STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT:
This Free Classic/Queen Anne home was built around 1904. Edwin and Mary Smith were the first residents; and
Mary continued to live there as a widow using it as a boarding house until 1910. From 1912 to 1930 Phero C.
Fergus resided there. It is currently owned by Susan and Victor Butcher.
APPLICATION ITEMS: Vinyl side the house with Georgia Pacific panel .40 gauge, fir out openings around
openings to maintain proper reveal with 3/a" pine (1 by) /.23 gauge coil stock. They want the vinyl for easy
maintenance, as they are getting older. They did not have the resources to finish the project between May 2002-
2004 under their building permit dated 5/22/02. Work to be completed by September 1, 2006.
Chapin Park Standards and Guidelines: H Existing Structures A. Building Materials
Required: Original exterior building materials shall be retained when possible.... The existing architectural detail
around windows, porches, doors and eaves shall be retained or replaced by replicas of the same design when
deteriorated beyond repair.
Recommended: Whenever possible, the original building materials should be restored. When maintaining or
repairing original siding is not feasible, aluminum, vinyl or composite siding may be used. When used over wood
surfaces, this siding should be the same size and style as the original wood. Every effort should be made to retain
the original trim around windows, doors, cornices, gables, eaves and other architectural features.
RECOMMENDATION: Mr. Butcher received a building permit on May 22, 2002 to apply siding to his home.
The siding was not installed and the permit has expired. The house is now part of the Chapin Park Local Historic
District and at the time of designation, March 14, 2005, the house appeared as it does today, a wood clap -board
sided house. Although the house has severely peeling paint, window reconfigurations and removed architectural
trim and drip mouldings, the wood is still in good condition and could be painted. If painted properly the paint
should last 15 years. Mr. Butcher does not want to prep the house and paint it because it would take too long. He
has already invested in some of the materials and has applied vinyl cladding to some windows and corner boards.
According to the 1987 Survey card with house had already undergone major alterations and was covered with
asbestos siding and had aluminum replacement storm windows and doors. There have been additional, significant
changes to the several of the windows on the sides of the house since 1987. The project to re -side the house was
started in 2002, prior to the local district designation, but the project was never completed and the permit expired.
Staff recommends approval of the vinyl siding with the stipulation that it only cover the clapboards and leaves the
shingles in the gables exposed and that the dentil work on the porch remain in tact.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: Leeper Park is a designed landscape
located in South Bend, Indiana in a residential area immediately north of the Downtown commercial
district of the city. In 1911, noted landscape architect George Kessler prepared a master plan for south
Bend to develop a citywide park and boulevard system. Leeper Park became a focal point within
Kessler's Plan.
APPLICATION ITEMS: To connect the existing sidewalk segment, located in the northern section of
Leeper Park along Riverside Drive, with a new five-foot wide concrete sidewalk to the segment of sidewalk at
Riverside Drive on the top of the bluff. (See attached color scale drawing, Exhibit A) The connecting sidewalk
will be approximately 355 feet long and it will have an access ramp directly across from the access ramp for
the sidewalk on the south side of Riverside Drive in Leeper Park. (The work on the south side was approved
by the Commission in COA #2006-0306A on March 20, 2006)
Standards for Leeper Park: 9.5 Circulation #3 Alteration of existing or addition of new circulation
layouts will be considered if it can be shown that better site circulation is necessary and that the alteration
does not alter the basic concept of the historic landscape design.
RECOMMENDATION: Kessler's sketch of his plan for Leeper Park is the basis for the landscape
landmark. In Kessler's sketch the area for the proposed sidewalk is not developed. (See Exhibit B).
An "informal" pathway connecting these two sidewalk segments has developed over the last century. Staff
recommends approval, as it does not alter the basic concept of the historic landscape design.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: Henriette and John B. Metzger
purchased this property in the 1870s and built their home in 1875. The home is a fine example of an
Italianate country villa. The house and property were landmarked in 1976.. Carla and Theron Roberts are
th6 current owners.
APPLICATION ITEMS: (Please refer to the sketch and photographs). Basically the homeowners wish to
clear out the dead and volunteer trees along with the dense undergrowth in the wooded area surrounding their
home in order to create a healthier environment for the mature trees and to create a green space and garden
between the wooded areas surrounding the house and the house. To remove/trim old growth trees that threaten
windmill that the Roberts wish to restore.
LOCAL LANDMARK STANDARDS: Building Site and Landscaping
Required: Major landscaping items, trees, fencing.... which reflect the property's history and
development shall be retained....
Recommended: New site work should be based upon actual knowledge of the past appearance of the
property found in photographs, drawings and newspapers. Plant materials and trees in close proximity to
the building that are causing deterioration to the building's historic fabric should be removed...
Prohibited: No changes may be made to the appearance of the site by removing major landscaping
items, trees, fencing ... and other elements before evaluating their importance to the property's history and
development.
RECOMMENDATION: Staff met with Carla and David at their home on May 25, 2006 to review their
concept for the landscaping. The wooded lot is over grown and dead limbs are falling off of trees and onto the
cars, deck and windmill at the rear of the house and also pose a threat to the main part of the house. The
landscaping features will follow the grass and tree landscaping features typical of rural Italianate homes
pictured in the St. Joseph County 1875 Atlas. The proposed work will improve the health of the remaining
trees around the house and retain the tree buffer between the house and US 23 and the subdivision. Staff
recommends approval.

Project Review:
John B. Metzger property, constructed 1875, landmarkcd 1976.
No work done outside for the last 10+ years. Many dead trees and `volunteer' maple trees
cover both the east and west sides of the two -acre property.
Proposal:
On the west side of the house, cut out dead trees and volunteers. Leave trees as indicated on
sketch to maintain the wooded nature of the property, but undo the damage that has resulted
from year, s of neglect. Create a green.space while enban. cing the viability of the trees that
remain so as not to present a threat to the house. Maintain the buffer of flowering plants
adjacent to the house at the base of the tree row. This will enhance the appearance of the
property and give a better view of the house approaching from the west.
On the north side of the gazebo, remove/trim some old growth trees that threaten the windmill,
which we would like to restore. Many trees remain on the north edge, which backs up to other
houses in Covington Shores, phase 3.
On the east part of the property, out out dead trees and volunteers. This area will be maintained
as a wooded area.

Il. PUBLIC HEARING
A. CERTIFICATES OF APPROPRIATENESS
1.2006-0418: 865 Forest Avenue
The Chair recognized Catherine Hostetler to read the Staff Report.
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: This is the Francis and Mary Hatch
house. It is a circa 1943 Free Classic Queen Anne designed by W.W. Schneider. Francis once worked
for the South Bend Tribune as a reporter and later as an editor. APPLICATION ITEMS: Modify kitchen
windows facing driveway; decrease vertical dimension of window by raising sill approximately 14"
CHAPIN PARK GUIDELINES: C. Windows and Doors. Required. Original windows and doors shall
be retained including sashes, lintels, sills, shutters, decorative glass, pediments, hoods and hardware.
When deteriorated beyond repair, they shall be replaced with units and trim resembling the'original. J
Recommended. If new sashes or doors are installed, the existing or original materials, design and
hardware should be used. Prohibited. New window and door openings which would alter the scale and
proportion of the building may not be introduced. RECOMMENDATION Windows are elements of
preservation within the Chapin Park local historic district and this house has many large double -hung and
fixed multi -pane windows. As this application proposes a change in the dimensions of two original
windows and the reduction of glass to wall proportions, staff does not recommend approval.
The owner was not present as he lives in Washington State. The Chair asked if anyone else was present
to represent this C of A. Seeing none, the Chair opened the floor to the public. Seeing none who wanted
to speak, the Chair closed the public portion of the hearing and recognized Commissioners with
questions. Joann Sporleder asked if the house is currently occupied. It is not. She also asked if we are in
communication with the owner. Catherine answered that she spoken to the owner on May 11 and
verbally gave him notice of the meeting date, location and time. Wayne had also met with him before
May I 1 to discuss his plans. The Chair closed this portion of the meeting and entertained a motion.
Martha Choitz: I move that Certificate of Appropriateness 2006-0418, 865 Forest Avenue, the window
shortening, be denied. Timothy Klusczinski seconded the motion.
Joann Sporleder: I am in favor of the denial as the proposal in the application does not follow the
guidelines for the district.
Mary Jane Chase: I am voting to deny the application as changes to historic structures often hurt the
resale value of the property.
Todd Zeiger: I am voting in favor of the motion to deny this C of A as it does not fallow the guidelines as
set forth for Chapin Park.
Lynn Patrick: I am voting to deny application 2006-0418 as it does not meet the guidelines far Chapin
Park, specifically the following: Original windows and doors shall be retained including sashes, lintels,
sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they
shall be replaced with units and trim resembling the original. If new sashes or doors are installed, the
existing or original materials, design and hardware should be used. And in particular thefinding that
new window and door opening, which would alter the scale and proportion of the building, may not be
introduced.
Tim Klusczinski: I am voting in favor of the motion to deny the C o A as it would alter the scale of the
building and this is not recommended in the guidelines just mentioned.
Martha Choitz: Raising the lower edge of the windows does not meet the guidelines of Chapin Park and I
vote yes to deny.
Jerry Ujdak: I am voting to deny for the reasons stated previously.
Catherine Hostetler: I vote to deny the CoA as it does alter the scale of the windows and this would be
visible. This is not recommended in the guidelines for Chapin Park.
The motion passed 8-0, all in favor of the denial of the Certificate of .Appropriateness 2006-0418, 865
Forest Avenue, South Bend, Indiana.
2.2006-0501: 121 Studebaker
Catherine Hostetler read the staff report and the owner, Nina Porter, was present with Ron Perry, who was
representing Dennis Moody, the contractor.
Joann Sporleder moved to approve Cert f tate of Appropriateness 2006-0501 as presented [with back -
primed tongue and groove porch decking and a shaped rather than squared off handrail]. Jerry Ujdak
seconded the motion and it passed 8-0.
3.2006-0505: Shetterley Park
Catherine Hostetler read the staff report and the Chair then recognized Jason Durr, Assistant City
Engineer and David McCormick, Managing Engineer of Christopher Burke Engineers. A handout of
shallow rooted trees and shrubs from the State Forester was submitted to the Commission. These shallow
rooted trees could be planted over the pipe alignment to shield the pipe without causing damage by
invasive root systems.
Jason Durr stated that the City had recently received approval from IDEM for this proposal. David
McCormick stated that the current plan would reduce the footprint of the project by at least 50% and the
trench width for the project would be reduced with the use of trench boxes (the cuts for the trenches will
be very deep — 30 ft in some cases). The project will also maintain existing grades. Odor control will be
attained through submersion of the pipe; a duckbill valve will no longer be needed.
The City agreed to amend the application to say that the City will replant trees, reseed the area and
provide erosion control.
The Chair recognized members of the public who wished to speak on this matter.
Brendan Crumlish, 1021 Riverside Drive, thanked the engineers for the redesign of the project and noted
his one concern — that the trees mentioned in the State Forester's report were not native species. This
would leave a big question mark for the future look of the park. Brendan suggested the use of deep-
rooted trees near the top of the slope and urged that more consideration was needed at this stage for the
landscaping.
Torn Price, 1049 Riverside Drive, also commended the City for its new plan, but was concerned that the
landscaping would not be in-kind and of similar value of what would be removed. He also wondered
what the timetable of construction would be and what types of erosion control would be utilized.
Further discussion occurred and the Chair then entertained a motion.
Timothy Klusczinski: I move to ask the City to amend its application 2006-0505, Shetterley Park, to state
that they willplant deep rooted trees near the top of the slope to the extentpractical with a preference for
native trees. Mary Jane Chase seconded the motion and all were in favor of the motion. The City did
provide consent to the amendment.'
Joann Sporleder moved to approve Certificate of Appropriateness 2006-0505, Shetterley Park, as
submitted and amended. Mary Jane Chase seconded the motion and it passes unanimously.
B. LANDMARKS
1. 1031 East Jefferson
Catherine reported that 1031 E. Jefferson Blvd had been placed under interim protection. This constituted
First Reading. Staff reported that no response had been received from the bank_ or from the real estate.
agent. The minutes from the May 5`s meeting were distributed.
Todd Zeiger moved to accept the May 5`h minutes. Mary Jane Chase seconded the motion and it passed
unanimously.
C. NATIONAL REGISTER NOMINATION (None at this time.)
III. REGULAR BUSINESS
A. APPROVAL OF MINUTES - April 19, 2006
Todd Zeiger moved to accept the April 19, 2006 minutes. Mary Jane Chased provided the second and the
motion was unanimously approved.
B. TREASURER'S REPORT
Timothy Klusczinski submitted the most recent budget location report.
C. COMMITTEE REPORTS
1. President's Report
Lynn Patrick mentioned 1031 E. Jefferson and noted that the Commission had just accepted the meeting
minutes. She also accepted the resignation of Commission member Diane Wrobel-Illes and thanked her
for her service. Committee Reports will be held off until the June meeting with the exception of Tim's
briefing on the Preservation Plan.
2. Preservation Plan Committee
Tim Klusczinski stated his impressions of the Preservation Plan and his "Big 12" ideas for changes. A
copy of this is included in the meeting binder. Todd Zeiger stated his agreement with Tim's briefing. He
also suggested that the Commission seek funds from the Historic Preservation Fund to hire a consultant to
redraft the plan, involve the public through focus groups and incorporate the upcoming results from the
resurvey of the City and the republishing of the County survey. Martha Choitz asked if other plans had
been consulted, included that of the National Trust. Shawn Peterson voiced his agreement that the Plan
needs to be rewritten, as there are many ambiguous sections. Todd stated that he could come up with
some figures for the project and Lynn asked that Tim's report be included in the June meeting packet.
D. STAFF REPORTS
1. Director's Report
Catherine submitted her report and gave an update on the RestoreMichiana conference and volunteer
scheduling.
2. Assistant Director's Report
Julie Schutte submitted her last Assistant Director's report and stated her appreciation, thanks and well -
wishes to the Commission members for three very fine years with the Commission.
3. Legal Report
A. Open Door/Sunshine Laws (Nothing new to report.)
B. Oliver School Site — 900 Indiana Avenue
Shawn reported that after reviewing the landmark ordinance for the School, the ordinance was for the
improvement on the site and not the site itself. Catherine stated her agreement of this view. The
ordinance is currently clouding the title of the site and inhibiting redevelopment proposals. Essentially,
approval of demolition nullified the landmark status for this site. Shawn created a resolution that could be
attached to the title of the property if approved by the Commission.
Todd moved to approve Resolution No. 2006-01 regarding the Oliver School site as presented by
Counsel. Mary Jane Chase seconded the motion. A majority of the Commission was in favor of the
motion and it passed. The members in agreement then signed the resolution.
IV. OLD BUSINESS
A. Chapin Park Booklet Distribution Phase
The Chapin Park Neighborhood Association Board is planning a little party and we hope to distribute the
books at that meeting. It should take place in early June.
B. Southhold Awards Breakfast
The breakfast was a success. Todd moved to have Lynn and Staff present the award far the Oliver Chilled .
Plow to Economic Development/Redevelopment. Joann Sporleder seconded the motion and all were in
favor.
V. ADJOURNMENT
Catherine Hostetler moved to adjourn. Tim Klusczinski seconded the motion and all were in favor. The

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: The Burke Building is a two storey
Colonial Revival style commercial structure constructed by W. W. Schnieder Construction Company in
1928 for Morris Burke, his wife Meriam and their children, Jacob Burke, Sara Burke Richman and her
husband, Isadore.
APPLICATION ITEMS: Complete Tear Off of roof and replacement of wood decking with7/16 OSB board
as needed. Compete re -roof with 45 black EPDM single -ply rubber roof system with EPS tapered roof
insulation; '/i" mechanically fastened fiber insulation. Remove coping tile on North and West sides and install
treated wood nailer and metal cap if original non-contributing coping tiles too fragile to be removed and
replaced. South and East parapet walls termination method will include installation of ter bar below the
existing tile with wall anchors to protect terra cotta. Mortar joints between the tiles would be caulked as
needed or could be ground and re -mortared. Existing skylights could be removed, the glass reworked as
needed and replaced a minimum cost.
Group B Standards: B. Treatment. Treatment shall be defined as any change of surface materials that will not
alter the style or original form. Such improvements include re -roofing, glazing ... A treatment change of any
surface whether on the landmark or its environment may require a Certificate of Appropriateness .... The
commission should review the proposed treatment for character and style consistency with the original
surfaces.
RECOMMENDATION: Staff recommends approval. None of the proposed work will alter the style or
original form of the Burke Building. The removal of non contributing tiles and their replacement with painted
metal will not be visible from the street. The Contractor, Ingwald Johnson, and the UEA should evaluate the
economic feasibility of the skylights and report to the HPC their course of action, as these feature are not
visible from the street.

Please find attached materials that comprise the Urban Enterprise
Association of South Bend, Inc (UEA) Certificate of
Appropriateness (COA) request to petition the Historic
Preservation Commission (HPC) for replacement of the roof at
1019 S. LVfichigan Street in South Bend. The following additional
information is to serve as a supplement to the attached materials.
Background
The UEA purchased the property in January 2001 with the intent
of securing the property and marketing it for resale for an
appropriate reuse. At the time of purchase, the building roof had
showed signs of periodic leaks, particularly in an area near the
southwest corner, surrounding the existing skylight. We had the
roof evaluated soon after purchase and found that inappropriate
materials (including a pole urethane foam spray-) combined with
sloppy repair methods left it in poor condition, ultimately needing
replacement. Marketing,* efforts were initiated, with the intention
of having the purchaser assume the costs of future root repair or
replacement as part of the sale arran0rement.
,Marketing efforts have been recently hampered over the last
several months as the roof leaks significantly worsened. Further
evaluation this spring has revealed a complete saturation of
underlying roof layLrs, especially the western third. including the
aforementioned skylight area. The UEA subsequently pursued
proposals for temporary repairs to this problem area of t:ie roof by
askin, for contractor quotes. No responses were received. The
UEA subsequently quoted a larger group of contractors. this time
asking for proposals for replacement and/or repair. Responses
were received from two contractors f6r roof replacement. each
commenting that roof conditions would prohibit repairs.
At their June 5. 2006 meeting, the UEA Board of Directors
approved the replacement of the root for a budget of 550.000.
Ingwald Johnson of Plymouth. Indiana was awarded the work
bused upon a proposal initially submitted on April IS and revised
on June 5. Please find these proposals also attached.
Contractor Proposal — Additional Information
There are currently 36 penetrations in the roof comprised of curbs.
caps. vent stacks. and chimneys. While the proposal includes
removal of all penetrations, the UEA prefers to maintain a
minimum number of these penetrations in anticipation of the
desired reuse alternatives for the property. As you'll note in these
proposals, the contractor has included removal of the 3 existing
skylights and the clay coping tile on the North and Nest parapet
walls. In an attempt to minimize disruption to these historic
elements and obtain additional project details, the UEA
subsequently requested the following additional information from
the contractor (items are included within initial cost of proposal
except where noted):
• Existing skylights could be removed, the glass reworked as
needed, and replaced at a minimal cost.
• Existing clay coping on the west and north walls may be
removed, replaced. and caulked depending on the condition
and the termination would occur under the tile. If existing
tiles prove to be fragile, sheet metal noted in the proposaly
will be used. Foam�overspray cannot be removed from
existing? tile.
• The termination method for the east and south parapet
walls will include installation. of aluminum ter bar below
existing tile with wall anchors. Mortar joints between the
tiles would be caulked as needed or could be Ground and
re -mortared at an additional cost.
• Roof materials would inciude the following in order of
application: 71116 OSB board, EPS tapered roof insulation:
'. inch mechanically fastened fiber; and 15, black EPDNI
single -ply rubber.
• Lower roof area would also be addressed with same
materials and installation methods.
As you know. earlier this year the UEA proceeded , with having the
building and property cleared of debris and other clutter. You are
also aware that the UEA recently approved a budget of 5-5.000 to
help fund a national media campaign for the property in
partnership with the HPC and Historic Landmarks of Indiana. The
UEA anticipates that replacement of the roof would serve as an
excellent complement to their ongoing efforts to attract a suitable
use for the building and further improve the S. Nlichigan Street
corridor. The UEA would greatly appreciate approval of the
attached COA request from the HPC.

HPC Meeting — 06.19.2006
■ Reported for First Day of Work!
■ Visited Navarre Cabin worksite at Leeper Park w/Commissioners Patrich,
Zeiger, Klusczinshy and HPC Director Catherine Hostetler and toured
completed restoration.
■ Visually inspected outside of home in N. St. Joseph LHD now being used as a
Logan group home w/HPC Director.
■ Toured LHD's by car with HPC Preservation Specialist Wayne Doolittle.
■ Visited 1013 E. Jefferson w/.Wayne Doolittle to assess and photograph possible
water damage to home on behalf of new homeowners.
■ Created first edition of quarterly newsletter The Commission Chronicle. The
newsletter will be sent to all homeowners in LHD's
■ Presented Central High School with its Landmark plaque and prepared a flyer
to be distributed to all tenants regarding Central's status as a Historic
Landmark.
■ Prepared and forwarded LHD legal definition information to John Carlson of
County GIS.
■ Proofread and corrected several sections of County Survey.
■ Met with Andy Laurent of Economic and Community Development.

I. CALL TO ORDER, ROLL CALL: Lynn Patrick called the meeting to order at 7:32 pm
II. PUBLIC HEARING
A. CERTIFICATES OF APPROPRIATENESS
Shawn Peterson [Counsel] and Catherine Hostetler point out to the Commission that there will
be an amended agenda for tonight's meeting to include the CoA 2006-0615A The Burke
Building. An amended agenda was not printed, but Catherine Hostetler reminds the
Commissioners that they received a copy of the new CoA in the mail. Lynn Patrick confirms that
she did receive said by mail.
Todd Zeiger moves to accept the amended agenda to include CoA 2006-0615A, Gerald Ujdak
seconds and the motion carries unanimously. The Commission will hear said CoA.
1.2006-0606: 817 Leland Avenue
The Chair recognized Catherine Hostetler to read the Staff Report.
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: This Free Classic/Queen Anne home
was built around 1904. Edwin and Mary Smith were the first residents; and Mary continued to live there
as a widow, using it as a boarding house until 1910. From 1912 to 1930 Phero C. Fergus lived there. It is
currently owned by Susan and Victor Butcher.
APPLICATION ITEMS: Vinyl side the house with Georgia Pacific panel .40 gauge, fir out openings
around openings to maintain proper reveal with'/<" pine (lby)/.23 gauge coil stock. They want the vinyl
for easy maintenance as they are getting older. They did not have the resources to finish the project
between May 2002-2004 under the building permit dated 5/22/02. Work to be completed by September
1, 2006. -
CHAPIN PARK GUIDELINES: II Existing Structures A. Building Materials
Required: Original exterior building materials shall be retained when possible ... The existing
architectural detail around windows, porches, doors and eaves shall be retained or replaced by replicas of
the same design when deteriorated beyond repair.
Recommended: Whenever possible, the original building materials should be restored. When
maintaining or repairing original siding is not feasible, aluminum, vinyl or composite siding may be used.
When used over wood surfaces, this siding should be the same'size and style as the original wood. Every
effort should be made to retain the original trim around windows, doors, cornices, gables, eaves and other
architectural features.
RECOMMENDATION:
Mr. Butcher received a building permit on May 22, 2002 to apply siding to his home. The siding was not
installed and the permit has expired. The house is now part of the Chapin Park Local Historic District and
at the time of designation, March 14, 2005, the house appeared as it does today, a wood clap=board sided
house. Although the house has severely peeling paint, window reconfigurations and removed architectural
trim and drip mouldings, the wood is still in good condition and could be painted. If painted properly the
paint should last 15 years. Mr. Butcher does not want to prep the house and paint it because it would take
too long. He has already invested in some of the materials and has applied vinyl cladding to some
windows and corner boards. According to the 1987 Survey card with house had already undergone major
alterations and was covered with asbestos siding and had aluminum replacement storm windows and
doors. There have been additional, significant changes to the several of the windows on the sides of the
house since 1987. The project to re-side the house was started in 2002, prior to the local district
designation, but the project was never completed and the permit expired.
Staff recommends approval of the vinyl siding with the stipulation that it only cover the clapboards and
leaves the shingles in the gables exposed and that the dentil work on the porch remain in tact.
The Chair recognizes the homeowners, Vic and Susan Butcher to speak on behalf of this project. Mrs.
Butcher offers that several modifications have been made to the house, even before they purchased it. So,
it is difficult to say exactly what the original appearance of the exterior would be, and would be
impossible to replicate the original appearance. The Chair opens the discussion to include
Commissioners that may have questions regarding the CoA.
Tim Klusczinski asks if the siding has already been purchased, and asked what the .40 gauge refers to-
either inches or centimeters. Mr. Butcher replies that the siding has not yet been purchased, but that he
has already made some investment in preparing the house for the work. Mr. Butcher adds that he's not
sure if the measurement is in inches or centimeters.
Linda Riley (referring to photos provided to the Commission) asks the homeowners about the condition of
the house right now, and whether or not the photos show peeling paint, or a stripped fagade. Mrs.
Butcher answers that the front of the house has been stripped, and states that upon removal of the
shingles a lot of the wood was found to be in poor condition. Mr. Butcher adds that he's not sure what the
material of the shingles was, but thinks that it was asphalt and not asbestos and assures the Commission
that materials were disposed of properly.
Lynn Patrick questions the condition of the wood clapboards. Mr. Butcher answers that some of the
clapboards aren't in bad shape overall, but that some portions of the exterior have taken the brunt of the
weather etc, so it varies by location. Lynn Patrick also asks the homeowner to estimate the cost of
project. Mr. Butcher replies that the project should be in the $4000 range to complete.
Mary Jane Chase questions the details of the CoA and wishes for clarification on what will or will not be
sided. Mr. Butcher answers that the exposed areas of detail work, gables etc. will be restored and
painted. Mr. Butcher notes that there are only two areas that wouldn't be sided as the clapboards cover
almost the entire surface of the exterior with the exception of the gable that includes a window and faces
Leland Avenue, and the overhang of the porch.
Tim Klusczinski asks if destruction of the sill ears would be necessaryfor installation of the j-channel.
Mr. Butcher replies that it will not be necessary to do so. Mr. Butcher reassures the Commission that in
his opinion, from the street one will not be able to tell that the siding is vinyl, as it is his intention to
restore the historically accurate appearance of the house as much as possible with as little maintenance
as required. Tim Klusczinski questions that the house is properly insulated. Mr. Butcher confirms that
there is blown in insulation.
Gerald Ujdak question the homeowners on what type of siding their considering, either Twin 4 or S? Mr.
Butcher answer that they're now leaning towards the Triple-3 siding as it most closely resembles the
original clapboards which are 3 and 5/8s. Gerald Ujdak also inquires after color selection. Mrs.
Butchers answers that the siding will be beige or ecru. The accent and picture framing will be cranberry
in color, as shown in the photos provided to the Commission.
Todd Zeiger asks the homeowners their intention regarding soffits and eaves. Mr. Butcher answers that
he would prefer to encapsulate them with an aluminum product. Mr. Butcher recognizes that some work
will have to be done to give a uniform appearance to ensure the trim meets the siding.
There were no public comments.
Shawn Peterson [Counsel] verifies with the homeowners that the homeowners are aware of and intend to
comply with the conditions of the CoA, specifically that they intend to leave the gables and detail exposed.
The Butcher's reply that some of the decorative elements will have to be replaced as they have
deteriorated beyond the point of repair, but do intend to replace the decorative pieces in kind to preserve
the appearance. Mr. Butcher asks the Commission for the recommendation on this matter, and Todd
Zeiger replies that the staff recommendations are what they are, and are stated in the CoA. Catherine
Hostetler replies that eaves are excluded from specific mention in the current CoA, but offers that the
encapsulating of the band boards and soffits can be stipulated. Mrs. Butcher states that she believes that
the best course of action regarding those elements will reveal itself during the project. Lynn Patrick
notes that the homeowners are looking for some guidance on their project. Todd Zeiger implores the
Commission to be sure that their approval is consistent regarding the appearance of the house. Linda
Riley asks the homeowner if it is prudent to mix vinyl and aluminum. The homeowner replies yes. Todd
Zeiger consults Shawn Peterson [Counsel] regarding the fact that MIM Butcher received a building
permit for this work before the creation bf the Chapin Park LHD and the guidelines of said. Shawn
Peterson [Counsel] responds that in letting the permit expire, the homeowners are now bound by the
guidelines that have since been adopted.
Gerald Ujdak suggests that the process be expedited, and the CoA be considered only as presented with
the understanding that some other details of the project be left for "another time" as it is obvious that the
homeowners are looking for some guidance in their decision-making. Lynn Patrick, Gerald Ujdak and the
Mr. Butcher discuss their hope that the clear solution to this point presents itself during the project. As
the soffit and eaves were not specifically mentioned in the current CoA, Catherine Hostetler verifies that
those items can be addressed in a separate CoA. Mr.Butcher asks that if he constructs his scaffolding
and begins his work, will he be in violation at any time. Mr. Butcher requests the option of either vinyl
siding to the soffit and then using an aluminum project on the facia, or merely using the siding on the
clapboards and then scraping and painting the overhangs. Martha Choitz asks the homeowner to verify
that they won't change the type of siding mid project and thereby change the appearance of the house.
The homeowners confirm that they will not change their choice ofsiding.
Tim Klusczinski states that he is unclear on approving a CoA as it appears and wishes to rework it as
there aren't any specifications regarding gauge thickness, and would prefer to see a sample of the
product to ensure the appearance of the house. Mr. Butcher offers to bring a sample for a review.
Tim Klusczinski suggests that Preservation Specialist Wayne Doolittle inspect a sample of the product
and compare it to the original clapboards. However, Wayne Doolittle is out of town. Mr. Butcher
responds that if you hold a piece of the Triple -3 siding up next to the house, they appear identical.
Shawn Peterson [Counsel] asks the homeowners if they wish to modem their CoA to include the option to
either paint or use the aluminum product on specified areas. The homeowners replied yes, as they're not
yet sure what is the most prudent course of action.
Lynn Patrick moves to approve 2006-0606 817 Leland "with the understanding that they (the
homeowners) have the option of vinyling and soffit with aluminum vents and soffit or to scrape and
paint the overhang, and that we would like only cover the clapboards and leave the shingles and the
gables exposed." "Also the dentil work on the porch will remain in tact or will be replaced in kind".
The homeowners confirm that those conditions are clear. Mary Jane Chase seconds the motion as
stated. The vote is 7-1, Todd Zeiger voted not to approve.
Catherine Hostetler instructs the homeowners on the next step in the process, including receipt of their
CoA and proceeding with the Building Department. The homeowners thanked the Commission.
2.2006-0608: Leeper Park West
The Chair recognized Catherine Hostetler to read the Staff Report.
STATEMENT OF SIGNIFICANCE/IIISTORIC CONTEXT: Leeper Park is a designed landscape
located in South Bend, Indiana in a residential area immediately north of the Downtown commercial
district of the city. In 1911, noted landscape architect George Kessler prepared a master plan for south
Bend to develop a citywide park and boulevard system. Leeper Park became a focal point within
Kessler's Plan.
APPLICATION ITEMS: To connect the existing sidewalk segment, located in the northern section of
Leeper Park along Riverside Drive, with a new five-foot wide concrete sidewalk to the segment of
sidewalk at Riverside Drive on the top of the bluff. (See attached color scale drawing, Exhibit A) The
connecting sidewalk will be approximately 355 feet long and it will have an access ramp directly across
from the access ramp for the sidewalk on the south side of Riverside Drive in Leeper Park. (The work on
the south side was approved by the Commission in COA #2006-0306A on March 20, 2006)
STANDARDS FOR LEEPER PARK: 9.5 Circulation #3: Alteration of existing or addition of new
circulation layouts will be considered if it can be shown that better site circulation is necessary and that
the alteration does not alter the basic concept of the historic landscape design.
RECOMMENDATION: Kessler's sketch of his plan for Leeper Park is the basis for the landscape
landmark. In Kessler's sketch the area for the proposed sidewalk is not developed. (See Exhibit B).
An "informal" pathway connecting these two sidewalk segments has developed over the last century.
Staff recommends approval, as it does not alter the basic concept of the historic landscape design.
Jason Durr, Assistant City Engineer for the City of South Bend was recognized to speak on behalf of the
project. Mr. Durr indicated that the sidewalk had been the request of public that use the park and those
that live near it, as foot traffic was already wearing a path in the grass. That path will be replaced by a S
foot concrete sidewalk. Due to a guardrail and river crossing, the sidewalk can only extend so far, and
users will have to cross on the West side of Lafayette.
Todd Zeiger asked a question of Mr. Durr regarding an item that appeared on the map, and whether or
not that item was covered in a separate CoA. Mr. Durr clarified that it was.
There were no public comments.
Todd Zeiger moved to approve CoA 2006-0608 Leeper Park West, the motion was seconded by Tim
Klusainski and Gerald Ujdak. The motion passed unanimously.

The Chair recognized Catherine Hostetler to read the Staff Report.
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: Henriette and John B. Metzger
purchased this property in the 1870s and built their home in 1875. The home is a fine example of an
Italianate country villa. The house and property were landmarked in 1976. Carla and Theron Roberts are
the current owners.
APPLICATION ITEMS: (Please refer to the sketch and photographs). Basically the homeowners wish
to clear out the dead and volunteer trees along with the dense undergrowth in the wooded area
surrounding their home in order to create a healthier environment for the mature trees and to create a
green space and garden between the wooded areas surrounding the house and the house. To remove/trim
old growth trees that threaten windmill that the Roberts wish to restore.
LOCAL LANDMARK STANDARDS: Building Site and Landscaping
Required: Major landscaping items, trees, fencing... which reflect the property's history and
development shall be retained..:.
Recommended: New site work should be based upon actual knowledge of the past appearance of the
property found in photographs, drawings and newspapers. Plant materials and trees in close proximity to
the building that are causing deterioration to the building's historic fabric should be removed...
Prohibited: No changes may be made to the appearance of the site by removing major landscaping
items, trees, fencing ... and other elements before evaluating their importance to the property's history and
development.
RECOMMENDATION: Staff met with Carla and Theron at their home on May 25, 2006 to review
their concept for the landscaping. The wooded lot is over grown and dead limbs are falling off of trees
and onto the cars, deck and windmill at the rear of the house and also pose a threat to the main part of the
house. The landscaping features will follow the grass and tree landscaping features typical of rural
Italianate homes pictured in the St. Joseph County 1875 Atlas. The proposed work will improve the
health of the remaining trees around the house and retain the tree buffer between the house and US 23 and
the subdivision. Staff recommends approval.
Carla Roberts, the homeowner, was recognized by the Chair to speak on behalf of the project. Mrs.
Roberts states that in the year that they've owned the house they have not done any work to the
landscaping as they have been busy working on the inside of the house. Mrs. Roberts distributed the
original copies of the CoA application photos as they'd copied poorly because they had been faxed into
the HPC office. The Commissioners expressed their thanks. Mrs. Roberts stated that her goal was to
maintain the appropriateness of the appearance of the house and landscaping. The homeowners plan to
restore the North and South lawns and remove construction gravel that was used during the building of a
nearby. subdivision. Mrs. Roberts has contacted, and will have, the expertise of the City Forester to, assist
in this project.
Further, the homeowners will restore the original windmill on the property at a later time. Lynn Patrick
responds that there are many resources and experts on windmills should the homeowners need some
guidance. Mrs. Roberts declines to have that additional work included on this CoA„ but will seek another
CoA later for the windmill restoration.
Gerald Ujdak questions Mrs. Roberts on what types of trees are on her property. Mrs. Roberts replies
that she's not sure what all is growing there. Some pines, maples and oaks for sure, but she's not sure
specifically what types.
There were no public comments.
Martha Choitz moves to approve CoA 2006-0608A 14297 US23, the motion is seconded by Todd
Zeiger. The motion: passes unanimously.
4.2006-0615A The Burke Building - The Chair recognized Catherine Hostetler to read the Staff Report.
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT: The Burke Building is.a two story
Colonial Revival style commercial structure constructed by W. W. Schnieder Construction Company in
1928 for Morris Burke, his wife Meriam and their children, Jacob -Burke, -Sara Burke Richman and her
husband, Isadore.
APPLICATION ITEMS: Complete Tear Off of roof and replacement of wood decking with7/16 OSB
board as needed. Compete re -roof with 45 black EPDM single -ply rubber roof system with EPS tapered
roof insulation; %i" mechanically fastened fiber insulation. Remove coping tile on North and West sides
and install treated wood nailer and metal cap if original non-contributing coping tiles too fragile to be
removed and replaced. South and East parapet walls termination method will include installation of ter
bar below the existing tile with wall anchors to protect terra cotta. Mortar joints between the tiles would
be caulked as needed or could be ground and re -mortared. Existing skylights could be removed, the glass
reworked as needed and replaced a minimum cost.
LOCAL LANDMARK STANDARDS: Group B Standards: B. Treatment. Treatment shall be
defined as any change of surface materials that will not alter the style or original form. Such
improvements include re -roofing, glazing ... A treatment change of any surface whether on the landmark
or its environment may require a Certificate of Appropriateness. The commission should review the
proposed treatment for character and style consistency with the original surfaces.
RECOMMENDATION: Staff recommends approval. None of the proposed work will alter the style or
original form of the Burke Building. The removal of non-contributing tiles and their replacement with
painted metal will not be visible from the street. The Contractor, Ingwald Johnson, and the UEA should
evaluate the economic feasibility of the skylights and report to the HPC their course of action, as these
features are not visible from the street.
Chris Dressel of UEA, ( Urban Enterprise Association) is recognized by the Chair to speak on behalf of
the project. Mr. Dressel states that the roof repair is necessary to assist his efforts to market the building
to potential buyers, which they have been doing since the UEA took ownership of the building in 2004.
The issues with the roof are causing damage inside the building, and very much detracting from the
overall appearance of the building. Mr. Dressel also states the negotiations with the contractor, Ingwald
Johnson (present at meeting) will allow for the matter of the skylights to be addressed once work begins,
and also explains that the historically significant features of the architecture including the terracotta and
decorative medallions will not be endangered. The skylights, not visible from the street may either be
repaired or removed depending on what is determined to be the most prudent course of action. Mr.
Dressel reiterates how helpful a proper roof would be to the redevelopment efforts of this property.
Mary Jane Chase inquires what the zoning is for the site and what the original configuration of the
additional floor of the building is. The second floor of the building was not occupied by the original
builders or subsequent owners. The building is currently zoned "Local Business ", which would not allow
for residential tenants.
Todd Zeiger inquires about downspouts. Mr. Dressel responds that the building has internal drains.
Todd emphasizes the importance of having the building occupied or under renovation by winter so that
the internal drains in the building don't freeze and cause further damage.
Lynn Patrick questions the availability of using the second floor of the building for housing, and the
possibility of rezoning. The second floor of the building is subdivided into 16 efficiency apartments. It
is the original configuration and is still in tact. Mr. Dressel indicated that the UEA considers every
situation differently, and so the UEA would consider pursuing rezoning the location if a potential client
wished to utilize the upstairs for rental units.
Gerald Ujdak inquires if the skylights leak or if they will be maintained or removed? Mr. Dressel replies
that they may not currently be leaking, but have obviously been an issue in the past. No decision has
been made yet, but will be based on the recommendation of the contractor when the project reaches that
point.
Todd Zeiger publicly thanks UEA for taking the lead on the marketing of this building, and for the
investment of the roof project.
Lynn Patrick requests that UEA provide the HPC with updates regarding this project and the decision
regarding the skylights. Mr. Dressel agrees to do so, and thanks the Commission for hearing the CoA.

B. LANDMARKS
1. 1013 East Jefferson
Catherine Hostetler reported to the Commission that the new homeowner, Serena Howley, closed
on the property today, June 19, 2006. HPC Staff toured the home today with Ms. Howley. The
Commission will be pursuing Landmark status for this property with the consent of the new
homeowner.

A. APPROVAL OF MINUTES
Tim Klusczinski moved to approve the Minutes of May 15, 2006 as printed, Martha Choitz
seconds. The Minutes were approved by unanimous vote.
B. TREASURER'S REPORT
Tim Klusczinski [Treasurer] included the Budget Location Report in the meeting packet.
Commissioner Riley questioned two items on the report. Catherine Hostetler clarified that the
two items Ms. Riley was referring to were two grant funds that the Commission is overseeing.
C. COMMITTEE REPORTS
1. President's Report
Lynn Patrick [President] requested that her report be held until the next meeting, July 17, 2006.
2. Landmarks Committee Chair: Gate House Update
The Minutes note (by request of Todd Zeiger) that Todd Zeiger is wearing two hats.
Todd Zeiger shared semi -confidential information with the Commission regarding the on-going
negotiations and conversations with Alderwoods regarding the roof, soffit, and gutter repairs and
overall restoration as well as the future use of the building at the entrance to Riverview
Cemetery. Greg Kil will be providing a preliminary rehabilitation report gratis. Shawn Peterson
[Counsel] expounded on the extension of the COA as a means to allow further review of options
- for future use of the structure. Todd Zeiger is encouraged by the progress and the commitment
Alderwoods is now exhibiting towards the project.
D. STAFF REPORTS
1. Director's Report — Catherine Hostetler
Catherine distributed her report and reviewed information about the upcoming Public Meetings
regarding City Plan. Additional flyers listing the meeting times and locations were distributed to
Commissioners. Catherine also introduced and welcomed new Assistant Director, Amy Herdman.
2. Assistant Director's Report — Amy Herdman
Assistant Director Herdman distributed her report to Commissioners.
3. Legal Report — Shawn Peterson
Counsel will be reviewing meeting procedures before the next meeting, as a roll call vote might
be more appropriate for all matters requiring a vote. This is particularly important if there are
dissenting votes, so that there is an official record of how commissioners voted. Each item that
requires a vote may require a roll call vote. Counsel also recommends that CoA's be as
thorough as possible so that they are inclusive all of details and conditions required. Catherine
Hostetler informs Counsel that HPC Staff did work with the homeowners in advance of tonight's
meeting, but that some details don't come to light until the presentation of the CoA. Given that,
Counsel suggests that in future CoA's, line item voting for approval or denial of specific details
and conditions may be necessary to assure compliance. Todd Zeiger adds that this procedure
would be workable and possibly in the best interest of homeowners to ensure expediency and
compliance. A discussion follows regarding wording for future CoA's that include conditions or
stipulations. Counsel will research and propose appropriate wording at the next meeting.
IV. OLD BUSINESS
1. Chapin Park Booklets distribution
An event was held June 3, 2006 during which 50-60 booklets were distributed to the 200
homeowners of Chapin Park. A discussion followed regarding the distribution of the remainder
of the books and how to efficiently capture the signatures attesting receipt of the book. Catherine
said that she thought that Chapin Park Board was to assume the responsibility for distributing
the booklets, but that may not be the case. Mary Jane Chase added that Chapin Park Board
should take over responsibility. Tim Klusczinski stated that the Board would be willing to share
the cost of mailing the booklets certified mail. Catherine and Lynn Patrick expressed their
concern for the expense and the possibility that homeowners wouldn't want to bear the
inconvenience of physically picking up their booklets. Todd Zeiger suggested that someone
deliver the booklets and that they sign a statement attesting that booklets were delivered to
specific addresses. Shawn [Counsel] verified that an affidavit could be drafted and signed by
whomever delivers the books in lieu of the homeowner's signatures. Lynn Patrick volunteered to
assist with delivery if necessary, as have HPC Staff. .
2. RestoreMichiana follow up
Catherine Hostetler reported that a follow meeting had been held on Thursday June 15, 2006,
attended by Commissioners Zeiger, herself, Amy Herdman, and Alicia Zartman of HLFT New
venues and ways to cut costs are being explored and plans are tentative for next spring. Todd
Zeiger will be forwarding financial information and feedback from participants to all who wish to
receive it. Todd reports that the feedback was overwhelmingly positive for both speakers and the
event as a whole.
V. NEW BUSINESS
Todd Zeiger distributed copies of the City Plan draft, specifically "Land Use and Growth " and
"Urban Design " as those are most relevant to the Historic Preservation Commission. Todd also
read aloud the portion of the draft that specifically addresses historic preservation. Todd has
participated for the last three years on the committee that has been drafting the City Plan. Todd
encouraged everyone to participate in the public meetings, read the draft, and to offer thoughts
and suggestions via email at the city's website ifpreferred.
