It is called the Slusser House after its early occupants. Anne DuShane Nuner, a relative of the locally -famous John Nuner who was such a pioneering founder of the local school system, inherited the house from her grandfather, Andrew DuShane, upon his death, and rented the house out, until 1927, when she sold it to George E.- Davies, president and part owner of the Davies Laundry & Cleaning Co, and also the Superior Laundry Co. It is an American Foursquare with a covered porch the full width of the house, and with dormers in the roof. In the last ten years or so, the [present owners have done a great number of good things to this house, substantially enhancing its appearance and structure. APPLICATION: The owners' next planned repair is replacement of garage doors, and this Application is for approval of that project. Previous repairs having been extensive, the cost of new doors is a significant concern, and they are considering metal doors. If photos or contractor estimates are not available by Monday evening's meeting, they will be requesting that this Application be tabled until next month. RECOMMENDATION The Preservation Guidelines follow the Rehabilitation Model. We cannot make a specific recommendation until the owners have more specific data regarding the planned replacement. We do, however, note that the owners' previous improvements have vastly improved the condition of the building, and that the present garage doors are likely not adequate for wet, rough weather next winter. O �/ STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Application Number: 2001-0824 Property Location: Leeper Park East Property Owner: City of South Bend Landmark or District Designation: Leeper Park Historic District STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT Leeper Park is a designed landscape located in South Bend, Indiana in a residential area immediately north of the downtown commercial district of the city. The park is situated on a tract of land at the base of a gently sloping terrace, fronting on the St. Joseph River. The site is bounded by the river on the north and east, Bartlet Street and Park Lane on the south; the western boundary of the park is defined by the toe of a steeply sloping hill at the top of which are the rear yards of homes of the city's Chapin Park Historic District. The park was designed by renowned landscape designer George Kessler. He laid out the plans of the park in 1912. In 1895; the City of South Bend purchased land east of Michigan Street and north of Bartlett Street for the purposes of developing a well field and water pumping facility. This purchase formed the nucleus of Leeper Park. In 1904, the city constructed a park drive along the riverfront extending along the eastern section and under the old Leeper (Michigan Street) Bridge. The roadway was officially named Riverside Drive in 1909. RECOMMENDATION The applicant is requesting the addition of new asphalt parking and streets along Riverside Drive between Bartlett and Michigan Streets, which will include erosion control and landscaping. This expanded parking should correct existing problems in the adjacent neighborhood. No trees will be removed and only a few bushes will be replaced. The design of the new lighting fixtures will match the existing lighting structures. The staff recommends the approval of this project. Stephen J. Construct approximately twenty-six (26) nine (9) foot wide by twenty (20) foot long asphalt standard parking spaces and nine (9) twenty (20) foot wide by nine (nine) foot long parallel parking spaces along the East side of Riverside Drive between Michigan Street and Bartlett Street. This includes grading and compacting the existing ground, placing and compacting four (4) inches of No. 53 crushed concrete as a sub -base, placing and compacting a minimum of four (4) inches of HMA No. 5 base, and placing and compacting a minimum of one (1) inch of HMA No. 11 Limestone Surface. 2. A standard concrete curb will be placed on the east side of the parking spaces as shown on the plans. 3. Construct the new parking spaces with a slope that provides drainage to the adjacent non -asphalted areas. The Contractor will place sod from the edge of curb to the edge of pavement in the designated drainage areas. This will include all necessary site preparation. SP -7 4. The inst"n of twelve new street lights (see plmmiiiDr type of pole, fixture, and placemenwi r ations) along the curbed edge of the --parking areas. The conduit containing the electric service shall be three (3) inch PVC Conduit at a minimum depth of three (3) feet. The Contractor will be responsible for the exact placement of the conduit as to not effect any trees that remain in the parking area. The electric feed will be obtained from the existing line located on a pole near the bridge to Leeper Island (as shown on the plans). The City will contact AEP prior to construction for placement of a meter. 5. Compact fills and subbase materials 100 % compaction. Testing will be done by nuclear gauge. Testing and inspection will be accomplished by the Department of Public Works. The department personnel are certified for earthwork and bituminous inspection and testing by INDOT. XXI. TEMPORARY EROSION CONTROL, A. Prevailing Specifications: 1999, INDOT Standard Specifications Section 205 B. Additions: 1. The Contractor shall be responsible for the preparation of the Erosion Control Plan, as required by 107.14.1 of the Prevailing Specifications. Temporary Erosion Control shall include the cost of the preparation of the plan, payment of fees and charges associated with the filing ofsaid permit and legal advertisement, and implementation of the plan, including maintenance of the erosion control elements. Should the Contractor fail to' comply with the requirements of any agency having lawful jurisdiction over the effectiveness of the Erosion Control Plan, or fail to adequately implement or maintain the the elements of the plan, the Contractor shall be solely responsible for fines, imprisonment or any other penalties lawfully imposed therefore. XXII. HOT MIX ASPHALT (HMAI: A. Prevailing Specifications: 1999, INDOT, Standard Specifications Section 402. B. Additions to Section 402: 1. The CONTRACTOR shall submit a job mix formula for approval five (5) calendar days prior to any mix placed. The contractor shall notify the City 48 hours prior to placing any asphalt. Mix placed without notification will be subject to no payment. 2. The CONTRACTOR shall hire an outside approved testing laboratory to perform testing. Test results shall be given to the City within 48 hours. A City representative shall be present and designate a random location for sample. A representative from testing lab shall take immediate possession of sample taken and sign City form. 3. A minium of one (1) plate sample, for each type of mix placed shall be taken for each day that 50 tons is placed, for more than 500 tons per day, one (1) sample for each 500 tons. Color to be selected at future date. 1a .1 = � .. ,, jam.' lap 40k. 40 0 Amp it PC T V 14 t 4o + ho IL 0 .06 M STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Application Number: Property Location: 519 Edgewater Drive Property Owner: William & Laurel Cochrane Landmark or District Designation: Edgewater Place Historic District Rating: Contributing STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT The development of the neighborhood began in 1871 with the plating of a section along the road leading to Mishawaka. In 1875, five houses were shows along the road. Most of the district, however, was left undeveloped until the platting of the Edgewater Place Addition in 1919 by Whitcomb and Keller, two of South Bend's important early developers and realtors. The home was built in 1919, owned by Whitcomb & Keller and rented until 1930. In that year, it was sold to Dow & Hazel Keim. He ran the Tyler- Keim Tire Company. % � ` ­-T� /�3/ RECOMMENDATION The homeowners are asking to replace the existing aluminum siding with vinyl siding of the same eight (8) inch width. They also plan to replace selected wood -sash windows with like wooden -sash windows. The standards and guidelines for this neighborhood state that existing exterior building materials shall be retained. The staff recommends approval. However, we would also suggest that when the existing siding is removed, and if the origional wood is a smaller reveal, that the owners match the origional wood if the cost remains within their budget.. Proposal for Renovation 1624 East Wayne Street South Bend, Indiana 46615 Owner: The Episcopal Cathedral of St. James Occupant: The Very Rev. Frederick Mann and family Narrative Explanation 1. History The house at 1624 East Wayne Street was built in 1.951. The accompanying site plan is a copy of the original in possession of the Episcopal Cathedral of St. James. At the time of its construction, there was no porch on the back of the house. Our research shows that the porch was added about nine years after construction, when the property was purchased by the second owner. A stab was poured and a screen enclosure created with a,corrugated fiberglass roof. Dimensions of the porch are 11'x23'. Footers were not used in pouring the porch stab and, over the years the stab has c i racked and begun to pull away from the wall of the house. The wood of the screen porch is in advanced stages of dryrot. In 1993, the house was re -roofed and the roof line was extended over the porch to create a continuous roof line. Skylights were added over the porch at that time. 11. Proposal ' The cathedral desires to create a year-round "sunroom" using the existing porch space and dimensions. After seeking several bids, the cathedral representative, Mr. Jack Swope, has chosen American Sunspace Additions to complete this project. This project as two elements: A. The Porch The attached construction contract will provide details. The existing roof will be utilized along with the existing wall of the house - remodeled to have a more indoor appearance. The concrete stab will be removed and replaced with a wooden floor that will be covered with either indoor/outdoor carpeting or high grade vinyl flooring. The screen area wilt be replaced with an eighteen inch "kneewall" whose external finish will match the siding of the house, thus providing an aesthetic took of continuity with the rest of the house. Instead of screen, double pain sliding window panels wilt be used that wilt match exactly the existing windows of the house. The contractor will provide a picture of similar construction following the submission of this application. B. -House Siding Current siding is eight inch aluminum. The original siding of the house was five inch wood stat siding. The aluminum siding was added prior to the cathedral purchasing the house in 1970 for the residence of its Dean and family. There is no insulation between the siding and the basic walls of the house. No former siding exists under the aluminum. The current condition creates both extremes of heat and cold along with moisture to be present inside the house - costing a great deal to both heat and cool the residence. American Sunspace will reside the house, removing existing aluminum siding and replacing with double -four vinyl siding that will exactly match that of the new garage, for which a siding variance was obtained on 13 August. Foam board will be placed between house wall and siding to provide an insulation factor of R-4 to R-8 (determined by what thickness of board can be used). The trim will remain white as it is currently and peak vents will be replaced with vinyl vents that match the current design. All other external features (stonework, doors, etc.) will remain as they are presently. ili. Conclusion Our desire is to have a home that fits well within the existing neighborhood and conforms more closely with the features of houses around it. We also want to provide our residents with a home that is low maintenance and environmentally comfortable.. We want to provide more living space for the family and for doing the kinds of entertaining often required of the cathedral dean for the parish and diocese. The proposed changes will enhance the house and its appearance while maintaining its historic lines and character. In 1875, five houses were shows along the road. Most of the district, however, was left undeveloped until the platting of the Edgewater Place Addition in 1919 by Whitcomb and Keller, two of South Bend's important early developers and realtors. The home was built in 1920, owned by Whitcomb & Keller and rented for 17 years. In 1938, the property was purchased by William Phillip who used it as an insurance agency. In 1951, he constructed the commercial addition to the side of the home. RECOMMENDATION The applicant has recently purchased the property and saved it from demolition by the City of South Bend. As he continues to progress, he will be asking the commission for approvals and suggestions with his intended improvements. This request is for the replacement of doors. He wishes to install full view, decorative beveled glass panel doors between the home and the walled garden. He has submitted photos of several available doors. He is seeking guidance from our historic architect in selecting the most appropriate style for five or six other exterior doors. The staff recommends the approval of his choices. The building was used for that purpose until 1919 with Prohibition. Between that year and the end of Prohibition, the building was used for other manufacturing. The production of beer was ended in 1950 with the dissolution of the company. Since that time, the building has been used for a number businesses including, a paint company, glass company and Harley-Davidson. This is a four to five story Gothic Revival style building with a single story rear addition for loading and mechanics. The glass front was added in the 1960's RECOMMENDATION A Certificate of Appropriateness was awarded by the Commission on July 17, 2000 for changes of two second floor windows, installation of new parking, new two headed street lights. To staffs' knowledge this work has not been started. Meanwhile, additional work was started to add a door to the west side of the building within an existing garage door. The west side of the structure has been altered several times between 1905 and recent years, including the addition of the garage door. Architect Greg Kil called the office on September 6, 2001 to give us an update on this project and asked the Commissions' approval to do thrk. Our inspector visited the property on September 14, 2001 and discovered that the work had been done by Murdock Construction, but not to the drawings specifications as provided by Mr. Kil. BODNAR ASSISTANT CITY ATTORNEY RE: MEETING PROCEDURES It is wise to remember that we are all public servants and that our bosses are the very people who attend our meetings, the public at large and those who reside in historic districts or who occupy historic landmarks. One way to serve them better is to make our meetings more professional and, frankly, shorter. . We can begin by starting promptly at 7;30 p.m., or as soon thereafter as a quorum is present.. My limited observation is that if a member is not present by 7:32 p.m., he or she almost certainly will not show, regardless of what Rhonda may have been told. It is insulting to ask members of the public who did show up on time to wait to see if anyone else comes. We should remember that our meetings start later than most (both the County Council and the South Bend Common Council begin at 7:00 p.m.), and many of the people with whom we deal have to be up early in the morning. We should take the COAs in the order in which the owners arrive, or at least hear all the COAs for which the owner is present first. This is common in local courts and Code Enforcement hearings in South Bend. Remembering that the owners are probably not that happy about having to be present, making them wait while matters are discussed concerning someone who didn't even bother to show up can be a further irritant. At the conclusion of the first COA hearing, the owner should be advised that he or she, (and all subsequent owners) at the conclusion of their hearings, are welcome to stay, but are certainly free to leave. In the long run we will avoid situations of someone saying "How come you gave the next owner more leeway on the kinds of windows to use than me?", or something to that effect. It would also reduce background noise throughout the hearing. While sometimes the staff reports are, for good reason, not available until the end of the. hearing, I know that a conscientious effort is made to circulate as many of these as possible prior to the meeting.- You have with the agenda most of those reports no later than Friday and have all weekend in which to review them. Reading the reports prior to the meeting is a good method of organizing your thoughts, thinking through any questions you may have, deciding if you need to drive by the property prior to the meeting, and otherwise being prepared to reach a sound decision. Asking the staff questions the day of the meeting is not forbidden and even encouraged. Grammar and spelling errors in those reports can be brought to the attention of the staff either before or after the meeting. Picayune comments about the reports bring disrespect to all who participate in the process. To further helpeed things along, the chairman sho"k at the start of each property if the reading of the report could be dispensed- with, and the reading should be dispensed with unless there is an objection or the report was circulated just prior to the meeting. It is the job of the chairperson of the meeting to keep it moving. This may involve asking a member to get back to the subject or conclude his or her comments. It is always a thankless task, not arising out of any animosity towards any member, and in the long run it will force all of us to concentrate on the issues. The public comments section does not necessarily mean a public debate. A simple "Thank you for your thoughts" could be sufficient. For example, the South Bend Common Council has incorporated into its rules a requirement that no questions may be asked of the council members during the public comments sessions and that matters which were on the agenda cannot be addressed either. Since an item brought up at the public discussion is not something you are necessarily prepared to deal with in detail like the speaker wants, a written response or a phone call the next day, when you have your facts in order (and, perhaps, when tempers have cooled down) is often more appropriate than a two-way discussion at that hour of the evening. Finally, please remember that you are not being graded or paid by the number of words you utter, nor are you paid by the length of the meeting. People don't go out of the meeting saying "Commissioner X must be pretty dumb because he or she hardly said a word." It is late, -dark, and will soon be cold when our meetings end. The Commission and the public would be well served if meetings consistently ended earlier. The purpose of this memo isn't to stifle debate or to criticize anyone in particular. I sit there and try to put myself in the shoes of the property owners who are being asked to give up a night of their lives because they happen to own an historically important house or live in an historically district, a hardship to them which they would not endure if they lived in other parts of the community. The lot currently has no structure of any kind existing as the result of a fire many years ago.. The staff has reservations about this project. There are no other temporary structures along Lincolnway East in the historic_ district. However, we should consider the value of some occupancy over a vacant lot. Some restrictions should be placed on the owners. The trailer should look as permanent as possible with skirting being placed around the bottom so as to cover the wheels and landscaping should be used to soften the view. NEAL, the owner. was present and responded to inquires by commission members. He stated that if the lot becomes profitable, he hopes to put in a permanent complex within a few years. He intends presently to reseal the lot, to take out overgrown scrub trees, and to install water and sewer lines. In response to a question from Martha Choitz, he explained that he wishes to put the proposed mobile office on a concrete pad in the back of the lot, approximately 10 feet from the alley. JOHN OXIAN: Moved for approval of the application, contingent upon-, A. Appropriate landscaping in front of the lot and bushes around the trailer. B. Skirting around the bottom of the mobile office. The garage on his property has white "double -four inch" Dutch -lap vinyl siding, and the homeowner wishes to match that siding on the house. In response to a question from the Commission, Bill Cochran stated that previously replaced windows had been Colby and Colby Window Manufactures. A man representing American Sunspace Additions was present to answer any questions. if needed. MARY JANE CHASE: Moved for approval of the proposal. as submitted. and Jerry Weiner seconded the motion. Some discussion followed as to whether screens should be required, and whether the doors should have horizontal panels. The Chair called for a vote on the motion, and it carried with Richard Morrison casting one opposing vote. 8. 2001-0906; Ethel Anderson, 1636 Lincolnway West KAREN HAMMOND-NASH: Read the staff report and recommendation. The owner was not present, nor was any representative. Following some brief discussion. Richard Morrision moved that the Commision deny Mr. Kiel request to have a Certificate of Appropriateness for the proposed altered door. JOHN OXIAN: Seconded the motion, and it carried unanimously.
