The foundation is rusticated concrete block, the 1" story is clapboard with an enclosed porch, the 2nd floor is wood shingles above'a string course. The roof is a high hip roof with 3 gabled roof dormers, exposed rafter ends, wide overhangs and is covered with asphalt shingles. ALTERATIONS: The HPC survey card, updated in 1998, lists the home as "Altered"; "Excellent". C of A's on file include: 1986-0417: Complete tear off and re -roof of house and porch. 2001-0710: Tear off and re -roof of carport with in-kind materials. 2002-0709: Extension of chain link fence and removal of portion of wood stockade fence. 2005-0608: Installation of new storm door. 2007-0705: Re -shingle 2 story main upright, rear lower section, bay window with Art Lock re -roofing shingles over 1 layer of roofing. Re -roof porch roof with asphalt shingles. APPLICATION ITEMS: Remove the old fence and build a new fence 3ft from the old fence. Using the existing steel poles of the chain link fence by framing the poles 1x4x6 ft treated wood. Using lx6x6 fence boards. The same as the old fence. DESCRIPTION OF PROPOSED PROJECT: Homeowner previously installed a chain link fence (Photos 1 & 2) intended to be a barrier between his wooden stockade fence and cars exiting a garage across the alley from his property. At one time, drivers would occasionally run their cars into and damage the wooden fence as they attempted to back out of the garage that abuts the alley across from his property. Of late, the homeowner reports that this no longer occurs; therefore he wishes to remove the chain link fence as this "buffer" is no longer necessary. The scope of work would include removing the chain link panels of the extant fence, and removing the current wooden fence. Then, the wooden fence would be re -built along the line where the current chain link now stands. The homeowner will utilize the existing posts of the chain link fence for the new- by framing the posts in lx4x6 treated lumber. 6' wooden fence boards will then be installed between the posts; maintaining the current wood fence height of 6' and replication of the style of picket, while moving the wooden fence line 3' south of its current location. STANDARDS AND GUIDELINES: The Guidelines selected by the Riverside Drive Local Historic District are (b2) - Rehabilitation Maintaining the existing character of the District, and whenever possible returning it to its original condition. Any rehabilitation would not require the removal of all non -original materials but would encourage the removal of all such materials which are incompatible with the defined elements of preservation for the District. The design of new construction or alteration would not require the duplication of the original design and construction, but should be compatible with the existing structures and the District's defined elements of preservation. The use of original materials or construction techniques would be encouraged, but contemporary methods and materials would be acceptable when compatible. - A. THE DISTRICT ENVIRONMENT Required Distinctive existing features such as parks, gardens, streetlights, fences, signs, benches, walkways streets alleys and building setbacks shall be retained. New plant materials, fencing, walkways, streetlights, signs and benches shall be compatible with the character of the neighborhood in size, scale, material and color. B. BUILDING SITE, LANDSCAPING AND ACCESSORIES Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. The roof is hipped with a central gable dormer covered with asphalt shingles. There is a full width front porch with full height Tuscan columns, with balusters and with lattice below. The windows are 1/1 double hung. There are two front doors. ALTERATIONS: The house has been vinyl sided and has replacement storm windows. In 1942 the home was remodeled into a 2 family dwelling. The garage was added in 1949. In 1960 a new rear addition was built. COA#2006-0424 documents a complete tear -off and re -roof with asphalt shingles APPLICATION ITEMS:. Replace awning windows with double hung 1/1; a complete replacement of the current windows. DISCRIPTION OF PROPOSED PROJECT; The homeowner wishes to replace two awning style windows, one on the west and one on south side, in his 1960 addition to the rear of his house with vinyl double hung windows to match the other double hung windows of the house. He proposes custom made Champion windows 1/1. STANDARDS AND GUIDELINES: C. WINDOWS AND DOORS Window and door frames are in most cases wood and vary depending upon the style of the home. Many are double hung windows with wood trim and sills. Brick structures have stone sills and brick lintels. In some cases where aluminum siding has been applied, the window and door trim has been covered. About half of the structures in the district have aluminum storm windows; the other half have wood storm windows. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood storm windows and doors painted or finished to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used, they should be of canvas material. 4 Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and reused in place. New window and door openings, which would alter the scale and proportion of the building may not be introduced. Keller built the Free Classic at 1041 Riverside in 1907. The house is 2'/z storeys with a square plan set on a concrete block foundation. The roof is hipped with gable projections and returns and is covered with asphalt shingles. The windows are double hung 1/1 and there is a bay window on the first floor of the north facade. The house was built with wood siding and shingles and has a brick chimney. The house is oriented to the northwest on Riverside Drive. ALTERATIONS: The house was aluminum sided before 1985 and the survey card notes that all of the window sills and lintels were removed except those for the bay window. The window surrounds on the front second storey windows appear to be original. A rear addition with a one storey, hipped roof with aluminum siding to match house was approved by the HPC on August 4, 1986. The house was re -roofed in March, 2006 APPLICATION ITEMS: Replacement windows on first and second floors 18 total. Double hung wood windows (Marvin Insert) per document cited below: - Proposed Work: Replacement (not inokind) 1. Description of Proposed Work: window replacement The windows with proposed changes at 1041 Riverside Drive consist of: ❑ First floor, front'room: 5 double hung wood windows with aluminum storms (request to replace all windows and sashes) ❑ First floor, back (dining room & kitchen): 5 double hung wood windows with aluminum storms (request to replace all windows and sashes) ❑ Second floor, front and back: 8 double hung wood windows with aluminum storms (request to replace all windows and sashes) The owner met with five different contractors to explore options for repairing and replacing the windows. Please note the letter from Christopher Kohler of Kohler Home Improvement, who has a specialization in window restoration/replacement (Appendix 1) that states that the windows need to be replaced. Based upon these consultations, the owner herein request to replace these 18 windows (of the 25 total in the home) with Marvin Inset windows in order to: 1)improve energy efficiency in the home (which is currently not efficient at all); achieve functioning windows that can be opened and closed easily and provide proper ventilation for the home; 3) replace windows that are currently in a state of disrepair (cracked wood/frames, broken cords, windows that no longer fit well into the window frame). In addition, please note that the house is considered "non-contributing" in this historic district, and is currently covered with aluminum siding. 2. Materials to be used The windows are to be replaced with Marvin Inset wood windows, brochures for which are located in Appendix 2. The windows will be replaced with Marvin Ultimate Insert Double Hung wood windows, which feature low emissivity argon insulating glass, traditional sash locks, primed wood (pine) interiors, and extruded aluminum clad exteriors. The existing screens and storms will stay on the exterior of the windows. 3. Construction Methods . Current windows will be removed, but all window frames will remain undisturbed. The Marvin Insert wood windows have a frame -in -frame design that allows them to fit directly within the existing openings. All windows will be custom made due to the dimensions of the existing windows. Frame -in windows will be installed with proper perimeter insulation and sealing. Exterior aluminum custom formed casing white trim will be provided on the windows where necessary. DESCRIPTION OF PROPOSED PROJECT: As detailed above the original window are to be removed and replaced with 1/1 aluminum clad pine wood Marvin Inserts. The current storm/screen windows will remain. The proposed replacement windows will be installed on the interior of the house and replace the entire window frame and sashes of each window. The wood Marvin Inserts will alter the window opening by increasing the size of the sashes 12" on each side and 14" on the top and bottom of each sash. The frame will sit on the existing sill adding an additional sill. This last item may not be as noticeable from the street since the permanent aluminum double track storm/screen combination windows will remain. STANDARDS AND GUIDELINES: C. STAFF RECOMMENDATION: The house was originally rated as non-contributing and is described as such in the Riverside Drive Standards and Guidelines. This is mainly because of the aluminum siding and the lack of architectural features. Staff concurs with that original finding of non-contributing given the overall housing fabric of the Riverside Drive LHD. The Preservation Specialist was on the site during the homeowner's lunch hour. Based on his exterior inspection he believes the windows can be repaired; and offered to inspect and to show the homeowner how to open the windows from the interior at the homeowner's convenience. A time and date for that interior inspection was not set. The Preservation Specialist also alerted the homeowner to the possibility that when the aluminum siding was installed the windows were not caulked and that installing new windows may not resolve the heating cost issues. Staff recommends approval of the replacement windows on the sides and rear of the house. Staff recommends that the first floor bay and single window and the second floor bedroom windows be either restored or use the less invasive and noticeable sash kits by Marvin- the tilt packs with jamb liners. This would be accomplished with consultation between the Preservation Specialist, Christopher Kohler, Director and Kathy Smarrella. Being old wooden double hung windows the sashes have no perimeter sealing where sash meets frame and sashes are single glazed. Although the windows could be re -conditioned and trade to operate more properly, this will do nothing for the exiergv efficiency problem. The obvious solution is window replacement.. Total tear out would be cost prohibitive, but insert (replacement) models would work well. Both Marvin and Pella make wood insert models that have thin: main frames which will maintains original appearance both interior and exterior. These windows can be order pre -primed and painted. Vinyl replacements do not meed painting but lack the strength of wood and have wider frames. A third choice is a wood sash only replacement kit which has no main frame, only sashes and jamb liners. I would recommend wood insert replacement models for all of house since windows are of large size and need the strength a woad rcplacentetat model offers. So as not to alter the original exterior appearance do not wrap window casings in aluminum, Using the sash only replacement bits for front of house and insert models for the rest is also an option. Description of Proposed Work: window replacement The windows with proposed changes at 1041 Riverside Drive consist of: First floor, front room: 5 double hung wood windows with aluminum storms (request to replace all windows and sashes) First floor, back (dining room & kitchen): 5 double hung wood windows with aluminum storms (request to replace all windows and sashes) Second floor, front and back: 8 double hung wood windows with aluminum storms (request to replace all windows and sashes) The owner met with five different contractors to explore options for repairing and replacing the windows. Please note the letter from Christopher Kohler of Kohler Home Improvement, who has a specialization in window restoration/replacement (Appendix 1) that states that the windows need to be replaced. Based upon these consultations, the owner herein request to replace these 18 windows (of the 25 total in the home) with Marvin Inset windows in order to:1)improve energy efficiency in the home (which is currently not efficient at all); achieve functioning windows that can be opened and closed easily and provide proper ventilation for the home; 3) replace windows that are currently in a state of disrepair (cracked wood/frames, broken cords, windows that no longer fit well into the window frame). In addition, please note that the house is considered "non-contributing" in this historic district, and is currently covered with aluminum siding. 2. Materials to be used The windows are to be replaced with Marvin Inset wood windows, brochures for which are located in Appendix 2. The windows will be replaced with Marvin Ultimate Insert Double Hung wood windows, which feature low emissivity argon insulating glass, traditional sash locks, primed wood (pine) interiors, and extruded aluminum clad exteriors. The existing screens and storms will stay on the exterior of the windows. 3. Construction Methods Current windows will be removed, but all window frames will remain undisturbed. The Marvin Insert wood windows have a frame -in -frame design that allows them to fit directly within the existing openings. The house is set upon a concrete block foundation. The walls of the house are wood shingle with board trim. The roof is a high hip has a right gable projection with gable returns. The roof is covered with asphalt shingles. There is a full width front porch with shingled posts and walls. The windows are 1/1 double hung. There is a nine pane attic window in the gable. The two stall garage has wood flush siding and low hipped roof, there are 2/2 windows on both the east and west side; a pair of restored original sliding doors on the east stall and an overhead door on the west stall opening. ALTERATIONS: The aluminum storm windows have been added on the house. In 2003 the entire garage was repaired and restored (COA#2003-0515-2). The overhead door on the garage is a replacement. A new roof was installed with COA#2005-0623-04. The fencing is not original to the house. APPLICATION ITEMS: 1. Relocate Garage Door from cross alley access to back alley access with a new 14' garage door opening. 2. Take existing siding from back and enclose existing garage door opening. 3. Remove concrete driveway and replace with grass and flower beds. DESCRIPTION OF PROPOSED PROJECT: The homeowner wishes to remove the wood siding on the rear of the garage to install a new windowless paneled garage door (Exhibit A), The non original overhead door currently on the front of the garage would be removed and replaced with the wood siding from the rear (Exhibit B) and single entry door salvaged from the house would be installed. The concrete drive area will be removed and grass and flowers planted. A wooden privacy fence to match the current one in the rear will be installed at a later date and is not part of this COA. BUILDING SITE, LANDSCAPING AND ACCESSORIES Individual properties in the district are characterized by a house located in the center of a flat lawn, often divided by a walk leading to the front entrance. Several of the residences are sited on two or more building lots; however, the preponderance of the homes have been erected on a single lot. Most of the properties include a double garage, usually located at the rear of the property. The majority of garages are accessed from straight driveways leading from the main thoroughfare, while a few are accessed from the alley. There are also a few homes with a covered carport located at the rear of the property, as well as a few with circular driveways. Driveway and sidewalk materials include concrete, asphalt and brick. All of the properties have trees and most have trimmed shrubbery and/or hedges. Most of the houses conform to a uniform setback line within each block. Required Plants, trees, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. Plant materials and trees in close proximity to the building that are causing deterioration to the building's historic fabric should be removed. However, trees and plant materials that must be removed should be immediately replaced by suitable flora. All high-intensity security lights should be approved by the Historic Preservation Commission. Prohibited No changes may be made to the appearance of the site by removing major landscaping items, trees, fencing, walkways, outbuildings or other elements before evaluating their importance to the property's history and development. Overview: Our current garage access is from the cross alley which runs along the northside of our property and accesses the garage from the east (front) side of the garage. This means that our back yard is currently open and our desire is to be able to close fence that off for multiple reasons. • Security – access to our backyard/rear home entrance from people walking through the cross alley is easy as the gate is open when we are in and out of the garage. The only way to limit is if we stop and close the gates whenever we come and go. This is at a minimum inconvenient and is difficult to do in inclement weather, especially when snow accumula- tion makes it difficult to open and close the gate. Safety – traffic on the cross alley, while not significant in volume, is a problem in terms of speed and proximity to our property as our home sits right on the alley and there is no lawn buffer. For the sake of ourselves and our young grandchildren, we want to be able to per- manently fence that side of the property. Privacy – with the current access on the cross alley both car and pedestrian traffic is liter- ally happening on the edge of our back yard. While most are courteous, some are not. Serviceability—current garage door configuration of single overhead door, and hinged sliding door, along with footprint of driveway only accommodates one vehicle being parked inside the garage. We are proposing: 1. Installation of a 14' wide garage door (Wayne Dalton – Lowes brand, Colonial Panel door without windows) on the back side of the garage which is 16' wide. 2. Proper building permits would be pulled and an appropriate wood header would be in- stalled to support the load of the hip roof. 3. BUILDING SITES LANDSCAPING AND ACCESSORIES Individual properties in the district are characterized by a house located in the center of a flat lawn, often divided by a walk leading to the front entrance. Several of the residences are sited on two or more building lots; however, the preponderance of the homes have been erected on a single lot. Most of the properties include a double garage, usually located at the rear of the property. The majority of garages are accessed from straight driveways leading from the main thoroughfare, while a few are accessed from the alley. There are also a few homes with a covered' carport located at the rear of the property, as well as a few with circular driveways. Driveway and sidewalk materials include concrete, asphalt and brick. All of the properties have trees and most have trimmed shrubbery and/or hedges. Most of the houses conform to a uniform setback line within each block. Required Major landscaping items, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Dominant land contours shall be retained. Structures such as gazebos, patio decks, fixed barbecue pits, swimming pools, tennis courts, greenhouses, new walls, fountains, fixed garden furniture, trellises and other similar structures shall be compatible to the historic character of the site and the neighborhood and inconspicuous when viewed from a public walkway. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. Plant materials and trees in close proximity to the building that are causing deterioration to the building's historic fabric should be removed. However, trees and plant materials that must be removed should be immediately replaced by suitable flora. All high-intensity security lights should be approved by the Historic Preservation Commission. Prohibited No changes may be made to the appearance of the site by removing major landscaping items, trees, fencing, walkways, outbuildings or other elements before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped. Front yard areas shall not be fenced and fences shall not extend forward beyond the setback line of the house. The installation of unsightly devices such as television reception dishes and solar collectors shall not be permitted in areas where they can be viewed from the public thoroughfare. WINDOWS AND DOORS Window and door frames are of wood or steel (some casements) or in the case of brick structures, stone sills and brick lintels. Where metal or vinyl siding has been applied, window trim has been covered. Storm windows are of wood or aluminum. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. The walls are wood shingles and the gabled roof has asphalt shingles. There is an enclosed front porch with narrow single pane windows; the windows on the house are 1/1 double hung with aluminum storms; there is a pair of casement dining room windows. ALTERATIONS: The front porch was enclosed with a bank of windows above the knee wall. There are replacement storm windows. A new front storm door, replacement gutters and foundation re -pointing were approved by the Commission in February 2004. The window shutters noted on the 1985 survey card have been removed. The original siding and trim have been removed for lead abatement and new wood siding and trim to match the original was approved to be installed in COA 2009-0529. APPLICATION ITEMS: 8 windows to be replaced (all other windows have been replaced). Due to rotting/decay most of these windows are beyond repair and are lead painted. Ones that could be repaired have no insulation value and repair cost would double. DESCRIPTION OF PROPOSED PROJECT. The COA application is for complete window replacement because of deterioration and for lead abatement. The windows proposed are four on the west side: the upstairs bath 1/1 double hung; the kitchen window 1/1 double hung and a pair of dining room casements windows. The final four windows are across the front of the house on the first storey inside the enclosed porch and all 1/1 double hung windows. The letter is dated May 31, 2009. Location The cemetery property is approximately 250-300 yards from the intersection of New Road and Rt. 331. The "cemetery is located on the south side of New Road, and St. Paul's Lutheran Church is located to the west of the site, on the north side of New Road. Despite this, the church and cemetery share the same address. Per the St. Joseph County Road numbering and address system, 15697 specifically corresponds to the (as it is an odd number) a property on the north side of an east/west road. The 1875 St. Joseph County atlas shows the church and cemetery on Page 69. (Included) Section 22, Township 36N, Range 3E Indiana Historic Sites and Structures Survey Rating The Interim Report published in June 2006 rated the St. Paul Lutheran Church Cemetery as Contributing: 032 C . St. Paul Lutheran Church Cemetery; 15697 New Rd.; c.1845 -present; Exploration/Settlement, Religion Context The congregation of St. Paul's Lutheran Church began meeting as a religious community in 1846, and was formally organized as a congregation in 1851. Although it is assumed that burials were taking place, records are non existent. The presumption though is that burials began circa 1851-1854, though the land was not deeded as a cemetery until 1862. The 1875 St. Joseph County Atlas show the plot essentially as it appears today. Church death records begin in 1898. Recommendation The St. Paul's Lutheran Church cemetery is recommended for designation as a Local Landmark based on the following criteria: 1. Its suitability for preservation; and 2. Its cultural and educational value. The cemetery fulfills criteria #1 in that the site is in good shape and the landscape is well maintained. It does not appear that any of the stones are suffering any damage other than typical weathering, although the application to the state registry suggests that they do find occasional vandalism. Also, a recent road improvement project on New Road ti has some congregants and officials concerned about the cemetery's proximity to the soft shoulder on the side of the road. While landmark status would not specifically dictate set backs or other matters with any future road work, it will allow the HPC and the church a voice in the conversation. The cemetery fulfills criteria #2 in that it is the resting place of a number of prominent families that helped to settle Madison Township. The burials also provide information and context about religious reformation as the burials reflect the time both before and after this German community divided between the Lutheran and Reformed religious communities. The cemetery is also the burial site of several veterans of United States Armed Forces, including veterans of the Civil War. Also, there are a number of other cemeteries in the County that are Local Landmarks and date to a similar time. I met with Mikki Dobski Shidler concerning the lights on Leeper Park Bridge. As part of a Breast Cancer Awareness Month the City would like to "change" the lighting to pink during October. Depending upon the financing the Engineering Department thinks that either the top globe of each light or all of the globes could be covered with a temporary, removable pink film. She said that she had already spoken with Todd Zeiger and he didn't have an issue with the proposal and he told her to contact HPC. The proposed pink lighting would be temporary and if the bottom globes were also to be covered the accumulated bugs were requested to be emptied from the globes. JOSEPH COUNTY, INDIANA ESTABLISHING STAFF PROCEDURES WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County, Indiana (the "Commission") exists and operates under the provisions of ordinances enacted by the Common Council of the City of South Bend, Indiana, and the County Council of St. Joseph County, Indiana (the "Enabling Ordinances"); and WHEREAS, the Commission is empowered, pursuant to the Enabling Ordinances, to adopt and has adopted By -Laws for carrying out the powers and duties of the Commission; and WHEREAS, the Enabling Ordinances provide that the Commission shall issue a certificate of appropriateness before any one of the following actions is taken: the construction, reconstruction, alteration, demolition or moving of any exterior feature of any building, structure or use; and ,WHEREAS, a certificate of appropriateness is not required for the ordinary maintenance and repair of any building, structure or use which will not involve a change in any exterior features; and WHEREAS, the Commission desires to establish procedures governing the conduct of the Staff of the Commission in order to avoid the Staff exercising powers or duties reserved to the Commission and to provide clear guidelines for the Staff to follow; and WHEREAS, Article 10 of the By -Laws provides the appropriate procedure for amending the By -Laws which requires that approval must be made by a vote of a majority of the Commissioners voting at a regular or special meeting of the Commissioners attended by all ofthem, provided that no such action shall be taken at a meeting of the Commission attended by less than all of the members unless the members are given at least ten (10) days notice of the substance of the proposed action to be taken at the meeting. The proposed amendment shall be introduced at one meeting and shall be acted upon at the next regular meeting or a special meeting called within at least ten (10) days notice; and WHEREAS, it is desirable that the By -Laws be amended to establish staff procedures for the conduct of the Staff of the Commission. NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY AS FOLLOWS: Section 1. A new article, Article 9.5, is adopted as the guideline for the conduct of the Staff of the Commission and shall be added to read as follows: ARTICLE 9.5. STAFF PROCEDURES Section 1. Certificates of Annromiateness (COA). Staff should, under no circumstances, approve a COA for any property. The Commission has the sole authority for considering a request for a COA. Staff shall have the authority to make a determination that a COA is not necessary in the case of work that is the ordinary maintenance and repair of any building, structure or use which will not involve a change in any exterior features of the property. Work undertaken on a property owned by a staff person, a consultant to the Commission or a Commissioner that falls under the routine maintenance categorical exclusion of the Ordinance should be reported, in advance, to the Commission president for his/her approval that a COA is not required. Section 2. Non -Historic Sidina. Removal of non -historic siding shall require a certificate of appropriateness. Section 3. Temporary Structures or Chanaes. Staff shall not have the authority to approve "temporary" structures or changes. Section 4. Monthlv Staff Reports. Staff approved routine maintenance exclusions shall be reported monthly. The monthly report shall list all site visits, phone calls or e-mails by all staff with owners of historic properties where it was determined that a COA was not required because it was routine maintenance. Section 5. Presentations by Staff at Commission Meetings. Staff presentations at a Commission meeting shall include PowerPoint slides or other digitally projected images during the presentation at the Commission meeting. Projecting images of the subject property and the proposed changes will allow the Commission members and the general public a better understanding and clarity of the historic aspects of the property and the proposed changes. This manner of presentation also gives the property owner something to refer to during their presentation or questions by the Commission. This manner of presentation also ensures that all Commission members are looking at the same picture at the same time during an explanation and will prevent confusion, especially during questioning by Commission members. The following images (at a minimum) shall be presented a) an overall front exterior; b) specific images pertaining to the impacted area of the building or site; c) architectural drawings and images 2 depicting the proposed alterations and d) photos of mock-ups and/or samples. The required images shall be digital pictures taken during the required site meeting between the staff member and the applicant and downloaded into a PowerPoint slide presentation. This rule shall not be construed to limit the presentations made by the Staff nor by the applicant. Section 2. This Resolution shall take effect immediately upon its adoption by the Commission. Riverside Drive Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE The Jones house is a typical square plan, 2+ story American Foursquare house built in 1908 by real estate developer Fred Keller of Whitcomb and Keller renown. The foundation is rusticated concrete black, the I" story is clapboard with an enclosed porch, the 2nd floor is wood shingles above a string course. The roof is a high hip roof with 3 gabled roof dormers, exposed rafter ends, wide overhangs and is covered with asphalt shingles. ALTERATIONS: The HPC survey card, updated in 1998, lists the home as "Altered'; "Excellent". C of A's on file include: 1986-0417: Complete tear off and re -roof of house and porch. 2001-0710: Tear off and re -roof of carport with in-kind materials. 2002-0709: Extension of chain link fence and removal of portion of wood stockade fence. 2005-0608: Installation of new storm door. 2007-0705: Re -shingle 2 story main upright, rear lower section, bay window with Art Lock re -roofing shingles over 1 layer of roofing. Re -roof porch roof with asphalt shingles. APPLICATION ITEMS: Remove the old fence and build a new fence 3ft from the old fence. Using the existing steel poles of the chain link fence by framing the poles lx4x6 ft treated wood. Using lx6x6 fence boards, the same as the old fence. DESCRIPTION OF PROPOSED PROJECT:. Homeowner previously installed a chain link fence (Photos 1 & 2) intended to be a barrier between his wooden stockade fence and cars exiting a garage across the alley from his property. At one time, drivers would occasionally run their cars into and damage the wooden fence as they attempted to back out of the garage that abuts the alley across from his property. Of late, the homeowner reports that this no longer occurs; therefore he wishes to remove the chain link fence as this "buffer" is no longer necessary. The scope of work would include removing the chain link panels of the extant fence, and removing the current wooden fence. Then, the wooden fence would be re -built along the line where the current chain link now stands. The homeowner will utilize the existing posts of the chain link fence for the new- by framing the posts in lx4x6 treated lumber. 6' wooden fence boards will then be installed between the posts; maintaining the current wood fence height of 6' and replication of the style of picket, while moving the wooden fence line 3' south of its current location. STANDARDS AND GUIDELINES: The Guidelines selected by the Riverside Drive Local Historic District are (b2) - Rehabilitation Maintaining the existing character of the District, and whenever possible returning it to its original condition. Any rehabilitation would not require the removal of all non -original materials but would encourage the removal of all such materials which are incompatible with the defined elements of preservation for the District. The design of new construction or alteration would not require the duplication of the original design and construction, but should be compatible.with the existing structures and the District's defined elements of preservation. The use of original materials or construction techniques would be encouraged, but contemporary methods and materials would be acceptable when compatible. A. THE DISTRICT ENVIRONMENT Required Distinctive existing features such as parks, gardens, streetlights, fences, signs, benches, walkways streets alleys and building setbacks shall be retained. New plant materials, fencing, walkways, streetlights, signs and benches shall be compatible with the character of the neighborhood in size,scale, material and color. B. BUILDING SITE, LANDSCAPING AND ACCESSORIES Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. STAFF RECOMMENDATION: Staff recommends approval of the application as it does not contradict the standards and guidelines of the neighborhood, the proposed building material is already in use on the property, 2 the relocation of the fence on the site will not be visible from the street, and the need for the "barrier" fence is now diminished. On a motion by Linda Riley with a second by Todd Zeiger the Commissioners voted unanimously to approve COA 2009-0826 as presented. STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Date: August 31, 2009 Application Number: 2009-0827 Property Location: 863 Forest Architectural Style/Date/Architect or Builder: American Foursquare -Free Classic/1906 Property Owner: Mark Snell Landmark or District Designation: Chapin Park LHD Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE: The home is a two storey with a square floor plan set upon a brick foundation. The roof is hipped with a central gable dormer covered with asphalt shingles. There is a full width front porch with full height Tuscan columns, with balusters and with lattice below. The windows are 1/1 double hung. There are two front doors. ALTERATIONS: The house has been vinyl sided and has replacement storm windows. In 1942 the home was remodeled into a 2 family dwelling. The garage was added in 1949. In 1960 a new rear addition was built. COA#2006-0424 documents a complete tear -off and re -roof with asphalt shingles APPLICATION ITEMS: Replace awning windows with double hung 1/1; a complete replacement of the current windows. DISCRIPTION OF PROPOSED PROJECT:, The homeowner wishes to replace two awning style windows, one on the west and one on south side, in his 1960 addition to the rear of his house with vinyl double hung windows to match the other double hung windows of the house. He proposes custom made Champion windows 1/1. STANDARDS AND GUIDELINES: C. WINDOWS AND DOORS Window and door frames are in most cases wood and vary depending upon the style of the home. Many are double hung windows with wood trim and sills. Brick structures have stone sills and brick lintels. In some cases where aluminum siding has been applied, the window and door trim has been covered. About half of the structures in the district have aluminum storm windows; the other half have wood storm windows. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood storm windows and doors painted or finished to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original 3 materials, design and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used, they should be of canvas material. Prohibited Original doors, windows, and hardware shall not be discarded when they can be restored and reused in place. New window and door openings, which would alter the scale and proportion of the building may not be introduced. Inappropriate new window and door features such as metal, vinyl or fiberglass awnings, hoods or aluminum insulating glass combinations that require removal of original windows and doors, shall not be installed. Not Recommended Fake shutters that would detract from the existing character or appearance of the building should not be used. STAFF RECOMMENDATION: Staff recommends approval. The Champion 1/1 double hung windows replacing the only awning style windows in a non-contributing rear addition to the house that is not visible from the street. STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Date: August 28, 2009 Application Number: 2009-0828 Property Location: 1041 Riverside Drive Architectural Style/Date/Architect or Builder: Free Classic/ 1907/Unknown Property Owner: Kathy Smarrella District Designation: Riverside Drive Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE Fred W. Keller built the Free Classic at 1041 Riverside in 1907. The house is 2'/z storeys with a square plan set on a concrete block foundation. The roof is hipped with gable projections and returns and is covered with asphalt shingles. The windows are double hung 1/1 and there is a bay window on the first floor of the north facade. The house was built with wood siding and shingles and has a brick chimney. The house is oriented to the northwest on Riverside Drive. ALTERATIONS: The house was aluminum sided before 1985 and the survey card notes that all of the window sills and lintels were removed except those for the bay window. The window surrounds on the front second storey windows appear to be original. A rear addition with a one storey, hipped roof with aluminum siding to match house was approved by the HPC on August 4, 1986. The house was re -roofed in March, 2006 APPLICATION ITEMS: Replacement windows on first and second floors 18 total. Double hung wood windows (Marvin Insert) per document cited below: Proposed Work: Replacement (not inokind) 1. Description of Proposed Work: window replacement The windows with proposed changes at 1041 Riverside Drive consist of: 4 ❑ First floor, front room: 5 double hung wood windows with aluminum storms (request to replace all windows and sashes) ❑ First floor, back (dining room & kitchen): 5 double hung wood windows with aluminum storms (request to replace all windows and sashes) ❑ Second floor, front and back: 8 double hung wood windows with aluminum storms (request to replace all windows and sashes) The owner met with five different contractors to explore options for repairing and replacing the windows. Please note the letter from Christopher Kohler of Kohler Home Improvement, who has a specialization in window restoration/replacement (Appendix 1) that states that the windows need to be replaced. Based upon these consultations, the owner herein request to replace these 18 windows (of the 25 total in the home) with Marvin Inset windows in order to: 1)improve energy efficiency in the home (which is currently not efficient at all); achieve functioning windows that can be opened and closed easily and provide proper ventilation for the home; 3) replace windows that are currently in a state of disrepair (cracked wood/frames, broken cords, windows that no longer fit well into the window frame). In addition, please note that the house is considered "non-contributing" in this historic district, and is currently covered with aluminum, siding. 2. Materials to be used The windows are to be replaced with Marvin Inset wood windows, brochures for which are located in Appendix 2. The windows will be replaced with Marvin Ultimate Insert Double Hung wood windows, which feature low emissivity argon insulating glass, traditional sash locks, primed wood (pine) interiors, and extruded aluminum clad exteriors. The existing screens and storms will stay on the exterior of the windows. 3. Construction Methods Current windows will be removed, but all window frames will remain undisturbed. The Marvin Insert wood windows have a frame -in -frame design that allows them to fit directly within the existing openings. All windows will be custom made due to the dimensions of the existing windows. Frame -in windows will be installed with proper perimeter insulation and sealing. Exterior aluminum custom formed casing white trim will be provided on the windows where necessary. DESCRIPTION OF PROPOSED PROJECT: As detailed above the original window are to be removed and replaced with 1/1 aluminum clad pine wood Marvin Inserts. The current storm/screen windows will remain. The proposed replacement windows will be installed on the interior of the house and replace the entire window frame and sashes of each window. The wood Marvin Inserts will alter the window opening by increasing the size of the sashes Y2" on each side and VV on the top and bottom of each sash. The frame will sit on the existing sill adding an additional sill. This last item may not be as noticeable from the street since the permanent aluminum double track storm/screen combination windows will remain. STANDARDS AND GUIDELINES: C. STAFF RECOMMENDATION: The house was originally rated as non-contributing and is described as such in the Riverside Drive Standards and Guidelines. This is mainly because of the aluminum siding and the lack of architectural features. Staff concurs with that original finding of non-contributing given the overall housing fabric of the Riverside Drive LHD. The Preservation Specialist was on the site during the homeowner's lunch hour. Based on his exterior inspection he believes the windows can be repaired; and offered to inspect and to show the homeowner how to open the windows from the interior at the homeowner's convenience. A time and date for that interior inspection was not set. The Preservation Specialist also alerted the homeowner to the possibility that when the aluminum siding was installed the windows were not caulked and that installing new windows may not resolve the heating cost issues. Staff recommends approval of the replacement windows on the sides and rear of the house. Staff recommends that the first floor bay and single window and the second floor bedroom windows be either restored or use the less invasive and noticeable sash kits by Marvin- the tilt packs with jamb liners. This would be accomplished with consultation between the Preservation Specialist, Christopher Kohler, Director and Kathy Smarrella. The entry is a single gable canopy with pedimented with arch under. ALTERATIONS: The house has aluminum siding and storm windows. There is a one storey east wing addition. There is a 2 story gable roof rear wing addition that was built in 1930. COA#2006-1113 documents the replacement of 8 south facing windows a one east second floor window with Crestline's Crestfit Vinyl Clad wood pocket replacement windows 6/1. APPLICATION ITEMS: Install Crestline exterior clad pocket windows, same as front that were replaced, approved Nov, 2006. Save windows as before. The house is set upon a concrete block foundation. The walls of the house are wood shingle with board trim. The roof is a high hip has a right gable projection with gable returns. The roof is covered with asphalt shingles. There is a full width front porch with shingled posts and walls. The windows are 1/1 double hung. There is a nine pane attic window in the gable. The two stall garage has wood flush siding and low hipped roof, there are 2/2 windows on both the east and west side; a pair of restored original sliding doors,on the east stall and an overhead door on the west stall opening. ALTERATIONS,: The aluminum storm windows have been added on the house. In 2003 the entire garage was repaired and restored (COA42003-0515-2). The overhead door on the garage is a replacement. The walls are wood shingles and the gabled roof has asphalt shingles. There is an enclosed front porch 12 with narrow single pane windows; the windows on the house are 1/1 double hung with aluminum storms; there is a pair of casement dining room windows. ALTERATIONS: The front porch was enclosed with a bank of windows above the knee wall. There are replacement storm windows. A new front storm door, replacement gutters and foundation re -painting were approved by the Commission in February 2004. The window shutters noted on the 1985 survey card have been removed. The original siding and trim have been removed for lead abatement and new wood siding and trim to match the original was approved to be installed in COA 2009-0529. APPLICATION ITEMS: 8 windows to be replaced (all other windows have been replaced). Due to rotting/decay most of these windows are beyond repair and are lead painted. Ones that could be repaired have no insulation value and repair cost would double. DESCRIPTION OF PROPOSED PROJECT. The COA application is for complete window replacement because of deterioration and for lead abatement. The windows proposed are four on the west side: the upstairs bath 1/1 double hung, the kitchen window 1/I double hung and a pair of dining room casements windows. The final four windows are across the front of the house on the first storey inside the enclosed porch and all 1/1 double hung windows. The proposed replacements will replicate the style of window, double hung and casement, with Pella wood windows with exterior aluminum cladding. STANDARDS AND GUIDELINES: Edgewater Place: C. WINDOWS AND DOORS Window and door frames are in nearly all cases wood. Brick structures have stone sills and brick lintels; masonry block structures have masonry sills and lintels.. In some cases where aluminum siding has been applied window trim has been covered. About half of the structures in the district have aluminum storm windows, the other half wood storm windows. Required Original windows and doors including sash, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware shall be retained or when deteriorated beyond repair, replaced with duplicates of the existing or original. Recommended Wood frame storm windows and doors, painted to match the existing or original, should be used but should not damage existing frames and should be removable in the future. Most of the original fabric 13 of this home has been removed and is in the process of being replaced in-kind with new wood siding and trim because of the need for lead abatement. The Preservation Specialist did visit the site recently and concurs that the windows are deteriorating, especially in the bathroom. Landmarks: St. Paul's Cemetery On a Motion by Tim HIusczinski with a second by Lynn Patrick a Resolution to designate St. Paul's Cemetery as a local landmark was voted unanimously by the Commissioners. III: Hearing of Visitors Comments from a IVY Tech student in an Historic Preservation course at the Madison campus were heard by the Commissioners. IV: Regular Business A. The minutes from the following meetings were accepted by consensus by the Commissioners: July 27, August 17 and August 21. B. Location Report was reviewed. The 2010 HPC County Budget has not been finalized; the City Grant to HPC is in the City's 2010 budget. C. Staff Reports: The correspondence folder was distributed and it was decided that the HPC would participate in the NNN Arts Cafe on November 1, 2009. Lynn Patrick would be there from 10-2 and Catherine Hostetler would be there from 2-5. The Staff Approved COAs were included in the Commissioners' packets. The Directors Report was distributed. D. Committee Reports The President's Report was distributed along with a revised copy of the membership on standing committees. V. Old Business The Director was instructed to set up a work session with the Commissioners and Attorney to discuss the procedures addressed in Resolution 09-02.
