The walls are stucco and the gable roof is covered in clay tile. There is an arched pergola over the entrance and a semi circular transom arch over the door of the attached garage. The windows are multi paned casements; wood frame large round arch windows are on flanking wings. ALTERATIONS: The shutters and iron style window boxes were added in 1998. The rear French doors and overhead garage doors are 1999 replacements; the terrace walls were restored in 1999. APPLICATION ITEMS: Install 5 solar panels on top of garage roof. See attached preliminary design for a 1.52 KWh photovoltaic system along with computer simulations of what completed installation will look like. DESCRIPTION OF PROPOSED PROJECT: Staff met with Mike Keen and Nathan Vogel of Inovateus Solar in the spring of 2013 at 1012 Riverside Drive. Staff reviewed the proposed location of the solar panels in a depressed area on the garage roof behind the parapet. This is the proposed location under consideration. The flat solar panels will be installed and will not be visible from the thoroughfare. STANDARDS AND GUIDELINES: B. ROOFS ANDROOFING Roof shapes in the district encompass all the various designs found in residential structures: hipped, gable, gambrel, flat, and combinations of these. Roofs are covered with a variety of materials such as asphalt, asbestos, wood and slate shingles as well as clay tiles. Residences in most cases have wood facias with gutters and downspouts. The facias of some vinyl or aluminum sided houses are covered with the same material. Required The existing shape and materials of the roof shall be retained. All architectural features which give the roof its essential character shall be retained, including dormer windows, cupolas, cornices, brackets, chimneys, cresting and weather vanes. Recommended Whenever possible, the original shape and materials of the roof shall be restored. Particular effort should be made to retain materials such as slate, tile, and other unique materials not commonly found in new construction. Roof covering which is deteriorated beyond repair should be replaced with new material that matches as closely as possible the original in composition, size, shape, color and texture. Gutters and downspouts are often a necessary adjunct in order to prevent deterioration of the structure; they should be maintained whenever possible or replaced with a style comparable and suitable to the architectural period. Prohibited Nothing shall be done to change the essential character of the roof as viewed from the thoroughfare by adding architectural features or large unsightly fixtures, or by using materials inappropriate to the style of the house. The roof shall not be stripped of architectural features important to its character. Not Recommended Overhanging eaves, soffits, brackets and gables should not be covered or enclosed when adding metal or vinyl siding to a building. E. MECHANICAL SYSTEMS The majority of the structures within the district have oil or gas heat, and have brick chimneys through the roof. Some houses have one or two window air conditioners. Required Mechanical systems shall be placed in areas that will result in the least possible alteration to the structural integrity and physical appearance of the building. Solar collectors and TV dishes shall be placed at the rear of the property and shielded by shrubbery and landscaping. Recommended Window air conditioners and exhaust fans should be installed at the rear or at an inconspicuous side window. Original lighting fixtures should be retained whenever possible. Prohibited Holes shall not be cut through walls or roofs to accommodate air conditioners or other mechanical equipment in areas that can be seen from the street. Not Recommended Exterior electrical and telephone cables should not be attached to the street elevations of the buildings. STAFF RECOMMENDATION: Staff recommends approval as the project conforms to the standards for the Riverside Drive Local Historic District. Prepared by: C.D. General Powers Concerning Planning and Development IC 36-7-2-1 Planning and zoning powers of reorganized units Sec. 1. (a) Except as provided in subsection (b), this chapter applies to all units except townships. (b) A unit consisting of: (1) two (2) or more townships; and (2) at least one (1) municipality; that has reorganized under IC 36-1.5 may exercise planning and zoning power under IC 36-7-4 if the unit's plan of reorganization under IC 36-1.5 authorizes the unit to exercise planning and zoning powers. A unit may plan for and regulate the use, improvement, and maintenance of real property and the location, condition, and maintenance of structures and other improvements. A unit may also regulate the platting and subdividing of real property and number the structures abutting public ways. In planning for and regulating the use of land or in regulating the platting or subdividing of real property, a unit may also regulate access to incident solar energy for all categories of land use. A unit may inspect any structure or other improvement at any reasonable time. As added by Acts 1980, P.L.211, SEC.2. A unit may regulate methods of, and use of materials in repair, alteration, and construction of structures and other improvements. IC 36-7-2-5 Repair, alteration, or destruction of structures and improvements Sec. 5. A unit may repair, alter, or destroy structures and other improvements if necessary. As added by Acts 1980,.P.L.211, SEC.2. IC 36-7-2-5.5 Removal or alteration of a sign as a condition of issuing a permit, license, or variance Sec. 5.5. A unit may not require that a lawfully erected sign be removed or altered as a condition of issuing: (1) a permit; (2) a license; (3) a variance; or (4) any other order concerning land use or development; unless the owner of the sign is compensated in accordance with IC 32-24 or has waived the right to and receipt of damages in writing. As added by P. L. 163-2006, SEC. 19. IC 36-7-2-6 Regulation of movement or removal of earth below ground level Sec. 6. A unit may regulate excavation, mining, drilling, and other movement or removal of earth below ground level. As added by Acts 1980, P.L.211, SEC.2. IC 36-7-2-7 Promotion of economic development and tourism Sec. 7. A unit may promote economic development and tourism. As added by Acts 1980, P.L.211, SEC.2. IC 36-7-2-8 Solar energy systems; ordinances; reasonable restrictions Sec. 8. (a) As used in this section, "solar energy system" means either of the following: (1) any solar collector or other solar energy device whose primary purpose is to provide for the collection, storage, and distribution of solar energy for space heating or cooling, or for water heating; or (2) any structural design feature of a building, whose primary purpose is to provide for the collection, storage, and distribution of energy for space heating or cooling, or for water heating. (b) A unit may not adopt any ordinance which has the effect of prohibiting or of unreasonably restricting the use of solar energy systems other than for the preservation or protection of the public health and safety. (c) This section does not apply to ordinances which impose reasonable restrictions on solar energy systems. However, it is the policy of this state to promote and encourage the use of solar energy systems and to remove obstacles to their use. Reasonable restrictions on solar energy systems are those restrictions which: (1) do not significantly increase the cost of the system or significantly decrease its efficiency; or (2) allow for an alternative system of comparable cost and efficiency. As added by Acts 1981, P.L.311, SEC.2. IC 36-7-2-9 Compliance with code of building laws and orders Sec. 9. Each unit shall require compliance with: (1) the code of building laws and fire safety laws that is adopted in the rules of the fire prevention and building safety commission under IC 22-13; (2) orders issued under IC 22-13-2-11 that grant a variance to the code of building laws and fire safety laws described in subdivision (1); (3) orders issued under IC 22-12-7 that apply the code of building laws described in subdivision (1); _ (4) IC 22-15-3-7; and (5) a written interpretation of a building law and fire safety law binding on the unit under IC 22-13- 5-3 or IC 22-13-5-4. As added by P.L.245-1987, SEC.19. Amended by P.L.71-1999, SEC.3, P.L.22-2005, SEC.50. IC 36-7-2-10 Ordinance making forestry operation a nuisance or abating operation void; exceptions to valid ordinance Sec. 10. (a) An ordinance adopted after March 31, 2005, by a unit of local government that: (1) makes a forestry operation (as defined in IC 32=30-6-1.5) a nuisance; or (2) provides for an abatement of a forestry operation as a: (A) nuisance; (B) trespass; or (C) zoning violation; under this chapter is void. (b) If the owner of a property owned the property before the enactment of an ordinance that restricts forestry operations but that is not invalidated by subsection (a), the property is exempt from the ordinance if the forestry operations (as defined by IC 32-30-6-1.5) on the property: (1) comply with generally accepted best management practices; (2) comply with the practices established in the Indiana Logging and Forestry Best Management Practices BMP Field Guide, as published in September 1999, by the division of forestry of the department of natural resources; and (3) have been in continuous operation on the property. Shortly after his land purchase, Horatio and his wife Martha built a Gothic Revival home on Navarre Street. They surrounded the home with an extensive orchard and called the area Chapin Park. Their house was the only structure in the area for nearly two decades until Horatio Chapin's death in 1871. At that time his daughter, Mary Chapin Anderson, wife of Judge Andrew Anderson, built a house at what is now 710 Park Avenue. This house was built facing Lamont Creek and was later turned to face Park Avenue when the creek was put underground. Edward Chapin, son of Horatio, platted the western half of the estate and laid out Park Avenue in 1890. Mary Chapin Anderson platted the area east of Park Avenue shortly afterwards. In 1891, Christopher Fassnacht, owner of South Bend Lumber Company, bought and platted the southern portion of Edward Chapin's property, which contained the Chapin House. Prominent residents in addition to Fassnacht who were influential in the growth of South Bend were: George and Fannie Hodson, lumber manufacturer and builder, A. P. and Ester Stone Sibley, George and Kate Ware, George Clark, Mary Clark Coquillard, and Mamie Giddings, musician. Soon the demands of growing South Bend made the area an investor's dream and houses were built until about 1910, by which time the district had achieved its general appearance. According to the City of South Bend Historic Sites and Structures Survey, the Chapin Park Historic District contains the highest concentration of architecturally significant structures to be found in the city. This is not surprising since many of the city's most prominent business, civic, and professional leaders resided there at the end of the 19th century and well into the 20th. With most of its housing stock still intact, the district is notable for the integrity of the building styles to be found within its boundaries; for the quality of workmanship and architectural detail; for the integrity of use and scale; and for the quality of its distinctive "street furniture:" red brick streets, Victorian lamp posts, and lushly wooded lawns, some of which are enclosed with wrought iron fences. [Since the district was listed on the National Register in 1982, many of homes east of Lafayette Boulevard on Main Street, Park Lane, Bartlett Street, and Lafayette Boulevard have either been moved to new locations or demolished. In 2004, the YWCA was demolished to make way for future expansion of Memorial Hospital.] The buildings in the district exhibit a continuous evolution in architectural styles from the Gothic Revival of the 1850s to the Second Empire, Shingle, Queen Anne, and Neo -Jacobean styles of the last three decades of the nineteenth century. The district also exhibits several lovely examples of vernacular Gable and Ell, Gable Front, and Folk Victorian cottages. The walls are stucco and the gable roof is covered in clay tile. 'Thele is an arched pergola over the entrance and a semi circular transom arch over the door of the attached garage. The windows are multi paned casements; wood frame large round arch windows are on flanking wings. ALTERATIONS: The shutters and iron style window boxes were added in 1998. The rear French doors and overhead garage doors are 1999 replacements; the terrace walls were restored in 1999. APPLICATION ITEMS: Install 5 solar panels on top of garage roof. See attached preliminary design for a 1.52 KWh photovoltaic system along with computer simulations of what compfeted installation will look like. DESCRIPTION OF PROPOSED PROJECT: Staff met with Mike Keen and Nathan Vogel of Inovateus Solar in the spring of 2013 at 1012 Riverside Drive. Staff reviewed the proposed location of the solar panels in a depressed area on the garage roof behind the parapet. This is the proposed location under consideration. The flat solar panels will be installed and will not be visible from the thoroughfare. e STANDARDS AND GUIDELINES: B. ROOFS ANDROOFING Roof shapes in the district encompass all the various designs found in residential structures: hipped, gable, gambrel, flat, and combinations of these. Roofs are covered with a variety of materials such as asphalt, asbestos, wood and slate shingles as well as clay tiles. Residences in most cases have wood facias with gutters and downspouts. The facias of some vinyl or aluminum sided houses are covered with the same material. Required The existing shape and materials of the roof shall be retained. All architectural features which give the roof its essential character shall be retained, including dormer windows, cupolas, cornices, brackets, chimneys, cresting and weather vanes. Recommended , . Whenever possible, the original shape and materials of the roof shall be restored. Particular effort should be made to retain materials such as slate, tile, and other unique materials not commonly found in new construction. Roof covering which is deteriorated beyond repair should be replaced with new material that matches as closely as possible the original in composition, size, shape, color and texture. Gutters and downspouts are often a necessary adjunct in order to prevent deterioration of the structure; they should be maintained whenever possible or replaced with a style comparable and suitable to the architectural period. Prohibited Nothing shall be done to change the essential character of the roof as viewed from the thoroughfare by adding architectural features or large unsightly fixtures, or by using materials inappropriate to the style of the house. The roof shall not be stripped of architectural features important to its character. Not Recommended Overhanging eaves, soffits, brackets and gables should not be covered or enclosed when adding metal or vinyl siding to a building. E. MECHANICAL SYSTEMS The majority of the structures within the district have oil or gas heat, and have brick chimneys through the roof. Some houses have one or two window air conditioners. Required Mechanical systems shall be placed in areas that will result in the least possible alteration to the structural integrity and physical appearance of the building. Solar collectors and TV dishes shall be placed at the rear of the property and shielded by shrubbery and landscaping. Recommended Window air conditioners and exhaust fans should be installed at the rear or at an inconspicuous side window. Original lighting fixtures should be retained whenever possible. Prohibited Holes shall not be cut through walls or roofs to accommodate air conditioners or other mechanical equipment in areas that can be seen from the street. Not Recommended Exterior electrical and telephone cables should not be attached to the street elevations of the buildings.
