Wayne is a two , storcy frame home with a brick fiicade on the first storey and vinyl "clapboard" siding on the second storey and the remaining three sides of the house.. The house has a rectangular plan. The gable roof is covered with asphalt shingles and simple raking trim. The first storey has a large front picture window with double 4 light casements in wood frames with limestone sills. There are paired 4 light casements on the 211d floor. There is a side brick chimney. The entry has a shed canopy supported by turned wood columns and railings set upon a concrete stoop. There is one storey gable roof side wing. There is a detached garage with siding and a gable roof with asphalt shingles. C� ALTERATIONS: The wrought iron posts and railings have been replaced with wood. The vinyl siding on the three sides of the house and second storey on the front of the house as well as the vinyl wrapping of all of the windows have been added. APPLI ITEMS: 15 solid vinyl replacement windows (15 openings). We are not modifying any openings. Large picture is NOT included. The grids/muntins will be colonial style, nothing matches our current pattern nor can we get anything to match per contractor. The goal of the project is to: I Increase the individual 5 sq ft opening of the windows (Fire Hazard for the second floor). The windows are not easy to open, the storms and screens are held into place by 4 screws that require pliers and a screwdriver to remove. The steel bar in the middle of the window doesn't allow for a larger person to exit quickly. 2. Reduce mold, mildew and moisture on the window pane, sill, jamb and head surrounding interior walls. 3. Insulate windows to increase energy savings and lower heating and cooling bills. 4. Not modify current window openings. 5. Make an Eco-Friendly choice with a vinyl product. Because vinyl never needs to be painted, it helps eliminate paint, stain and other maintenance- related products form entering the waste stream or releasing volatile organic compounds into the atmosphere. Also, vinyl resin is derived largely from common salt- a sustainable and abundant natural resource. Source: "A Clear View: Vinyl Window and the Environment" DESCRIPTION OF PROPOSED PROJECT: The homeowners wish to completely replace all of the metal casement windows in the home with solid vinyl double hung windows from Richards Building Supply Company to approximate the muntin pattern of the original windows. Insulate the jambs, install 13 new double hung window units, install I new pre mulled combination DH-P-DA Window Unit to be 25- 50-25; Install I new twin, premulled double hung window unit; all new window units to have colonial muntins, both lights, excluding only picture window units; install new wood blind stops to inside; re-wrap all outside casings and sills with new aluminum. The proposed windows will have flat muntins between the panes of glass. STANDARDS AND GUIDELINES: Fast Wavue Street: C. WENDOWS AND Molts Window and door frames are of wood or steel (some casements) or in the case of brick structures, stone sills and brick lintels. Where metal or vinyl siding has been applied, window trim has been covered. Storm windows are of wood or aluminum. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware, V'hen deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors painted to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and re -used in place. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features such as aluminum insulating glass combinations that require removal of the ori6nal windows and doors shall not be installed. Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOINUMENDATION: The casement steel windows have clearly deteriorated on the interior. The Preservation Specialist feels that the casements windows could be re- conditioned and fitted with invisible interior storms. The homeowner has complied with the Commissioners' request to address their concerns about the use of the two panel slider as an egress and has detailed where each of the replacement windows would be located. The homeowner has demonstrated that the replacement windows will replicate as closely as possible the current windows. The exceptions are the double hung window proposed for the west side lower level and the sliding window for cast side lower window replacement option. The double hung window will be located in the rear of the house and not visible from the street. The homeowner stated that sliding window proposed on the cast louver level is the closest to what can be clone for an operational window without going to a casement for $ 1500.00 and that this window is partially obscured by trees and bustles. WAIVER OF STATUTORY TIME PERIOD FOR CERTIFICATE OF APPROPRIATENESS - WHEREAS, county and city ordinances require the Historic Preservation Commission of South Bend and St. Joseph County (the "Commission!) to consider my application for a certificate of appropriateness within forty-five (45) days after its filing; and WHEREAS, the county and city ordinances require the Commission to issue a denial, if they choose to do so, within sixty (60) days of receipt of my application; and WHEREAS, the undersigned, as applicant, has requested that the Commis . sion delay its decision on my application. Schmiedeler and Renee Marie LaReau Landmark or District Designation: East Wayne Street Rating: Significant DESCRIPTION OF STRUCTURE/ SITE: This two storey brick Renaissance Revival home has the original tile roof and features brick quoins, Corinthian columns between the front arched windows, leaded glass windows flank the decorative doorway molding. See Photo #1 ALTERATIONS: The side porch was enclosed and the garage added around 1951. There are aluminum storm windows and storm door on front of house and five replacement fixed single pane windows. In 2008 per COA #2008 -0904, 9 double hung windows, 5 vinyl picture windows and 1 hinged wood window were replaced with Marvin Insert wood windows; 3 double hung front second storey windows were replaced with Marvin wood sash -pacs and the front storm door was replaced with a Larson full view storm un almond. APPLICATION ITEMS: Demolition of swimming pool in backyard. Fill with sand and topsoil. Remove section of fence from garage to the rear of the house along the driveway. Neither the fence nor the pool is original to the property or visible from the street. DESCRIPTION OF PROPOSED PROJECT: Per attached detailed explanation the homeowners wish to have.Foegley Landscape, Inc. remove the non - original swimming pool at the rear of the house and return that space to lawn retaining the brick paver surround. The also wish to remove the non - original deteriorating stockade style fence between the house and garage. Foegley will remove all debris from site. STANDARDS AND GUIDELINES: B. BUILDING SITE LANDSCAPING AND ACCESSORIES Individual properties in the district are characterized by a house located in the center of a flat lawn, often divided by a walk leading to the front entrance. Several of the residences are sited on two or more building lots; however, the preponderance of the homes have been erected on a single lot. Most of the properties include a double garage, usually located at the rear of the property. The majority of garages are accessed from straight driveways leading from the main thoroughfare, while a few are accessed from the alley. There are also a few homes with a covered carport located at the rear of the property, as well as a few with circular driveways. Driveway and sidewalk materials include concrete, asphalt and brick. All of the properties have trees and most have trimmed shrubbery and/or hedges. Most of the houses conform to a uniform setback line within each block Required Major landscaping items, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Dominant land contours shall be retained. Structures such as gazebos, patio decks, fixed barbecue pits, swimming pools, tennis courts, greenhouses, new walls, fountains, fixed garden furniture, trellises and other similar structures shall be compatible to the historic character of the site and the neighborhood and inconspicuous when viewed from a public walkway. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. Plant materials and trees in close proximity to the building that are causing deterioration to the building's historic fabric should be removed. However, trees and plant materials that must be removed should be immediately replaced by suitable flora. All high intensity security lights should be approved by the Historic Preservation Commission. Prohibited No changes may be made to the appearance of the site by removing major landscaping items, trees, fencing, walkways, outbuildings or other elements before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped. Front yard areas shall not be fenced and fences shall not extend forward beyond the setback line of the house. The installation of unsightly devices such as television reception dishes and solar collectors shall not be permitted in areas where they can be viewed from the public thoroughfare. Not Recommended Telephone or utility poles with high - intensity overhead lights should be installed so that they cannot be seen from the thoroughfare. v, , t STAFF RECOMMENDATION: Staff recommends approval of the removal of the non - original features: the in- ground pool and stockade fencing between the house and garage at the rear of the house and the replacement of the pool with sod. Contractor Address: 52215 Lilac Road City: South Bend Phone: (574) 277 -2424 Current Use of Building: Single Family Type of Building Construction: Brick Proposed Work: Demolition 1 Description of Proposed Work: Backyard In- Ground Swimming Pool De- molition The two -story brick house at -1611 East Wayne Street currently has an in- ground swimming in the backyard, - which is not visible from the street, as shown in Fig. 1. The pool is not original to the property, and the current owners are unsure as to the exact time of its installation. According to neighbors who swam in the pool within the last year or so, the pool is in relatively modern condition. The fence around the entire pool area meets relevant codes. The current owners would like to remove the pool from the backyard for the following reasons: • Return the property to a condition more similar to its original condition without a pool. • Retain use of the backyard as a yard. At present, there is no grass in the backyard. • Eliminate drowning risk to 9- month -old daughter of current owners and other neighborhood children. (Neighbors on either side combine to have 5 children under the age of 6, and neighbors immediately behind have 4 children under the age of 13. Current owners are aware of 5 other children on the block under the age of 6 and several other older children.) • Eliminate expense of maintaining pool. The current owners have secured a quote from Foegley Landscape, Inc. to complete the pool demolition, fill with sand and topsoil, and install of sod. With a Certificate of Appropriateness, current owners will move forward with Foegley Landscape completing the planned work because they see two associated advantages. First, the current owners understand that Foegley has a reputation within the community for doing quality work. Second, having a single contractor handle the entire job reduces opportunities for miscommunications and errors. (a) (b) Figure 1: Two front (south) views of 1611 East Wayne Street showing that the backyard swimming pool and proposed section of fence to be removed are not visible from the street. 2 Materials to be Used As described in Section 1, the only external materials involved in the proposed work are sand to fill part of the pool area, topsoil to fill the top 4 inches of the pool area, and sod. 3 Construction Methods Foegley will remove and dispose of the wood fence sections that stretch from the garage at the back of the property to the back side of the house along the the driveway. This section of fence is not visible from the street, as shown in Figs. 1(b) and 2, and is no longer needed to satisfy relevant codes once the pool is removed. This section of fence is currently in need of repair due to moss and rotting boards as seen in Fig. 2. Foegley will jackhammer the concrete deck surrounding the pool shown in Fig. 3, the bottom of the pool, and the sides of the pool 2 feet below the surface. Foegley will remove and dispose of the fiberglass lining from the interior of the pool. Foegley will deposit the broken concrete into the bottom of the pool and fill the remainder of the pool with sand. Atop the sand, Foegley will topdress the pool area with topsoil to a depth of 4 inches. Atop the topsoil, Foegley will install sod. North Shore Architectural Style/Date /Architect or Builder: Non - Applicable Property Owner: City of South Rend Landmark or District Designation: West North Shore Rating: Not rated DESCRIPTION OF STRUCTURE/ SITE: The land is located on the south side of the T intersection of Lafayette and West North Shore Drive between the St. Joseph River and W. North Shore Blvd. The site is grass covered with trees and shrub plantings; a metal barricade and a timber pole with directional signage are also present. See - photographs in Exhibit #1 ALTERATIONS: The addition of the man-made materials: barricade timber post with signage. APPLICATION ITEMS: Install a stainless steel single access control cabinet approximately 3'x5' with a small attached radio antenna behind the shrub located behind the timber pole and barricade. DESCRIPTION OF PROPOSED PROJECT: The City of South Bend Public Works Department proposes to install a 3'x5' cabinet to house controls and monitoring devices to regulate the flow of Combined Sewer Overflow toward the sewage treatment plant instead of to the river. The cabinet will be installed on a poured concrete slab behind the shrubbery. See attached project specifications and site plans. STANDARDS AND GUIDELINES: I. THE ENVIRONMENT The West North Shore Drive residential neighborhood from Michigan Avenue to Iroquois Avenue has a distinctive and valuable character. The external appearance of the river and street, homes, and yards communicates and reflects the fact that for over half a century it has been and still is a comfortable residential neighborhood. All of the architectural and charming character of West North Shore Drive has been preserved. The homes are generally architecturally and historically distinctive, large and located on ample lots. A. THE NEIGHBORHOOD AND TIRE RIVER The intimate relationship of the St. Joseph River to this residential neighborhood and to each individual home should be preserved. At present residents, visitors, and passers -by drink in the delights of the River - its Swift, unimpeded current, its substantial breadth and its banks of verdant natural growth. The erection of high walls or other artificial barriers to the enjoyment of the scenic River must be prohibited. Parking on the river side of North Shore Drive must be prohibited. If erosion control efforts become necessary to preserve the river banks, they must involve processes and material consistent with natural beauty of the banks. Poured concrete, concrete slabs, concrete building blocks or other unsightly material must be avoided. The development of boat landings, access points, scenic overlooks, or terraces should be done in such a way as to preserve the natural beauty of the river and banks. Grass clippings and leaves should be placed on the bank so as to induce building up the bank. They must not detract from the beauty of the bank. Unsightly brush and weeds must be eliminated. Dead or diseased trees and branches should be removed. STAFF RECOMMENDATION: Staff recommends approval. The proposed stainless steel cabinet will be installed on a concrete pad in an area that is below street grade and further shielded from view by a large bush. For this project, ten (10) CSO diversion structures have been prioritized for upgrade and improvements that include actuated regulator valves on the CSO throttle pipes. The valves are integrated through a computerized CSONet system that will modulate the valves to the best utilize the City's combined sewer system for each particular storm event. The system will regulate flow to the interceptor much like traffic signals regulate traffic flow on streets. The result is that, instead of being discharged to the river as CSO, more flow will reach the treatment plant and water quality impact of CSOs in the St. Joseph River will be reduced. CSO 025 Location — North Shore Historical District One site is located in the North Shore Local Historic District at the intersection of North Shore and Lafayette. Most of the work for this project will be below ground however we will need to install a control cabinet and a small radio antenna along the south side of North Shore. The control cabinet will be made out of stainless steel and will be located at the intersection of Lafayette and North Shore on the south side. The location of the cabinet is shown on the site plan. There is an existing bush that we would used to hide the cabinet. This control cabinet will housie the telemetry and control equipment for the pinch valve that will be installed below the street. This site would was selected because of the existing vegetation that could be used to obscure the view of the control cabinet. This bid opening for this project is scheduled for August 24, 2009. 15. Wire bundles between subpanels and front panel mounted devices shall be anchored and protected from damage by opening and closing of the panel door. 16. No front panel mounted device requiring operator manipulation (e.g. pushbutton, hand switch, controller) shall be located higher than 66- inches above finished floor or grade. 17. Panel shall have a blank lockable front panel door. Devices shall be mounted on a swing out panel directly behind front door. 18. Panduits located on either side of terminal strips shall have a minimum clearance of 1.5- inches between the panduit and terminal strip. 19. An easily accessible pocket built into the panel door shall be provided to enclose the "As Built" panel wiring diagrams. 20. Panels shall be UL approved. 21. Control panels located in field shall be NEMA 4X rated and shall have the following features: a. Panels shall be Type 316L stainless steel construction with a minimum thickness of 12 -gage for all surfaces (except those areas requiring reinforcement) having a smooth brushed finish. b. Stainless steel screw clamp assemblies on three sides of each door. c. Rolled lip around three sides of door and along top of enclosure opening. d. Hasp and staple for padlocking. Provide stainless steel padlock. Coordinate keying requirements with Owner. e. Panel shall be white polyester urethane powder coated, from the factory, to reduce solar heat load. B. Identification: 1. Provide laminated plastic nameplate for identification of panels. Use self - tapping stainless steel screw for fastening. In instances where self - tapping screws may degrade the panel NEMA rating, the NEMA rating shall be retained through the use of gaskets on both sides of the panel surface and the use of a retaining plate on the panel back that is of identical size to that of the nameplate. In this case, full penetration screws with nuts shall be used. 2. Panel identification nameplates shall have 1/2 -inch high letter engravings. 3. All front panel mounted devices shall be identified with nameplates engraved with the functional description of the device. Nameplate engraving shall be in accordance with the identification provided in the contract drawings 4. Tag all electrical components and devices mounted within control panels with high adhesive labels. 5. All terminal strips shall be identified with nameplate engraved as "TB -XX" where `XX' is the numerical identification of the terminal strip. 6. All terminals within the terminal strip shall be identified with sequential numbers and wire numbers. 7. All internal panel wiring shall be color coded and numerically identified with unique wire numbers affixed at both ends. The windows are 4/4 double hung, paired with wood casings and original storms. There are eyebrow wall dormers at the second floor in the front and rear of the house. There are brick chimneys at either end of the main portion of the house. The Entry has a steep gable roof; plain rake board articulated at the eaves ends with exposed rafter tails, simple entablature detail and iron balcony railing above entry door. There is a south side shed roof wing with paired double hung arched windows flanked by attenuated double hung brick header course sills. There is an east side one storey flat roof wing with second floor access door to roof; the rear porch below has a plain round wood support column. The house is situated on a corner lot of Wayne and Twyckenham. (See photo pages 1 & 2) ALTERATIONS: The two car brick garage was built in 1949. The brick half walls between the house and garage may have been added then along with the wrought iron arch way with lantern. The slate roof was replaced with facsimile slate in 2004 along with new copper gutters and downspouts. The wood balustrade on the rear (east) porch was removed after 1987. Limestone landscaping features, patio and pathways in the rear has been added after 1987. An aluminum "wrought iron" fence encloses the yard along the east and south yard. APPLICATION ITEMS: Rebuild brick columns.- Install wrought iron gate. Remove wrought iron arch, and install lanterns atop columns. (See photos 3 & 4) Replace balcony railing. DESCRIPTION OF PROPOSED PROJECT: The homeowners proposes to re -point the brick pillars, install Arroyo Craftsman lantern lighting on top of the pillars after removing the wrought iron arch with pendant lantern. (Located on the west/front of house obscured by trees and shrubbery from the street -see photo page #1) They also propose to install a 36 "x50 +" custom gate (See Illustration #1) either in wrought iron or black powder coated aluminum to resemble wrought iron between the brick pillars. They also propose to re- install a railing around the deck of the second floor rear porch (See Illustration #2). The balustrade is to be crafted from kiln dried lumber (See Illustration #3) using 1 1 /2 "xl 1/2" balusters and an upper railing 3"x2 "x11 /2" set between baluster columns of varied heights and topped with wood or copper pyramidal caps. The balustrade will be painted. STANDARDS AND GUIDELINES: East Wavne Street: D. ENTRANCES, PORCHES AND STEPS Most houses in the district have small open porches at the main entrance. Stoops and small patios also are in evidence. Of those porches that have roofs, many have either hip or gable roofs or are covered by the main roof of the house. Columned porticos, porches with broken pediments or turrets, and other porch forms characteristic of the Period Revival styles are also found in the district. Required 0 Existing or original porches, stoops, patios and steps, including handrails, balusters, columns, brackets, tiles and roof decorations, shall be retained or replaced by replicas of the same design and materials when deteriorated beyond repair. Porches and additions reflecting later architectural styles and which are important to the building's historical integrity shall be retained. Recommended When enclosing porches for heat conservation or for other reasons, it should be done in a manner that does not alter the architectural or historical character of the building. Prohibited Front porches, stoops, patios and steps that are important to the building's style and development shall not be altered or removed. Not Recommended Original porch details should not be replaced with materials representing an earlier period or style from the original. III. NEW CONSTRUCTION New construction includes any new building or structure constructed within the boundaries of the historic district, or any new addition to an existing building. New construction should be designed considering the appearance of the other buildings in the neighborhood. A. HEIGHT AND PROPORTION The majority of structures in the district are two stories high and are square, rectangular, or irregular in plan. There are a few story- and -a -half residences. The prevalent facade proportions are between a 1:1 and a 1:2 height -to -width ratio. Required The height of a new structure and its height -to -width proportions shall be consistent with adjacent buildings in the district. The building height shall be no greater than that of the tallest existing structure and no less than that of the lowest existing structure of the same type in the same block. Facade proportions shall be established by permitting no structure with a facade wider or narrower than those existing in the same block. Additions to existing buildings shall be related in height and proportion to the existing structure. Recommended Contemporary designs should be compatible in character and mood to the building or neighborhood. Prohibited Additions may not be constructed that would change the existing facade of a building, alter its scale or architectural character, or add new height. Not Recommended New stories should not be added, nor should existing stories be removed, which would destroy important architectural details, features or spaces of the building. The house has an asphalt shingle hip roof with gable dormers NvIii Ic the tower in front has a mansard roof with wood shingles. There is a full width wrap around front porch with pared Doric columns on stone piers supporting an entablature with dentils and balustrade. The porch .has a flat rood. The windows are 1/1 double hung and most have segmental arch molded crit abl at tires. The front door is wood with a single leaded light' sidelights are leaded and there is a stained glass transom. (See photo 41) ALTERATIONS: The porch was added in 1901 to reflect the classical revival style in vogue after the Colombian Exposition in Chicago. The metal finials at the comers of the tower have been removed. APPLICATION ITEMS: Reitirbisli/restore./retrofit existing window sashes in () and 11 on second floor as described in annex. Redeliver to job site and reinstall sashes into the original frames. 3. Remove the existing puttyand glass from the sashes. 4. Strip the paint from the sashes. Where caustic chemical strippers are used properly neutralize the wood prior to painting or epoxy reconsolidation to a litnius Ph of 5-8.5. 5. Restore the sash with two part epoxy wood consolidants as necessary and in accordance with specifications and the U.S. liepartment of Interior Guidelines. 6. Wayne is a 2 storey frame construction with a large front shed dormer set on a rectangular floor plan situated on a corner lot. It has a gambrel roof with asphalt shingles and has molded trim on the rake board. The windows are 6/6 double hung. The entry is a single gable canopy with open arch under, entablature and cornice details, supported by square box columns with lattice work and a brick stoop. (See photograph #1) ALTERATIONS: The garage 18 x 20 was built in 1949. Replacement siding (aluminum) was noted on the 1987 survey card also as Altered, Major. The open porch on the north east comer of the house was enclosed in 1995 (COA #1995- 1130); a 700 square foot addition was added to the north side of the house in 2000 (COA# 2000 - 0821). The two center windows on the second storey above the entry's gable are replacement windows. There are aluminum storm windows on the front windows. The louvered shutters noted on the 1987 survey card are no longer there. APPLICATION ITEMS: Replace 2 downstairs and 2 upstairs windows with more energy - efficient windows as close to the original construction as possible. All four windows face Wayne Street. DESCRIPTION OF PROPOSED PROJECT: The homeowners wish to completely replace the four front windows with Pella Architect Double Hung 6/6. These windows are aluminum clad pine with insulated low E Standard glass. The entire window systems will be removed along with the exterior window trims. The windows will be replaced with Pella Architect Double Hung 6/6 windows and use the AZEC composite material to replicate the exterior trim. Dave Waechter of Pella Windows will be present at the meeting with a sample of the proposed replacement window. (See attached diagrams provided) STANDARDS AND GUIDELINES: East Wayne Street: C. WINDOWS AND DOORS Window and door frames are of wood or steel (some casements) or in the case of brick structures, stone sills and brick lintels. Where metal or vinyl siding has been applied, window trim has been covered. Storm windows are of wood or aluminum. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors painted to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and re -used in place. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features such as aluminum insulating glass combinations that require removal of the original windows and doors shall not be installed. Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: Staff has met with the homeowners on site concerning this project. It is the Staff s opinion that the original windows can be repaired and restored as they are not deteriorated beyond repair. The homeowners' preference is to install new. Attended Heather Willis Neal's presentation at the St. Joseph County Library on Indiana's Open Door Policy and how it applies to the HPC. July 29 Meeting with Mr. Bickle for the re- submission of their COA application for replacement windows at 1704 East Wayne. August 3 Meeting with County Commissioner Dave Thomas on current and 2010 Department Budget. On site meeting with Jason Cook of Blue and Gold Homes concerning the removal of the front porch at 326 W. Marion in the Chapin Park LHD. Provided him and the homeowner with the Standards and Guidelines for Chapin Park and advice as to how to reinstall the porch. August 5 Met with Mike Szymanski of the SBCSC Service Department for the submission of the in -kind replacement of the wood doors at Jefferson School. Arranged for permission to review blue prints /architectural drawings for Marquette School at the Service Department. August 6 &7 Vacation Days. August 10 Attended the Finance Committee meeting for the Northern Indiana Center for History; researched the fagade easement for the Oliver Inn, prepared 106 Reviews, on site visits to Jefferson School and 1041 Riverside Drive. August 11 Luncheon meeting and tour with Professor Krupali Uplekar of Notre Dame for possible sites for study for her fall Preservation Class. August 12 Accepted Amy Minnick's resignation as Assistant Director and requested that Queenie Evans, Human Resources Director for St. Joseph County, post the position. Received notification from Patty Godsey, Administrative Assistant to the County Commissioners, that the County Commissioners must approve all job postings prior to their release. August 13 Brief meeting with Jeff Gibney about Downtown development and the LaSalle Hotel. David Relos is being hired on to work on those projects. Also met with Sue Solmos concerning the positioning of our historic neighborhoods within her programs. St. Paul Lutheran Church Cemetery 15697 New Road, Madison Township Proposed Historic Landmark Landmark Nomination Sandy Hochstetler, Secretary and Karl Andrew Brenner, Pastor Loci, cosigned a letter requesting that the HPC consider historic landmark status. The letter is dated May 31, 2009. Location The cemetery property is approximately 250 -300 yards from the intersection of New Road and Rt. 331. The cemetery is located on the south side of New Road, and St. Paul's Lutheran Church is located to the west of the site, on the north side of New Road. Despite this, the church and cemetery share the same address. Per the St. Joseph County Road numbering and address system, 15697 specifically corresponds to the (as it is an odd number) a property on the north side of an east /west road. The 1875 St. Joseph County atlas shows the church and cemetery on Page 69. (Included) Section 22, Township 36N, Range 3E Indiana Historic Sites and Structures Survey Rating The Interim Report published in June 2006 rated the St. Paul Lutheran Church Cemetery as Contributing: 032 C St. Paul Lutheran Church Cemetery; 15697 New Rd.; c.1845- present; Exploration /Settlement, Religion Context The congregation of St. Paul's Lutheran Church began meeting as a religious community in 1846, and was formally organized as a congregation in 1851. Although it is assumed that burials were taking place, records are non existent. The presumption though is that burials began circa 1851 -1854, though the land was not deeded as a cemetery until 1862. The 1875 St. Joseph County Atlas show the plot essentially as it appears today. Church death records begin in 1898. Recommendation The St. Paul's Lutheran Church cemetery is recommended for designation as a Local Landmark based on the following criteria: 1. Its suitability for preservation; and 2. Its cultural and educational value. The cemetery fulfills criteria #1 in that the site is in good shape and the landscape is well maintained. It does not appear that any of the stones are suffering any damage other than typical weathering, although the application to the state registry suggests that they do find occasional vandalism. Also, a recent road improvement project on New Road has some congregants and officials concerned about the cemetery's proximity to the soft shoulder on the side of the road. While landmark status would not specifically dictate set backs or other matters with any future road work, it will allow the F PC and the church a voice in the conversation. The cemetery fulfills criteria #2 in that it is the resting place of a number of prominent families that helped to settle Madison Township. The burials also provide information and context about religious reformation as the burials reflect the time both before and after this German community divided between the Lutheran and Reformed religious communities. The cemetery is also the burial site of several veterans of United States Armed Forces, including veterans of the Civil War. Also, there are a number of other cemeteries in the County that are Local Landmarks and date to a similar time. Wayne is a two storey frame home with a brick fagade on the first storey and vinyl "clapboard" siding on the second storey and the remaining three sides of the house.. The house has a rectangular plan. The gable roof is covered with asphalt shingles and simple raking trim. The first storey has a large front picture window with double 4 light casements in wood frames with limestone sills. There are paired 4 light casements on the 2nd floor. There is a side brick chimney. The entry has a shed canopy supported by turned wood columns and railings set upon a concrete stoop. There is one storey gable roof side wing. There is a detached garage with siding and a gable roof with asphalt shingles. ALTERATIONS: The wrought iron posts and railings have been replaced with wood. The vinyl siding on the three sides of the house and second storey on the front of the house as well as the vinyl wrapping of all of the windows have been added. APPLICATION ITEMS: 15 solid vinyl replacement windows (15 openings). We are not modifying any openings. Large picture is NOT included. The grids /muntins will be colonial style, nothing matches our current pattern nor can we get anything to match per contractor. The goal of the project is to: 1. Increase the individual 5 sq ft opening of the windows (Fire Hazard for the second floor). The windows are not easy to open, the storms and screens are held into place by 4 screws that require pliers and a screwdriver to remove. The steel bar in the middle of the window doesn't allow for a larger person to exit quickly. 2. Reduce mold, mildew and moisture on the window pane, sill, jamb and head surrounding interior walls. 3. Insulate windows to increase energy savings and lower heating and cooling bills. 4. Not modify current window openings. 5. Make an Eco- Friendly choice with a vinyl product. Because vinyl never needs to be painted, it helps eliminate paint, stain and other maintenance - related products form entering the waste stream or releasing volatile organic compounds into the atmosphere. Also, vinyl resin is derived largely from common salt- a sustainable and a bundant natural resource. Source: "A Clear View. Vinyl Window and the Environment " DESCRIPTION OF PROPOSED PROJECT: The homeowners wish to completely replace all of the metal casement windows in the home with solid vinyl double hung windows from Richards Building Supply Company to approximate the muntin pattern of the original windows. Insulate the jambs, install 13 new double hung window units, install 1 new pre mulled combination DH -P -DA Window Unit to be 25- 50 -25; Install 1 new twin, premulled double hung window unit; all new window units to have colonial muntins, both lights, excluding only picture window units; install new wood blind stops to inside; re -wrap all outside casings and sills with new aluminum. The proposed windows will have flat muntins between the panes of glass. STANDARDS AND GUIDELINES: East Wayne Street: C. WINDOWS AND D OORS Window and door frames are of wood or steel (some casements) or in the case of brick structures, stone sills and brick lintels. Where metal or vinyl siding has been applied, window trim has been covered. Storm windows are of wood or aluminum. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors painted to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and re- used in place. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features such as aluminum insulating glass combinations that require removal of the original windows and doors shall not be installed. N Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: The casement steel windows have clearly deteriorated on the interior. The Preservation Specialist feels that the casements windows could be re- conditioned and fitted with invisible interior storms. The homeowner has complied with the Commissioners' request to address their concerns about the use of the two panel slider as an egress and has detailed where each of the replacement windows would be located. The homeowner has demonstrated that the replacement windows will replicate as closely as possible the current windows. The exceptions are the double hung window proposed for the west side lower level and the sliding window for east side lower window replacement option. The double hung window will be located in the rear of the house and not visible from the street. The homeowner stated that sliding window proposed on the east lower level is the closest to what can be done for an operational window without going to a casement for $1500.00 and that this window is partially obscured by trees and bushes. See Photo #1 ALTERATIONS: The side porch was enclosed and the garage added around 1951. There are aluminum storm windows and storm door on front of house and five replacement fixed single pane windows. In 2008 per COA #2008 -0904, 9 double hung windows, 5 vinyl picture windows and 1 hinged wood window were replaced with Marvin Insert wood windows; 3 double hung front second storey windows were replaced with Marvin wood sash -pacs and the front storm door was replaced with a Larson full view storm un almond. APPLICATION ITEMS: Demolition of swimming pool in backyard. Fill with sand and topsoil. Remove section of fence from garage to the rear of the house along the driveway. Neither the fence nor the pool is original to the property or visible from the street. DESCRIPTION OF PROPOSED PROJECT: Per attached detailed explanation the homeowners wisli to have Foegley Landscape, Inc. remove the non - original swimming pool at the rear of the house and return that space to lawn retaining the brick paver surround. The also wish to remove the non - original deteriorating stockade style fence between the house and garage. Foegley will remove all debris from site. STANDARDS AND GUIDELINES: B. BUILDING SITE, LANDSCAPING AND ACCESSORIES Individual properties in the district are characterized by a house located in the center of a flat lawn, often divided by a walk leading to the front entrance. Several of the residences are sited on two or more building lots; however, the preponderance of the homes have been erected on a single lot. Most of the properties include a double garage, usually located at the rear of the property. The majority of garages are accessed from straight driveways leading from the main thoroughfare, while a few are accessed from the alley. There are also a few homes with a covered carport located at the rear of the property, as well as a few with circular driveways. Driveway and sidewalk materials include concrete, asphalt and brick. All of the properties have trees and most have trimmed shrubbery and/or hedges. of the houses conform to a uniform setback line within each block Required Major landscaping items, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Dominant land contours shall be retained. Structures such as gazebos, patio decks, fixed barbecue pits, swimming pools, tennis courts, greenhouses, new walls, fountains, fixed garden furniture, trellises and other similar structures shall be compatible to the historic character of the site and the neighborhood and inconspicuous when viewed from a public walkway. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. Plant materials and trees in close proximity to the building that are causing deterioration to the building's historic fabric should be removed. However, trees and plant materials that must be removed should be immediately replaced by suitable flora. All high intensity security lights should be approved by the Historic Preservation Commission. Prohibited No changes may be made to the appearance of the site by removing major landscaping items, trees, fencing, walkways, outbuildings or other elements before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped. Front yard areas shall not be fenced and fences shall not extend forward beyond the setback line of the house. The installation of unsightly devices such as television reception dishes and solar collectors shall not be permitted in areas where they can be viewed from the public thoroughfare. North Shore Architectural Style/Date /Architect or Builder: Non - Applicable Property Owner: City of South Bend District Designation: West North Shore Rating: Not rated DESCRIPTION OF STRUCTURE/ SITE: The land is located on the south side of the T intersection of Lafayette and West North Shore Drive between the St. Joseph River and W. North Shore Blvd. The site is grass covered with trees and shrub plantings; a metal barricade and a timber pole with directional signage are also present. See photographs in Exhibit #1 ALTERATIONS: The addition of the man -made materials: barricade timber post with signage. APPLICATION ITEMS: Install a stainless steel single access control cabinet approximately 3'x5' with a small attached radio antenna behind the shrub located behind the timber pole and barricade. DESCRIPTION OF PROPOSED PROJECT: The City of South Bend Public Works Department proposes to install a 3'x5' cabinet to house controls and monitoring devices to regulate the flow of Combined Sewer Overflow toward the sewage treatment plant instead of to the river. The cabinet will be installed on a poured concrete slab behind the shrubbery. See attached project specifications and site plans. STANDARDS AND GUIDELINES: I. THE ENVIRONMENT The West North Shore Drive residential neighborhood from Michigan Avenue to Iroquois Avenue has a distinctive and valuable character. The external appearance of the river and street, homes, and yards communicates and reflects the fact that for over half a century it has been and still is a comfortable residential neighborhood. All of the architectural and charming character of West North Shore Drive has been preserved. The homes are generally architecturally and historically distinctive, large and located on ample lots. A. THE NEIGHBORHOOD AND THE RIVER The intimate relationship of the St. Joseph River to this residential neighborhood and to each individual home should be preserved. At present residents, visitors, and passers -by drink in the delights of the River - its Swift, unimpeded current, its substantial breadth and its banks of verdant natural growth. The erection of high walls or other artificial barriers to the enjoyment of the scenic River must be prohibited. Parking on the river side of North Shore Drive must be prohibited. If erosion control efforts become necessary to preserve the river banks, they must involve processes and material consistent with natural beauty of the banks. Poured concrete, concrete slabs, concrete building blocks or other unsightly material must be avoided. The development of boat landings, access points, scenic overlooks, or terraces should be done in such a way as to preserve the natural beauty of the river and banks. Grass clippings and leaves should be placed on the bank so as to induce building up the bank. They must not detract from the beauty of the bank. Unsightly brush and weeds must be eliminated. Dead or diseased trees and branches should be removed. STAFF RECOMMENDATION: Staff recommends approval. The proposed stainless steel cabinet will be installed on a concrete pad in an area that is below street grade and further shielded from view by a large bush. The windows are casements, paired with wood casings and original storms. There are eyebrow wall dormers at the second floor in the front and rear of the house. There are brick chimneys at either end of the main portion of the house. The Entry has a steep gable roof; plain rake board articulated at the eaves ends with exposed rafter tails, simple entablature detail and iron balcony railing above entry door. There is a south side shed roof wing with paired double hung arched windows flanked by attenuated double hung brick header course sills. There is an east side one storey flat roof wing with second floor access door to roof, the rear porch below has a plain round wood support column. The house is situated on a corner lot of Wayne and Twyckenham. (See photo pages 1 & 2) ALTERATIONS: The two car brick garage was built in 1949. The brick half walls between the house and garage may have been added then along with the wrought iron arch way with lantern. The slate roof was replaced with facsimile slate in 2004 along with new copper gutters and downspouts. The wood balustrade on the rear (east) porch was removed after 1987. Limestone landscaping features, patio and pathways in the rear has been added after 1987. An aluminum "wrought iron" fence encloses the yard along the east and south yard. 2 APPLICATION ITEMS: Rebuild brick columns. Install wrought iron gate. Remove wrought iron arch and install lanterns atop columns. (See photos 3 & 4) Replace balcony railing. DESCRIPTION OF PROPOSED PROJECT: The homeowners proposes to re -point the brick pillars, install Arroyo Craftsman lantern lighting on top of the pillars after removing the wrought iron arch with pendant lantern. (Located on the west/front of house obscured by trees and shrubbery from the street -see photo page #1) They also propose to install a 36 "x50 +" custom gate (See Illustration #1) in wrought iron between the brick pillars. They also propose to re- install a railing around the deck of the second floor rear porch (See Illustration #2). The balustrade is to be crafted from kiln dried lumber (See Illustration #3) using 1 1 /2 "xl 1/2" balusters and an upper railing 3"x2 "x11 /2" set between baluster columns of varied heights and topped with wood or copper pyramidal caps. The balustrade will be painted. STANDARDS AND GUIDELINES: East Wayne Street: D. ENTRANCES, PORCHES AND STEPS Most houses in the district have small open porches at the main entrance. Stoops and small patios also are in evidence. Of those porches that have roofs, many have either hip or gable roofs or are covered by the main roof of the house. Columned porticos, porches with broken pediments or turrets, and other porch forms characteristic of the Period Revival styles are also found in the district. Required Existing or original porches, stoops, patios and steps, including handrails, balusters, columns, brackets, tiles and roof decorations, shall be retained or replaced by replicas of the same design and materials when deteriorated beyond repair. Porches and additions reflecting later architectural styles and which are important to the building's historical integrity shall be retained. Recommended When enclosing porches for heat conservation or for other reasons, it should be done in a manner that does not alter the architectural or historical character of the building. Prohibited Front porches, stoops, patios and steps that are important to the building's style and development shall not be altered or removed. Not Recommended Original porch details should not be replaced with materials representing an earlier period or style from the original. III. NEW CONSTRUCTION New construction includes any new building or structure constructed within the boundaries of the historic district, or any new addition to an existing building. New construction should be designed considering the appearance of the other buildings in the neighborhood. A. HEIGHT AND PROPORTION The majority of structures in the district are two stories high and are square, rectangular, or irregular in plan. There are a few story- and -a -half residences. The prevalent facade proportions are between a 1:1 and a 1:2 height -to -width ratio. Required The height of a new structure and its height -to -width proportions shall be consistent with adjacent buildings in the district. The building height shall be no greater than that of the tallest existing structure and no less than that of the lowest existing structure of the same type in the same block. Facade proportions shall be established by permitting no structure with a facade wider or narrower than those existing in the same block. Additions to existing buildings shall be related in height and proportion to the existing structure. 7 Recommended Contemporary designs should be compatible in character and mood to the building or neighborhood. Prohibited Additions may not be constructed that would change the existing facade of a building, alter its scale or architectural character, or add new height. Not Recommended New stories should not be added, nor should existing stories be removed, which would destroy important architectural details, features or spaces of the building. Any style or period of architecture that is incompatible with what exists should not be permitted in the new additions. STAFF RECOMMENDATION: Staff recommends approval. The proposed railing follows the rhythm and scale of the one photographed for the 1987 survey (See photo #5). The Craftsmen design of the railing and the proposed gate and lanterns accentuate the influence of mediaeval and Tudor styles on the Craftsman school of design features of the house in the exposed rafter tails and eye brow dormers. STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Date: August 3, 2009 Application Number: 2009 -0731C Property Location: 710 Park Avenue Architectural Style/Date: Second Empire /1875 Property Owner: Georges Enderle Landmark or District Designation: Local Landmark &Chapin Park LHD/NR Rating: Outstanding DESCRIPTION OF STRUCTURE/ SITE:The Mary Chapin Anderson and Andrew Anderson house is a three storey Second Empire home with an irregular plan. It has a stone foundation with walls of shiplap clapboard siding with corner boards; the entablature has paired brackets. The house has an asphalt shingle hip roof with gable dormers while the tower in front has a mansard roof with wood shingles. There is a full width wrap around front porch with pared Doric columns on stone piers supporting an entablature with dentils and balustrade. The porch has a flat rood. The windows are 1/1 double hung and most have segmental arch molded entablatures. The front door is wood with a single leaded light' sidelights are leaded and there is a stained glass transom. (See photo #1) ALTERATIONS: The porch was added in 1901 to reflect the classical revival style in vogue after the Colombian Exposition in Chicago. The metal finials at the corners of the tower have been removed. APPLICATION ITEMS: Refurbish/restore /retrofit existing window sashes in guestroom I and II on second floor as described in annex. (See also previous restoration in 2008.) Old glasses will be stored in basement. DISCRIPTION OF PROPOSED PROJECT: The homeowner has engaged Replacement Systems International Ltd. who proposes to Refurbish/Restore/Retrofit existing window sashes as follows: 1. Remove the sashes from the frames and label /mark for identification. 2. Pickup of sashes only from the job site and deliver the sashes to our shop. Redeliver to job site and reinstall sashes into the original frames. 3. Remove the existing putty and glass from the sashes. 4. Strip the paint from the sashes. Where caustic chemical strippers are used properly neutralize the wood prior to painting or epoxy reconsolidation to a litmus Ph of 5 -8.5. 5. Restore the sash with two part epoxy wood consolidants as necessary and in accordance with specifications and the U.S. Department of Interior Guidelines. 6. Custom mill new window members /profiles to match existing where needed. 7. Route sash pockets as required and re -glaze with new sealed insulated glass (dual sealed). Prime /seal glass pocket before installing insulated glass. Set glass with beveled wood stops. 8. Weather strip the operating sashes at the perimeter and meeting rails with integral woven pile weatherstripping for maximum air tightness and durability. 9. Install new Samson Red Spot sash cords and furnish additional sash weight ballast to balance additional weight on the insulated glass. 10. Refurbish pulleys/hardware. 11. Prime and finish paint all stripped, restored or new wood. 12. Use Resorcinol or Urethane waterproof exterior glue in all exterior joinery where exterior glues are required. Sash Restoration and Retrofit of six double hung windows on the second floor. Four windows are to be retrofitted with dual pane sealed insulated glass and two windows are to be fitted with Mon -Ray High Performance secondary glazing storm windows in lieu of sealed insulated glass. Upper sashes are to have arch top or half round top glass to match the existing prime window glass. All lower sashes in the six 97" high windows are to be glazed with TEMPERED GLASS to meet safety code. All upper sashes are to have brass pole sockets. The windows are located on the southwest and northwest fagade of the house; the Mon -Ray storms are an interior application that will not be visible from the exterior. (See photographs # 2-4) STANDARDS AND GUIDELINES: CHAPIN PARK STANDARDS AND GUIDELINES: C. Windows and Doors Required: Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods and hardware. The entry is a single gable canopy with open arch under, entablature and cornice details, supported by square box columns with lattice work and a brick stoop. (See photograph #1) ALTERATIONS: The garage 18 x 20 was built in 1949. Replacement siding (aluminum) was noted on the 1987 survey card also as Altered, Major. The open porch on the north east corner of the house was enclosed in 1995 (COA #1995 - 1130); a 700 square foot addition was added to the north side of the house in 2000 (COA# 2000 - 0821). The two center windows on the second storey above the entry's gable are replacement windows. There are aluminum storm windows on the front windows. The louvered shutters noted on the 1987 survey card are no longer there. APPLICATION ITEMS: Replace 2 downstairs and 2 upstairs windows with more energy - efficient windows as close to the original construction as possible. All four windows face Wayne Street. DESCRIPTION OF PROPOSED PROJECT: The homeowners wish to completely replace the four front windows with Pella Architect Double Hung 6/6. These windows are aluminum clad pine with insulated low E Standard glass. The entire window systems will be removed along with the exterior window trims. The windows will be replaced with Pella Architect Double Hung 6/6 windows and use the AZEC composite material to replicate the exterior trim. Dave Waechter of Pella Windows will be present at the meeting with a sample of the proposed replacement window. (See attached diagrams provided) STANDARDS AND GUIDELINES: East Wayne Street: C. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features such as aluminum insulating glass combinations that require removal of the original windows and doors shall not be installed. Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: Staff has met with the homeowners on site concerning this project.
