PRESERVATION STANDARDS
IA. The Environment.
Required: New Plant material... shall be compatible with the character of the neighborhood in size,
scale, material, and color.
IB. Recommended: New site work should be appropriate to existing surrounding site elements in
scale, type, and appearance.
Suggested Trees for Tree Lawns in the Riverside Drive District are: Sugar Maple, Tuliptree, White Oak,
Pin Oak, and disease resistant varieties of American Elm (Page 46).
RECOMMENDATION
The Sugar Maple is a suggested tree for trees lawns in Riverside Drive and the district's landscape
assessment encourages the planting of trees in tree lawns. Per,this information, staff recommends that
this landscape proposal is appropriate to the district and its standards. Staff recommends approval of
the planting of the sugar maple in the tree lawn.
Staff believes the Prices would like to plant an Acer rubrum, or Red Maple, in their rear yard. This
variety grows approximately 40' to 70' tall, can be easily transplanted, and is tolerant to many different
conditions and to air pollution. The foliage is a medium green throughout the summer; and is typically
orange to red in the fall, depending on the cultivars. The Red Maple is also a relatively fast grower. Staff
finds this tree compatible to the size, scale, and color of other landscaping and mature trees in the district.
It is appropriate to the district, and therefore, staff recommends approval.
Staff recommends approval of application 2004-1201, the planting of the Sugar Maple and the
Rubrum Maple, as shown on the site plan created by Foegley Landscape, Inc., for 1049 Riverside
Drive.

Over the past two months HPC staff and Commission members have had several
meetings with Temple Beth -El, the Chapin Park Neighborhood Association Board, and
interested neighbors. The issues addressed were: the position of Temple Beth -El
with regards to the district, and the application and wording of the standards and
guidelines. prepared by the neighborhood and HPC for the district.
Progress with Temple Beth -El
At the November 811 meeting, the Neighborhood Board members and
representatives from Temple Beth -El disagreed on possible changes to the
proposed boundaries. Instead, the parties present agreed to meet again to
discuss if possible options crafted into the language of the standards could
provide Temple Beth -El with the flexibility its representatives. desired. HPC
noted it would table its opinion at the request of the Neighborhood Board.
The next meeting took place on November 22. Geoff Newman and David Mirkin
presented a draft of possible language to add to Section V. General of the
Chapin Park standards. Discussion of the draft took place, and all agreed that
some form of the draft could be added to the standards. David Mirkin agreed
to revise the draft and send it to HPC staff and the Neighborhood Board.
Staff received the second draft a few days later, reviewed it and added
comments,'and forwarded it to the City Legal Department. John Livingston and
several other City Attorneys have reviewed the document and added comments
for revisions. The most recent version should be included with this month's
meeting packet.

1. 68286 Miami Road, Local Landmark, Rear Addition Review
Jerry U. reviewed his contacts with the owners and his exploration of the exterior of the
house. The owner applied for approval of a 900 sq ft. addition in August, which the
Commission denied. Jerry, during his examination of the structure, discovered
foundation damage, rotting porch and window elements, and siding in need of
replacement due to water damage. The house sits on a 5 1/2' deep basement and a
crawl space. Water enters often through a cellar door. Their well and septic may also
need to be relocated if an addition were approved and constructed.
Jerry and the office have not received a revised plan. The owners also mentioned vinyl
siding the house, which would not be appropriate and would cause long term problems
for the house.

After discussion, the Executive Committee decided to uphold the decision granted at
the August meeting to deny the application as the addition would demolish a large
number of contributing features of the landmark, and very much hide the cross gable
form and proportions of the building. .
The Committee directed staff to send a letter to the owners regarding the
inappropriateness of the addition, and stressing the need to repair the current problems
with the house that would be merely hidden and possible complicated by an addition.
The Commission would review a more logical plan that reflected the form and
proportions of the house
2. Preservation Plan
a. John O: would like to pull together his various papers and HPC resolutions to add to the
Preservation Plan. He and Catherine would then meet with john Livingston before
review by HPC and passage by the Council. Expected date of completion is: March
2005.

On Wednesday, December 8, 2004, the Executive Committee of the Historic Preservation Commission met to discuss the plans for
your landmarked home at 68286 Miami. We had an in-depth discussion concerning the current state of your home's exterior and
of your plans to contract a 900 square foot addition to the rear and side of your home to create a larger dining area and a more spa-
cious first floor full bath.
This proposed addition to your home was denied at the Historic Preservation Commissions August meeting. Commissioner Jerry
Udjak has since had several conversations with you and your architect, Tom Rupard during which revised plans were to be given to
Jerry for our December 8 meeting. Since he did not receive the new plans the Executive Committee had no alternative but to up-
hold the denial of your COA #2004-0804-1. The reasons for the denial are that the proposed addition would obscure too much of
the original landmark's characteristic gabled ell form and shape. Basically, the addition would overwhelm your farm house.
The commission shares your concerns about the paint failure. However, vinyl siding would only make matter worse by trapping
moisture and rotting your walls The deteriorating siding should be replaced where needed with clear #1 cedar siding that matches
your original siding.
The water problems causing the paint failure and siding deterioration could be traced to improper roofing but are more than likely
being caused by the gutters and downspouts being overloaded with leaves and not draining properly. Also contributing to the water
problems are the cracks and gaps in the mortar of your fieldstone foundation. These should be filled and repaired as soon as possi-
ble. Unfortunately, your lovely porch is showing signs of deterioration as well.
We would encourage you to speak with Tom Rupard about a plan to stabilize the structure of your home before even considering
putting on an expensive addition. We would be willing to work with you and Tom to develop sensible and economic solutions to
these problems and could recommend products and techniques. We look forward to hearing from you and working with you in the
future to preserve your home.

A. Buildings in the district should not be demolished except where a building poses a threat to the
pU blic safety, and demolition is the ,only alternative, Documentation of interior and exterior fea-
tures of the original' buildings, especially homes rated as historically significant, is encouraged.
Measured drawings and photographs may be submitted to the Historic Preservation Cor=ussion
for safekeeping and future reference.
B. A Certificate of Appropriatez►ess is required before moving any building or structure. The moviz►g
of a building within, out of, or into the district is discouraged; however, moving is preferred to dein-
olition, Buildings incompatible with existing structures in the historic district shall be prohibited.
C. Any rehabilitation work shall not be such as Fo change a building to a style dated previous to
its original style.
D. In planning rehabilitation projects, an architect or contractor experienced in preservation
should be consulted.
E. There shall be a liaison committee consisting. of three (3) property owners in the district. The
committee's responsibility will be to work with the residents of the district and* the Historic
Preservation Commission (See Appendix Q.
F All guidelines will be reviewed and updated, on the recor=' endation of the liaison* committee,
at least every five years.

G. In the case of structures located within the district which are designated individually as
rL-mdmarks, the most restrictive guidelines shall apply.
H. Existing easements and codicils in property owners' abstracts shallremain in effect.
VI. ENFORCEMENT F.ROCEDURES
Enforcement of the preservation guidelines for the historic district is made possible in the Zoning
Ordinance of South Bend, ordinance No. 5565-73. The Historic Preservation Commission shall issue
a Certificate of Appropriateness before commencement of any construction, reconstruction, alter-
ation, demolition or moving of any house or structure within the historic district boundaries (see
Appendix A). This ordinance, however, does not prevent the ordinary maintenance and repair of
any building or structure which does not involve a change in any exterior feature, nor does it pre-
vent the reconstruction, alteration, demolition, or moving of any building or structure which the
Building Comnussioner or other official, has determined to be a hazard to public safety.
The Historic Preservation Commission will accept applications for Certificate of Appropriateness
only from the property owner. Property owners wishing to do, or have done, any work affecting the
exterior of their building or land must apply directly to the Historic Preservation Commission on the
form prescribed by the Commission (see Appendix A).. The Commission will review the application
and either issue a Certificate of Appropriateness or else deny the application, stating in writing the
reasons for such denial. Upon such denial the applicant may appeal to the Common Council.
In making its determination, the .Historic Preservation Commission shall consider three factors:
first, appropriateness of the proposed work to the preservation of the building and district; second;
the detriment to the public welfare if the proposed work is permitted even though it is not deemed
appropriate; third, the potential hardship that the'denial of the Certificate of Appropriateness
would cause the applicant.
Where the Historic Preservation Commission deems it necessary, the commission -may petition the
Common Council for a temporary delay in the issuance of the required perrnit(s) for proposed con -

I. Temple Beth-El, 305 W. Madison, South Bend, Indiana is located on the east'half of
the block bordered by Madison, Lafayette, Marion, and William streets. The west half of
this block is within the Chapin park Historic District, Temple Beth-El owns, through a

trust, a lot in the west half of this block, and may acquire other lots in the west half of this
block for the purposes of additional building, grounds or parking. No Historic
Preservation Commission decision or requirement in these Guidelines or elsewhere shall
apply to any lot in the west half of this block owned at the time by Temple .Beth-El or one
Of its trusts. Instead, Temple Beth-EI and its trusts shall maintain any structure. or
property owned in the west half of the block consistent with these Guidelines unless and
until Temple Beth-E1 decides to demolish the structure for building, grounds or parking

Chapin Park -Temple Beth -EI Exceptions
After our conversation, I am further amending the new Paragraph I which will be contained in the
Section V, GENERAL SECTION of the Chapin Park Local Historic District Preservation guidelines.
I have reviewed David Mirkin's suggestions made to the Historic Preservation Commission. I am
suggesting new language which would read as follows:
�• There is excepted from the general provisions of paragraphs A and B, a partial
exception for the future property acquisitions and uses by Temple Beth -EI, 305 W. .
Madison Street, South Bend, Indiana. Temple Beth -EI is currently located on the east
half of the block bordered by Madison, Lafayette, Marion, and William streets. The west
half of this block is within the confines of the Chapin Park Historic District. Temple
Beth -EI currently owns, through a trust, a lot in the west half of this block and may
acquire in the future other lots in the west half of this block for the purposes of
additional building, grounds or parking for expansion of its campus. Temple Beth -EI
and its trusts shall maintain any structures or property in the west half of the aforesaid
blocks consistent with these guidelines unless and until Temple Beth -EI decides to
demolish any structures or buildings. In the event that Temple Beth -EI wishes to use
such land in the west half of the block for Temple purposes, it shall notify the Historic
Preservation Commission and seek a Certificate of Appropriateness for the removal of
any buildings or structures in the designated area. Upon grant of said Certificate of
Appropriateness by Historic Preservation Commission, Temple Beth -EI may demolish
or provide for the removal of said buildings. Temple Beth -EI may demolish the structure
and clear the land, provided that first the structures to be sold and relocated are offered
and publically advertised at a price of One Dollar ($1.o0) with the relocation expenses
to be borne by the buyer. The structures shall be offered for a period of not less than
one hundred and eighty (180) days. This time period may be extended by up to an
additional 60 days at the request of the Historic Preservation Commission orthe Chapin
Park Historic District board. This paragraph shall not constitute a waiver of any of the
zoning or building code sections of the South Bend Municipal Code applicable to these
properties. This waiver will only apply to Temple Beth -EI while it or another house of
worship owns and uses the property. This waiver does not apply to any other properties
in the district.

CATHERINE HOSTETLER: (See staff report attached to C of A). Homeowner, Tom
Price was present.
Joann Sporleder asked the homeowner what size trees they are planning on planting.
Tom Price stated that they had not picked out any particular trees yet; however, they
would like to have trees that gave off a significant amount of shade. Joann Sporleder
suggested that the homeowner pick a tree for the tree lawn that is a fairly good size tree
so that it cannot be knocked over or pushed over by passing persons or cars, etc.
LYNN PATRICK: I move that we approve application 2004-1201.
GERALD UJDAK: Seconds the motion and it passes unanimously.

JOHN LIVINGSTON: We met with Temple Beth -El and Chapin Park Neighborhood
Association and interested neighbors within the district to try and come up with some sort
of compromise that would allow Temple Beth -El to expand in the future if such need
ever becomes apparent.
The west side of the block where Temple Beth -El is located will have its own
standards to allow for a possible removal of certain buildings at such times when Temple
Beth -El acquires those buildings and then decides that they need more room on their
campus for educational buildings or other buildings.
If they purchase a building they agree to take care of that building and keep it up to
standards until such time that they would have to use it for their temple purposes. They
shall then follow the normal procedure of filing for a'C of A, which is spelled out in the
city code as well as in the state law.
The Indiana Code also provides that to demolish a building or to remove a building
within the confines of a historic district one must seek a C of A. Upon the grant of this C
of A, Temple Beth -El then would have a certain period to advertise the sale and
relocation of these properties. The preferred method is that these historic structures be
moved rather than be demolished. They would offer these buildings for $1.00 dollar with
the relocation expenses to be borne by the buyer. The structures would be offered for a
period of not less than 180 days with the possible extension of an additional 60 days at
the request of the Historic Preservation Commission or the neighborhood organization.
This paragraph would not constitute a waiver of any of the zoning or building code
sections of the South Bend Municipal Code. It would apply only while Temple Beth -El
owns these properties. If these properties should be sold to someone else then the waiver
would not apply. It would also apply if Temple Beth -El were to move; then the waiver
would expire. This particular section is in paragraph I of section 5, the general section of
the Chapin Park Local Historic Preservation Guidelines.
There was also a small change to paragraph F, which would read: "All guidelines
will be reviewed and updated upon the recommendation of the liaison committee at least
every five years with on going consideration and respect given to Temple Beth -El's
exemption with regard to demolition or the removal of Certificates of Appropriateness."
We have worked on this since September and I believe that we have come up with a fair
solution for this. (See legal department interoffice memorandum and staff report
regarding Chapin Park Historic Preservation District & Temple Beth -El Developments in
meeting packet).

Mr. Newman, from Temple Beth -El , and Kolin Hodson, a member of the Chapin Park
Board and a liaison for the NNN, and the Rabbi Steven Leapman for Temple Beth -El
spoke in favor of the proposed Chapin Park Historic. District and thanked everyone who
had worked so hard to make it possible.
JOANN SPORLEDER: I move that we accept the legal department interoffice
memorandum dated December 17, 2004; which is an amendment to the Chapin Park
standards.

D. EXECUTIVE COMMITTEE REPORT
1. Districts Committee: Chapin Park and Temple Beth -El
2. Executive Committee Report: Meeting 1,2/08/2005
CATHERINE HOSTETLER: This is the executive committee that was held on
December 81h, concerning 68286 Miami Road, local landmark.
This has been an issue with the commission since last August. Gerald Ujdak has put
in a lot of hours and time working with the family that owns this property to try and get
them to understand that their issues with their property are not going to be resolved by
putting on a very expensive addition onto a house that is already failing. He has had
limited success with them.
Julie and I constructed a letter at the direction of the executive committee and we
sent it out to the family. We have not received a response yet. We sent a copy to the
homeowner, which you have in your meeting packet. We also sent a copy to the person
she has been using as an architect so that he would understand what the issues were and
would have a copy of the same documents she has. We have not received a response
from him either.
We also sent a copy of this letter to Gary in the building department so that if
anyone were to try and pull any permits they would be aware of what was going on and
could check and make sure that there weren't any additions being put on the house with
out the homeowners first getting the proper permits.
What the homeowners basically want to do is put on a very elaborate addition to a
house that has severe water damage and foundations issues.

GERALD UJDAK: The addition that they are talking about is approximately nine
hundred square feet. It would involve a great deal of alterations, movement of the septic
system, etc. The porch also needs rebuilding. It is a charming house from the road; but,
when one gets closer to it one discovers that is has suffered from a lack of TLC for many
years and has serious problems. I don't think that these homeowners have a handle on
how much money it is going to take to do this work.
CATHERINE HOSTETLER: The recommendation of the staff was basically to stabilize
the existing residence._ They need to take care of those issues first before they start to
consider putting on additions to the house.
The second issue that the executive committee addressed was the preservation plan.
John Oxian and I are going to work together to get that organized, along with John
Livingston, so that we can present it back to the Historic Preservation Commission in
March.

CATHERINE HOSTETLER: We have approved at least six C of A's for in-kind
replacements since our last meeting. We have one open issue and that is 115 E. South
Street. This is the house that is in Taylor's field that had a fire. The structure is very
difficult to go into to get an evaluation. I have a picture of it that Wayne took. Joann
Sporleder and Wayne Doolittle were supposed to have gone out to get an assessment of
the house. We have not received their reports back yet.
The grants have all been approved for the brochure and the money has been
encumbered for our part to get the districts grant done. We have the money set aside for
the final printing of the surveys and the excess monies. I am working with Suzanne
Stanis to get a new memorandum of agreement drawn up to reflect the additional
$6,700.00 dollars that we are going to spend to do the resurvey.
Julie Schutte and I took Virginia O'Hair out to lunch on Thursday at Tippecanoe
Place and gave her a certificate of appreciation for all of the work she has done and for
the time she has served on the Historic Preservation Commission. She was also happy to
be invited to sit on the Southhold Awards Committee and stated that she would be very
happy to continue to serve on that committee.
John Oxian asked that a motion be made that a C of A list of all staff approved properties
be attached to the minutes every month.

CATHERINE HOSTETLER: What we need to do is activate the Southhold Awards
2005 Committee. We do have the Palais Royal and we do have a date set for May 21,
2005. We just need to work on recipients of the southhold awards, getting a speaker,
and setting the menu. This year we will be charging a nominal fee of $10.00 for the
breakfast.
V. NEW BUSINESS
CATHERINE HOSTETLER: Joann Sporleder's term as the commission's historian is
going to expire this month. A motion needs to be made to have her reappointed for
another three-year term.
MARY JANE CHASE: I will make a motion that Joann Sporleder be reappointed to serve
another three years as the Historic Preservation Commission's architectural historian.
LYNN PATRICK: Seconds the motion and it passes unanimously. Joann Sporleder abstains.
John Livingston informs commission members that the Morris Civic Auditorium is in the
planning and design stages for a new marquee for their building.
VI. HEARING OF VISITORS
Don Sporleder reported 'on the Regional Greenways Corridor Planning efforts and would
invite the commission and perhaps the staff to participate in the next planning session for
this regional greenways work shop that will be held January 25th at 2:00 pm. at the nature
center at Bendix Woods County Park. As you recall this is an effort to work with the
national parks service and the counties across the northern end of the state from Lake
Porter, LaPorte, St. Joe, Elkhart, LaGrange, Marshall, and including our neighbors up
north since that river corridor we have runs into Michigan as well, so Berrien and Cass
counties will be involved also.
The state of Michigan has just developed a Heritage River Trails Program and the
first segment of this identified Heritage River Trails goes from Colon through Three
Rivers. A fifty -mile segment has been set. This is an effort to identify those Heritage
River Trails through that state and I would submit that we have right here some very
effective heritage elements with our St. Joseph River and the connection with the LaSalle
linkage across the section of the county over to Kankakee. I would again encourage and
include the identification of our historic places, those natural resource elements, and the
water trials would be an important part of it.

Larry and Margaret Porter, homeowners located at 917 Leland Avenue, briefly
stated reasons why they were against Leland Avenue being included in the Chapin Park
Historic District.
