amount as determined by the Executive Director. 5) The HPC will provide a desk and work area for the Inspector in the HPC office for the Inspector's use in performing the tasks and duties set forth above. 6) The Inspector shall be deemed an independent contractor for all purposes and nothing contained in this Agreement shall be construed to create an employer/employee relationship, partnership or joint venture between the Inspector, the HPC, the City of South Bend, Indiana, or St. Joseph County, Indiana, with respect to the Inspector's activities conducted pursuant to the terms of this Agreement. The Inspector shall, as such, assume and pay in full any and all payroll taxes, unemployment insurance, workers compensation insurance, or other legally mandated costs, expenses, or withholdings associated with the services provided herein. 7) All work product of the Inspector that is produced while performing services for the HPC shall be the sole property of the HPC. 8) The HPC may modify this Agreement or terminate this Agreement at any time provided that the HPC notifies the Inspector in writing of its decision to modify or terminate this Agreement at least forty-eight (48) hours in advance of the effective time of such modification or termination. Any payment due to the Inspector at the time of termination of this Agreement shall be made to the Inspector no later than the date of the next regular services payment date. 9) The Inspector may terminate this Agreement upon thirty (30) days written notice delivered to the HPC at or prior to a regular monthly meeting of the HPC. This notice period may be shortened to seven (7) days if health or other urgent circumstances require. 2 10) Upon termination of this Agreement, whether by mutual consent or at the election of a parry, the Inspector shall promptly return to the HPC any of the HPC's materials, documents or other tangible property of any kind which the 'Inspector acquired from the HPC, or as a consequence of those services rendered for the HPC, or which the Inspector produced for the HPC. 11) This Agreement shall begin on January 1, 2016 and shall terminate on December 31, 2016. This Agreement replaces all prior agreements between the parties and all prior agreements between the parties shall be null and void. This Agreement shall continue in effect for one-year terms until it is canceled or terminated by either parry as provided hereinabove. 12) This Agreement shall inure to the benefit of and be binding upon the parties hereto, their successors and permitted assigns. This Agreement shall be governed by and enforced and construed in accordance with the laws of the State of Indiana and any action to enforce any of the terms hereof shall be filed in the Superior Court of St. Joseph County, Indiana. This Agreement may be executed in any number of counterparts, each of which shall be deemed an original without the production of the other and all such counterparts together shall constitute but one and the same instrument. 13) Neither party hereto may assign, either wholly or in part, any of its rights or obligations under this Agreement to any other natural person or legal entity without the prior written consent of the other party hereto. 14) This Agreement shall constitute the entire agreement between the parties hereto relative to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings of the parties and no variance or modification hereof shall be valid or enforceable except by supplemental agreement in writing, dated subsequent to the date hereon and executed by the parties in the same manner as this Agreement.
