The walls are sided with aluminum. The full width front porch has decorative wrought iron roof supports and three fixed pane picture windows with operable awning windows along their bases. The windows in the house are either single, double, triple or quadruple aluminum awning style windows. The second storey front window has a large fixed central pane with by operable sidelights and is shaded by an aluminum awning. There are three aluminum storm doors two of which are half view and one three quarter view covering wood doors of various styles. The gabled roof is covered with asphalt shingles. ALTERATIONS: The aluminum siding, storm doors and all of the windows are not original to the house. The wrought iron porch supports are later additions. The current roofing material was added in 1993 with a COA. APPLICATION ITEMS: Replace windows and storm doors per attached list and pictures. DESCRIPTION OF PROPOSED PROJECT: The owner proposes to replace all of the fifty year old aluminum windows with Vista Panorama custom made vinyl windows that would fit into the same openings. There will be 2 32 x 48 double hung, 2 32x 36 double hung and 2 34 x 48 double hung windows on the first floor along with an 18 x 36 casement window. The second floor's large picture and sidelight assembly will be replaced with a central fixed pane and two double hung windows measuring 48 x 96. Also on the second floor there will be 2 32x 48 double hung windows and 1 casement 18 x 24 and 1 awning 32 x 26. The casement windows and awning windows will not have muntins. All per listing and brochure pages. Michiana's Best Choice Windows will remove all of the old windows/material and install the new windows with frames into the openings; the exterior will be aluminum wrapped just inside the exisitng "J" channels and caulked off. The storm doors will all be replaced Comfort Bilt "West Point" Storm Doors per brochure page. STANDARDS AND GUIDELINES: II. EXISTING STRUCTURES C. WINDOWS AND DOORS Window and door frames are in most cases wood. Brick structures have stone sills and brick lintels. In some cases where synthetic siding has been applied, window trim has been covered. Many structures in the district have aluminum storm windows. Some houses retain wood framed storm windows. Required Original windows and doors including sash, lintels, sills, shutters, decorative glass, pediments, hoods and hardware shall be retained or when deteriorated beyond repair, replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors, painted to match the original, should be used but should not damage existing frames. If new sash and doors are used, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows, and hardware shall not be discarded when they can be restored and re -used in place. New window and door openings which would alter the scale and proportion of the building should not be introduced. Inappropriate new window and door features, such as aluminum and insulating glass combinations that require removal of the original windows and doors, shall not be installed. Not Recommended Awnings, hoods or fake shutters made of metal, vinyl or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION ' : Staff recommends approval as the proposed projects conform to the standards and guidelines for River Bend. Catherine D. NOW, THEREFORE, the HPC and the Inspector agree as follows: 1) The Inspector will perform the following services for the HPC as needed or requested by the HPC: a) Inspect all Local Landmarks and Historic Districts on a regular basis, looking for any unauthorized alterations, repairs, renovations, removals or additions. This includes buildings, structures, natural landscape items and man made landscape items. b) Inspect properties that have received a Certificate of Appropriateness to ensure that the work being done complies with the terms of the Certificate as approved. c) When needed, assist the HPC staff in reviewing new applications for a Certificate of Appropriateness. d) Contact the Building Department to have "Stop Work Orders" placed on any projects that are in violation of proper HPC authority or a Certificate of Appropriateness. e) Document all violations in writing and with photographs, and submit this documentation to the HPC Director or Assistant Director for further process. f) Keep complete records of all inspections, as well as complete time logs for services rendered to the HPC. The time logs shall be submitted on a regular basis for purposes of payment for inspection services rendered. The Inspector shall provide a monthly report to the HPC of activities for the prior month. g) Inspect designated properties for' compliance with the minimum maintenance standards established by the HPC, discuss violations with the HPC staff, and, if necessary after discussion, report violators to Building Department Code Enforcement authorities and attend pertinent Code Enforcement meetings or hearings. h) Attend HPC meetings as needed or as requested by HPC members or the Director or Assistant Director. i) Maintain the confidentiality of all information disclosed to the Inspector during the course of providing the services set forth herein, which the HPC deems to be confidential, unless the HPC consents in writing to the disclosure of that _ information. 2) The HPC will pay the Inspector at the rate of fifteen dollars ($15.00) per hour for services provided and for which the Inspector submits proper logs or records of those services provided as described above. 3) Payment for the Inspector's services shall be made by St. Joseph County on a weekly basis pursuant to funds appropriated to the HPC for such services. 4) The Inspector shall provide at least four (4) hours of service per week. 5) The HPC will provide a desk and work area for the Inspector in the HPC office for the Inspector's use in performing the tasks and duties set forth above. 6) The Inspector shall be deemed an independent contractor for all purposes and nothing contained in this Agreement shall be construed to create an employer/employee relationship, partnership or joint venture between the Inspector, the HPC, the City of South Bend, Indiana, or St. Joseph County, Indiana, with respect to the Inspector's activities conducted pursuant to the terms of this Agreement. The Inspector shall, as such, assume and pay in full any and all payroll taxes, unemployment insurance, workers compensation insurance, or other legally mandated costs, expenses, or withholdings associated with the services provided herein. 7) All work product of the Inspector that is produced while performing services for the HPC shall be the sole property of the HPC. 8) The HPC may modify this Agreement or terminate this Agreement at any time provided that the HPC notifies the Inspector in writing of its decision to modify or terminate this Agreement at least forty-eight (48) hours in advance of the effective time of such modification or termination. Any payment due to the Inspector at the time of termination of this Agreement shall be made to the Inspector no later than the date of the next regular services payment date. 9) The Inspector may terminate this Agreement upon thirty (30) days written notice delivered to the HPC at or prior to a regular monthly meeting of the HPC. This notice period may be shortened to seven (7) days if health or other urgent circumstances require. 10) Upon termination of this Agreement, whether by mutual consent or at the election of a party, the Inspector shall promptly return to the HPC any of the HPC's materials, documents or other tangible property of any kind which the Inspector acquired from the HPC, or as a consequence of those services rendered for the HPC, or which the Inspector produced for the HPC. 11) This Agreement shall begin on ' January 1, 2014 and shall terminate on December 31, 2014. This Agreement replaces all prior agreements between the parties and all prior agreements between the parties shall be null and void. This Agreement shall continue in effect for one-year terms until it is canceled or terminated by either party as provided hereinabove. 12) This Agreement shall inure to the benefit of and be binding upon the parties hereto, their successors and permitted assigns. This Agreement shall be governed by and enforced and construed in accordance with the laws of the State of Indiana and any action to enforce any of the terms hereof shall be filed in the Superior Court of St. Joseph County, Indiana. This Agreement may be executed in any number of counterparts, each of which shall be deemed an original without the production of the other and all such counterparts together shall constitute but one and the same instrument. 13) Neither party hereto may assign, either wholly or in part, any of its rights or obligations under this Agreement to any other natural person or legal entity without the prior written consent of the other party hereto. 14) This Agreement shall constitute the entire agreement between the parties hereto relative to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings of the parties and no variance or modification hereof shall be valid or enforceable except by supplemental agreement in writing, dated subsequent to the date hereon and executed by the parties in the same manner as this Agreement.
