PUBLIC HEARING:
In the absence of the homeowner, Laura Mallozzi, President Klusczinski
asked for a motion to table COA#2008-1030 until the January 26, 2008
meeting. Staff was requested to send a letter notifying Ms. Mallozzi of
her options to either come to the meeting in January with the bids or to
risk having her COA denied.
On a motion by Linda Riley with a second by David Sassano the ,
Commissioners voted unanimously to table COA 2008-1030 until
January 26, 2008.
There were no visitors or members of the public present.
REGULAR BUISNESS:
President Klusczinski asked that if there were no changes or corrections
to the minutes for the meetings held on November 17, 2008 and
November 21, 2008 that they could be approved by Consensus. The
minutes for both meetings were adopted by Consensus.
The Treasurer's Report was accepted.
STAFF REPORTS:
Catherine Hostetler submitted the Director's Report and the Assistant
Director's Report to the Commissioners. Catherine distributed the HPC
2009 meeting schedule. It was decided to continue to meet on the 13th
Floor Conference Room. There was no report submitted by Legal.

The meeting was called to order at 12:00 p.m. at the offices
of the Historic Preservation Commission of South Bend
and St. Joseph County.
b. Members Present
Linda Riley, Jerry Niezgodski, Todd Zeiger. Mary Jane
Chase was not able to attend.
c. Review of duties of the committee
The duties of the committee were reviewed. They are to
develop a recommended slate of officers for the 2009 year
for adoption by the Commission.

The committee also discussed some possible people to fill
vacant slots on the Historic Preservation Commission. The

City of South Bend is advertising for applicants. The
Mayor has one appointment who is supposed to be a
Republican and the County has one appointment who also
is supposed to be a Republican. Interested candidates
should talk to President Tim Klusczinski,
The slate of 2009 Officers was read. In a motion by David Sassano with a secondby
Linda Riley the 2009 Slate of Officers 'was unanimously approved.

Historic Preservation Commission of South Bend and St. Joseph County
Legal Affairs Committee
December 5, 2008

Review of recommendations of the director for changes to COA rules /procedures
Deadline for submission of COA Application
A general discussion was held regarding issues that are arising with the late submission of
applications for Certificates of Appropriateness. Staff is seeking a solution to provide
adequate time for staff review and due diligence gathering of COA Applications as a
precursor to providing the Commission with data on which to make their decision. Late
applications make it nearly impossible for the staff to complete their due diligence and still
get complete packets out the Commission one week befote'the meeting.
A number of ideas were explored. Consensus was reached that the following four changes
be approved by the Commission as part of our COA Application procedures
1) Applications far a Certificate ofAppropriateness must be submitted to the office of the Historic
Preservation Commission of South Bend and St. Joseph Count by 5. 00p on the first Monday of each
County i c
month. If the In Monday of the month is a Federal or 04 Holiday and the office is ofidalyl closed, then the
deadline will be 5.00 p.m. of the I 't Tuesday.
2) Applications submitted after the deadline may or may not be placed on the next Commission agenda
depending at the discretion of the staff who will determine if a) thea is still sufficient time far staff to complete
the necessary due diligence around the application and provide the Commission with the information prior to
the meeting B) that the application is complete and theirforr received (see below).
3) Applicants submitting a COA application after the deadline will be 1rquitrd to sign a waiver of the
4510 day rule in order for the matter to be placed on the -next agenda.

4) The COA Application be modified to include a line to indicate when The application utas submitted
(Date) at the office. The submitted date nill be different than when an application is considered to be received
An application will considered to be received (and therefore will receive the ofidal COA Number) only when
staff has determined that the application is complete by including all the necessary material as outlined in The
Commission's enabling ordinance. The 45160 dg clocks outlined in The enabling ordinance will only start
once an application is considered received.
Fine for late submission
After careful consideration, it was determined that the ability of the Commission staff or
Commission to establish fine for late submissions is not within the authority as granted to
it under either the Commission's enabling ordinance at either the local or State level.
Fee for special meeting
The notion of instituting a fine or fee for the cost of a special meeting was explored.
Discussion revolved around the notion that the Commission and its staff are bound to serve
the public. Any fee for a special meeting would have to be directly attributable to actual cost
incurred by the Commission outside its normal business. Since none of the Commissioners
receive compensation for their dudes and the office and staff costs remain the same — the
actual attributable cost would be the cost to provide notice in the South Bend Tribune and
perhaps extra postage to mail out the packets. The consensus was that imposing a fine or fee
for special meetings was not a practical solution.
OTHER BUSINESS
It was recommended that the Commission formally adopt the COA application and its
associated language.
After a brief discussion President Klusczinski said that he would entertain a motion to
accept the recommendations and policy changes of the Legal Affairs Committee. -
On a motion by Mary Jane Chase with a second by David Sassano the Commissioners
unanimously approved the recommendations and policy changes of the Legal Affairs
Committee.
Catherine Hostetler then presented the Preservation Specialist Contract for 2009 for the
Commissioners' approval. On a motion by Mary Jane Chase with a second by David
Sassano the Commissioners unanimously approved the Preservation Specialist 2009
Contract.
Larry Meteiver requested that the Commission adopt a resolution to amend their By -Laws to
include the National Alliance of Preservation Commission's Code of Ethics for
Commissions and Staff. The vote would take place at the January 26, 2009 meeting.
On a motion by President I<Iusczinski with a second by Linda Riley the Commissioners
voted unanimously .to place the resolution to amend the by laws on the January 26, 2009
agenda for adoption.

President Klusczinski announced that he had an additional new business item that he would
like to propose and that was to instruct Staff to prepare a National Register Nomination for
Marquette School. After a brief discussion concerning Marquette's local landmark
designation and the benefits of the National Register status President Klusczinski asked for a
motion. On a motion by Mary Jane Chase with a second by Linda Riley the Commissioners
voted unanimously to have the Staff prepare the National Register Nomination for
Marquette School.
Since there was no additional business President Klusczinski entertained a motion for
adjournment. The meeting adjourned at 7:50 p.m.

4th Annual day long seminar of practical preservation solutions for owners of older homes
and buildings.
Audience:
Neighboring CLG staff and commissioners, owners of older homes including local landmarks in a
4+ county radius, anyone interested in do-it-yourself home maintenance and repair projects.
Benefits:
Strengthen the preservation ethic in South Bend/St. Joseph County, as recognized by our
Preserve America Community designation.
Empower home owners to maintain their homes according to at least HPC minimum maintenance
standards (in cooperation with Code Enforcement).
Facility rental fee benefits St. Joseph's High School (site of event).
Catering and other purchased services (printing, promotion, etc.) benefit local economy.
Local vendors and contractors are highlighted- promoting locally owned businesses employing
residents of South Bend and St. Joseph County.
Provide educational content to residents of South Bend and St. Joseph County.

Small group, intensive training on home repair challenges such as window repair, HVAC,
plumbing and electrical matters, taught and organized by HPC Preservation Specialist.

Anyone interested in do-it-yourself home maintenance and repair projects.
Benefits:
Strengthen the preservation ethic in South Bend/St. Joseph County, as recognized by our
Preserve America Community designation.
Empower home owners to maintain their homes according to at least HPG minimum maintenance
standards (in cooperation with Code Enforcement).
Provide educational content to residents of South Bend and St. Joseph County.
Products and supplies are purchased locally, benefiting local economy.
Southhold Awards - Spring 2009
Awards program celebrating notable achievements in preservation, restoration and rehabilitation.
Individuals, companies and entire college architecture classes (ND) have been recipients of
previous Southhold awards.
Audience:
Award nominees, anyone interested in civic or preservation activities
Benefits:
Strengthen the preservation ethic in South Bend/St. Joseph County, as recognized by our

Lincoln Highway Association National Conference — June 16-20, 2009
Partner in the 17th annual national conference celebrating the Lincoln Highway and all of
the historic assets along this famous route. HPC is providing a speaker (by LHA
invitation) for this conference.

Conference is promoted nation-wide so attendees may come from anywhere in the US,
local dignitaries and residents are also invited and encouraged to attend.
Benefits:
Strengthen the preservation ethic in South Bend/St. Joseph County, as recognized by our
Preserve America Community designation.
Provide educational content to residents of South Bend and St. Joseph County.
Celebrate our unique local history.
Conference will generate hundreds of thousands of dollars in revenue for the local economy.
Create visibility for South Bend as a destination for heritage tourism.
Promote South Bend's historic assets and unique position on the Lincoln Highway.
Support designation of the Indiana leg of the Lincoln Highway as a Scenic Byway availing federal
grant monies and other project support.

An award program that recognizes outstanding efforts in outdoor d6cor and landscaping in
historic districts or at landmark sites. Nominees are recommended by neighbors, and inspected
by HPC staff for award designation.
Audience:
All residents of local historic districts and landmarks.
Benefits:
Strengthen the preservation ethic in South Bend/St. Joseph County, as recognized by our
Preserve America Community designation.
Celebrate good examples of thoughtful landscaping that helps to beautify South Bend and St.
Joseph County.
Reinforces sense of community among residents of historic districts and landmarks.
National Preservation Institute Workshop — September 15-17, 2009
A three day workshop for preservation professionals on historic cemetery preservation and
maintenance.
Audience:
Workshop is promoted nation-wide so attendees may come from anywhere in the US.
Benefits:
Strengthen the preservation ethic in South Bend/St. Joseph County, as recognized by our
Preserve America Community designation.
South Bend was chosen as the site of this workshop by the National Preservation Institute
located in Alexandria, VA. Our selection as an NPI site, may lead to additional workshops and
seminars being held here.
Facility rental fee benefits St. Paul's Memorial Methodist Church — listed in 2006 on the HPC's Six
at Risk List of threatened historical assets.
Catering and other purchased services (printing, promotion, etc.) benefit local economy.
Attendees are responsible for their own hotel accommodations for their three night stay to the
benefit of the local economy.
Local preservation professionals will be admitted to the sessions free of charge as we are the
host community.
Local parks service staff will have the benefit of the speakers' expertise and knowledge
when visiting local sites.
Create visibility for South Bend as a destination for heritage tourism.
Increase awareness of urgent need to protect historic assets.
Other notes:
Current partners include: National Preservation Institute, St. Paul's Memorial Methodist
Church and the Schuyler Colfax Chapter of the DAR.
Continuing Outreach Efforts:
Quarterly Newsletter
In 2009, efforts will be made to deliver newsletter content entirely online and by email,
reducing mailing and printing costs without sacrificing service to our districts and
landmarks.
Contractors List
The HPC maintains a list of responsible, qualified contractors in Michiana. Language on
the list reiterates that the listed contractors are not sanctioned or endorsed by the HPC but
are known to the HPC through previous projects in districts and landmarks. Lists are
distributed by request to anyone that contacts our office.
Benjamin Moore Paint Program
This computer program is available by request to test out color schemes and paint
applications before a costly paint purchase. Although the HPC has no purview over paint
colors or techniques, the program is still a valuable resource for homeowners
contemplating exterior painting.
Open Office Hours
The archives and library of the HPC are open to anyone researching their home or
conducting genealogy investigations. Staff is available to consult or assist as needed.
On Staff Preservation Specialist
Preservation Specialist is on staff to provide guidance to homeowners seeking advice on
projects, or needing referrals to contractors or specialists. Site visits and consults
scheduled at the convenience of the caller, and are free of charge.

In-house National Register Preparation
HPC staff prepares and submits National Register nominations on behalf of both private
and public owners of significant structures in South Bend and St. Joseph County.
Historic Sites and Structures Inventory
The HPC collaborates with Indiana DHPA and Historic Landmarks Foundation of
Indiana to conduct architectural surveys of significant structures in both South Bend and
St. Joseph County and then editing and distributing the published inventory.
HPC Gift Items
The HPC has partnered with local businesses and artists to provide a few gift items for
purchase. Proceeds are used to order additional product and for program planning and
other HPC projects.

A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF
SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA
AMENDING THE COMMISSION'S BY-LAWS AND
ADOPTING THE NAPC CODE OF ETHICS
WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County,
Indiana (the "Commission') exists and operates under the provisions of ordinances enacted by the
Common Council of the City of South Bend, Indiana, and the County Council of St. Joseph County,
Indiana; and
WHEREAS, the Commission is empowered to adopt and has adopted By -Laws governing the
conduct of the Commission and of the Commissioners; and
WHEREAS, Article 10 of the By -Laws provides the appropriate procedure for amending the
By -Laws which requires that approval must be made by a vote of a majority of the Commissioners
voting at a regular or special meeting of the Commissioners attended by all of them, provided that no
such action shall be taken at a meeting of the Commission attended by less than all of the members
unless the members are given at least ten (10) days notice of the substance of the proposed action to
be taken at the meeting. The proposed amendment shall be introduced at one meeting and shall be
acted upon at the next regular meeting or a special meeting called within at least ten (10) days notice;
and
WHEREAS, The National Alliance of Preservation Commissions (NAPC) is the only
organization devoted solely to representing the nation's preservation commissions and its mission is
"to build strong local preservation programs through education, advocacy and training"; and
WHEREAS, as part of that mission, the NAPC has developed a Code of Ethics to promote
and maintain the highest standards of honesty, integrity and professionalism among the
commissioners and staff who serve their communities through preservation commissions; and
WHEREAS, The Commission endorses this Code as the ethical benchmark to which all
its members should aspire; and
WHEREAS, it is desirable that the By -Laws be amended to adopt the NAPC Code of Ethics
as the guideline for the ethical conduct of the Commission, its members and staff.
NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION
COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY AS FOLLOWS:
Section 1. ' A new section of Article 2 shall be added to read as follows:
ARTICLE 2
Section 3. Code of Ethics. - The following National Alliance of Preservation Commissions
Code of Ethics is adopted as the guideline for the ethical conduct of the members and staff of the
Commission:
a. Responsibility to the Community
The most effective historic preservation takes place locally, and all preservation
commissioners and staffshould remember that it is their duty, as public servants, to advance
the greater good of the community.
1. Commissioners and Staff should be advocates for the community's heritage resources,
striving to protect their integrity while recognizing the rights of citizens, individually and
collectively, to their beneficial use and enjoyment.
2. Commissioners and Staff should promote public awareness, appreciation, access and
support for the preservation of heritage resources.
3. Commissioners and Staff should develop standards and guidelines that are appropriate
for the resources and protect the community's unique character, environment and quality of
life.
4. Commissioners and Staff should respect the diversity of heritage resources that may hold
different meanings for various groups and communities.
5. Commissioners and Staff should respect the public's right to know by providing full,
clear and accurate information and observing both the letter and spirit of open meetings and
open records laws.
6. Commissioners and Staff should provide opportunities for meaningful public
participation in the work of the commission.
7. Commissioners and Staff should make timely, fair, informed and impartial decisions that
guarantee citizens' rights to due process and equal protection under the law.
8. Commissioners and Staff should be sensitive to the interrelatedness of their decisions and
the long-term implications for the resources and the community.
9. Commissioners and Staff should seek compromises or search for alternatives where
necessary to achieve overall preservation goals and provide substantial justice for citizens.

10. Commissioners and Staff should recognize that the historic built environment changes
over time and encourage new development that respects the historic character and fabric that
preceded it.
11. Commissioners and Staff should continually evaluate and update their plans, ordinances,
standards, guidelines and procedures to ensure they meet the community's current and future
needs.
12. Commissioners and Staff should always strive to make decisions that are in the best
interest of the community.
b. Responsibility to the Profession
Preservation commissioners and staff are drawn from many disciplines and backgrounds.
The common thread that joins them is their interest and commitment to preserve heritage
resources in their communities. A multi-disciplinaryprofession has developed over the years
from the historic preservation movement, and commissioners and staff have an obligation to
advance the best interests of this profession in the context of their commission .work.
1. Commissioners and Staff should be mindful that they are representatives of the greater
local, state and national preservation community and conduct themselves in a way that brings
credit to their commission and the profession.
2. Commissioners and Staff should share their knowledge and experience and contribute to
the development of other colleagues, particularly newly appointed commissioners, students
and interns.
3. Commissioners and Staff should actively promote heritage preservation and strive to
increase the involvement of underrepresented groups.
4. Commissioners and Staff should support through their memberships and other
contributions organizations that promote heritage preservation.
5. Commissioners and Staff should work collaboratively with related professionals and
professional organizations whose actions also affect heritage conservation including, but not
limited to, planners, code officials, architects, landscape architects, archaeologists, attorneys,
realtors, and developers.
6. Commissioners and Staff should treat fairly and comment responsibly on the professional
views of colleagues and members of other professions.
7. Commissioners and Staff should render all practicable assistance to other colleagues and
organizations in an emergency when heritage resources are at risk.

8. Commissioners and Staff should acquire a depth of knowledge that will enable them to
explain to others the role of heritage preservation in a complex, modern world.
9. Commissioners and Staff should recognize that the field of heritage preservation is
constantly evolving and actively pursue continuing educational opportunities in order to
maintain, refine and enhance their capabilities as practitioners.
c. Standards of Professional Conduct
As public servants, commissioners and staff are expected to conduct themselves in
accordance with the law. These standards set forth both a baseline for such legal conduct as
well as aspirational goals for ethical behavior that may require a conscientious effort to
attain.
1. ,Commissioners and Staff should thoroughly understand the legal framework of heritage
preservation and consistently operate within the bounds of their authority and responsibility
under the law.
2. Commissioners and Staff should treat all citizens fairly, impartially and with respect, and
refrain from discrimination or harassment of any kind.
3. Commissioners and Staff should not accept gifts or favors under any circumstances
where it might appear that acceptance could influence their judgment.
4. Commissioners and Staff should disclose all personal or financial advantages that might
accrue to them, their business interests or family members either directly or indirectly from a
recommendation or decision.
5. Preservation Commissioners and Staff who have an actual or apparent conflict of interest
in a matter coming before them should recuse themselves entirely from deliberations and
decisions.
6. Commissioners and Staff are obligated to utilize their knowledge and experience to make
decisions and therefore should abstain from participating and voting only in cases of a bona
fide conflict of interest.
7. Commissioners and Staff should not disclose confidential information obtained in the
course of their duties, except as required by the law, or use confidential information to
further a personal interest.
8. Commissioners and Staff should not abuse their office by advancing an agenda that is not
in the best interest of the community or heritage preservation.

9. Commissioners and Staff should seek the advice of colleagues or other professionals on
matters that fall outside their expert knowledge or competence.
10. Commissioners and staff should be consistent in their actions and recommendations,
treating similarly situated properties similarly and providing clear explanations when
different treatment is required.
11. Commissioners and Staff should reveal illegal conduct on the part of other
commissioners, staff, officials, applicants or their representatives to an appropriate higher
authority.
12. Commissioners and Staff should not participate in deliberations or decisions without
adequate preparation and knowledge of the matter before them.
13. Commissioners and Staff should avoid dishonesty, never misrepresenting facts or
distorting information to achieve a desired outcome.
14. Commissioners and Staff should recognize the uniqueness of heritage properties,
applying preservation theories, methods, and standards appropriate to each particular case.
15. Commissioners and Staff should be sensitive to ethical issues and ensure they are raised,
critically analyzed and addressed by the commission and other appropriate authorities.
The members and staff of the Commission shall strive to adhere to this Code of Ethics.
Section 2. This Resolution shall take effect immediately upon its adoption by the
Commission.

Spoke with Sean Coleman, SJC Treasurer and offered HPC staff
assistance with year end tax payments. Assistant Director, Amy
Minnick, helped with the phones for two days over the lunch hours.

PUBLIC HEARING
COA#2008-1030. The homeowner Laura Mallozzi presented a sample of the vinyl
simulated wood shake siding now being proposed for the encapsulation of her house for
lead abatement. This product resembles the original siding application on her home. She
also requested bids from six painters for the painting of the exterior of her home. She
received only one response from Leo Burke of Burke's Painting and Power Washing with a
price of $5,800.00 for scraping and the spraying of one coat of paint. Ms. Mallozzi submitted
a letter from Charles Mc Mannis, South Bend Housing Authority Director of the Lead
Grant, that stated that the HUD lead grant program does not include payment painting the
exterior of the homes, only vinyl siding. The garage is being considered but Ms. Mallozzi did
not specifically ask for it in the lead grant but she thought that it would be scraped and
painted. Since the petitioner did not have a clear idea concerning the installation and
application process of the siding and the type of windows that were being proposed for
replacement President Klusczinski requested a motion to continue the COA #2008-1030
until the February 23 meeting. On a motion by Mary Jane Chase with a second by Jerry
Niezgodski the Commissioners voted unanimously to Continue COA#2008-1030 until
February 23, 2009. Staff was instructed to follow up.with Charles Mc Mannis with a list of
the Commissioners questions and concerns.
REGULAR BUSINESS:
President Klusczinski stated that unless there were any corrections to the December 15,
2008 Minutes that the minutes be approved by Consensus. The minutes were approved by
Consensus.
Treasurer Mary Jane Chase presented the Treasurer's Report/Location Report.
The Correspondence folder was examined. The Staff COA Approval Report for the
fourth quarter 2008 and the Annual Office Activity Report for 2008 was distributed. The
Director's Report along with the 2009 Outreach Programs was distributed. The Assistant
Director's Report was distributed. Amy Minnick also drew the Commissioners' attention
to the National Preservation Institute 2009 Brochure in which the HPC was noted as the
host agency for the September 17 Cemetery Landscapes Seminar.
Under Legal, Larry Meteiver distributed a copy of the NAPC Code of Ethics that was
incorporated verbatim into Resolution 09-01 for the Commissioners to vote on to adopt as
Section 3 to the Commission's By -Laws under Article 2.
President Klusczinski did not have a President's Report. He did state that the 2009
Committee Assignments would remain as they were in 2008.
Amy Minnick distributed a working copy of the March 13 In -Service and March 14 Restore
Michiana. The RSVPs have been gratifying for the In -Service and included the executive
level of both cities governments and their key people. The Web -Sight is also up and
running. The Restore Michiana Workshops are counted as CLG training sessions and CLG
credit would be given for the In -Service.
OLD BUSINESS
President Klusczinski sponsored Resolution 09-01 for adoption into the Commissions By -
Laws. On a motion by Timothy Klusczinski with a second by Mary Jane Chase Resolution
09-01 was unanimously approved.
NEW BUSINESS
Catherine announced that she had received communication from Rhonda Saunders Baker
stating the Grand Rapids, Michigan will be the location of the NAPC Forum scheduled for
July 29 -August 1, 2010 with requests for consideration for donations and/or sponsorships.
She also read Drane Wilkinson's e-mail concerning the event.
President Klusczinski requested that Amy distribute the list of potential and confirmed
donors for Restore Michiana Events; because some of this funding is from the private sector
he felt that the Board consider whether or not to accept it and under what conditions.
During the course of the discussion President Klusczinski disclosed that he is on the Board
of CPI which may be a donor to Restore Michiana. There was also a discussion concerning
the need for a signed Disclosure Statement/Agreement with private sector stating that the
donor would not expect preferential treatment from the HPC. It was stated that Restore
Michiana co-sponsor HLFI collects and accounts for all the donations and all of the fees.
The chair then entertained a motion " to accept the listing of the donors in the amounts
specified for Restore Michiana under Historic Landmarks Foundation of Indiana in
partnership with Historic Preservation as we have had a proper declaration at this meeting
and we have no apparent conflicts of interest in receipt of the money". David Sassano
moved that President Klusczinski's language for motion be accepted, with a second by Mary
Jane Chase the Commissioners voted unanimously to approve the motion.
On a motion by David Sassano with a second by Mary Jane Chase the Commissioners voted
unanimously to Adjourn at 8:00.
