Notice is hereby given'that a meeting of the Historic Preservation Commission of
South Bend & St. Joseph County (the "Commission") will be held on Friday, May 5, 2006, in the
Commission's offices on the I" Floor of the Law Building, 125 S. Lafayette Boulevard, South
Bend, Indiana 46601, commencing at 5:00 p.m. The purpose of the meeting will be to place
interim protection on 1013 E. Jefferson Blvd in the Howard Park National Register District.

I. CALL TO ORDER: Lynn Patrick called the meeting to order at 5:03 pm.
II. LANDMARK — FIRST READING & INTERIM PROTECTION —1013 E. JEFFERSON
Current photos of 1013 E. Jefferson were passed around to the Commission members [Exhibit 1] and
Catherine Hostetler described the significance of the property. The house was built in 1907 for Harry
Johnson, the grandson of J. M. Studebaker, as a wedding present. Ennis Austin, a prominent South Bend
architect, designed the residence for the new family. The house was also rated Significant/12 in the South
Bend survey. Julie Schutte noted that the property is located in the Howard Park National Register
District, two houses from another landmark.
Catherine briefly described the situation that currently threatens the residence. A law practice located
next to 1013 E. Jefferson would like to purchase the house in order to demolish it for parking. Their
bonded agent, Kenny Kent, notified the building department of his client's desire to demolish the
building. He is the agent for the seller, TCU, and the attorneys. The sale to the attorneys depends on the
demolition of the residence. However, another serious buyer has submitted a bona fide counteroffer
directly to the bank after some anomalies with Remax and the bank. She would like to purchase the
building to rehab it.
The Commission then considered if the building was architecturally and/or historically significant to
proceed with interim protection and landmark status. Todd Zeiger reiterated that is does meet the criteria
as the residence is rated S/12, is located in a National Register Historic District, was designed by a noted
South Bend architect, and is connected to the Studebaker family.
Lynn Patrick: I moved to accept the following findings of fact regarding 1013 E. Jefferson Blvd, the
Studebaker — Johnson House and to place the structure under interim protection. The Studebaker —
Johnson House located at 1013 E. Jefferson fulfills the three criteria for landmark status and should be
placed under interim protection for six months or until landmark status is granted or denied by the
Common Council. It fulfills the three criteria for landmark status: 1.) It is architecturally/historically
important and connected to the development of the area because it was designed by Ennis Austin for
Harry D. Johnson, Jr., the eldest grandson of J. M. Studebaker and a master mechanic at the Studebaker
Corp; 2.) Its educational value as an architecturally significant home owned by a member of the
prominent Studebaker family; and 3.) Its suitability for preservation because it is rated significant/notable
in the South Bend survey and was designed by Ennis Austin in 1907 for Mr. Johnson. Ennis Austin was a
partner for the prominent architectural firm of Austin and Shambleau. Diane Wrobel-Illes: Second.
Lynn asked for discussion on the motion. There was none. Lynn asked for public comment. There was
none. She asked for a vote: the motion on the floor passed 7-0 all in favor.
III. ADJOURNMENT
No other matters were discussed. Todd Zeiger moved to adjourn and Martha Choitz seconded the motion.
All were in favor and the meeting adjourned at 5:20 p.m.

Please be advised that the Historic Preservation Commission of South Bend and St. Joseph County had a meeting
on May 5, 2006 and entertained an initial proposal to create landmark status for the Studebaker/Johnson House
located at 1013 E. Jefferson, South Bend, IN 46617 in the Howard Park National Register District; as a result of
this initial proposal for landmark status, the Historic Preservation Commission voted to place the property under
interim protection.
Interim protection means that this structure cannot be moved or demolished for the next six months or until Local
Historic Landmark Designation has been established or rejected by the Historic Preservation Commission and the
South Bend Common Council. Interim protection also means that the exterior appearance of the building and
building's site may not be changed by alteration, reconstruction or addition. This does not preclude painting. Any
additions, alterations or reconstructions, including demolition must be reviewed and approved by this office prior to
any building or demolition permits being issued for this site.
The authority for this action is the South Bend City Code Section 21-13.02 subsection (d)5.'A copy of this
ordinance may be obtained in this office of the office of the City Clerk of South Bend during normal business
hours.

STATEMENT OF SIGNIFICANCEMISTORIC CONTEXT,
This is the Francis and Mary Hatch house. It is a circa 1103 Free Classic Queen Anne designed by W.W. Schneider.
Francis once worked for the South Bend Tribune as a reporter and later as an editor.
APPLICATION ITEMS
Modify kitchen windows facing driveway; decrease vertical dimension of window by raising sill approximately 10"
CHAPIN PARK GUIDELINES; C. Windows and Doors,
Required. Original windows and doors shall be retained including sashes, lintels, sills, shutters, decorative glass,
pediments, hoods and hardware. When deteriorated beyond repair, they shall be replaced with units and trim
resembling the original. Recommended. If new sashes or doors are installed, the existing or original materials,
design and hardware should be used. Prohibited. New window and door openings which would alter the scale and
proportion of the building may not be introduced.
RECOMMENDATION
Windows are elements of preservation within the Chapin Park local historic district and this house has many large
double -hung and fixed multi -pane windows.
As this application proposes a change in the dimensions of two original windows and the reduction of glass to wall
proportions, staff does not recommend approval.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
This is the Charlotte and Frederick Ort House, which was built circa 1865-1870. In 1902, it was moved to this
location from 348 W. Colfax to make way for Central High School. Ort settled in the area in 1850, was a farmer and
worked for the Judson Flour Mill. The house is an excellent example of a frame Italianate residence.
APPLICATION ITEMS:

LANDMARK GUIDELINES
C. Renovations and Additions. Renovation is the modification of a structure, which does not alter the general massing, while
am addition is a change in mass. Additions to landmarks should not detract from the original form and unity of the landmark
and should not cover singular examples of architectural detail. The proportions, materials and ratios of the existing structure
should be carried though in the additions. Care should be taken not to change or alter the following:
1. Structure — Necessary structural improvements, where safety demands should be accomplished in such a way as
to cause minimal visible change to the original style and construction.
2. Material — Additions and improvements involving any new material in a landmark should be of the same material
as the original.
RECOMMENDATION
The porch posts, brackets and roof configuration will remain the same despite the submitted drawing. The t
replacement of the porch decking and latticework is an in-kind replacement and staff recommends approval.
The proposed addition of the handrail to the porch meets the guideline standards for materials, will not cover .
singular architectural details and should not change the rhythm of the front fagade. The move of the stairs will also
meet the guidelines for materials and will not change the original form and unity of the landmark. If desired at
some point in the future, the stairs could be moved back to the current location and the handrail could be removed
as well. Staff recommends approval of the replacement of the porch decking, the repair of the lattice, the
moving of the stairs and the addition of the simple handrail.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: Shetterley Park is an element of the
Riverside Drive District that sets it apart from other Local Historic Districts and provides a natural green
space enclosure along Riverside Drive that serves as a buffer from urban noise. It serves as a tie to the St.
Joseph River by providing usable space close to the water and a visual link to the West North Shore Local
Historic District.
APPLICATION ITEMS: This project is to replace CSO #6 with a newly constructed CSO #6 located
almost parallel to the east of the current one through Shetterley Park, down the bluff to the St. Joseph River.
The project will begin at the manhole at Leland and Riverside. A temporary construction staging area will be
located in the lawn area at the top of the hill slope. Portions of the existing pipe and outfall structure maybe
removed for the construction of the new one. Outfall pipe segments that are not removed will be abandoned in
place and filled with lean concrete. Tree clearing and a temporary approach path will be required to access the
construction areas. Excavation depths of 30 vertical feet or greater will be required for this new construction.
Disturbed areas will be stabilized with erosion control blanket and seeded with grass following construction.
Re -vegetation of the disturbed hill slope areas with tree seedlings will be completed. Deep-rooted vegetation
will not be replaced above revised pipe alignment. However, shallow rooted trees, shrubs, grasses,
groundcover or bushes may be installed. The new outfall structure will contain a sump and internal baffle for
odor control and two additional manholes are anticipated along the slope for pipe grade changes. These will be
visible. A headwall approximately 3 to 5 feet tall will be visible from the river. Exposed concrete surfaces
will be cast -in-place with a form liner that may give the appearance of a glacial or flagstone fagade.
Earthwork grading will be completed around the outfall structure and pipe alignment. Riprap will be placed
adjacent to the outfall in underwater and above water areas for erosion and scour control.
This project is subject to IDEM Wet Weather Section approval. The approximate alignment may vary
depending upon construct ability issues. The City and their consultants will make every attempt to minimize
tree removal and restore areas as soon as possible following construction.
RECOMMENDATION: Staff recommends approval of the project as presented realizing that the exact
location of the new CSO will be determined on site.

1. 2006-0314: 411 West North Shore Drive
Catherine Hostetler read the staff report and Mr. Jones, the homeowner, was present. Joann Sgoileder
asked if the existing trees would remain. Mr. Jones stated that they would remain but the existing
taxis shrubs would be removed and replaced with boxwood.
Joann Sporleder moved to approve Certificate of Appropriateness 2006-0314, 411 West North
Shore, as submitted. Timothy Klusczinski seconded the motion and it passed 8-0, all in favor.
2. 2006-0324: 519 Riverside Drive
Catherine Hostetler read the staff report for this application. The homeowner and the contractor were
not present at the meeting.
Mary Jane Chase moved to approve application 2006-0324, 519 Riverside Drive, as presented.
Joann Sporleder seconded the motion and it passed 8-0 in favor.
3. 2006-03330: 130 Park Lane
Catherine Hostetler read the staff report and Lynn Patrick recognized Jennifer Craig, the
representative from the Junior League of South Bend. Todd Zeiger asked if the sign would be
illuminated. It will not be. Joann Sporleder asked if there were other signs in the neighborhood and if
it met the City's Code for signage. Catherine noted that she directed the applicant to review the
signage on Lincolnway East and that the area did have several signs for Memorial Hospital and the
other medical clinics. Jennifer Craig noted that the contractor, John Yarger, had researched the
requirements and was confident that the sign met code.
Martha Choitz moved to accept application 2006-0330 as presented. Jerry Ujdak seconded the
motion and it passed unanimously.

4. 2006-0403: 849 Forest Avenue
Catherine Hostetler read the staff report and Joan Downs-Krostenko was present at the meeting. She
noted one change to the application: her contractor had recommended against the square scoring of
the driveway. There was some discussion about the scoring and effect the retention of the bottom
portion of the driveway might have upon the streetscape and the rhythm of the properties. Jerry
Ujdak asked about the height of the retaining wall. It would be two courses tall.
Joann Sporleder moved to approve application 2006-0403 as presented, all parts included.
Timothy Klusczinski seconded the motion and it passed unanimously.

Catherine read an email from Jason Durr of the South Bend Department of Public Works. He
requested to withdraw this application from consideration and would submit a new application.

D. STAFF REPORTS
1. C of A Approvals; Correspondence; Director's Report
Catherine distributed a listing of the approved CofAs for the first quarter of 2006. There had been 23
applications submitted. Catherine read the letter from John Strauss regarding salvage from Lincoln
School, a thank you note from the Oxian family and the letter received from the Hughes/Taschetta
family regarding the underpass of the Leeper Park Bridge. She also passed out her Director's report
and a summary of the work the Commission does in the City. Joann Sporleder asked how the
Commission's inventory compared to other cities. Todd Zeiger thought this Commission had the
largest inventory in Indiana with the exception of Indianapolis.
2. Assistant Director's Report: Julie Schutte passed out her report and noted the progress on the
Chapin Park Guidebooks. They would be delivered with the next five working days.
4. Legal: The Legal Report was delayed, as Shawn Peterson had not yet arrived.
IV. OLD BUSINESS
1. Chapin Park Booklets Printing (combined with the Assistant Director's Report)
2. Southhold Awards Breakfast
Catherine reported that we had received about 70 reservations for the breakfast and were shooting for
100. The flowers, food, venue and awards had all been finalized.
IV. NEW BUSINESS
1. Southhold Nominations
There was some discussion on the award nominations for the Southhold Breakfast. A meeting of the
Southhold Awards Committee would be scheduled to finalize the award recipients.
President's Report
[Shawn Peterson arrived at 6:30.] Lynn Patrick noted that INDOT sent a report on the US 31 road
project and staff would review the document. The Standards and Maintenance Committee met to
review the deck at 721 Forest and allowed the applicant to proceed with the work. Lynn asked Shawn
how to proceed with a personnel committee to review job applications and the Southhold Awards
Committee — what notification was needed for these meetings. Sean noted that the personnel
committee could be held in executive session as a closed meeting and that the Southhold Committee
could meet without notice as it does not take official action. Lynn reported that Wayne Doolittle
asked to change his title from Inspector to Preservation Specialist. The consensus of the Commission
was favorable toward this change. Lynn asked Todd and Tim to review the Preservation Plan
individually to streamline and focus the document. She also asked for volunteers to review an . .
upcoming proposal for a Catholic Workers house to be located in Taylor's Field. She also asked that
each Committee meet before the May meeting to touch base and present a report.
Legal Report
Shawn noted that the Gatehouse appeal was continued until June as negotiations were moving in a
positive direction, and hopefully, Alderwoods would abandon the appeal. Part of the negotiations
included monies to bring the building up to code before change of ownership/etc. Shawn also briefly
reviewed Sunshine laws for executive sessions.
V. HEARING OF VISITORS AND ANNOUNCEMENTS
1. Rolanda Hughes
Rolanda stated her appreciation of the attendance of Commission members and staff at the Shetterley
Park meeting and also reiterated her hopes that an underpass would be constructed below the Leeper Park
bridge to connect the east and west sections of the park.
2. Don Sporleder
Don mentioned that he had attended a presentation by Notre Dame architecture students regarding the
preservation and restoration of Copshahoim and that it was an excellent event.

May 2 Meeting with Ted Foti of Memorial Hospital about the feasibility
of using Leeper Park East as parking for Memorial during its 2-3
year construction phase and Bartlett relocation. Referred Ted to
John Wiltrout as to the advisability of using a water well field as
surface parking.
May 3 Quarterly meeting with Memorial Hospital and NNN and the
various neighborhood organizations and districts: major issue
addressed the loss of 200 parking spaces for 2-3 years during their
construction projects and Bartlett relocation. Suggestions, other
than Leeper Park which was nixed as far as we know, included
using the SBCSC Administration Parking lot across from the Bus
Station and providing a shuttle to the Hospital Campus; using the
Freeman -Spicer aka old Studebaker museum site and lot as a
parking area and providing a shuttle to the Hospital Campus.

A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF
SOUTH BEND AND ST. JOSEPH COUNTY ACKNOWLEGING REMOVAL
OF LANDMARKING STATUS FOR FORMER OLIVER SCHOOL SITE
WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County
(the "Commission") exists and operates under the provisions of ordinances enacted by the
Common Council of the City of South Bend, Indiana (the "Common Council") and the County
Council of St. Joseph County (collectively, the "Ordinance"); and
WHEREAS, on March 17, 1982, the Commission petitioned the Common Council to
designate, by ordinance, the former Oliver School located at 900 Indiana Avenue in the City of
South Bend, Indiana (the "City"), more particularly described as follows:

(the "Property") as a local landmark; and
WHEREAS, the Common Council adopted Ordinance No. 7122-82 designating the
Property as a historic landmark (the "Designating Ordinance"); and
WHEREAS, the Ordinance provides the Commission authority to approve demolition
permits for local landmarks and to interpret established standards and guidelines for local
landmarks; and
WHEREAS, the Commission approved a demolition permit for the Property to allow the
Oliver School structure to be demolished, which demolition subsequently occurred; and
WHEREAS, the Designating Ordinance, in the Commission's opinion, was applicable
only to the improvements, including the structure formerly known as Oliver School (the
"Improvements"); ,
NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION
COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY AS FOLLOWS:
1. The Commission hereby determines that the Designating Ordinance was
applicable only to the Improvements and that in light of the Improvements approved demolition
hereby deems the Designating Ordinance to be null and void.
2. This Resolution shall take effect immediately upon its adoption by the
Commission.

Dear Colleague:
Because of your interest in history and historic resources, you are cordially invited to attend the
Twelfth Annual "Grassroots Preservation Roundup" sponsored by the DNR Division of Historic
Preservation and Archaeology (DHPA). The Roundup will be held in New Albany at the historic
Division Street School and the Carnegie Center for Art and History on Saturday, June 3, 2006
from 9:00 a.m. to 4:00 p.m. EDT. This event is being hosted locally by the New Albany Historic
Preservation Commission. —
The Roundup is a free and informal event open to anyone interested in local history and the
preservation of historic resources for future generations to use and enjoy. It is intended to help
local preservationists make connections with each other and the State Historic Preservation Office
for the common cause of preserving local landmarks and heritage. Participants will have the
chance to learn about the DHPA's programs, give brief presentations about their organizations'
successes, challenges, and activities, and network with colleagues. Lunch and afternoon
refreshments will be provided.
Enclosed is a flyer about the event and a tentative schedule of the day's activities. After the
informational session and lunch, there will be a tour of local preservation highlights, followed by
refreshments and an opportunity to network with other participants. If you cannot attend, please
pass this flyer on to someone else who might be interested. If you belong to a preservation -related
group or organization, please share this information with other members.

We'll hear from the New Albany Historic Preservation Commission and other groups about local
preservation activities.

Representatives from participating organizations may give brief presentations about their groups and can
discuss local projects or preservation challenges and successes. Because a number of groups will be
represented, we need to be able to accommodate them all within the allotted time. Therefore, please limit
speakers to one person from each organization and 5 minutes maximum per speaker. There will be time
to network with fellow Roundup participants during lunch, the tour, and the dessert reception.

Where to begin...
My impression of the task to comb the Preservation Plan document was to confront an
enormous patchwork of preservation ideals, practices, suggestions, methods and goals
collected over the years. As you might suspect, this document focuses upon Historic
Landmarks and Districts although it sometimes breaks rank with that discipline to dabble
in wider topics like the collaboration with other government agencies.
Unfortunately, this document closely resembles a scrapbook whereby its content has been
interposed over time. Sections are related in philosophical and procedural ways yet
maintain independence from one another. The result is that certain sections go into too
much detail and duplicate similar language found in other areas. The implications of that
redundancy do become confusing if one required a specific reference to advise a specific
action. We've all heard the expression "Less is More." I cannot think of a better way to
illustrate this point.
What the Plan lacks, is a more logical and contiguous form that would make it a better
resource tool for this and future Commission bodies. There is no shortcut here. In light
of this strategy, I will make the following recommendations to improve our Preservation
Plan document. I call these the BIG twelve:
1. Establish a conceptual order of existing material and then identify voids in that
outline. Next create any "missing" pieces to fill in the gaps.
a. I am submitting a modified table of contents that better illustrates this
notion.
b. At times this does require that headings be re -ordered.
2. Scarce Resources are by their very nature, endangered. I propose merging the
"Scarce Resources" section into "Endangered Resources" since the action and risk
is similar. Each definition should be retained, however. This will allow us to
remove a significant amount of redundant material.
3. Create an Incentives Listing. Move applicable material from "Endangered
Resources" into that section. This includes but is not limited to Federal
Development Tax Credit, Indiana Rehabilitation Tax Credit & Community
Development Block Grants.
4. Move "Interdepartmental Relations" into "Summary and Recommendations"
5. Revision dates should mark any working forms contained in the "Plan."
6. It's impractical to include hardcopies of every example of historic district
guidebook. However I suggest that each district be named along with the date it
was established. Subsequently, publication revisions should be referenced.
7. Revision dates for Landmark Standards should be included and updated whenever
revisions occur.
8. Add the definition for the term "Site" as it appears under "Scarce Resources"
section.
9. Combine information from "Local Landmarks designation Procedure" into
"Policy for Declaring Poorly Maintained, Endangered or Scarce Resources as
Local Landmarks."
10. After above change, rename Policy for Declaring, etc" as "Local Landmarks
Designation Procedure."
11. Suggestions should be segregated from policy. The phrase "work with" found
throughout the text, flags this. Suggestions that are allowed to remain after
further review should appear under the Summary and Recommendations section.
12. References to preservation authority (HPC) within other local governmental
statutes or ordinances should be added into the Preservation Plan.
Admittedly, these are only some of the more basic changes apparent until this
Commission orders the revision task. Despite all the changes and trade-offs I believe
that the final product will certainly be more comprehensive and perhaps even shorter
than the current version.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: This is the Francis and Mary Hatch
house. It is a circa 1903 Free Classic Queen Anne designed by W.W. Schneider. Francis once worked
for the South Bend Tribune as a reporter and later as an editor. APPLICATION ITEMS: Modify kitchen
windows facing driveway; decrease vertical dimension of window by raising sill approximately 14"
CHAPIN PARK GUIDELINES: C. Windows and Doors. Required. Original windows and doors shall
be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods and hardware.
When deteriorated beyond repair, they shall be replaced with units and trim resembling the original.
Recommended. If new sashes or doors are installed, the existing or original materials, design and
hardware should be used. Prohibited. New window and door openings which would alter the scale' and
proportion of the building may. not be introduced. RECOMMENDATION Windows are elements of
preservation within the Chapin Park local historic district and this house has many large double -hung and
fixed multi -pane windows. As this application proposes a change in the dimensions of two original
windows and the reduction of glass to wall proportions, staff does not recommend approval. .
The owner was not present as he lives in Washington State. The Chair asked if anyone else was present
to represent this C of A. Seeing none, the Chair opened the floor to the public. Seeing none who wanted
to speak, the Chair closed the public portion of the hearing and recognized Commissioners with
questions. Joann Sporleder asked if the house is currently occupied. It is not. She also asked if we are in
communication with the owner. Catherine answered that she spoken to the owner on May 11 and
verbally gave him notice of the meeting date, location and time. Wayne had also met with him before
May I 1 to discuss his plans. The Chair closed this portion of the meeting and entertained a motion.
Martha Choitz: I move that Certificate of Appropriateness 2006-0418, 865 Forest Avenue, the window
shortening, be denied. Timothy Klusczinski seconded the motion.
Joann Sporleder: I am in favor of the denial as the proposal in the application does not follow the . .
guidelines for the district.
Mary Jane Chase: I am voting to deny the application as changes to historic structures often hurt the
resale value of the property.
Todd Zeiger. I am voting in favor of the motion to deny this C of A as it does not follow the guidelines as
set forth for Chapin Park
Lynn Patrick. I am voting to deny application 2006-0418 as it does not meet the guidelines for Chapin
Park specifically the following: Original windows and doors shall be retained including sashes, lintels,
sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they
shall be replaced with units and trim resembling the original. If new sashes or doors are installed, the

Tim Klusczinski: I am voting in favor of the motion to deny the C o A as it would alter the scale of the
building and this is not recommended in the guidelines just mentioned.
Martha Choitz: Raising the lower edge of the windows does not meet the guidelines of Chapin Park and I
vote yes to deny.
Jerry Ujdak: I am voting to deny for the reasons stated previously.
Catherine Hostetler. I vote to deny the CoA as it does alter the scale of the windows and this would be
visible. This is not recommended in the guidelines for Chapin Park
The motion passed 8-0, all in favor of the denial of the Certificate of Appropriateness 2006-0418, 865
Forest Avenue, South Bend, Indiana.
2.2006-0501: 121 Studebaker
Catherine Hostetler read the staff report and the owner, Nina Porter, was present with Ron Perry, who was
representing Dennis Moody, the contractor.
Joann Sporleder moved to approve Certificate of Appropriateness 2006-0501 as presented [with back -
primed tongue and groove porch decking and a shaped rather than squared off handrailj. Jerry Ujdak
seconded the motion and it passed 8-0.
3.2006-0505: Shetterley Park
Catherine Hostetler read the staff report and the Chair then recognized Jason Durr, Assistant City
Engineer and David McCormick, Managing Engineer of Christopher Burke Engineers. A handout of
shallow rooted trees and shrubs from the State Forester was submitted to the Commission. These shallow
rooted trees could be planted over the pipe alignment to shield the pipe without causing damage by
invasive root systems.
Jason Durr stated that the City had recently received approval from IDEM for this proposal. David
McCormick stated that the current plan would reduce the footprint of the project by at least 50% and the
trench width for the project would be reduced with the use of trench boxes (the cuts for the trenches will
be very deep — 30 ft in some cases). The project will also maintain existing grades. Odor control will be
attained through submersion of the pipe; a duckbill valve will no longer be needed.
The City agreed to amend the application to say that the City will replant trees, reseed the area and
provide erosion control.
The Chair recognized members of the public who wished to speak on this matter.
Brendan Crumlish, 1021 Riverside Drive, thanked the engineers for the redesign of the project and noted
his one concern — that the trees mentioned in the State Forester's report were not native species. This
would leave a big question mark for the fixture look of the park. Brendan suggested the use of deep-
rooted trees near the top of the slope and urged that more consideration was needed at this stage for the
landscaping.
Tom Price, 1049 Riverside Drive, also commended the City for its new plan, but was concerned that the
landscaping would not be in-kind and of similar value of what would be removed. He also wondered
what the timetable of construction would be and what types of erosion control would be utilized.
Further discussion occurred and the Chair then entertained a motion.
Timothy Klusczinski: I move to ask the City to amend its application 2006-0505, Shetterley Park, to state
that they will plant deep rooted trees near the top of the slope to the extent practical with a preference for
native trees. Mary Jane Chase seconded the motion and all were in favor of the motion. The City did
provide consent to the amendment. -
Joann Sporleder moved to approve Certificate of Appropriateness 2006-0505, Shetterley Park, as
submitted and amended. Mary Jane Chase seconded the motion and it passes unanimously.

1. 1031 East Jefferson
Catherine reported that 1031 E. Jefferson Blvd had been placed under interim protection. This constituted
First Reading. Staff reported that no response had been received from the bank or from the real estate
agent. The minutes from the May 5b meeting were distributed.
Todd Zeiger moved to accept the May 5th minutes. Mary Jane Chase seconded the motion and it passed
unanimously.
C. NATIONAL REGISTER NOMINATION (None at this time.)
III. REGULAR BUSINESS
A. APPROVAL OF MINUTES - April 19, 2006 .
Todd Zeiger moved to accept the April 19, 2006 minutes. Mary Jane Chased provided the second and the
motion was unanimously approved.
B. TREASURER'S REPORT
Timothy Klusczinski submitted the most recent budget location report.
C. COMMITTEE REPORTS
1. President's Report
Lynn Patrick mentioned 1031 E. Jefferson and noted that the Commission had just accepted the meeting
minutes. She also accepted the resignation of Commission member Diane Wrobel-Illes and thanked her
for her service. Committee Reports will be held off until the June meeting with the exception of Tim's
briefing on the Preservation Plan.
2. Preservation Plan Committee
Tim Klusczinski stated his impressions of the Preservation Plan and his "Big 12" ideas for changes. A
copy of this is included in the meeting binder. Todd Zeiger stated his agreement with Tim's briefing. He
also suggested that the Commission seek funds from the Historic Preservation Fund to hire a consultant to
redraft the plan, involve the public through focus groups and incorporate the upcoming results from the
resurvey of the City and the republishing of the County survey. Martha Choitz asked if other plans had
been consulted, included that of the National Trust. Shawn Peterson voiced his agreement that the Plan
needs to be rewritten, as there are many ambiguous sections. Todd stated that he could come up with
some figures for the project and Lynn asked that Tim's report be included in the June meeting packet.
D. STAFF REPORTS
1. Director's Report
Catherine submitted her report and gave an update on the RestoreMichiana conference and volunteer
scheduling. '
2. Assistant Director's Report
Julie Schutte submitted her last Assistant Director's report and stated her appreciation, thanks and well -
wishes to the Commission members for three very fine years with the Commission.
3. Legal Report
A. Open Door/Sunshine Laws (Nothing new to report.)
B. Oliver School Site — 900 Indiana Avenue
Shawn reported that after reviewing the landmark ordinance for the School, the ordinance was for the
improvement on the site and not the site itself. Catherine stated her agreement of this view. The
ordinance is currently clouding the title of the site and inhibiting redevelopment proposals. Essentially,
approval of demolition nullified the landmark status for this site. Shawn created a resolution that could be
attached to the title of the property if approved by the Commission.
Todd moved to approve Resolution No. 2006-01 regarding the Oliver School site as presented by
Counsel. Mary Jane Chase seconded the motion. A majority of the Commission was in favor of the
motion and it passed. The members in agreement then signed the resolution.
IV. OLD BUSINESS
A. Chapin Park Booklet Distribution Phase
The Chapin Park Neighborhood Association Board is planning a little party and we hope to distribute the
books at that meeting. It should take place in early June.
B. Southhold Awards Breakfast
The breakfast was a success. Todd moved to have Lynn and Staffpresent the award far the Oliver Chilled
Plow to Economic Development/Redevelopment. Joann Sporleder seconded the motion and all were in
favor.
