Adjournment CERTIFICATE OF APPROPRIATENESS STAFF REPORT APPLICATION —1998-1027 PROPERTY — 533 River Avenue South Bend, IN. OWNER, — Eugene J. Cieplinski DESIGNATION — LHD-EP RATING — Non -Contributing STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT This house was built in 1904 by Seth Hammond & Leslie Whitcomb, two real estate moguls responsible for the platting of the Hammond & Whitcomb Addition to the City as well as numerous other subdivisions. The house was rented out until 1912 when it was sold to William Boyer. Mr. Boyer continued to use the house as a rental, leasing it to Fred & Carrie Cauffinan in 1914 and selling it to them in 1917. Mr. Cauffinan was the manager of the Hankow Tea Company. The Cauffmans resided in this house until 1920 when it was sold to Amos & Mary Briner. Mr. Briner was an autoworker at Studebaker, they lived there until their deaths in the late 1930s. The house stood vacant until 1940 when it was sold to Earl H. & Bessie Arnold to settle a dispute between Amos Briners heirs, John Briner and Mabel Enos. Earl Arnold was an electrical contractor who married Bessie Brown in 1907. The Arnolds did not live at this address, the resided in a house on Navarre Street and rented this house out. Mr. Arnold died in 1957, leaving the house to Mrs. Arnold who continued to rent the house until 1959 when she sold it to the current tenants, Charles and Garnett Markley. Mr. Markley was the proprietor of Club Cigar Store, he married Garnett Clark in 1929. The couple continued to reside here until 1969 when they sold the house to Ralph J. Dierbeck. Mr. Dierbeck owned the house until 1985 when he transferred the property over to his daughter, Beverly Lawson and her husband, Bill. Mr. & Mrs. Lawson sold the house to the current owner, Eugene Cieplinski, in 1988. PROPOSED CHANGE Applicant is proposing to install five shingle type vents located at the peak of the roof line. The vents will be covered with asphalt shingles to match the rest of the roof. STANDARDS The Preservation Guidelines for Edgewater Place Historic District state: b) ....The Guidelines for the Edgewater Place District follow the Rehabilitation Model.... historical integrity shall be retained. CERTIFICATE OF APPROPRIATENESS STAFF REPORT STANDARDS II. Existing Structure II.B.3. Prohibited Nothing shall be done to change the essential character of the roof by adding architectural features or roofing materials inappropriate to the style of the house. RECOMMENDATION Several telephone calls were made to the applicant to obtain a picture of the type of vent to be installed. We finally received a photographic print with a drawing of the location of the event. Staff feels that the installation of the vent is appropriate but that since there are several types of vents available, and the desire for the vents to be inconspicuous, a definite indication of the style or type of vent was important. The staff will pass onto the body of the whole the final determination of this vent style since a specific type is still lacking. .tl --�. OWNER — Greg & Lisa Cronkright DESIGNATION — LHD-EP RATING — Contributing C/10 STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT This house was built in 1922 for Clarence E. & Edyth Folger. Mr. Folger was the president and manager of the Folger Barlick Company, a whole sale and retail window shades and awnings store. His wife, Edyth, was the companies secretary. Mr. & Mrs. Folger resided there until 1926 when they sold the house to Mary Misher, a stenographer at Studebaker Brothers. She only owned the house for two years, selling it to John & Mary Newman in 1928. Mr. Newman resided there until his death in 1954, his wife, Mary, continued to live there until 1969. The Newman family continued to own the house until 1977 when it was sold to Leon and Lahna Richardson. They resided at this address until 1979 when it was sold to Kenneth Deboer. Mr. Deboer owned the house until 1998 when he sold it to the current owners, Greg and Lisa Cronkright. PROPOSED CHANGE Applicant is proposing to fix the left set of barn style garage doors into one solid door and place it on a "barn track" that will be mounted in the garage so that the door slides side to side instead of opening outward. STANDARDS The Preservation Guidelines for Edgewater Place Historic District state: b) ....The Guidelines for the Edgewater Place District follow the Rehabilitation Model.... historical integrity shall be retained. Required Existing or original windows and doors, including sash, lintels, sills, shutters, decorative glass ... shall be retained, or when deteriorated beyond repair, replaced with duplicates of the existing or original. CERTIFICATE OF APPROPRIATENESS STAFF REPORT STANDARDS II.C.3. Prohibited Existing or original windows and doors, and hardware shall not be discarded when they can be restored and reused in place. RECOMMENDATION The staff applauds the property owner in attempting to reach a compromise between their desire to have a functional garage door and still maintain the original. The proposed change meets all of the regulations of the district, while affording the owner and the Commission the retention of the original door. The staff would like to point out to the applicant that it will be necessary to retain the original hardware for possible future use when executing the project.. We recommend approval. GARAGE DOOR Our garage has two sets of barn style doors which are hinged and swing open. We are requesting that we would be able to hang one set of these doors using a "barn track' which would allow the doors to slide from the top rather than' swing open. The set of doors. on the left would be joined together as one big door and then hung from a track that Would be mounted inside the garage. This big door then could to be opened more easily, especially in the winter. In stead of needing to clear the snow. away from the area in front of the doors before they could be opened, the big door on the left would slide behind the set of doors ori the right no matter how much 'snow was directly in front of them. The big door would need to be slightly recessed, but the original look and style of the doors and the garage would not appear to have changed. (This photo has been altered to show.purposed change.) J'ROPOSED CHANGE Applicant is proposing to replace the existing wood storm door on the side entrance of the house with a weather resistant and energy efficient aluminum cladded wood storm door. The old door has eight window divisions in a two tier pattern. The new proposed door has an aluminum exterior with twelve window divisions in a three tier pattern. CERTIFICATE OF APPROPRIATENESS STAFF REPORT STANDARDS II.C.2. Recommended Wood frame storm windows and doors, painted to match the existing or original should be used by should not damage existing frames and should be removable in the future. If new sash and doors are used the existing or original materials, design and hardware should be used. When metal storm windows or doors are used they should be painted, anodized or coated to match the existing. II.C.3. Prohibited Existing or original windows and doors, and hardware shall not be discarded when they can be restored and reused in place. New windows or door openings that would alter the scale and proportion of the building may not be introduced. Inappropriate new window or door features such as aluminum insulating glass combinations that require the removal of original windows and doors may not be installed. RECOMMENDATION The applicant has a valid reason for changing the door. The current one is warped and will not close properly. Staff feels that there could possibly be a door that more closely resembles the current one, but in the event that is not possible, staff recommends approval. This current storm door sags which does not allow it to shut properly and leaves a gap at the top of the door frame. L -brackets at the top and bottom hold the storm door together. The replacement window for this door is also in poor repair. The window panes are loose and screws have been used to keep them from falling out of the frame. We would like to replace this storm door with a more weather resistant and energy efficient storm door. OWNER — Frank & Katherine Coussens DESIGNATION — LHD-WNS RATING — Significant S/12 STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT This house was built in 1905 by Dr. Edwin J. Lent, an ear, nose and throat specialist. Dr. Lent was born in 1870 in Ontario, Canada. He received his training at Queen's University and graduated from there in 1892 at which time he moved to Lakeville, Indiana. Dr. Lent married Maude Vanlieu in 1893 in Lakeville, where the young couple resided until 1899 when they moved to New York City. Dr. & Mrs. Lent moved to South Bend in 1900 where he helped organize the South Bend Clinic. Dr. Lent resided at this residence until his death in 1938, leaving the house to his wife, Maude. Mrs. Lent resided in the house until the mid 1940s when she sold it to Paul J. Sweeney. Mr. Sweeney resided there until his death in 1986 at which time the house was sold to the current owners, Frank & Katherine Coussens. PROPOSED CHANGE Applicant is proposing to construct a 20'x20' addition to the existing garage converting it from a one stall garage to a three stall garage. The new addition would have the same gable roof formation as the original and would either have vinyl siding in the same color and width as the existing garage's clapboard siding or the owner is willing to side the new addition in clapboard. The new addition would be attached to the existing garage on the right side and a door would be installed to allow access from the addition to the original garage. STANDARDS The Preservation Guidelines for West North Shore Historic District state: b) ... The Guidelines for the West North Shore Historic District follow the Rehabilitation Model... New Construction or Additions to Existing Structures Preferred: New additions to existing structures must be compatible in scale, building materials and texture to the building to which the addition is made. Retain as much of the original structure as possible, so that the addition could be removed without damage to the basic structure and appearance of the building. CERTIFICATE OF APPROPRIATENESS STAFF REPORT RECOMMENDATION The addition to the existing garage is needed. Applicant wishes to construct over and around an existing concrete pad located next to the existing garage which has served for parking. Enclosure of this area already used for parking conforms to district guidelines and will match in style and appearance. The only damage to the current garage will be the east wall, which will be removed when the addition is added. PHOTOGRAPH 1636 Lincolnway West Historical Context This property is located on the south side of Lincolnway West between North College and the old New York Central Rail Road Line, in South Bend, Indiana. It is described as being the East portion of Ruple's Outlot. The brick building at 1636 Lincolnway West was built in 1905 as brewery and offices for the South Bend Brewing Association. Its design, with different tiers and decreasing heights towards the rear, reflects the process of brewing beer. Height was needed for brewing because the system was based on gravity flow assisted by pumping and hoisting. The horizontal extensions in the rear contained power, heating, refrigeration equipment and loading facilities. The South Bend Brewing Association was founded in 1903 by a group of South Bend saloon keepers primarily of Polish, German and Hungarian descent. They organized in order to manufacture and produce beer. The men began their firm with a capitalization of $100,000.00 made by selling 10,000 shares of stock. By the end of 1904 the association was leasing saloons around the city and by the end of the next year they were in control of ten, many of which were located on the west side of town where they and there fellow immigrants were primarily located. The brewery's main products in the early years were Tiger and Hoosier Beer. The first manager was Jerry Voelkers who was given the post in April of 1904. Voelkers was a German who had previously been involved in the plumbing business. He died in 1911 and was replaced by Thomas Hoban. After the Volstead Act and the restrictions of Prohibition began in 1919, the association changed its charter and began to manufacture ice cream, candy, cereal beverages, soft drinks and malt extracts. They also began distilling denatured alcohol for industrial purposes. In 1922 the firm's name was changed to the South Bend Beverage and Ice Association and George Voedisch, a twenty-five year employee of Muessel Brewery in South Bend, became President and General Manager of the firm. The Voedisch family remained associated with the business until the brewery closed. George Voedisch died in August of 1940. His sons, Hugo (Ike), and John, took control of the company. John became president and his brother became vice- president. Hugo died in 1945. 1 HISTORICAL CONTEXT CONTINUED After Prohibition the company began to again brew beer and was soon producing 50,000 barrels a year. The primary sales area for their products was in northern Indiana and southern Michigan. The firm late built new offices at College and Lincolnway West and the old offices were converted to manufacturing space. By 1950 business was stagnating, producing half of their past volume. Brewery officials blamed a federal excise tax of $8.00 per barrel for the decline, for it was a severe burden for a small brewery. The brewery closed November 11, 1950. The firm's ice department, Polar Ice and Fuel, remained in business for a few more years. The building was used in the 1950's by White Way Glass Company, operated by Russell E. Frushour. By 1960 it was being used by the I.W. Lower company who specialized in paints. From 1970 to 1985 it housed McDaniels' Harley-Davidson Company. In 1985 it was also being used by Acme Design Service Incorporated. Kenneth Inwood purchased the building in 1990 and sold it to the current owner, Ethel Anderson, in 1995. ARCHITECTURAL DESCRIPTION This is a four to five story Gothic Revival style industrial building with a single story rear addition for loading and mechanics. It has a flat, multi -leveled roof with castellated parapets and two five story square towers at either end of the front facade. The walls are brick painted with ads on the front and sides of the buildings and toped with corbelled cornice banding beneath the battlements. The front windows are evenly arranged with voussoired roman -arch heads and stone sills, all of wich are boarded up. The windows and doors on the west facade were once large basket -handle arcades, which are now bricked up and replaced with rectangular openings. The rest of the structure contains square and rectangular shaped windows of various sizes which are all either bricked up or boarded shut. The rear single story portion of the structure still has some loading doors in operation, however, they are of the modern steel and aluminum variety. The front of the building has had a modern class storefront added to the first story where a used furniture store is housed. The building still boasts a smoke stack, battlements and two turrets. RECOMMENDATION Based on the Historic Preservation Commission's Local Landmark Criteria's adopted by the Common Council, the building at 1636 Lincolnway West has been recommended to the Common Council for designation as a Local Historic Landmark by Historic Preservation Commission. 2 RECOMMENDATION The building meets the criteria in at least three areas: 1.) Its character, interest, or value as part of the development, heritage, or culture of the City of South Bend, St. Joseph County, the State of Indiana, or the United States of America. 2.) Its embodiment of elements of architectural design, detail, materials, or craftsmanship which represents an architectural characteristics or innovation. 3.) Its suitability for preservation. 4.) Its identification with the life of a person of historical significance. The building fulfills criteria #1 as an example of the lives and growth of the Eastern European immigrants in South Bend and as an example of the plight of the small business during Prohibition and their eventual decline do to big business expansion. The building fulfills criteria #2 as an excellent example of a turn of the century, Gothic Industrial complex. The building is rated a significant twelve in the Indiana Historic Sites and Structures Inventory. The building fulfills criteria #3 by the integrity of its original construction with minor changes to the facade, that can be easily restored. It is an example example of Industrial architectures movement in the turn of the century to the Gothic style of architecture complete with turrets and battlements. The building fulfills criteria #4 by its association with George Voedisch, the president and general manager of the South Bend Beverage and Ice Association. Staff finds that the building meets the criteria for designation as a Local Landmark and recommends that the Commission send such a recommendation to the Common Council. rls 11/S/98 3 MINUTES OF THE REGULAR MEETING of the HISTORIC PRESERVATION COMMISSION Monthly Meeting 7:30 p.m. Monday October 19, 1998 County Commissioner's Conference Room 7th Floor County -City Building I. Call to Order John Oxian, president of the commission, brought the meeting to order at 7:30 p.m. II. Roll Call Commission members present were: John Oxian, Joann Sporleder, Catherine Hostetler, Adrian Fine, Ron Zmyslo and Janeanne Petrass. Commission staff present was: Ed Talley, acting director, Rhonda Saunders, administrative assistant, and Aladean DeRose, consul, arrived at 8:00. Also attending the meeting were: Don Sporleder, David Betson and Noreen Howard. Mr. Oxian table the Certificate of Appropriateness for 1323 E. Wayne Street, at the request of the owner and the National Register Nomination, 3016 Portage Avenue, at the request of its board. III. Public Hearing A. Certificate of Appropriateness Applications 1. 1998-1001 - 944, Riverside Drive, new chain link fence in rear yard. Mr. Talley presented the staff report and circulated photographs. He also noted that the owner, Mr. Betson, was present. Mrs. Hostetler moved to approve the application as recommended by staff. Mrs. Petrass seconded the motion. Mr. Oxian asked the owner, Mr. Betson, why he was removing the existing portions of fencing. Mr. Betson stated that the existing sections consisted of rotting wood posts with chain link attached to the posts. Mr. Talley stated that since Mr. Betson purchased the property he has worked on restoring elements of the house.. The motion passed unanimously. 2. 1998-1001-2 pt.B - 1012 Riverside Drive, addition of wood shutters and window boxes. Mr. Talley presented the staff report and circulated photographs. He also noted that the owners, Mr. & Mrs. Howard, were present. Mr. Oxian asked if the owner wanted to install wood window boxes. Mrs. Howard stated that she has decided to use a wrought iron style window box instead to better keep with the houses Mediterranean feel. She presented the Commission with photographs and drawings exhibiting the house with such shutters and window boxes. Mr. Oxian asked if the shutters would be operable. Mrs. Howard stated that they would be fixed shutters. Mr. Fine asked if the shutters would be made of wood. 1 Mrs. Howard stated that the shutters would be made of wood. Mr. Zmyslo asked if the house was described as a Mediterranean Style house in the survey. Mrs. Saunders stated that the survey referred to the house as Revival Style. Mr. Zmyslo stated that the proposed changes would not alter the houses existing style. There was some discussion over the condition of the house prior to the new owners clean up efforts. Mr. Talley noted that during the clean up the owners have discovered many yard features such as, stone benches and birdbaths. Mr. Oxian stated that all the items that the owners have uncovered should be listed and given to the Commission for feature reference. Mrs. Sporleder asked if the lantern located on the first floor would be removed to make room for the shutter. Mrs. Howard stated that the lantern would simply be moved over. Mrs. Sporleder further noted that the proposed changes would not alter the structure physically and could easily be removed. Mr. Zmyslo concurred with Mrs. Sporleders remarks stressing that the proposed changes could easily be removed. Mrs. Sporleder moved to approve the addition of permanent wood shutters, the movement of a first story light fixture to accommodate a shutter and the addition of iron type window boxes, as described in the application and as presented to the Commission by the owner. Mr. Zmyslo seconded the motion. The motion passed unanimously. 2. 1998-1006 - 520 East Colfax, gutters and downspouts. Mr. Talley presented the staff report and circulated photographs. Mrs. Hostetler moved to approve the application as submitted. Mrs. Petrass seconded the motion. Mrs. Sporleder asked if the proposed location for the gutters and downspouts would have been original to the house. Mr. Fine stated that the rear porch configuration is not original to the house and the side porch appears to not have had gutters or downspouts. He also noted that a handicap ramp was added to the side porch which causes water to run off onto the ramp instead of onto the ground, causing deterioration. Mr. Zmyslo asked if the porch might have had built in gutters like the rest of the house. Mr. Fine stated that the porch might have had such gutters, however, there is no evidence to support the notion. Mr. Oxian noted that the original back porch had gutters that fell off during the move. Mr. Fine further stated that the reason behind wanting the gutters and downspouts was to stop future deterioration of the handicap ramp. He also noted that the downspouts would be placed as inconspicuously as possible. The motion passed with Mr. Fine abstaining do to his position with the Historic Landmarks Foundation. Mr. Oxian stated that the hospital purchased this house with the intention of using the lot for parking, but, fully intended to participate in saving the house. He went on to discuss how the house came to be moved, noting that Historic Landmarks Foundation was most successful in saving the building. B. Local Landmark 1.415 E. Madison - second reading Mr. Talley presented the staff report and circulated photographs. He noted that there has been no response from the owner. Mr. Oxian stated that this house was the second Greek Revival style house in South Bend and that there are not many houses of this style left. Mrs. Sporleder questioned whether or not the house can be considered a true Greek Revival Style house since it was built very late for this style and that it lacks many of the traditional Greek Revival elements. 2 Mr. Oxian asked what style Mrs. Sporleder thought the house was. Mrs. Sporleder stated that the only two elements of the house which could be considered Greek Revival are the three window panes over the front door and the proportion of the windows. She also noted that the house does not have side lights on either side of the door, or the appropriate detailing over windows, or cornice returns which are all typical features of a Greek Revival Style House. Mrs. Sporleder went on to state that the over all procreations of the house are out of scale with the Greek Revival Style. Mrs. Sporleder noted that the house may have had such detailing at one time and has since been removed. Mrs. Saunders interjected that the few Greek elements that the house currently possesses were added to the structure in the early 1900s and that the house was basically Vernacular in style. Mr. Oxian asked if the construction date of the house was correct. Mrs. Saunders stated that the date was taken from the survey card. Mr. Fine stated that something about the houses style did not seem right. Mr. Oxian stated that the house probably had a different style when it was constructed. Mr. Talley stated that the house may have been Vernacular in style at its inception. Mrs. Sporleder concurred that the house could have been Vernacular in style with various Greek elements. Mr. Oxian noted that the part of the construction that bothered him most was that the cornices did not return as was typical in most Greek Revival style houses. There was some more discussion over the architectural style of the house. Mr. Talley asked if it would be all right with the Commission if the Staff made the necessary corrections to the staff report while not interrupting its flow through the system. Mr. Oxian stated that since the report has not yet gone down to the Common Council that the Staff could make the needed corrections. There was more discussion over the Greek elements the house lacked. Mr. Oxian suggested that the Staff label the house a Vernacular style house with Greek elements. Mr. Oxian also noted that the reason he brought this house before the Commission was because of its poor condition and its past problems with Code Enforcements. Mrs. Saunders noted that the owner has not responded to any letters the Commission has sent to him. There was some discussion over the history of the house. Mrs. Sporleder noted that Forrest West, a previous owner, was a well known South Bend Architect and should be noted in the persons of significance portion of the staff report. Mrs. Sporleder moved to send the proposed local landmark, 415 W. Madison to the Common Council, with the previously mentioned corrections. Mrs. Petrass seconded the motion. The motion passed unanimously. III. Regular Business A. Approval of Minutes 1. September 21, 1998 - Mr. Oxian noted that under Certificate of Appropriateness number 3 all proposed changes should be listed, not just the rear door porch. He also stated that under the area of Local Landmark where it stated that there was a question over if Mr. Brookins owned the house, when the real question was whether or not he moved the house. Mrs. Sporleder stated that she believed Mr. Brookins was not responsible for moving the house. Mrs. Hostetler moved to approve the minutes as corrected. Mr. Fine seconded the motion. The motion passed unanimously. B. Treasurer's Report None. 3 C. Correspondence (see attachments) Mr. Talley stated that the Staff has issued to the Commission a document titled "Review" which summarizes all the correspondence and all the activities the office has handled during the last month. Mr. Talley stated that pages three and four can serve as a treasurers report because they are the current account ledger for the Commission as of August 30, 1998. He also noted that the next two pages were the Community and Economic Development Staff Report for CDBG funding for 1999. Mr. Oxian stated that he accomplished his goal in raising the available CDBG funds from $19,000.00 to $25,000.00. Mr. Talley stated that the entire CDBG read out is located on the next page. Mr. Talley reported that on October 14, 1998 he represented the Commission in making a presentation to the State Board of Review, noting that all the properties before the Board passed. He noted that a fax, from the County Engineer and Beverly Crone requesting that the matters concerning bridges be tabled, was received by the Review Board after the proposed nominations were passed. Mr. Oxian stated that Mr. Talley did a very good job on his presentation to the Review Board. Mr. Zmyslo asked exactly what the applications were for. Mr. Talley stated that it was a State and National Register Application. Mr. Oxian stated that since approved the applications will now proceed to the Federal Review Board. Mr. Talley noted that the Review Board made comments about how they would like to visit South Bend. He further noted that in response to these comments the Staff has officially requested that the next time the Board has their one, not held in Indianapolis Quarterly Review, that it be held in South Bend. Mr. Talley stated that the correspondence on 2000 letterhead is in regards to the Millennium Task Force meeting to be held on October 21, 1998, which the Commission is invited to. Mr. Talley stated that the Commission mailed out the Request for Proposals, regarding the resurvey of the County, which are due back November 6, 1998. He noted that the the grant should be awarded prior to Thanksgiving. Mr. Talley reported that the 1999 DHPA Grant application has been completed with a request for $25,000.00 to print the resurvey of the County. He then reported on all the conferences and ceremonies the Staff has attended. Mr. Talley stated that the archaeological dig in Leeper Park has been set up for the weekend of October 23rd and 24th with IUSB. He also reported that everything was progressing nicely with the rehabilitation of Leeper Bridge after the auto accident. Mr. Talley asked the Commission if the Staff should continue in this new format for reporting correspondence and the accomplishments of the Staff.. The Commission should approval of the format and its continued use. Mr. Oxian noted that the broken pylons from the Leeper Bridge are being housed at Water Works. D. Committee Reports 4 1. Historic Districts Mr. Oxian stated that North St. Joseph Street Proposed Historic District would be before the Common Council again, with out the house at 121 E. Navarre, on October 26, 1998. He also noted that the South St. Joseph Street Proposed Historic District would be before the Common Council in November. 2. Historic Landmarks Mr. Oxian noted that after corresponding with the City Clerks Office Jefferson Street should now be up for first reading. 3. Standards & Maintenance a. 202 S. Jacob Mr. Fine stated that the Committee met on September 30th with the property owner, William Lamie to discuss his project and drawings. He reported that the Committee is recommending approval of the conceptual changes that are being proposed to the rear of the house, including the hip roof over the garage, the rear portico with columns, the replacement of the large window with French doors and the kitchen and garage expansion. Mr. Fine noted that the front portico does not have a final agreed upon design and that the Committee is okay with the concept, but, not the current design. He also noted that the owner seemed pleased with the meeting and the Commissions willingness to help home owners. E. Staff Reports 1. CofA Staff Approvals - see attachment 2. Legal Mrs. DeRose stated that she has prepared two proposed ordinances for informal discussion by the appropriate subcommittees of the Common Council. Mr. Oxian stated that the ordinance converting annexed County Local Landmarks into City Local Landmarks should pass with out a problem and thus should be introduced to the Common Council. He further noted that he will present the ordinance requesting interim protection for proposed Local Landmarks to the Common Council on October 26th. Mrs. DeRose asked if the Model Preservation Act has been approved by the Indiana State Legislature. Mr. Fine stated that the model has not been approved. There was some discussion over a time limit for the ordinance. V. Old Business 1. Leeper Park - Tennis Court Parking Lot Mr. Oxian noted that this Certificate of Appropriateness was presented under the wrong standards at the last meeting. Mr. Talley presented the staff report and circulated photographs. Mr. Talley noted that since his trip to New Harmony, Indiana, where he was exposed to aggregate sidewalks he has wondered if an aggregate may be the best sidewalk material for Leeper Park. He further expressed his feelings that the Commission may in the future feel that they approved this project too soon, without, considering the rest of the sidewalk projects through out the park. 5 K�viSeo� tr/�6�p� Mr. Talley stated that the Commission may also want to consider the traffic caused by bicyclists, skate borders and in-line skaters when the type of material is chosen for the rest of the parks sidewalks. There was some discussion over the hazards of skate boards, skaters and bicyclists and the appropriateness of recommending a paving material that is unfriendly for such recreational activities. There was more discussion over if the Commission has the right to limit such activities. Mr. Talley noted that it might be wise to approve the proposed project to help maintain a friendly atmosphere between the Commission and the Parks department. He also noted that the proposed parking lot is shown in the Westerly Report, which the Commission has already approved, thus, the Commission has approved this project. Mr. Oxian suggested that Mr. Talley discuss the surface and activities issues with the Parks Department. Mr. Zmyslo stated that he could not imagine a park that did not allow the above mentioned activities and questioned the Commissions authority to restrict such activities. Mr. Oxian stated that the Commission could not restrict the activities. Mr. Zmyslo stated that he did not believe the Commission should be involved in such a topic. Mrs. Hostetler stated that since the parks designation was based on the rehabilitation of an hsitoric landscape, the Commission should be involved and concerned about this topic, but, can only affect it through recommending materials to be used if activities are to restricted and if activities are not to be restricted. Mr. Zmyslo asked what the original paths were made of. Mr. Talley stated that they were made of Peat Gravel. There was more discussion over the restriction of activities in the park and recommended paving materials. Mrs. Hostetler moved to approve the application. Mrs. Petrass seconded the motion. The motion passed unanimously. 2. Leeper Park - Rose Garden Plaque Mr. Talley presented the staff report and circulated photographs. He also noted that the plaque is being placed in the location of the water fountain which has led the staff to recommend temporary approval of the location until the reintroduction of the fountain. Mr. Fine asked if the plaque is to be moved to another location in the park when the fountain is installed. Mr. Talley stated that it should be relocated to another spot in the Sunken Garden. Mr. Zmyslo asked if a permanent location for the plaque could be designated now. Mr. Talley stated that he has given the Parks Department temporary permission to install the plaque, because, the dedication of the plaque was held on the 20th. Mrs. Sporleder noted that the plaque was placed on the west end of the garden and not the east end. Mr. Zmyslo moved to approve the plaque in its present location on a temporary basis until the water fountain is reinstalled in its original location at which time the plaque will be moved to a permanent location with in the park to be determined at a later date by the Commission and the Parks and Recreation Department. Mrs. Sporleder seconded the motion. The motion passed unanimously. 3. Historic District Guidelines Mr. Oxian asked if the guidelines were finished. Mrs. Saunders stated that she did not want to make any corrections in the guidelines until all the Commission members had submitted their corrections. Mr. Oxian told the Commission members to look at their guidelines and hand in their corrections. C V. New Business Mr. Oxian stated that he would like to have the rating for the Hoosier Brewery located at 1636 Lincolnway West, changed from an S/11 to an S/12. He also noted that when he spoke with Glory June she stated that the State would not accept this property as a national Register Nominee by itself because South Bend has other breweries. Mr. Oxian went on to report that he has spoken with the owner of the Muessel Brewery who has shown interest in being nominated for the National Register jointly with the Hoosier Brewery. Mrs. Hostetler moved to correct the rating for 1636 Lincolnway West from an S/11 to an S/12. Mrs. Sporleder seconded the motion. The motion passed unanimously. VI. Hear of Visitors Mr. Sporleder noted that the Blake Garden Hospitality Hub is still in litigation with the developers and that there is status conference to be held on October 29th in the MACOG conference room. He also noted that Greenfield, Indiana would be opening and dedicating its new trail system, which follows old train lines, on October 24th. VII. Announcements and Miscellaneous Matters None. VIII. Adjournment Mr. Oxian adjourned the meeting at 9:30 pm. 7 Review The Historic Preservation Commission of South Bend and St. Joseph County has handled the following items of business during the past thirty days: Guest speaker at Portage Manor Luncheon (Met with the Board of Director, County Commissioners, County Legal Counsel to answer question regarding the National Register nomination for Portage Manor. The end result was a motion by their board to re -consider the previous motion, which was "against" the nomination. The main contention was the "additional jumping through hoops" that they claim would cause them undo hardship when using Federal money.) Archeology dig and probing in Leeper Park (Conducted by the Archeology Department of IU at South Bend, under the direction of Dale Quantris, Departmental head. Results: carriage drives, formal rose garden located.) St. Joseph County Strategic Plan Hearing (Director Ed Talley attended this public meeting held on October 28 at Adams High School. This was one of a series of meeting which were held during the months of October and November throughout St. Joseph County.) East Wayne Street Liaison Member Meeting (Mr. James Hasse of the East Wayne Street Local Historic District came to the office for about a one hour meeting. Topics were: street light project, new guidelines, invitation to attend one of their meetings in November. Several days later he returned following a review of the new guidelines books with some questions and corrections. The meetings were positive and constructive.) Global Information System Meeting (A series of meetings are being conducted by The Polis Center; IUPUI, Cavanaugh Hall; Indianapolis, Indiana; with Kathy McCarter AIT Director. The Polis Center was hired by the St. Joseph County Commissioners to conduct a series of meetings so that data could be collected to aid in the planning of a GIS which will supposedly PAGE 1 be instituted City and County wide within the next three to five years. This system will serve many departments including the HPC. All maps, historical survey data, etc., will be on the system. A complete new series of hubs and networks will be installed throughout governmental buildings which can share the information, provide e-mail and other uses. A hand-held unit can also be used by our staff, which when initiated at the address of any property listed in the City or County Survey will bring up on the screen all of the data we now have in the office relating to the address. Building and Engineering Departments will have data useful to them on the system which shows utilities, lot size, boundaries, permits issued, etc.) Meeting with the St. Joseph County Engineer (A meeting held on the 30th of October with the County Engineer was cordial . It was in response to the meeting at Portage Manor as well as a letter of opposition filed by her office and the County Commissioners for the East Bank Multiple Property National Nominations. The County Engineer claims that because a property is listed a "historic", her office is caused undo cost and additional time when conducting projects that use Federal dollars. The HPC is not the only organization to run into this same discussion with this person. In fact, I learned that information relating to the 106 review process was being supplied by Sandy, Director of MACOG. The information was also being absorbed by the two female County Commissioners. This then resulted in a 100 -percent opposition campaign by the Commissioners and the County Engineer. This office has read, reviewed and discussed this topic until I am confident we are soon to be experts on this matter. A copy of the letter to the County Engineer is attached/) Request For Proposals -1998 DHPA Grant (Several telephone calls and in person meetings were conducted in regard to the potential bidders of this project. Bids were due 11-06-98 and were opened by the Executive Committee on 11-10-98. Three bids were received.) City Council Ordinances (About 5 ordinances were handled this past month. Considerable time was involved due to requirements by the City Clerk's office, which caused revisions by this office as well as by Aladean. Leeper Park Sidewalks (Several telephone conversations, question and answer sessions and meetings were held for the design and layout of the sidewalks for the central section of Leeper Park's central section. The direction of this process should yield new sidewalks for the central section of the park, which appear in the same location of the original. Exposed aggregate will be used for the walks that PAGE 2 are not along the river bank.) Riverbend & North St. Joseph District Parking Problems (A meeting at Memorial Hospital was attended by this office. There appears to be a solution to the parking problems with the issuance of parking permits for the residents.) Your specific concern seems to be the wattage of the Metal Halide lamps in conjunction with the height of the pole. The concern seems to be fair, since this will be the first time Metal Halide would be used in a City street lighting system. Based upon this situation may.we suggest that you forward your required plans for the balance of the project to this office, and in the meanwhile order two fixtures complete with refractor and lamps to be installed within the district for an actual test. The Historic Preservation Commission meets again for its monthly meeting on the, 19th of this month whereby the matter pending approval can be concluded, less the wattage of the lamps. From experience, I wish to correct information submitted to your office relating to the burning temperature of the lamps. Instead of the 3200 - degree Kelvin lamp, the 2800 -degree Kelvin lamp should be utilized. I have and would be willing to loan to the City a 70 -watt Metal Halide ballast, which would then require a lamp to be ordered for the test. Following the HPC meeting on the 19th, all equipment for the project could be ordered, less ballast and lamps, pending the outcome of the test exercise. I was extremely impressed with the condition of your facility which shows a tremendous amount of love, time and money put forth for renovations. I applaud your total labor of love. Concerning the topic of nomination for Portage Manor to the National Register of Historic Places, I wish to address a couple of points of misunderstanding. First, examples used by one of your members who presented problems of an acquaintance living on West Colfax Street in South Bend innocently concluded that this friend's problems were tied to the Historic Preservation Commission's review process.. These stories.are misleading, because the properties on West Colfax are actually governed by the. City of South Bend's Design Review Committee which includes the downtown area, Chapin and West Washington Street Corridor. The Historic Preservation Commission is NOT included in any review process of these areas unless the property is designated a Local Historic Landmark. The new Transpo Station is also under the jurisdiction of the Design Review Committee. Second, concerns presented by St. Joseph County Commissioner Cynthia Bodle relating to the LaSalle Street Bridge nomination to the National Register by the City of South Bend and the Economics Development Department are also confusing. Even though the bridge will be placed on the National Listing, it in no way encumbers any actions having to do with bridge maintenance or its existence. National Register listing is simply honorary. It was my impression going into the meeting with your board that there seemed to' be misunderstandings . 'of the role of the Historic Preservation Commission relating to National Listings. I attempted to seek the reasons for this confusion and have concluded that: _(I) due to mis-information provided to you by our previous Director, (2) evidence which has confused the Historic Preservation Commission with another agency and (3) that National Listings are only honorary should leave the situation completely without opposition or confusion. Please advise us of your decision regarding the nomination of Portage Manor to the National Register of Historic Sites and Structures. I hope that your initial recommendation might now turn to favor. We have a serious demand for parking. Presently, the visiting parkers are spilling over into the surrounding neighborhoods, thereby causing congestion and taking away space in front of homes. Consequently, we look to all areas which provide parking for us on campus. That corner, obviously, fits the criteria. Approximately two years ago I notified the Park Avenue Neighborhood Association, the Near Northwest Neighborhood Association, Southhold and Mr. John Oxian that Memorial would construct a foundation and move the building to any site designated within the historical districts. John and I had several conversations. No site was identified by any party. We even looked at moving it into Leeper Park and turning over ownership to one of the organizations just as we have done on 13 .other structures over the past eight years. That was not acceptable to the Park Board. As a consequence, we made everyone aware that after two years we needed to move forward. Parking was even more critical then earlier due to the increased demand for health care services on the campus. We have, contracted with a company to remove asbestos and begin demolition. Due to a change in the position of the Director of this Commission it was necessary to review current projects that affect this department. After some delay in ' obtaining specifications and prints from. the Board of Public Works, our, request through the Water Works Department was finally fulfilled. Because of the ,delay, our digestion of this project's scope has just been finalized. I met with John Wiltrout yesterday 'afternoon to review the entire project. John was most accommodating as usual and the re . view process produced the following items needing clarification: 1. The Certificate of Appropriateness issued on August 17, 1998 (1998-0715) carries the recommendation that the Director of the Historic Preservation Commission meet with the chosen contractors to discuss the park and building historic significance. This is extremely important because there is NO mention in the Specifications as to the historical significance of the building or the park grounds. Due to the fact that there was no 106 review for this project, some of this information was omitted. (Sec. 13) 2. There does not seem to be a clearly organized 'method for the convergence of construction equipment into Leeper Park nor the designation of a confined work area within the park. (See 13.7; See. 0 10 10) 3. The removal of historic portions of the building and park are not clear as well as the disposition of these items. (Sec. 02050) 4. Location of the Siamese connections, valves, etc. concerning the fire sprinkler system. (Sec. 15300) 5. The Northern Indiana Historical Museum's . annual Cabin Days in May seems to be in question, and this directly ties into the location of the 'work areas, c Ionstruction material storage, etc. 6. Location and detrimental effects of the acid and gas vents (15400, 15575) 7. Unacceptable use of Portland,Cement on brick surfaces in the building per National Park Service Directives. (Sec.' 16050) Drilling and boring for electrical piping through exterior walls. (Sec. 16050) 9. I believe that this is the first major construction project that involves a Local and National Historic Landmark within the City of South Bend. The Historic Preservation Commission took into account the need for possible upgrading of the building and the necessity to install and remove well sites throughout Leeper Park when the park and building were historically designated. The items and questions that are referred to in this letter should ' NOT be construed as any opposition or an attempt to be burdensome to the construction project, but rather the fulfilling of this department's responsibilities. The Historic Preservation Commission of South Bend and St. Joseph County is designated by the Indiana State Historic Preservation Office as a Certified Local Government. This elevated responsibility of review allows for this Commission to review and designate historic sites and structures. It also allows us to review and comment on projects affecting historic sites and structures, even.the 106 review process. An archeology probing and limited dig was conducted on October 23, 1998 by the Archeology Department of Indiana University, South Bend campus for the area directly east of the pump station. Results indicated the original carriage drives and formal rose garden in the park. We see from boring reports done by Earth Exploration of Indianapolis, Indiana that they too found original remnants of the park. We understand that there will be a meeting on Friday, November 6, 1998 with the contractors who's bids were selected to preform the project. We will await word from you as to when we will be able to meet with these individuals and look forward to reviewing answers to the various topics that are listed in this letter. As always, when we deal with the Water Works Department we anticipate a completely organized, hassle free and co-operative atmosphere. To this point we have experienced just that. JOSEPH COUNTY This contract for the re -survey -of St. Joseph County shall be in force from this first day of December in the year of 1998 between the Historic Preservation Commission of South Bend and St. Joseph County and the Westerly Group, Inc. of 556 West 1175 North Road, Farmersburg, Indiana, 47850, until completion -of said contract, which shall occur on or by the first day of August, in the year of 1999. This contract shall be for the wok described and the meeting of conditions described in the attached sub— paragraphs as stated below; and shall be completed and executed for the total amount of Forty -thousand, five -hundred -dollars ($40,500.00).' This amount shall be paid according to terms listed within this document, commencing with the first day of the life of this contractual agreement, which is signed by both parties, which have entered into said contract. A re -survey of the St. Joseph County Historic Sites and Structures Inventory, located throughout said county in all rural areas and incorporated towns with the exception of the City of South Bend and the City, of Mishawaka. This survey encompasses approximately 400 square miles and the identification of some 1800 properties and individual listings. The Townships included in the re -survey area shall include: Harris, Clay, German, Warren, Olive, Penn, Portage, Centre, Greene, Madison, Union, Liberty and Lincoln. This is a re- survey of St: Joseph County done in 1985. The survey will identify and rate individual landmarks, including farmsteads, potential rural historic districts, scenic and landscape resources. A grant has been awarded by the Department of Natural Resources. Division of Archeology for the activities involved in the re -survey. This grant is funded by the National Park Service, Department of the Interior, and administered through the Division of Historic Preservation and Archeology. The following conditions are part of the bid nrapg5al and will be anartgLtbe nroiect award contract: (1) Bidders must meet the professional standards given in 36 CFR 61, and must be able to demonstrate Previous experience in completing a Historic Sites and Structures Interim Report Publication. A resume outlining qualifications and experience must accompany the bid proposal. The successful bidder must be approved by the Indiana•Division of Historic Preservation and Archeology .(DHPA), Indiana Department of Natural Resources, before a contract can be awarded. (2) . Bidders shall provide a firm fixed-price bid, and include in the bid all travel, supplies, and miscellaneous costs which mightbe incurred in completing the project. (3) The bidder shall adhere to and the project shall be conducted in Accordance with the Secretary of the Interior's Standards and Guidelines for Identification, Evaluation and Registration and DHPA Survey and Planning Grants Manual. (4) The successful bidder shall be required to provide a finished product which shall include survey data cards and data -base entry of information for the anticipated publication of a summary report. Editing and publication of the summary reports are not a part of the project. Electronic data base information, shall be on three -and -one -half-inch double sided, high density, 135 tracks per inch disks minimum and compatible with a Windows 95 operating system. The Westerly Group shall also supply preliminary survey forms and USGS maps. 'Photographs shall be standard 35mm, black and white. (5) Twenty (20%) percent of the contract amount will be paid at the time a contract is signed. Fifteen (15%) percent will be withheld until the final product has been reviewed and approved by the DHPA. (6) Awarding of this contract shall be contingent upon approval by the DHPA which shall be obtained before a contract will be jet. (7) In all hiring or employment made possible by or resulting from Historic Preservation Fund grant awards, the consultant: (1) will not discriminate against any employee or applicant for employment because of race, color, religion, sex; age, or national origin, and (2) will take affirmative action to ensure that applicants are employed,and that employees are treated during employment without regard to their race, color, religion, sex, or national origin. This requirement applies to, but is not limited to the following: employment, promotion, demotion, or transfer; recruitment or recruitment advertising, layoff or termination, rates of pay or other forms of compensation, and selection for training, including apprenticeship. Page ;1 • ' (8) The grantee, the Department of the Interior, the Comptroller General of the"United States, "or any of their duly, authorized representatives, shall have access to any books, documents, papers, and records of the consultant, which are directly pertinent to this specific contract, for the purposes of making audits, examinations, excerpts, and transcriptions. The hired consultant shall maintain all required records for three years after the final payment is received and all other pending matters are closed. ((9) No part of the money appropriated by any enactment of Congress shall, in the absence of express authorization by Congress, be used directly or indirectly to pay for any personal service, advertisement, telegram, telephone, letter, printed or written matter, or other device intended or designed to influence in any manner or member of Congress, to favor or oppose, by vote or, otherwise, any legislation or appropriation by Congress, whether before or after the introduction of any bill or resolution proposing such legislation or appropriation: but this shall not prevent officers or employees of the United States or its Departments at the request of any Member, or to Congress through the proper official channels, requests for legislation or appropriations which they deem necessary for the efficient conduct of the public business. 10) The consultant shall comply with the Copeland "Antikickback" Act (18 USC 874) as supplemented in Department of labor regulations. This act provides that each contractor shall be prohibited from inducing, by any means, any person employed in the construction; completion, or repair of public work, to give upany part if the compensation to which he is otherwise entitled. (11) TERMINATION AND BREACH OF CONTRACT:. If the Consultant fails or refuses to perform the work in an acceptable manner. the sub -grantee may give notice in writing to the consultant and his surety of such failure or refusal, specifying the same and directing what.action shall be taken. If the consultant, or his surety, within a period of ten (10) days after such notice does not proceed in compliance therewith, without violating the contract, to take the prosecution of the work out of the hands of said consultant, and may, at his option, turn the work over to the surety, or enter, into an agreement with another consultant for the completion of the contract according to the terms and provisigns thereof, or he may use such other methods as, in his opinion, shall be required for the completion of said contract in an acceptable manner. All costs of completing the work under the contract shall be deducted from any'monies due or which may become due said consultant. In case the expense'so incurred by the sub -grantee may be less than the sum which would have been payable under the contract if it'had been completed by said consultant, then said consultant shall be entitled to receive the difference, but in case such expense shall exceed the sum which would have been payable under the contract, then the consultant and his surety shall be liable and shall pay to the sub -grantee the amount of said excess. By taking over the prosecution of the work, the sub -grantee does not forfeit the right to recover damages from the consultant or his surety for his failure to complete the work within the time specified. (12) Progress reports shall be submitted to the Historic Preservation Commission of South Bend and St. Joseph County on a timely basis according to the following schedule: Reports due on the sixth (6th) day of each month, commencing with the month of December, and shall continue on this schedule until the sixth (6th) day of May, 1999, which shall be the final report due "of all areas of the survey. A mid -point meeting shall also be required, which shall be a chance for the Commission to review the scope and progress of the project. This mid -point meeting shall be conducted on the February 6, 1999, which is also progress due date: All stipulations of this survey shall be in the hands of the Director of the Historic Preservation Commission of South Bend and St. Joseph County by the thirty-first (31 st) day of May 1999. This shall include all survey cards, data base materials and all and any other documents, reports, diskettes, photographs, plans, prints, etc., deemed necessary to meet the fulfillment of said contract. (13) A draft version of the St. Joseph County Historic Sites and. Structures Inventory Report shall be submitted to the , Director of the Historic Preservation Commission of South Bend and St. Joseph County on or before the thirty- first (31st) day of the month of May. This draft will be submitted for review by the Historic Preservation Commission of South Bend and St. Joseph County and DHPA and will be returned for correction as required. The consultant will then have thirty (30) days to make corrections and re -submit the inventory. The inventory must then be approved and accepted by the Historic Preservation Commission of South Bend and St. Joseph County. After this approval, it will be sent to DHPA for review.
