Property Owner: Mr. & Mrs. Axelberg Designation: Local Historic District — East Wayne Street Rating: Contributing -10 RECOMMENDATION In 1999, the Commission granted approval of a landscaping plan that included enclosure of a portion of the back yard in an ornamental fence, specifically, either coated chain link.concealed by a hedge, or an aluminum reproduction of an old cast iron style intended to compliment the cast iron lantern and trim on their garage entrance. The rest of the landscaping plan was extensive, and is nearing completion, and as it does, the Axelbergs are realizing that the fence will not only be more useful, but also be more visually appealing if it enclosed a longer sweep of lawn. The proposed changes bring the fence no closer to either street. The Axelbergs would also like to install a wooden play set in the North East corner of the area to be enclosed by the fence. Staff recommends approval of a new Certificate of Appropriateness, approving the new drawing submitted including both fence and play set. Property Owner:' Mr. & Mrs. Joseph & Carmal Alby Designation: Local Historic District — East Wayne Street Rating: Significant -11 RECOMMENDATION Staff finds this request to present a very difficult decision. The Standards for East Wayne Street clearly state that no artificial siding is to be approved unless (a) artificial siding already exist on the house in question, or (b) the existing wooden siding is so deteriorated, that it cannot possibly be preserved. The wooden siding on this house is not apparently deteriorated. However, the owner's contractor informs staff that the owners have had to paint the house every twenty-four months. Staff finds that the siding does appear to be somewhat in need of painting now, and that painting every twenty-four months is, in the opinion of staff, an unreasonably burdensome situation. The questions staff has for the owners are, first, do they have any notion why the house needs painting so often? Usually, the problem involves excess moisture, such as from a bathroom without an outside exhaust fan, or attic vents that are inadequate to serve today's well -insulated houses. Blown -in insulation can also cause problems. If the problem is excess moisture, vinyl siding will only exacerbate it, causing yet more serious deterioration to the interior of the house. If it is something else, vinyl siding may or may not resolve it. The owner's contractor, when questioned by staff, was unable to account for the problem that made the house require painting so often. The director of the Northern Regional Office of Indiana Historic Landmarks Foundation has offered technical assistance, should the owners request it, to locate and resolve the problem. Our own Architectural Historian is on sabbatical in Rome, so not available -to -consult -for -this report. . Property Owner: Lucy & Bob Jones Landmark or District Designation: Local Historic District — West North Shore Drive Rating: Contributing - 10 STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT Margaret and Harry Cooper purchased this lot in 1924, and in 1938 commissioned local builder William Reinke to build this house. Dr. Cooper practiced medicine at 410 Sherland Building. In 1948, the Coopers sold the house to Dr. George E. Gates, a specialist in internal medicine at South Bend Clinic. In 1968, Dr. Gates sold the house to Ann & Thomas Singer. Mr. Singer worked at Crumpacker May Levy & Searer until his death in 1976. Mrs. Singer continued living in this house until 1980, when she sold to Robert J. DuComb, Jr., who sold it a year later to Linda K Davis. Ms. Davis lived there until 1984, when she sold to Wilber Elliott, a member of the U.S. Air Force. In 1994, Mr. Elliott sold to Raimo and Paivi Vaylyner. I believe that they have recently sold to the present owners, Lucy and Bob Jones. RECOMMENDATION Staff recommends approval of: (1) the proposed enlargement of the existing kitchen window on the East side of the house; (2) the proposed new skylights in the back of the roof; and, (3) the proposed new addition, according to the plans attached to the Application, with the following stipulations: (a) When the existing kitchen window is removed, and its opening enlarged, the new windows to be installed shall match the windows in the front of the house in size and style, and may be paired or tripled. (b) Windows in the addition shall match the existing windows in size and style, and may be paired or tripled where desired. (c) The second floor balcony door shall be retained for use elsewhere in the house. (d)--The-window in -the -middle -of -the -back -second -floor, -and -the -window between-the_two bump -outs on the back of the first floor appear to have windowsills original to the house. If so, these sills shall be retained and reused. (e) All other new windowsills shall match the sills original to the house. (f) Siding and shingles on the new addition shall match the rest of the house. Staff notes the intention to re -shingle the entire house. Staff has no particular objection, but does also note that our records show new shingles having been installed on the entire house and garage roofs in 1997. Staff also notes that the placement of the rear windows is asymmetrical and odd. Property Owner: Robert C. Schafer, Personal Representative of the Estate of Mabel F. Schafer Landmark or District Designation: Local Historic District — Lincolnway East Rating: Contributing - 9 STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT The original front part of this house was a Queen Anne or Free Classic farmhouse, built in about 1882, and built according to some of the better building and design practices of the day, but not under the direction of an architect. Not too many years later, perhaps 1990, according to indications in the City Directories, a duplex addition was added on to it. There were several other additional rooms patched on thereafter. The original porches are gone. The earliest clear record of ownership shows Eva & Carl Beal owning the house, and living in the 1404 portion in 1927. Mr Beal was manager of the Ludwig Auto Supply Company. In the 1930s, the Beals transferred co -ownership of the. house to Alta & Oscar Ludwig. Mr. Ludwig was the owner of Ludwig Auto Supply. The Ludwigs rented out their portion of the house, and never lived there. In 1938, the Beals and Ludwigs sold the house to Tower Federal Savings & Loan Assoc., which owned it for six years, renting out apartments in it. Mr. Schaffer informs me that by 1944 the house was becoming run-down, and depressing neighboring property values, so his parents, who lived next door (and were incidentally the owners of a local dairy), purchased the house, had it covered with gray asphalt siding, and performed some other repairs, to keep its appearance up. They continued its use as an apartment house. At the time that this area became a historic district, his widowed mother was the sole owner. It was she who caused a large piece.of plywood to be nailed over the upstairs hall/stair window, just after the decision was made to become a historic district, and that piece of plywood remains there to this day. Mabel Schafer died in 1983, and her son Nelson, who was first representing her estate, has also died. The surviving son, Robert, has now become personal representative in place of his deceased brother. He is actually living in one of the apartments in this house. RECOMMENDATION A.. Staff recommends approval of the leveling of the foundation, provided only that all aspects of the South Bend Building Code be followed. B. Staff recommends approval of the replacement siding exhibiting the same reveal as that originally found on the front, or oldest, part of the house. The existing siding is already artificial, and is an appalling variety of different styles in very bad condition. That said, we are worried about the proposed method of installation. Mr. Schafer proposes to install new vinyl siding over the top of the existing siding, most of which is seriously deteriorated asphalt. There is also some vinyl, and, I believe, some artificial stone siding on various portions of the house. Mr. Schafer's thoughts are, first, that the triple layer of siding will give very good insulation, and save on utility bills, and, second, that he wishes to avoid the cost of tear -off and disposal of the huge amount of heavy asphalt siding involved. I inquired of the Building Department inspectors whether this would receive their approval. It might, but might not. Their concerns would be, first, whether the plan called for insulation panels, firing strips, or both, to provide a flat surface for the new siding, and second, whether the proposed method of fastening would be adequate to hold through three layers of siding into the supporting structural members. At least the artificial stone might need to be removed. A second concern is that this proposed installation would result in such a deep layer of siding that, not only will the window trim be deeply covered, they will be much recessed as well. C. Staff recommends approving replacement all the windows in the house, including the one that has been boarded up, provided that the following conditions are met: (1) The sizes and shapes of the original window openings should be preserved, and the windows sized to fit the entire opening; not filed in with extra stuff between the actual window and the existing wall; (2) All windows in the front portion of the house, or visible from Lincolnway East, should be one pane over one pane, OR two -panes over two -panes; (3) All portions of the window sashes or frames visible from the exterior, including any storm or screen windows, should be either painted, or colored as described in the Lang Manufacturing brochure submitted with this Application; (4) There should be an exterior trim frame of the same breadth as on the original windows, i.e., 4" to 511, around the sides and top of each window. If this cannot be done by exposing the original frame, then it should be done by installation of new exterior trim, stained or painted in a color of the owner's choice. Staff is aware that vinyl replacement windows are not routinely approved. However, in this case, several of the windows to be replaced are already vinyl windows, and those that are wood are covered with mill -finish aluminum storm windows. D. Staff recommends that when the siding and windows are replaced, the shutters existing on -some -of the -windows -be -removed -and -NOT -replaced. E. Staff recommends approval of the chimney repair, specifying the use of high -lime, low Portland content mortar on all portions of the chimney made with brick manufactured prior to 1930. Property Owner: Constance Ray Tooley & Thomas Tooley Designation: Local Landmark — Eby House Rating: Outstanding -13 RECOMMENDATION There are eleven items on the original Application letter. Items 1, 2, 3, 5, 6, 7, and 8, I have already staff approved. Items 4, 9, 10, and 11 remain. Staff recommends approval of the request to repair existing gutters, and the installation of new gutters where rain is causing water damage. If the homeowners can show us an indication that hidden or built- in gutters were originally on this roof, we should then approve their restoration; otherwise, not. If our architectural historian, or another certified architect, renders a professional opinion that the "Rainhandler System" would provide equal or better protection to the house than gutters would, than Staff would recommend approval of that alternative. Staff recommends approval of the request to remove the stucco from the foundation, and tuck point the exposed brick. Staff notes that the foundation was probably covered with stucco to conceal the differences between the original brick, and that used in additions. However, now that the stucco itself is becoming worn, its cosmetic benefits are diminished. Staff recommends approval of the request to install windows in the enclosed back porch or landing area, provided that all window trim shall match that used throughout the rest of the house, in size, shape, material, and design. Regarding the request to install a fence along the East side of the property, please see the May 23 letter addressed to me regarding the halogen lights installed by the South Bend Housing Authority just East of the Tooleys' home. Any assistance that we can render the Tooley family regarding this situation would be appropriate. I went by their house in the middle of the night to see how bad it was. It is bad! Standing by their home in the middle of the night, I could read the fine print of a newspaper about as easily as in the daytime. The Housing Authority presents a blank, windowless wall facing the Tooleys, and an absolutely empty (at night) parking lot. This empty lot and blind wall are protected by a fence as high as my head, topped by spikes angled out towards the Tooley residence, looped with mean barbed wire. The dreary and vaguely threatening scene is lit by giant halogen lights, with about the poorest color rendering and color quality I have ever seen. One rather expects to see armed, jack- booted solders patrolling with snarling guard -dogs on short leashes. I cannot even conjecture what the fence, lights, or barbed wire are protecting, or from whom. Even with the barbed wire removed, the fence and the lights will still radiate a prison atmosphere. An attempt by the Tooleys to mitigate the situation by building their own fence should not be necessary, and would not be adequate. The solid stockade style fence existing around the South and West sides of the Tooleys' house was installed prior to the house becoming a landmark, and is neither appropriate to the house or the site, nor consistent with Historic Preservation standards. Staff could not recommend installing more of it under any circumstances. If the Tooleys, in spite of our efforts to help dim or eliminate the offending lights, still desire a wooden fence along the East side of their property, staff could recommend approval of either of two solutions: Either (a) the installation of a Queen Anne style (or compatible) fence along the East side, or else (b) the moving of the existing stockade privacy fence from either the South or the West side of the property, to the East side, and the installation of an appropriate Queen Anne or similar style fence in place of the fence that gets moved. AFTER we purchased the beautiful old house, a local landmark, at 514 W. La Salld Ave., the South Bend Housing Authority installed FOUR huge halogen lights on the side of their` building shining out over. their parking lot and directly into our house and backyard. I have enclosed a copy of the letter I wrote to them regarding the problem which describes in detail how that installation has affected our quality of life in this new home. Since that letter was sent, Charles is no longer at this facility and they have lowered the lights, but they still are overwhelming. It is still necessary to close all the drapes on the east and south sides of the house every evening, in order to be able to enjoy any of the rooms on the first flgor, or to be able ' to sleep at night ... on the second floori!l1 It is really intolerable. And, as I mentioned in my letter to them, ".,, has effectively stolen the peace, tranquility and beauty from our home and yard". In addition to the lights, we live with an eighty -foot stretch of chainlink fence, interwoven with green vinyl and topped with barbed wire! It runs the entire length of the east side of our property. And, it is leaning into our yard far enough that we would have to build our fence at least 2 ft inside our property line in order to assure' it doesn't get knocked down by the cars in their parking lot which back into their fence! They have agreed to let us remove the barbed wire. What we are hoping is that shields could be put on their lights so they would shine down not into our yard • their fence permanently straightened, the barbed wire removed, and the .vinyl taken off. Maybe they could install the cement `bumpers" to. keep their cars and trucks from knocking their fence into our yard. Wayne Street on June 14, 2002. A contractor installed casement windows on June 10 and June 11 that had apparently not been submitted for approval by the Historic Preservation Commission. It was my belief the contractor had obtained approval prior to installation from the Commission. As you know, I have been very fastidious in ensuring the commission approved all improvements done at my home. In each case, the contractor sent appropriate specifications to the Commission and appeared as requested. I served on the E. Wayne Historic District Committee for almost two years and am very familiar with the Commission's procedures. I was contacted in California at a medical meeting about the possible lack of knowledge of the commission for work taking place at my home. I instructed the individual caring for my home in my absence to have all work stopped immediately. On my return on June 14, I called you to discuss the situation. I shared with you it was my understanding that a Certificate of Appropriateness had been granted to the contractor. I learned at that time the contractor did not submit application to the Commission for the replacement windows. After I spoke with you, I called the contractor. He thought I had made application to the Commission. Clearly, there was a significant misunderstanding on this matter. I took him an application for Certificate of Appropriateness to complete and fax on June 15. Enclosed are pictures and related comments on the replacement windows that were installed before further work took place. I want to thank you for your thorough investigation of this matter. I am appreciative of Mr. Wayne Doolittle's careful inspection of the East Wayne Historic District to maintain the historical beauty of the neighborhood.
