JOSEPH COUNTY, INDIANA ("HPC") PLACING MARQUETTE SCHOOL, LOCATED AT 1905 COLLEGE STREET; SOUTH BEND, INDIANA, UNDER INTERIM PROTECTION WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County, Indiana was established in 1973 by South Bend Ordinance No. 5565-73 and is charged to "Survey, identify, plan for and advise the Common Council and the Area Plan Commission concerning the establishment of Historic Preservation Districts [and] the designation of Historic Landmarks. South Bend Municipal Code § 21-13.02 WHEREAS, the HPC is a Certified Local Government Agency, and is the local authority charged to identify, study, and recommend those local sites and structures with qualities recognized by the State of Indiana or the United States National Park Service for historic designation or for inclusion in the National Register of Historic Places, respectively. WHEREAS, Marquette School has been endorsed as a candidate for the National Register of Historic Places by both the National Trust for Historic Preservation (Exhibit A) and the Indiana Department of Natural Resources — Division of Historic Preservation and Archeology (Exhibit B). WHEREAS, on November 26, 2007 the South Bend Common Council, passed Substitute Bill No. 61-07, thereby establishing Marquette School as a Local Historic Landmark. WHEREAS, on December 5, 2007, Mayor Stephen Luecke sent a letter to the South Bend Common Council stating that he would veto Substitute Bill No. 61- 07. WHEREAS, on December 10, 2007, the South Bend Common Council, at its regular meeting, ratified the opinion of its Counselor, Kathleen Cekanski- Ferrand that, "Under the relevant Indiana law and the relevant provisions of the current South Bend Municipal Code, the Mayor does not have the authority to veto an ordinance passed by the Common Council which establishes a local historic landmark". WHEREAS, Substitute Bill No. 61-07 became Ordinance No. 9807-07 [Source: Council Record, Book #49 on file in the Office of the City Clerk] WHEREAS, on December 11, 2007, the South Bend Tribune reported that: Mayor [Luecke's office issued a press statement late Tuesday that said he disagrees with council attorney Kathy Cekanski-Farrand's legal opinion and that his veto should stand. The statement also said that city attorney Chuck Leone feels the mayor has veto authority on historic landmarking. "While this matter could be resolved through the courts, I also believe that it is not very productive to spend tax dollars to do this," Luecke said.] WHEREAS, Ordinance No. 9807-07 was published in the Tri -County News, Inc. and the South Bend Tribune on January 4, 2008 and became legally effective thereafter. WHEREAS, in a letter sent to Commissioner Cheryl Musgrave of the Department of Local Government Finance ("DLGF"), dated June 18, 2008, Mayor Stephen Luecke states that "though the original financing documents called for demolition of the current Marquette Primary Center, the School Corp., at my request has agreed to consider alternate uses for that building. It is my preference to save structures when possible and to find suitable alternate uses when the original use is no longer practical". (Exhibit C) WHEREAS, on June 26, 2008, DLGF, Commissioner Musgrave approved a petition from the South Bend Community School Corporation ("SBCSC") including the construction of a new school on the Marquette site and "As a condition of this Order, SBCSC, over the next 12 months, shall work in good faith with the City of South Bend to explore viable alternative uses for the existing Marquette School Building". (Exhibit C) WHEREAS, in an effort to formally recognize Marquette School for its architectural merit as an unaltered example of the Collegiate -Gothic Revival style with Art Deco influence, its design by Austin and Shambleau, workmanship by Thomas L. Hickey, historic significance as a Public Works Administration project of the Roosevelt Administration and for its continuous use as a neighborhood school since 1937, the HPC prepared its National Register application in conjunction with Partners in Preservation, Inc. WHEREAS, the ultimate listing of any structure within the National Register of Historic Places, will in no conceivable way limit or hamper its current or future purpose, use, disposition or adaptive reuse. 2 WHEREAS, Marquette School's listing within the National Register of Historic Places is an honorable status and offers rehabilitation tax credit opportunities which are a benefit for any alternate or improvised use. WHEREAS, on September 22, 20112:05 PM, a letter was sent by Andrea L. Beachkofsky, Deputy City Attorney, Dept. of Law; City of South Bend to the Building Department Commissioner and states as follows: "Please be advised that no COA [Certificate of Appropriateness] is needed in order to grant a demo permit for the Marquette project. While an ordinance was passed certifying the school as a local historic landmark that ordinance was VETOED by the Mayor. Therefore, the school is NOT A HISTORIC LANDMARK and a COA is NOT NEEDED as a prerequisite to granting a demo permit." (Exhibit D) WHEREAS, on October 3, 2011, the SBCSC adopted a Resolution "Opposing the Nomination of Marquette Primary Center to the National Register of Historic Places." NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY THAT MARQUETTE IS UNDER INTERIM PROTECTION.. There is no question that Marquette School is an important historic resource which deserves to be landmarked by the City of South Bend. Its unique architectural composition, with elements of the Collegiate Gothic style and a very strong Art Deco influence, along with the building's connection with the Public Works Administration has resulted in the building's "Outstanding" rating in the Indiana Historic Sites and Structures inventory. That, along with the State Historic Preservation Office's determination ofNational Register eligibility is a strong mandate ,for its historic designation locally. The Nacional Trust for Historic Preservation has been tracking the endangered nature of historic schools for the past decade. We advocate the preservation of historic schools because over time we have learned many lessons related to the adaptability and longevity of these structures. We believe they offer cultural continuity, traditional irreplaceable amenities, and time and again we find renovation a cost effective option versus the cost of new construction. We understand that the South Bend Community School Corporation has a responsibility to ensure that any funds spent on schools will provide students with the best quality facilities at the most reasonable cost. The National Trust hopes that the Community School Corporation will seriously investigate alternatives for the Marquette School's rehabilitation that will preserve the historic school while making upgrades and additions to ensure facilities of the highest quality for South Bend's students. People often argue that it is too expensive to renovate older schools — that it is chcaper to just start over. (574) 299-1917 p•2 the cost equation, generally we have found that renovation is less expensive than new construction when all of the factors are taken into consideration. It is important to secure architectural services from a firm with some track record in the renovation of schools, as prejudices against old buildings abound within the construction industry. ©Sen renovation, coupled with sensitive additions and alterations to meet tomorrow's programmatic and technological needs, is the right answer — essentially providing the students with the best advantages from both worlds. Beyond the importance of preservation, the renovation of Marquette also makes.sense environmentally. Demolition of an almost 60,000 square foot building will result in hundreds of truckloads of debris being needlessly hauled off to a landfill. Renovation will avoid the loss of the embedded energy that was first used to manufacture the materials that constructed the building. It will reuse materials and reduce the amount of new energy and materials required to build a new school. All of these are valuable lessons to teach our children. With our extensive experience with the issues faced byhistoric schools around the nation, we would be pleased to consult and participate with the South Bend Community School Corporation to assist in the decision making process. We can also consult on strategies for renovation or adaptive use to overcome obstacles to preservation through creative design. By working together, we are confident we can help South Bend achieve the goal of a quality school environment for all children without sacrificing historic merit. Jefferson Blvd. South Bend, IN 48801 Dear Council Members: I am writing at the request of Timothy Klusczlnsld, President of the Historic Preservation Commission of South Bend and St. Joseph County, to provide information about the statewide survey program, ratings in the survey, and the significance of Marquette School which was evaluated and rated. The Indiana Historic Sites and Structures inventory is the statewide survey program that has been Inexistence since 1975. It derives from this offlce's mandate as the Indiana State Historic Preservation Office to Identify properties around the state that may be eligible for listing in the National Register of Historic Places. To date,.62 of Indiana's 92 counties have been surveyed and most surveys published as "interim" reports. Reports for several of the state's larger metropolitan areas have been published separately. We are currently reviewing the final draft of'report for the City of South Bend. The surveys identify buildings, bridges, cemeteries; and historic districts that are 40 years old and older and have not been seriously altered for the purpose of evaluating architectural and historical significance and rating them regarding eligibility for listing in the National Register. Relatively few properties receive an `Outstanding" rating; only those that clearly appear to be National Register candidates for their architectural andtor historical merit. According to the survey information compiled, the Marquette School reeehred the Outstanding rating on the basis of both architectural and historical significance. It was designed by the local architectural firm of Austin & Shambleau in the Art Deco style and is an excellent example of that style, popular in the late 192.0a and 30s. it is also significant for Its association with the Public Works Administration, a New Deal socialleconomic program that had a notable impact in South Bend during the Great Depression. After reviewing the supporting survey information provided us, we beileVe the Marquette School Is eligible for listing to the National Register of Historic Places. JOSEPH COUNTY, FOR ) THE APPROVAL OF A LEASE WITH THE ) No. 08-005 SOUTH BEND COMMUNITY SCHOOL ) CORPORATION 2002 BUILDING ) CORPORATION. ) A petition was filed on behalf of the South Bend Community School Corporation (SBCSC) for approval of a lease rental agreement with SBCSC providing for the lease,, containing an option to purchase, which provides for the following project ("Project's: Monroe Primary Center and Marquette Primary Center; and in connection with the undertaking of the Project, the School Corporation will apply a portion of the funds it receives from the sale of the above -referenced schools to the South Bend Community School Corporation 2002 Building Corporation (`Building Corporation') "for the cost of any or all or any portion of the improvements to Washington High School and Clay High School as described in the Petition for Approval. The annual maximum lease rental payment is $2,950,000 payable in semiannual installments on June 30 and December 30 beginning not later than June 30, 2009. The total term of the Lease shall not exceed twenty-three (23) years. The total project costs are $36,165,000. The Department of Local Government Finance ("Department'j, pursuant to Executive Order 05-19, has reviewed the proposed lease and the Project, and has applied the guidelines set forth in the Guidance for Review of School Building Project Financing and the factors set forth in IC 20-46-7- 11. The school has complied with the appropriate provisions of IC 6-1.1-20 and IC 2046-7-8. After careful consideration of all facts, the Department FINDS the following: 1. SBCSC petitioned the Department for approval of the Project on January 18, 2008. The petition was received by the Department on January 23, 2008. SBCSC Petition for Approval, January 18, 2008. 2. The preliminary determination to enter into.the lease rental agreement, which occurred on June 4, 2007, included the required information in accordance with IC 6-1.1-20-3.1 and IC 6-1.1-20-3.2, and was properly published in the newspaper on June 8, 2007: — •- --a. The maximum term of the lease is .23 years. b. The maximum annual lease rental payment is $2,950,000. c. The estimated interest rate that will be paid is expected to not exceed six percent (6%); and the total interest costs associated with the bonds are expected to not exceed $21,688,795. d. The purpose of the lease is briefly summarized below, and does not contain the entire . description of the project as published in the preliminary determination notice: a5xh%6t4--G Page 1 of 6 (1) Monroe Primary Center: complete renovation of the 85,800 sq. ft. existing building, and an addition of a single -story structure of approximately 19,500 sq. ft.; (2) Marouette Primary Center: construction of a new two-story school building approximately 78,000 sq. ft. is planned for the north end of the current site; (3) Washington High School: study of traffic patterns on school's parking; and (4) Clay High School: remodeling of fine arts classrooms to support magnet program. e. A statement that any owners of real property within the political subdivision or registered voters residing within the political subdivision who want to initiate a petition and remonstrance process against the proposed lease payments are required to file a petition not later than thirty (30) days after publication of the preliminary determination was properly included in the published notice. On December 7, 2007, the St. Joseph County Voter Registration office certified that 3,133 total qualified petitioners supported the Project and 469 total qualified remonstrators opposed the Project. SBCSC included a statement in the preliminary determination notice that it expected to appeal ... for a new facility adjustment (as defined in IC 2045-1-16) for an increased maximum permissible tuition support levy to pay the estimated costs of opening a new school facility, the 78,000 sq. ft. Marquette Primary Center. Specifically, SBCSC has indicated that a tax levy of $300,000 will be sought at a tax rate impact of $0.0055. In accordance with IC 2046-7-8, the petition was received by the Department less than twenty- four (24) months after the first date of publication of the preliminary determination. Specifically, the preliminary determination was published on June 8, 2007, and the petition was received by the Department on January 23, 2008. Per IC 20-46-7-9(b), the Department sought the recommendation of the Control Board. The s Control Board met on February 21, 2008. The vote by the Control Board in support of the Project -- - was five (5) to one (1) with one (1) abstention. As authorized by IC 20-46-7-9(c), the Department extended the three (3) month review and decision period by an additional three (3) months when the Department provided written notice to Dr. Robert Zimmerman, former superintendent of SBCSC, on April 10, 2008. In accordance with IC 2046-7-10, SBCSC properly conducted a feasibility study, held public hearings, and heard public testimony on using a twelve (12) month school term rather than expanding classroom space. This feasibility study was completed on April 23, 2007 by Hebard & Hebard. The hearings on year round school were conducted on June 4, 2007 and June 18, 2007. It was determined by SBCSC that year round school would not affect the need for the Project. As stated above, the Department considered the factors in IC 20-46-7-11: a. The current and proposed square footage of school building space per student: (1) Marouette Primary Center: new construction: 78,000 sq ft.; current sq ft of school bldg per student at current enrollment = 213.55 (66,200 current sq ft / 310 current enrollment), and current sq ft per student at current capacity =153.24 (66,200 current sq ft / 432 current capacity). Square foot per student at new capacity =156.00 (78,000 after project sq ft / 500). (2) Monroe Primary Center: remodeling of existing structure prior to project: 89,720 sq ft; and after project: 108,905. Square foot prior to project per student at current enrollment =152.34 (89,270 current sq ft / 586 current enrollment), and square foot prior to project per student at current capacity =141.70 (89,270 current sq ft / 630 current capacity); Square foot per student at proposed capacity =181.51(108,905 sq ft after project / 600 new capacity). The age and condition of the current school facilities: (1) Marauette Primary Center: constructed in 1936 with 8 classroom addition in 1953. (2) Monroe Primary Center: constructed in 1931 (i.e., "Castle School'). d. the cost per square foot of the school building construction project: (1) Mamuette Primary Center: total estimated costs of new construction for 78,000 sq ft building per sq ft = $150.61. The effect that completion of the school building construction project would have on SBCSC's tax rate: Maximum tax rate impact of this project = $0.0463. f. (2) School Corporation's current debt service tax rate = $0.3156. (3) New facility appeal tax rate impact = $0.0055; and tax levy = $300,000. For 2006 -pay -2007, the average general fund tax rate for schools statewide was $0.6715. SBCSC's general fund tax rate was $0.6239, which is $0.0476 below the state average. The state does not pay for such programs now, and it would take legislative approval for the state to begin paying for such programs. WHEREFORE, based upon the above findings, evidence presented to the Department in case file #08-005, and other records the Department considered relevant, the Department hereby APPROVES: Execution of a lease rental agreement with SBCSC providing for the lease, containing an option to purchase, which provides for the Project described above and in file #08-005. Construction costs are rising for labor and materials and projects have lost the window of opportunity for most efficient work when students are on vacation. 'The project financing as proposed by SBCSC takes advantage of existing debt rolling off and refunding prior issuances so that there is no incremental tax impact. This is good planning on the part of the School Corp. to not add tax burden to our community. This project will upgrade and modernize the final two school buildings in its inventory of 34 buildings - these are the only two in the corporation without air conditioning and that do not meet handicap accessibility standards. Finally, I too am concerned for the taxpayers of our community. On this issue theyhave. spoken overwhelmingly in support of the projects. A remonstrance was filed against the :• financing. WHEREAS, on December 10, 2007, the South Bend Common Council, at its regular meeting, ratified the opinion of its Counselor, Kathleen Cekanski-Ferrand that, "Under the relevant Indiana law and the relevant provisions of the current South Bend Municipal Code, the Mayor does not have the authority to veto an ordinance passed by the Common Council which establishes a local historic landmark". APPLICATION ITEMS: Remodel of existing attic into new living spaces. Exterior work included the addition of (3) new dormers on the South (street) side of the house. Also included is the removal and replacement of roof shingles on the South side of the house for dormer installation. DESCRIPTION OF PROPOSED PROJECT. The Kellers propose to install three new dormer windows into the attic space. The new dormers will allow daylight and fresh air into the attic spaces and will create areas of flat ceiling 7' high to relieve the otherwise sloped surfaces. Each dormer is sized to accommodate a casement window that meets emergency egress requirements while remaining stylistically sympathetic to a home designed in the 1920s. The dormers will be rough frames with standard 2x4 construction and will be clad with painted cedar siding and trim. NEW CONSTRUCTION New construction includes any new building or structure constructed within the boundaries of the historic district, or any new addition to an existing building. New construction should be designed considering the appearance of the other buildings in the neighborhood. A. HEIGHT AND PROPORTION The majority of structures in the district are two stories high and are square, rectangular, or irregular in plan. There are a few story -and -a -half residences. The prevalent facade proportions are between a 1:1 and a 1:2 height -to -width ratio. Required The height of new structure and its height -to -width proportions shall be consistent with adjacent buildings in the district. The building height shall be no greater than that of the tallest existing structure and no less than that of the lowest existing structure of the same type in the same block. Facade proportions shall be established by permitting no structure with a facade wider or narrower than those existing in the same block. Additions to existing buildings shall be related in height and proportion to the existing structure.. Recommended Contemporary designs should be compatible in character and mood to the building or neighborhood. Prohibited Additions may not be constructed that would change the existing facade of a building, alter its scale or architectural character, or add new height. Not Recommended New stories should not be added, nor should existing stories be removed, which would destroy important architectural details, features or spaces of the building. Any style or period of architecture that is incompatible with what exists should not be permitted in the new additions. B. BUILDING MATERIALS Wall materials in the district include brick, stucco, half-timbering, stone, clapboard, shingle, and metal and vinyl siding. Required Exterior materials used on a new structure shall be compatible in scale, texture and color with adjacent structures. Materials used on an addition to an existing structure shall relate to the existing or original materials of that structure. As much of the original structure as possible shall be retained so that the addition could be removed without damage to the basic structure and appearance of the building. Recommended Metal or vinyl siding may be used when it is the only feasible alternative. This siding should be compatible with the original size and style and with the materials of other buildings in the district. Prohibited Inappropriate materials such as asbestos, asphalt, molded or artificial stone, or artificial brick shall not be used. Not Recommended Glass blocks should not be used. Concrete block should not be used for anything other than foundations. STAFF RECOMMENDATION: Staff recommends approval as the project conforms to the guidelines for new construction and materials in the East Wayne Street District. The dormers are sympathetic to the Colonial Revival style of the house; and there are two Colonial Revival homes, one on E. Wayne South and one on Sunnyside, that have gabled dormers similar to what is being proposed. These rooms will have sloped ceilings dictated by the existing roof framing, but are very close to the minimum amount of space requiring headroom of 7-0" or greater. Also, each room is currently lit with a pair of quarter round windows, too small to admit much natural light and fresh air, and too small for emergency egress. The Kellers are proposing to install three new dormer windows into the attic space. The dormer to the east will serve the Guest Bedroom, while the other two will serve the Family Room. The new dormers will allow daylight and fresh air into the attic spaces, and will create areas of flat ceiling 7-0" high to relieve the otherwise sloped surfaces. The design of the dormer is in keeping with nearby historic homes on East Wayne Street South, Sunnyside Avenue, and East Jefferson Boulevard. Each dormer is sized to accommodate a casement window that meets emergency egress requirements while remaining stylistically sympathetic to a home designed in the 1920s. The window size is similar but proportionally smaller than the existing windows below them. Similarly, the muntin pattern creates panes of glass that are proportionally similar to existing windows in the house. New windows will have insulated glass, and will employ a simulated divided light muntins with spacer bars between the panes of glass. The window exterior will be painted wood to match existing windows. Dormers will be rough framed with standard 2x4 construction, and will be clad with painted cedar siding and trim. Casement windows will be by Marvin Windows and Doors from their line of Ultimate Push -Out Casement Windows. Dormer roof shingles as well as new shingles for the south side of the house will match the existing asphalt shingle roof. 1319 E. They were unaware that they were in an historic district and replaced windows without building permits or COAs prior to Wayne being notified. They have applied for the COA, the windows that were removed were disposed of, they understand 2 that they cannot remove any other windows and must have them assessed by a contractor to determine if they are deteriorated beyond repair. The COA will be placed on the November Agenda. Continued the work on the Marquette N.R. Staff Report after an on sight visit to photograph the school with Wayne. 14 October The State Theatre hit the radar screen when Steve Szaday informed us that there was graffiti on the building in the alcove at the top of the fire escape and that there were massive amounts of pigeon droppings plus an open door on that level. Contacted John Martinez, City graffiti specialist and Elicia and I met him at the site to evaluate the damage Informed DTSB, Tamara Nichols Smith of the situation requesting that the Bank be notified and that the City secure the open doorway. Office was informed that door had been open since 2005 or 2006 and that DTSB would power wash the graffiti from the terra cotta! Wayne South has a 2 storey frame construction that is faced with brick on `Z" plan. The house has a gable roof with gable returns, simple entablature and dentil row with asphalt shingles. The windows on the main body of the house are 6/1 double hung sashes with flat arch lintels with keystone and cast concrete sill. The windows have wood paneled and louvered shutters with cut-out tree motif. The house has a gable entry with an arch under, entablature and dentil row in gable rake supported by square box columns. The porch is brick and the entryway has a paneled door with sidelights and a wood sunburst pattern fanlight. There is an aluminum sided shed roof addition on the one storey wing at the rear. There is a 2 car 2 door brick gable roof garage with asphalt shingles. ALTERATIONS: The rear shed addition was constructed in 1987. A 6' privacy fence was installed in 1998 with COA 1998- 0316. APPLICATION ITEMS: Remodel of existing attic into new living spaces. Exterior work included the addition of (3) new dormers on the South (street) side of the house. Also included is the removal and replacement of roof shingles on the South side of the house for dormer installation. DESCRIPTION OF PROPOSED PROJECT. The Kellers propose to install three new dormer windows into the attic space. The new dormers will allow daylight and fresh air into the attic spaces and will create areas of flat ceiling 7' high to relieve the otherwise sloped surfaces. Each dormer is sized to accommodate a casement window that meets emergency egress requirements while remaining stylistically sympathetic to a home designed in the 1920s. The dormers will be rough frames with standard 2x4 construction and will be clad with painted cedar siding and trim. The dormer roof shingles as well as new shingles for the south side of the house will match existing asphalt shingle roof. See attached documentation and elevations. STANDARDS AND GUIDELINES: East Wavne Street: III. NEW CONSTRUCTION New construction includes any new building or structure constructed within the boundaries of the historic district, or any new addition to an existing building. New construction should be designed considering the appearance of the other buildings in the neighborhood. A. HEIGHT AND PROPORTION The majority of structures in the district are two stories high and are square, rectangular, or irregular in plan. There are a few story -and -a -half residences. The prevalent facade proportions are between a 1:1 and a 1:2 height -to -width ratio. Required The height of a new structure and its height -to -width proportions shall be consistent with adjacent buildings in the district. The building height shall be no greater than that of the tallest existing structure and no less than that of the lowest existing structure of the same type in the same block. Facade proportions shall be established by permitting no structure with a facade wider or narrower than those existing in the same block. Additions to existing buildings shall be related in height and proportion to the existing structure. Recommended Contemporary designs should be compatible in character and mood to the building or neighborhood. Prohibited Additions may not be constructed that would change the existing facade of a building, alter its scale or architectural character, or add new height. Not Recommended New stories should not be added, nor should existing stories be removed, which would destroy important architectural details, features or spaces of the building. Any style or period of architecture that is incompatible with what exists should not be permitted in the new additions. B. BUILDING MATERIALS Wall materials in the district include brick, stucco, half-timbering, stone, clapboard, shingle, and metal and vinyl siding. Required Exterior materials used on a new structure shall be compatible in scale, texture and color with adjacent structures. Materials used on an addition to an existing structure shall relate to the existing or original materials of that structure. As much of the original structure as possible shall be retained so that the addition could be removed without damage to the basic structure and appearance of the building. Recommended Metal or vinyl siding may be used when it is the only feasible alternative. This siding should be compatible with the original size and style and with the materials of other buildings in the district. Prohibited Inappropriate materials such as asbestos, asphalt, molded or artificial stone, or artificial brick shall not be used. Not Recommended Glass blocks should not be used. Concrete block should not be used for anything other than foundations. STAFF RECOMMENDATION: Staff recommends approval as the project conforms to the guidelines for new construction and materials in the East Wayne Street District. The dormers are sympathetic to the Colonial Revival style of the house; and there are two Colonial Revival homes, one on E. Wayne South and one on Sunnyside, that have gabled dormers similar to what is being proposed.
