Wayne Street LHD Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE: This is a two storey frame Colonial Revival home with a rectangular plan, flared gable asphalt shingle roof with three gable inset dormers at the front. The porch roof extended from the main roof supported by square box columns with mold trim as capital. There is a central entry with sidelights. There is a two car garage wing with two doors with molded trim cornice, wood balustrade on the flat roof. All of the windows and doors appear to be original. ALTERATIONS : Enclosed arched area at rear garage was noted on survey card. APPLICATION ITEMS: Removal of 4 non -conforming pine trees (3 Blue Spruce/1 Fir)[See Exhibit A&B] which obscure the view of the house from the street(Exhibit C) and impede the growth of lawn/grass (large portion of yard). Addition of (1 or 2) new deciduous trees within tree lawn along Twyckenham Drive (Exhibit D) DESCRIPTION OF PROPOSED PROJECT: The homeowners wish to remove the four trees directly in front of their home and replace them with a maple tree in the tree lawn. The maple trees recommended for tree lawns for the East Wayne Street District are the Norway Maple and Sugar Maple. The spruce trees were less than 6 feet tall in March 1987 when the survey photograph of the home was taken for the original survey card. Brent Thompson, City Forester, submitted an e-mail after visiting the site (Exhibit E) stating that the spruce trees are healthy but could be trimmed up or replaced. STANDARDS AND GUIDELINES: I. THE ENVIRONMENT A. THE DISTRICT ENVIRONMENT The district is characterized by its proximity to downtown South Bend. It encompasses several blocks of East Wayne Street, North and South, from Eddy Street east to Greenlawn and the south side of Jefferson Boulevard from Eddy Street east to Sunnyside Avenue. The district is bounded on the north by Jefferson Boulevard from Eddy Street to Sunnyside Avenue and then by the north property lines of the Wayne Street properties to Greenlawn. The south boundary is the southern right of way of the alley or the southern property lines of East Wayne Street, South. Unique features of the neighborhood include the island of homes between East Wayne Street North and East Wayne Street South, the parks at each end of the island, and the brick pillars at the entrance way (Eddy Street) to the subdivision with signage reading "Whitcomb and Keller's Sunnymede." Definition - the term "trees" in the following standards shall be defined as follows: shade trees - twelve (12) inches in diameter. ornamental trees - four (4) inches in diameter or fifteen (15) feet in height. evergreen trees - eight (8) inches in diameter or fifteen (15) feet in height*. Any removal or planting of trees which are of the sizes indicated above or larger shall be reviewed by the Historic Preservation Commission. *Definition of trees by David Barncord, ASLA, Indiana Certified Landscape architect, THE LANDSCAPE DESIGN COMPANY, INC B. BUILDING SITE, LANDSCAPING AND .ACCESSORIES Individual properties in the district are characterized by a house located in the center of a flat lawn, often divided by a walk leading to the front entrance. Several of the residences are sited on two or more building lots; however, the preponderance of the homes have been erected on a single lot. Most of the properties include a double garage, usually located at the rear of the property. The majority of garages are accessed from straight driveways leading from the main thoroughfare, while a few are accessed from the alley. There are also a few homes with a covered carport located at the rear of the property, as well as a few with circular driveways. Driveway and sidewalk materials include concrete, asphalt and brick. All of the properties have trees and most have trimmed shrubbery and/or hedges. Most of the houses conform to a uniform setback line within each block. Required Major landscaping items, fencing, walkways, private yard lights, signs (house numbers) and benches which reflect the property's history and development shall be retained. Dominant land contours shall be retained. Structures such as gazebos, patio decks, fixed barbecue pits, swimming pools, tennis courts, greenhouses, new walls, fountains, fixed garden furniture, trellises and other similar structures shall be compatible to the historic character of the site and the neighborhood and inconspicuous when viewed from a public walkway. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should be appropriate to existing surrounding site elements in scale, type and appearance. Plant materials and trees in close proximity to the building that are causing deterioration to the building's historic fabric should be removed. However, trees and plant materials that must be removed should be immediately replaced by suitable flora. All highintensity security lights should be approved by the Historic Preservation Commission. Prohibited No changes may be made to the appearance of the site by removing major landscaping items, trees, fencing, walkways, outbuildings or other elements before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped. Front yard areas shall not be fenced and fences shall not extend forward beyond the setback line of the house. The installation of unsightly devices such as television reception dishes and solar collectors shall not be permitted in areas where they can be viewed from the public thoroughfare. Not Recommended Telephone or utility poles with high-intensity overhead lights should be installed so that they cannot be seen from the thoroughfare. STAFF RECOMMENDATION: Staff recommends approval. There is a full width screen enclosed porch with wood supports set on brick piers and rail with stone caps. There is wood and chain link fence along the side yard on the west and a stockade fence along the east side. See Photograph #1 ALTERATIONS: The 6/6 window in the front gable is a replacement window for the original two narrow 1/1 windows. The fences are not original to the house. APPLICATION ITEMS: Continue current fence around back of property to close off lot from the alley. See Exhibit A. DESCRIPTION OF PROPOSED PROJECT: The Applicant wishes to enclose the lot along the alley and west side with fencing to match what is currently there. The current fence is a 4.5 foot chain link fence stretched between wooden supports. See Exhibit B and Photographs #2&3 STANDARDS AND GUIDELINES: B. BUILDING SITE, LANDSCAPING & ACCESSORIES This section focuses on individual properties and amenities. Building sites tend to be irregularly shaped, of varying topography and with different setbacks with regard to plots. Alleys are generally behind houses. Landscape accessories like fences are unique to each structure. Chapin Place presents a unique situation within the district. Applications from properties that have property lines on Chapin Place will be considered on a case-by-case basis. Required Fencing, walkways, outbuildings, private yard lights, signs (i.e. house numbers) and benches (visible from the street) as well as trees located in a yard or tree lawn which reflect the property's history and development shall be retained. A tree located in such areas shall only be removed if the removal is required due to storm damage, disease, threatened damage to a structure or for such other reason acceptable to the Historic Preservation Commission. Storm damaged or diseased trees should then be replaced with an - approved species at the same or approximate location wherever possible. Utility poles with high-intensity overhead lights should be installed so that they cannot be seen from a street. The Commission will evaluate all installations as well as any potential exceptions resulting from special circumstances, before granting a C of A. The current fence is constructed of wooden supports with chain-link stretched between them. This material was chosen as it will match the existing fence and because the garden is very shady and we would like to be able to plant up against the fence which is more successful when some sunlight is available to the plants. This fence plan is in part a remedy for the shade which has . been produced by the recent installation along the east side.of the garden by my neighbor of a 6 foot stockade fence which, though handsome, has increased the shade in my garden substantially. The proposed fence at 605 Rex Street would be on the east side of the lot the same elevation as the existing fence, approximately 4 and a half feet high. Along the alley the fence would be raised to 6 feet thus matching the elevation of the stockade fence which it meets on the western edge of the property. Wayne Street Architectural Style/Date/Architect or Builder: Renaissance Revival/1929/11. R Stapp/Whitcomb&Keller Property Owner: James P. Schmiedeler and Renee Marie LaReau Landmark or District Designation: East Wayne Street Rating: Significant DESCRIPTION OF STRUCTURE/ SITE: This two storey brick Renaissance Revival home has the original tile roof and features brick quoins, Corinthian columns between the front arched windows, leaded glass windows flank the decorative doorway molding. See Photo 91 ALTERATIONS: The side porch was enclosed and the garage added around 1951. There are aluminum storm windows and storm door on front of house and five replacement fixed single pane windows. APPLICATION ITEMS: Replacement of 12 double hung wood windows, 5 vinyl picture windows and 1 hinged wood window with Marvin Insert wood windows (replace 18 of 30 windows in house). Replacement of bare aluminum front storm door with Larson full -view almond color aluminum storm door to match trim. Further details in attached document. DESCRIPTION OF PROPOSED PROJECT: Repair 4 double hung windows but replacement of 12 double hung with Marvin Ultimate Insert Double Hung wood windows with aluminum clad exteriors and with simulated divided lights that are permanently adhered to both sides of the glass (pages 7,8,12,13,15, 17&18) . These will duplicate the 6/6 of the original windows and will include full exterior screens with aluminum surrounds. Replace five replacement vinyl fixed single pane "picture" windows (pp. 9 11 & 20) the windows on page 11 will be replaced with double hung windows and the kitchen window on page 20 will be replaced by a Marvin Insert Awning wood window all of the other will be replaced with a Marvin Insert picture wood window. Replace one hinged wooden window (p.10) with a Marvin Ultimate Insert Double Hung to duplicate current muttin pattern. Replace the non -original storm door with a full view storm door. STANDARDS AND GUIDELINES: C. WINDOWS AND DOORS Window and door frames are of wood or steel (some casements) or in the case of brick structures, stone sills and brick lintels. Where metal or vinyl siding has been applied, window trim has been covered. Storm windows are of wood or aluminum. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors painted to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and re -used in place. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features such as aluminum insulating glass combinations that require removal of the original windows and doors shall not be installed. Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. STAFF RECOMMENDATION: Staff recommends approval of the replacement of the five vinyl replacement picture windows -two with double hung inserts as described on page 11 and one with a Marvin Awning Window as described on page 20, the repair of the arched front windows, dining room French doors, repair of 2 hinged wood windows and the repair of 4 double hung windows with wooden storms and the replacement of the non -original storm door with the Larson full view model 350-17. Preservation Specialist, Wayne Doolittle, met with Mr. Schmiedeler on August 25 at the house and inspected the windows. It is Mr. Doolittle's opinion that the double hung windows are in good repair, but are painted shut. Some of the sash cord are missing, but after the windows are opened, they can be easily repaired. He also is of the opinion that the lead paint concerns of the homeowner will not be alleviated by replacing the window sashes since the interior of the house was painted with lead based paint between 1929-1978. That being said, the Commission has routinely approved replacement windows East Wayne Street District even when they were not deteriorated beyond repair and has shown a preference for the SDL feature proposed for these replacements. On Wednesday, May 8, 2008, Thomas Feehan of The Feehan Corporation (52105 Woodridge Drive, South Bend) conducted a whole -house inspection of the property per the current owners' purchase agreement with the previous owner. Feehan's summary of the inspection, found in Appendix 1 of this application; states in item 4: "In the living room open the paint sealed windows. Throughout the house the windows are paint stuck, have broken sash cords, loose putty and chipping lead based paint. Repair or replace the windows:' The 30 windows in the house consist of: • 16 double hung wood windows — 8 with bare aluminum storms (request to replace all) — 5 with wood storms (request to replace 1, others to be retained and repaired) — 3 with white aluminum storms (request to replace all) • 5 vinyl picture windows (request to replace all) • 4 wood windows that match the rear French doors (to be retained) • 3 hinged wood windows (request to replace 1, others to be retained and repaired) • 2 leaded glass wood windows (to be retained) The owners met with three different contractors to explore their options for repairing and replacing the windows as recommended by the inspection. Based upon these consultations, the owners herein request to replace 18 of the 30 windows in the house with Marvin Insert wood windows in order to: 1 Figure 1: Front (south) of 1611 East Wayne Street showing front door with bare aluminum storm door, two leaded glass wood windows, three double hung wood windows with wood storms, three double hung wood windows with bare aluminum storms, and one vinyl picture window. • Achieve continuity of the look of the house, consistent with its historic nature, by replacing the incon- sistent set of windows currently in place with windows that match the appearance of those existing windows that can be retained and repaired and that represent most strongly the historic character of the house. • Achieve a reasonable number of functioning windows in the house to provide proper ventilation and sealing. • Eliminate chipping lead-based paint on windows prior to the birth of their first child in mid-November 2008. Furthermore, the owners request to replace the bare aluminum storm door on the front of the house with a Larson full -light off-white aluminum storm door. This new storm door will better display the wood front door, which has its own leaded glass window to match the two on either side of it, and better match the off-white frames of the existing and new windows to achieve a consistent look to the house. The details of all of these requests are provided below. 2 2 Materials to be Used The windows are to be replaced with Marvin Insert wood windows (to be ordered through Quality Window & Door, 27888 Co Rd 32 W, Elkhart), brochures for which are located in Appendix 2. The front storm door is to be replaced with a Larson aluminum storm door (to be ordered through Lowes). Brochures for the storm door are located in Appendix 3. Window Replacement , Of the 18 windows to be replaced, the 12 double hung wood windows, the 1 hinged wood window, and 2 of the vinyl picture windows are to be replaced with Marvin Ultimate Insert Double Hung wood windows (for a total of 15). These windows feature low emissivity argon insulating glass, traditional sash locks, primed wood (pine) interiors, and extruded aluminum clad exteriors (in Sierra White color to match the off-white trim color of the existing windows). The windows will all have simulated divided lites in which the bars are permanently adhered to both sides of the glass, dividing each sash into 6 lights (3 over 3). This configuration matches the existing widows. The bars of the simulated divided lights will be a -inch thick to match the dimensions of those in the existing windows. The windows will all have full exterior screens with an aluminum surround. These windows are located throughout the house, as described in detail below. Two of the vinyl picture windows (in the den on the first floor facing the front and rear of the house as described below) are to be replaced with Marvin insert picture wood windows. These windows are similar to the double hung windows described above, except they are single, stationary units without hardware. They will be single lites without any screens. The vinyl picture window above the kitchen sink is to be replaced with a Marvin Insert Awning wood window. This window features one -lite insulating glass, traditional hardware, primed wood (pine) interior, and extruded aluminum clad exterior (in Sierra White color to match the other windows). The window will have a charcoal fiberglass screen with an aluminum surround. Front Storm Door The front storm door is to be replaced with a Larson Classic -View Full -View aluminum storm door, model number 350-17. The door has a 1.25 -inch thick heavy -gauge aluminum mainframe with a maintenance -free finish in an almond color that will match the existing off-white trim color of the existing windows. It has a full -view clear glass and brushed nickel finish exterior and interior handles. 3 3 Construction Methods Window Replacement Current windows will be removed, but all window frames will remain undisturbed. The Marvin Insert wood windows have a frame -in -frame design that allows them to fit directly within the existing openings. All windows for this application will be custom made because of the dimensions of the existing windows. Frame -in -frame windows will be installed with proper perimeter insulation and sealing. Exterior aluminum custom -formed casing trim in Sierra White color will be provided on the windows where necessary. Front Storm Door Current storm door and frame will be removed. It has a stone foundation with walls of shiplap clapboard siding with corner boards; the entablature has paired brackets. The house has an asphalt shingle hip roof with gable dormers while the tower in front has a mansard roof with wood shingles. There is a full width wrap around front porch with paired Doric columns on stone piers supporting an entablature with dentils and balustrade. The porch has a flat roof. The windows are 1/1 double hung and most have segmental arch molded entablatures. The front door is wood with a single leaded light; sidelights are leaded and there is a stained glass transom. ALTERATIONS: The porch was added in 1901 to reflect the classical revival style in vogue after the Colombian Exposition in Chicago. The metal finials at the corners of the tower have been removed. APPLICATION ITEMS: Refurbish/restore/retrofit existing window sashes in master bedroom and bathroom on second floor as described in annex. Old glasses will be stored in basement. DESCRIPTION OF PROPOSED PROJECT: Please refer to Replacement Systems International, Ltd. proposal by Richard C. Spigelmyer. Exhibit A. STANDARDS AND GUIDELINES: CHAPIN PARK STANDARDS AND GUIDELINES: C. Windows and Doors Required: Original windows and doors shall be retained including sashes lintels, sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they shall be replaced with unites and trim resembling the original. GROUP B LANDMARK STANDARDS: b. Treatment: Treatment shall be defined as any change of surface materials that will nor alter the style or original form. Such improvements include reproofing, glazing, or landscaping lawns and may involve a change that can potentially enhance or detract from the character of the landmark.... STAFF RECOMMENDATION: Staff Recommends Approval. The work proposed is identical to COA# 2008-0604 approved by Commission on June 16, 2008. It is a 1 '/Z storey frame home with a 1 storey gable wing and an irregular floor plan. The central section of the house has a gable roof with large shed dormers. There are casement windows as well as a large picture window with brick header course sills and ornamental louvered 2 shutters. The fagade is brick with vertical and horizontal wood siding. The central porch has a shed roof that extends from the first storey gable with brick supports and a brick and concrete stoop. There is a central brick chimney. There is an attached two car garage with one garage door and a gable roof. ALTERATIONS: There is a pre -1986 1 storey hip rear addition. New Storm Doors. APPLICATION ITEMS: Vinyl Window Replacement DESCRIPTION OF PROPOSED PROJECT: Replace casement windows with Champion Windows in vinyl weather weld tan replicating the muntin patterns of the originals. In the basement: 2 Adds Glass block windows one with vent and another with dryer vent; 4 Hopper tilt Basement Window with full screen; 1 casement with screen for kitchen, 12 double casements throughout the house; 5 Double casements with fixed - centers in three upstairs bedrooms, the landing; and one downstairs bedroom with a double casement with a fixed central picture window without muntins. Per documentations attached. (Exhibit A) STANDARDS AND GUIDELINES: East Wavne Street: C. WINDOWS AND DOORS Window and door frames are of wood or steel (some casements) or in the case of brick structures, stone sills and brick lintels Where metal or vinyl siding has been applied, window trim has been covered. Storm windows are of wood or aluminum. Required Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they shall be replaced with units and trim resembling the original. Recommended Wood frame storm windows and doors painted to match the original should be used but should not damage existing frames. If new sashes or doors are installed, the existing or original materials, design, and hardware should be used. When metal storm doors are used, they should be painted, anodized or coated to match the existing. When awnings are used they should be of canvas material. Prohibited Original doors, windows and hardware shall not be discarded when they can be restored and re -used in place. New window and door openings which would alter the scale and proportion of the building shall not be introduced. Inappropriate new window and door features such as aluminum insulating glass combinations that require removal of the original windows and doors shall not be installed. Not Recommended Awnings, hoods, and fake shutters made of metal, vinyl, or fiberglass should not be used if they would detract from the existing character or appearance of the building. III New Construction B. Building Materials' Glass blocks should not be used. Concrete block should not be used for anything other than foundations. STAFF RECOMMENDATION: The proposed Champion windows are a special order that will replicate the muntin pattern of the original metal casement windows. (Exhibit A&B) The muntin pattern will be positioned between the glass panes. The HPC has routinely approved replacement casement windows in the East Wayne Street LHD even when they were not deteriorated beyond repair with preference given to exterior "true divided light" exterior muntins. (Exhibit D) Staff recommends approval with the condition that the muttons are dimensional muttons and not the flat muttons. Staff recommends approval of the two glass block basement window installations with the vents as long as they are not visible from the street. 3 Klusczinski: Please. Klusczinski: Are there any questions for the petitioner? Riley: Are you, are they having them replaced so that they may have storms and screens or what's the reason for replacing them? Brandt: They're just deteriorated and the cranks on the casements aren't working... Riley: Ok, and you show this as an exhibit is this the type of window that you're going to put in with the cross bars? Hostetler: Those are showing the kind of windows that have been preferred by the Commission. That's Exhibit D. Those are the ones that when we went through the C of A's for the last several years, for E Wayne St those were the ones that were preferred over other types of windows. Although they'd approved other types of windows, those were the preferred. Sassano: But that's not what we're getting here? Hostetler: No. Brandt: Exactly what they have now. Sassano: Two panes of glass, with a mutton inside the glass. Brandt: Two horizontal bars. Sassano: Inside the glass? Brandt: Yes, uh huh, absolutely. Klusczinski: Are you replacing the windows that are there now with casement windows? Brandt: Yes, sir. Sassano: What about the casings and trim, does everything come out? Brandt: No, the existing exterior casing is staying there. Sassano: So just the sash, you're only taking the sash out and putting new sash in? Brandt: Right. Klusczinski: Could staff elaborate on the quality of windows that are in there right now? Hostetler: We could not tell from the exterior that they were deteriorated on the interior. We did not go inside the house. Cosmetically, they looked ok from the street. Wayne and I both went out there several times. And like Mr. Brandt said, they're not replacing that exterior framing and that's what we could see. If they're not functioning or opening from the inside, that is not something that the staff could not observe. Klusczinski: Thank you, sure. Any other questions? Zeiger: I think that as you were getting at David, staff is recommending that the muttons are dimensional which means that they're on the exterior and not that they're just flat in between. Hostetler: No, dimensional is inside. Champion does not make exterior muttons. It would be interior, and Champion has two different styles of muttons. One is just a flat piece of metal, and one has dimension to it so there's some type of shadow lines to it. Zeiger: It's all inside the glass? Sassano: It's all inside the glass. Hostetler: That's what they offer, that's what we have to deal with. Zeiger: The other question that I had real quick was the rating. Catherine, the rating is non-contributing? Sassano: In my opinion Todd, it's a bit of a mixed metaphor, a bit of a 1950's Brady bunch kind of house and the traditional steel window is not really that integral to the design element, and so I don't think that the overall image of the house is going to suffer. Zeiger: Yes, that's why I was asking. I tend to concur, I just wanted to see what everyone else's thoughts were. Riley: You're not going to notice any dierence, they'll look better... It has a brick foundations and chimney. The walls are wood clapboard with corner boards. Two gables have fish -scale and un -coursed square shingles applications. The roof is a cross gable with wide rakeboards and covered with asphalt shingles. There is a flat second storey rood over the rear wing. The house has a small corner porch on the south side of the center gable with knee braces at the corners and one turned support; the roof of the porch is an extension of the center gable rood. The windows are 1/1 double hung with moulded entablatures and exterior shutters. There is a similar entablature over the wood front door with three full length lights. There is a large shade tree on the south side and a hip roof two stall garage at the rear of the house; one stall has original doors the other a modern single door. ALTERATIONS: The front porch was removed in 1949. Replacement concrete porch steps and floor. The shutters appear to be of recent vintage. APPLICATION ITEMS: Install new wood fence around the house and garage per diagram (Exhibit A) and design (Exhibit B). Wood fence at rear and side of house 6 feet high from back left of house to rear (flush with garage); 4 feet high from garage side down the right side of property line, with a 4 foot high access from side fence to side porch. 2. Plant a tree, preferably a flowering crabapple tree, in the south (right) side of the front yard. Owners are willing to accept Commission's guidance on recommendation of tree variety. DESCRIPTION OF PROPOSED PROJECT: Refer to Exhibit A. Facing the house at 844 Forest: there would be a 6 foot fence section at the rear left of the house which would connect to a section of 6 foot fencing along the property line on the left side of the house which would continue down the property line and then angle off to the right to avoid a large tree before continuing along the rear property line to connect to the garage. STANDARDS AND GUIDELINES: CHAPIN PARK: I. THE ENVIRONMENT A. THE DISTRICT ENVIRONMENT The Chapin Park Local Historic District is a particularly fine residential area located close to downtown South Bend, the St. Joseph River, Memorial Hospital and Leeper Park. This section is meant to protect and guide appropriate maintenance of the common areas of the district (i.e. visual landscape and streetscapes). Required Brick streets contribute greatly to the character of the neighborhood. These streets have always been essentially passenger car thoroughfares. The appointments of the streets (i.e. lighting, curbs, horse hitches and monuments) should contribute as much as possible to their architectural, historic and residential character. Retention and maintenance of existing brick streets in the district is required. Repair work to fill voids and gaps must utilize brick paver materials and acceptable installation methods whenever applicable. When utility work dictates the removal of street sections (pavers), the original materials will be reinstalled. Brick streets shall be patched with brick pavers. Concrete, asphalt, fillers and similar materials shall not be used. All original streetlights shall be maintained, especially the George Cutter "Park View" streetlights designed by the Cutter Company for this neighborhood. Present efforts by the Neighborhood Association and the Historic Preservation Commission to restore "Park View" streetlights to the district shall continue. Any change in lighting must receive approval of the Historic Preservation Commission. New or different fencing requires a C of A and shall reflect the style and character of the individual property and the surrounding environment and properties. R, Recommended The current or historic character of lawns should be preserved. Front yard areas, common lawns and tree lawns should remain open. New or replacement trees should be compatible in variety with those presently growing. Vacant lots should be kept landscaped appropriately while vacant, and may be used for recreational or residential development. When replacement of utility poles or power supply lines is necessary, consideration should be given to underground conduits or utility poles erected along rear property lines. Prohibited Existing relationships of buildings and their environments shall not be destroyed by widening existing streets, applying asphalt or other bituminous coverings or by introducing new streets or parking lots. Signs, streetlights, benches, new plant materials, fencing, walkways and paving materials which are out of scale or inappropriate to the neighborhood may not be used. The erection of high walls or barriers, which would alter the relationship of the houses, shall be prohibited. Utility poles with high intensity overhead lights shall not be used on main thoroughfares. B. BUILDING SITE, LANDSCAPING & ACCESSORIES This section focuses on individual properties and amenities. Building sites tend to be irregularly shaped, of varying topography and with different setbacks with regard to plots. Alleys are generally behind houses. Landscape accessories like fences are unique to each structure. Chapin Place presents a unique situation within the district. Applications from properties that have property lines on Chapin Place will be considered on a case-by-case basis. Required Fencing, walkways, outbuildings, private yard lights, signs (i.e. house numbers) and benches (visible from the street) as well as trees located in a yard or tree lawn which reflects the property's history and development shall be retained. A tree located in such areas shall only be removed if the removal is required due to storm damage, disease, threatened damage to a structure or for such other reason acceptable to the Historic Preservation Commission. Storm damaged or diseased trees should then be replaced with an approved species at the same or approximate location wherever possible. Fencing visible from the street in front of the structure shall be open (meaning spaces between the pickets) and consistent with the historic character of a structure enclosed. Recommended New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should also be appropriate to existing surrounding site elements in scale, type and appearance. Front yard areas should remain open. (See above for information regarding fences.) Trees in close proximity to a building may cause structural damage. Owners are encouraged to remove these trees and replace (or replant) them at a more appropriate location as soon as planting season permits and upon approval of a C of A. Prohibited No changes may be made to the appearance of the site by removing trees, fencing, walkways, outbuildings or other elements. before evaluating their importance to the property's history and development. Front yard areas shall not be transformed into parking lots nor paved nor blacktopped, nor enclosed by solid fences, chain link, nor industrial/commercial style fences. The installation of unsightly large devices, such as television satellite dishes, skylights or solar panels, shall not be permitted in areas where they detract from the architecture of a building, are intrusive to the public view of the building or are highly visibly from a public street, or ruled inappropriate after Commission review. Utility poles with high-intensity overhead lights should be installed so that they cannot be seen from a street. The Commission will evaluate all installations as well as any potential exceptions resulting from special circumstances, before granting a C of A. APPENDIX B: Overall Recommendations for Landscape Preservation in Local Historic Districts %/ &. Any vegetation with thorns or fruit should be restricted to establishment at least 5 feet away from public rights of way. Thorns pose an obvious danger, especially when thorny trees are handing over the sidewalk at eye level. Fruit, such as that of the Flowering Crabapple, can cause a pedestrian to slip and lose their balance and fall. STAFF RECOMMENDATION: Staff recommends approval of the fencing with the gates. The Surveyor Location Report indicates a privacy fence along the rear and left property line of 844 Forest which no longer exists. The new four foot fence with gates would enclose the rest of the yard from the side at the angled window and would mirror the style of the 6 foot fence and would not detract from the house. Staff also recognizes an alternate site for the side four foot fence with gate could be behind the concrete steps if the owner so desires. Staff recommends approval of the flowering crab apple tree as long as it can be located in the yard so that when is reaches maturity it does not drop fruit on the side walk. Owners may wish to consider an alternate flowering tree or a crabapple variety that has small fruit. Klusczinski: Please state your name and address for the record. Guisinger: My name is Alexandra Guisinger, I live at 844 Forest Avenue. Thank you for putting my house on the agenda at such late notice. We are requesting a backyard, not only because we have two small boys, but also unfortunately we have been broken into 3 times this summer and two times prior to that. There was a bright Barbie pink security fence that matched our pink house that we currently have and rather than replace that with another securityfence, we propose to have a slightly more attractive custom built fence. The fence will be cut so as to maintain a tree in the corner of our lot. I know, my husband and I discussed the staffsuggestion about the alternative location of the front. We'd actually originally envisioned having it where that alternative suggestion was. We prefer the where we'd like it for a couple of reasons; one, given the last break in I'd like to cover the side door if possible. Having that open gives people the opportunity to pretend that they're knocking on that door, having a gate in front of that would at least block one more door in theory. And the other reason is that with two small children obviously the larger the backyard the more space to venture out. And as to the crab apple, my mother has sent me information on a very small crab apple that she grows in the backyard that I want to replicate. It's very small, cherry like apples. The crab apple though, we'll also make sure to place it in the (unclear) of the yard. Klusczinski: Thank you, the Chair recognizes any questions from the Commission for the petitioner. Niezgodski: I was unclear, exactly... there was mention of putting the fence where it used to be is that what was said? Guisinger: No, not exactly, there's a fence that used to be on the back left and then back across the garage, and there was not a fence between us ever. I won't say ever, but since we've been there. So, we're running a 4 ft fence between us and the house to the right of us. The question is really where do we tuck in to come into the house. We have a concrete porch and so on the side you could either put it behind the porch or you could put it in front of the porch. We want it in front of the porch fora couple of reasons and actually the third reason that I didn't even mention and we could probably get around this but the fence guy also wants it further in front because the fence guy is worried that, as you can see there's a tree, and so the fence guys worried that if we have it behind the porch that its going to be difficult and unstable if we run it too close to that big tree. And so putting it in front of this porch makes it closer to the street but it solves the other problem. And also we've had, not too many times, but we've had a few incidences of people who look into this window and I would like to solve that as well. I should also note that the house next to us is vacant as well, and I think that's part of the problem as well. Having a fence between us and the house next door, not that there's anything wrong with the house but it keeps people cutting through that yard into our house. Riley: Have the neighbors on the other side been told about your fence? Guisinger: No. I've been trying to contact Tom, though he's not frequently there, so I will do so as soon as we get the permit. Riley: I thought that we had to notify neighbors. Hostetler: Well, there used to be a fence here on that particular side where that neighbor lives. The fence is going to be basically... Guisinger: No, the 6ft fence is (unclear), the 4 ft fence is the one that, the 6ft fence where the people have the apartment building.... Hostetler: And there used to be a privacy fence here? Guisinger: Yes, Tom Green lives next door where... Hostetler: Where the Oft fence is going to be. Guisinger: Yes, but I haven't been able to reach him. I've been told that he's also not... Klusczinski: Yes, that's very understandable. I live in the district, and I have some knowledge of Mr. Green. I think in order to stay germane to what we're to consider tonight it isn't necessarily any qualifications for permits or notifications. I think that would fall into the jurisdiction of the building commission, which I think that you would have to arrange your permit with them anyway I believe. At least as far as we're concerned, this is the fence design and the proposed tree with the respect to the guidebooks and standards for the district. Riley: The reason that asked, and you may remember this, one of our neighbors was putting up a fence and the neighbors on either side were notified so we could come down and object or approve and we came before you and objected to something they were doing and you went along with it... Hostetler: We wouldn't have sent out those notices because that's not... they must have... Klusczinski: Applied for a building permit first. It's a procedural thing. Hostetler: I mean, we would never... Guisinger: I know that we're rushing to get this because we have been broken into in the last month, and one time earlier this summer. The fence is going to be for, to try to meet, unfortunately I haven't been able to speak to him but to meet any concerns. It's 4 ft on his side. It will not cover his window. Riley: Is that the side that you're talking about? Guisinger: Yes. This side is an empty house. We have an empty house between us and then the owner lives on the other side of that. And he has been slowly refurbishing the house and that's why it's been empty. The 4 ft fence though won't cover up this window. Riley: And will that be painted or natural or what? Guisinger: I was going to go natural so that it will turn gray and then at some point we will be able to paint the house to better go with the gray and not barbie pink. I know also that I'd prefer not to deal with a painted fence. Klusczinski: Very good, any other questions? Wayne Street LHD Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE: This is a two storey frame Colonial Revival home with a rectangular plan, flared gable asphalt shingle roof with three gable inset dormers at the front. The porch roof extended from the main roof supported by square box columns with mold trim as capital. There is a central entry with sidelights. There is a two car garage wing with two doors with molded trim cornice, wood balustrade on the flat roof. All of the windows and doors appear to be original. ALTERATIONS: Enclosed arched area at rear garage was noted on survey card. APPLICATION ITEMS: Removal of 4 non -conforming pine trees (3 Blue Spruce/1 Fir) [See Exhibit A&B] which obscure the view of the house from the street (Exhibit C) and impede the growth of lawn/grass (large portion of yard). Addition of (1 or 2) new deciduous trees within tree lawn along Twyckenham Drive (Exhibit D) DESCRIPTION OF PROPOSED PROJECT: The homeowners wish to remove the four trees directly in front of their home and replace them with a maple tree in the tree lawn. The maple trees recommended for tree lawns for the East Wayne Street District are the Norway Maple and Sugar Maple. The spruce trees were less than 6 feet tall in March 1987 when the survey photograph of the home was taken for the original survey card. Brent Thompson, City Forester, submitted an e-mail after visiting the site (Exhibit E) stating that the spruce trees are healthy but could be trimmed up or replaced. STANDARDS AND GUIDELINES: Reading was waived by President Klusczinski. STAFF RECOMMENDATION: Staff recommends approval. The trees are out of scale with the house and the property. Kevin Buccellato. 304 South Twyckenham Drive, South Bend, Indiana. Mr. Buccellato said that the Staff summed up his project nicely and that he had further pictures to document the presentation for the Commissioners. He stated further that it was their goal to contribute to the neighborhood by restoring the house to its former grandeur but that these overgrown trees were preventing the house to be seen from the street. They have also been unable to grow grass in the front of the house. The Commission in its discussion observed that there were a large number of trees on the site and that the Buccellatos were asking to remove something that really doesn't belong on the site. It was also opined that it should be up to the discretion of the homeowners if they decided to plant 1 or 2 or any Maple trees in the tree lawn. President Klusczinski asked if there were any members of the public wishing to speak in favor or against the petition. There were none and President Klusczinski then called final comments and discussion from the Commissioners. Since there were no additional comments he asked for a motion. Mary Jane Chase: I will make a motion that we accept application 2008-0827 as stated in the application for the removal of the trees. Linda Riley: Second. Catherine Hostetler: Application Number: 2008-0903 Property Location: 605 Rex Architectural Style/Date/Architect or Builder: Gable -front/ c1905 or c 1899 Property Owner: Joan Downs Landmark or District Designation: Chapin Park Rating: Contributing DESCRIPTION OF STRUCTURE/ SITE: The house is a gable -front one and a half storey structure with the original shingles in the gable and clapboard siding and corner boards. There is a full width screen enclosed porch with wood supports set on brick piers and rail with stone caps. There is wood and chain link fence along the side yard on the west and a stockade fence along the east side. See Photograph #1 ALTERATIONS: The 6/6 window in the front gable is a replacement window for the original two narrow 1/1 windows. The fences are not original to the house. 4 APPLICATION ITEMS: Continue current fence around back of property to close off lot from the alley. See Exhibit A. DESCRIPTION OF PROPOSED PROJECT: The Applicant wishes to enclose the lot along the alley and west side with fencing to match what is currently there. The current fence is a 4.5 & 6 foot chain link fence stretched between wooden supports. See Exhibit B and Photographs #2&3 STANDARDS AND GUIDELINES: Reading was waived by President Klusczinski. STAFF RECOMMENDATION: Staff recommends approval of the fence in the rear and rear side of the lot. President Klusczinski: Is the petitioner here? You are also entitled to a brief presentation. Please state your name and address. Joan Downs: My name is Joan Downs, I live at 849 Forest Avenue. I purchased 605 Rex Street in order to rehabilitate it. In my restoration project I would like t fence the back yard, close it off from the alley. And, it is very shady there, so I choose to continue the current fence as it exists separating me from neighbors to the west which is a chain link fence with wooden supports because it lets the most light in order to allow the plants to grow. I thought that it would look the least obtrusive if I didn't add a new piece of fence and a different style because currently the west side is fenced in one style and the east side in a stockade, which is handsome, but makes it exceptionally dark; so I would prefer to do the chain link with wooden supports to close off the alley. President Klusczinski: Thank you. Any Commissioner with questions for the petitioner? Hearing none we move to Commission discussion. Moving on to Certificate of Appropriateness 2008- 0904 Catherine Hostetler: Application Number: 2008-4904 Property Location: 1611 E. Wayne Street Architectural Style/Date/Architect or Builder: Renaissance Revival/1929/II. R. Stapp/Whitcomb&Keller Property Owner: James P. Schmiedeler and Renee Marie La Reau Landmark or District Designation: East Wayne Street Rating: Significant 3 DESCRIPTION OF STRUCTURE/ SITE: This two storey brick Renaissance Revival home has the original tile roof and features brick quoins, Corinthian columns between the front arched windows, leaded glass windows flank the decorative doorway molding. See Photo #1 ALTERATIONS: The side porch was enclosed and the garage added around 1951. There are aluminum storm windows and storm door on front of house and five replacement fixed single pane windows. APPLICATION ITEMS: Replacement of 12 double hung wood windows, 5 vinyl picture windows and 1 hinged wood window with Marvin Insert wood windows (replace 18 of 30 windows in house). Replacement of bare aluminum front storm door with Larson full -view almond color aluminum storm door to match trim. Further details in attached document. DESCRIPTION OF PROPOSED PROJECT: Repair 4 double hung windows but replacement of 12 double hung with Marvin Ultimate Insert Double Hung wood windows with aluminum clad exteriors and with simulated divided lights that are permanently adhered to both sides of the glass (pages 7,8,12,13,15, 17&18) . These will duplicate the 6/6 of the original windows and will include full exterior screens with aluminum surrounds. Replace five replacement vinyl fixed single pane "picture" windows (pp. 9 11 & 20) the windows on page 11 will be replaced with double hung windows and the kitchen window on page 20 will be replaced by a Marvin Insert Awning wood window all of the other will be replaced with a Marvin Insert picture wood window. Replace one hinged wooden window (p.10) with a Marvin Ultimate Insert Double Hung to duplicate current muntin pattern. Replace the non -original storm door with a full view storm door. STANDARDS AND GUIDELINES: The reading was waived by President Klusczinski. STAFF RECOMMENDATION: Staff recommends approval of the replacement of the five vinyl replacement picture windows -two with double hung inserts as described on page 11 and one with a Marvin Awning Window as described on page 20, the repair of the arched front windows, dining room French doors, repair of 2 hinged wood windows and the repair of 4 double hung windows with wooden storms and the replacement of the non -original storm door with the Larson full view model 350-17. Preservation Specialist, Wayne Doolittle, met with Mr. Schmiedeler on August 25 at the house and inspected the windows. It is Mr. Doolittle's opinion that the double hung windows are in good repair, but are painted shut. Some of the sash cords are missing, but after the windows are opened, they can be easily repaired. He also is of the opinion that the lead paint concerns of the homeowner will not be alleviated by replacing the window sashes since the interior of the house was painted with lead based paint between 1929-1978. That being said, the Commission has routinely approved replacement windows East Wayne Street District even when they were not deteriorated beyond repair and has shown a preference for the SDL feature proposed for these replacements. Staff prefers that the windows be repaired. President Klusczinski: Please state your names and addresses for the record. James Schmiedeler: I am James Schmiedeler living at 1611 E. Wayne Street. Renee La Reau: I am Renee La Reau living at 1611 E. Wayne Street President Klusczinski: You are entitled to a brief presentation. 9 James Schmiedeler: Okay. He described the process that they went through with the Inspector and with several contractors concerning the non-operable windows and the chipping lead based paint. They felt the most comfortable with the suggestion of Chris Kohler that only some of the windows need to be replaced while others could be repaired; and with the proposal from Marvin for their architectural series windows. The goals were to have uniform, safe and operable windows that retained the historic character of the house. President Klusczinski: Any Commissioners with questions for the Petitioners. Linda Riley and David Sassano entered into a discussion with Chris Kohler of Kohler Home Improvement and James Schmiedeler concerning the merits of repairing over replacement of the windows. During the course of this discussion Chris Kohlerpointed out that some of the windows have sustained considerable water damage which he did not think could be repaired without Herculean effort. James pointed out that there are several of different window and storm window replacement styles currently on the house and they wished to have uniformity as well as operable windows. David Sassano's concern was for the restoration of the four arched front windows on the front faVade and the use of Marvin sash packs for the three front second storey windows for uniformity of treatment on the front facade and not cladding the brick mold with aluminum. The rest of the window replacements were acceptable to him. Todd Zeiger expressed reservations of the Marvin Inserts and preferred to see windows restored but that tilt packs were an acceptable alternative. There was also discussion about the lead issues caused by the window tracks and the homeowners' opposition to renovation of the original windows. President Klusczinski closed the discussion and moved to public hearing. Since there were no members of the public wishing to speak for or against the petition he gave the Commissioners the option for additional comment. At this point the Commissioners, Attorney and the homeowners discussed the options of either approving parts of the COA or signing a waiver for a delay. The sentiment was not for a delay or a piecemeal approach; with the Contractor agreeing to install tilt packs on the front fagade. At the request of President Klusczinski, David Sassano made the following motion: David Sassano: I make a motion that we allow the petitioner to amend the C of A to include three wood replacement sashes for the three windows facing the fagade on the second floor. That sash is commonly called a tilt pack or a sash pack which I feel to be considered a replacement in-kind. I would be wood with insulated glass and a simulated divided light. Linda Riley: I'll second it. President Klusczinski: Before we vote, is this acceptable? James Schmiedeler: Most definitely! President Klusczinski: The petitioner is amenable to that, let the record show ... any additional comments? Todd Zeiger: Just a clarification, that would also include not wrapping those front frames... Chris Kohler: Yes. President Klusczinski: All those in favor signify by saying, Aye (7), Opposed? REGULAR BUSINESS 5 In a Motion by Linda Riley to approve the minutes of the August 18, 2008 meeting that was amended by Timothy Klusczinski to correct the spelling on page 5 from "mutton" to "muntin" with a second by Lynn Patrick the minutes were adopted by consensus. Treasurer Mary Jane Chase entered the Office of the Historic Preservation Commission Location Report for the month of August into the record. In response to Todd Zeiger inquiry concerning the County Budget the Director responded that the Office is scheduled for a meeting on September 24, 2008with the County Commissioners between 6-7.30p.m. Staff Reports Director Catherine Hostetler distributed for the Commissioners' information the correspondence of the New Carlisle Newsletter and the NNN's request to participate in the Art Cafe. The Directors Report was distributed which is attached as Appendix A. There was a discussion of the Rotary project concerning the Band Shell at Potawatomi Park, which was thought to be rated outstanding in the Survey [actually it is rated Notable], and making it more handicapped accessible for patrons and performers. The Assistant Director's Report was not given. The Assistant Director gave birth to a son, Quinlan James, on September 14 and could be on family leave until December 8, 2008. Legal Counsel gave the Commission his response to President Klusczinski's concerns about the inactivity of the various district liaisons. Larry Meteiver said that there was no statutory process that the Commission needs to go through to get that process of involving liaisons moving; it is basically identifying those people willing to serve in each district and having at least one of them at the monthly HPC meetings especially if a COA from their respective districts was on the Agenda for their input. President Klusczinski stated that it is his view that it is helpful for the Commission when reviewing s COA that the Commission is aware of the opinion in its respective district. He out lined two crucial tasks to allow for the information to flow to and from the Commission the first was for the Liaisons to receive a copy of the monthly agenda and the other was for the Liaisons to recognize new neighbors and provide them with information and the district's guidelines. Lynn Patrick as chair of the Historic District Committee and has the Liaisons as part of her responsibility stated that she has found very little interest. President Klusczinski mentioned that elections weren't necessary if there were only three volunteers for three openings. He also stated that a detriment to liaisons attending the meetings were the length of the meetings and the fact that the Hearing of Visitors was at the very end of the Agenda. He stated that his goal as president was to keep the meetings short. Larry Meteiver suggested an amendment to the By -Laws to move the Hearing of Visitors on the Agenda to the end of Regular Business. In a motion by Todd Zeiger with a second from Linda Riley there was a unanimous vote to table the motion to move the Hearing of Visitors on the Agenda with an amendment to the By -Laws until the next Commission meeting. President Klusczinski distributed a copy of his September President's Report which is included as Appendix B. Old Business: Catherine responded to David Sassano's inquiry that she will meet with Hebard & Hebard on Thursday, September 18 at 2:00 to discuss Monroe School. Todd Zeiger announced that the HPC did receive the HLFI grant of $2000.00 to perform an independent analysis of the slate roof and possibly the windows for restorability and color. This will be performed as part of HPC's due diligence and David Sassano will make the arrangements with either Midland or Slatile. President Klusczinski stated that HPC does not have a COA for this project but when it does the Standards and Maintenance Committee has already been charged to take 6 the lead on that; do the investigation, before we hold our regularly scheduled meeting and for the Standards and Maintenance Committee to give that presentation at that meeting. New Business: Mary Jane Chase summarized her experience at the Third District meeting with the Parks Board concerning the condition and status of the Zoo, Conservatory, Golf Courses and Parks. The citizens and college students from Bethel and IUSB were enthusiastic in their support for the need of educational programs and not just games. The Parks Board said that a Volunteer Coordinator would be needed. Todd Zeiger proposed that the Botanical Society investigate.a 99 -Year lease of the Conservatories from the City of South Bend. In a motion by President Klusczinski with a second from Mary Jane Chase the Commission voted unanimously to elevate Linda Riley to Secretary from Assistant Secretary. In a motion by President Klusczinski with multiple seconds the Commission voted unanimously for Larry Meteiver and Catherine Hostetler to form an ad hoc committee to investigate the use of summary minutes for the Commission's public hearings and meetings. Upon a Motion by President Klusczinski with multiple seconds, the Commission voted to unanimously to Adjourn at 8:40 pm.
