STATEMENT OF SIGNIFICANCE./HISTORIC CONTEXT
Jenny L. Sharples, widow of'Dennis Sharples, -purchased lot 16 of Andersons
Subdivision, from Joseph L. Harter in March of 1905 for $1,000.00. She built
this house a few months later with the intention of using it as a rental'. She
.rented the house.to James Miller, a -painter for I.W. Lower, from 1905 to 1910.
AFter Mr. Miller moved out Mrs. Sharples rented the.house to various -people
until her death in 1947. In July of 1947 -Bessie M. Rhinehart, executor of -Mrs.
Sharple.'s estate, ..sold the house to .Lloyd C. Beatty. Mr. Beatty was the
general supervisor at the Studebaker Corporation and the first owner to reside
in the house. He lived there until 1951 when it was sold to Marjorie and
Robert Woodward'and Earl and Bertha Hooten,. Mrs. Hooten was MarjorieWoodwards
mother, they lived-in the house for a year, selling.it to.Mrs. Hootens son,
Robert H.. Freshley-in 1952. Mr. Freshley was the.president of Basic Machine
Products Inc:, he resided in.the house with his wife,,Dorothy, until 1958 when
he sold it to Carleton,H. Rhinehart. Mr. Rhinehart was a driver for Dallas &
Mavis, he lived there with his wife., Nellie, until 1979. The house stood
vacant.from 1980 to 1989 when it was sold to the current owners, Michael and-
Darcia O'Blenis. ,
PROPOSED CHANGE
Applicant proposes to terrace the first level of. -the river bank. The terrace
would include wood steps, new plantings and pruning of the esisting.trees to
promote growth.
STANDARDS
The Preservation Guidelines for.Riverside Drive Historic District:
b)....The Guidelines for -the Riverside Drive District follow the
Rehabilitation Model....
I.A.•l.' Required
New plant materials....shall•be compatible with the character of the
neighborhood in size, scale, material and color. The river front neighborhood
character of the district shall be retained.
I.A.2. Recommended
If erosion control efforts become necessary to preserve the riverbank, they'
should involve processes and materials consistent with the natural beauty -of
the banks. Large, deep-rooted trees and shrubs as well as fast spreading .
ground cover should be used whenplanting for erosion control. As much natural
vegetation as possible should be preserved:
I.A.3. Prohibited
In erosion control, materials shall not be -utilized in an unsightly manner.
Digging into or otherwise introducing or accelerating the deterioration or
erosion of the riverbank is prohibited. The development of public boat docks,

fishing areas, -access points, scenic -overlooks or terraces is prohibited..
I.B.I. Required
Plants, trees ... which reflect the property's history and development shall be
retained.-
I.B.2. Recommended -
New site work should also be appropriate to existing surrounding site elements
in scale, type and appearance.'The development of private boat landings-,
access points... should be done in such•a way as to avoid obstructing the view
of the river and its banks.
I.A.3. Prohibited
No -changes may be made to the appearance of the site by removing old plants,
trees, fencing...and•other elements before evaluating their importance to the
property's history and development.
RECOMMENDATION
The Historic Preservation Commission has long been aware of the problems of
erosion and specifically the progressive slumping of the riverbank in this
section of the Riverside.Drive Local Historic District. Over the past several.
years, Staff has sought to develop a project or set of guidelines to assist
:the owners of threatened structures in this vicinity in addressing these
problems. Thoubh these attempts have not yet come to fruition, Staff welcome
responsible attempts -by owners to impede the effects of erosion and slumping.
The applicants have.'in this case consulted with John Law of the Indiana Dept.
of Natural Resources to develop the proposed program of coordinated terracing
and flora above the floodway where development would require permission from,
DNR and the Army Corps of Engineers. Staff has discussed the issues ?with the:
applicant to assure their understanding of the dynamic nature of the erosion
problem and the limitations of any singular property addressing it without
concerted efforts at adjacent properties. Within these limitations,.the
proposal represents a responsible and most immediately available response on
their parts.
Their proposal for terracing and flora is consistent with the guidelines
listed above. For the sake of clarity, Staff understands the limitation found
in I.A.3 prohibiting "public...,, scenic overlooks and terraces" as meaning
spaces intended for occupation and not the more mundane terracing of a- slope
for the support of vegetation which is clearly indicated in other language.
Staff recommends approval of this application and recommends careful.
monitoring•of its performance-for•indications to direct future developments.

RE: Bank Erosion

This is a follow up to the May 15th site visit behind your home, along the
south shore of the St. Joseph River in the SE 1/4 of the NE 1/4 of Section 2
Portage Township, in South Bend. The purpose of the visit was to get ideas on
the control of natural bank slumping.
The soil type for all three properties is a Tyner sandy loam escarpment. The
enclosed diagram (figure 1) is an excellent example of the forces working to
create the slope failures. The impermeable layer is probable somewhere close
to the area of the flat shelf midway down the bank.
Several ideas were discussed to control or manage the bank to prevent the
erosion. The first recommendation is to minimize the amount of water
peculating in to the bank. This can be accomplished by installing gutter down
drain extensions to take all roof water down the slope, past the critical
area. A splash -block or similar dissipator will be needed at the end to
prevent erosion at the end of the tube. This should be done on all three
properties. Also, reduce the amount of weight close to edge of bank.
Another item discussed was terracing the bank. This is a good method of
control but will be very labour intensive. The goal here should be to
transform the long, steep, unstable slope into several short, flatter, more
stable areas to better control runoff water and promote vegetation. The
bottom terrace should be started as close to the toe of the slope as possible
and anchored as much as possible. once the terrace wall is constructed,
install a "breathable" filter fabric along the back off the wall. Install
drain tubing behind the wall, along the bottom, and outlet on each end to
remove excess water from the soil behind the wall. Backfill using soil from
above. Use splash blocks at the end of the tubes on both ends. All yard
waste material should be completely removed before starting so only clean soil
is used.
Vegetation should be planted and established as absolutely as soon as possible
after each tear is completed. See form 42 for some recommended plants. The
yard waste material can be composted to use as a soil amendment when planting
the terraces or add good quality topsoil. Lightly sprinkle plants until
established.

The question about removing the trees, is a tough one. On one hand the trees
do help prevent erosion by intercepting and slowing rain drops and the roots'
do help stabilize and hold the existing soil. They do also, however add
considerable weight to the bank, and as they continue to tip towards the
river, increase slumping - especially when falling over. my recommendation is
if the trees appear to be -stabile and not in danger of sliding down the bank
or tipping over, leave them, but keep them pruned to reduce weight and
shading. If the tree is close to failure, remove but leave the stump and
roots in place.
Planning will be a big part of this project. Proceed in phases and complete
each phase before starting another.
These are merely recommendations and are not the only solutions. It may also
be beneficial to check with several different private land landscapers, grade
contractors, and tree services for other options and opinions.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
Real estate tycoon,. Fred W. Keller, built this house in 1909 and sold -it to
Marshall'Hughes in 1910. Mr. Hughes rented the house to Otto Gelbrich, a
foreman at the Oliver Chilled Plow.Company. Mr. Gelbrich and his wife, Ada,
resided there until 1913 when Mr: Hughes sold the house to Florence and,
Maurice Kahn. Mr. Kahn i,�*as the president of the Lamb. -Shirt Company from 1912
to'1928, he left -the company to become the secretary -treasurer of the
Electro -Voice Manufacturing Company. Mr. Kahn lived in the house until his
death in 1941 at which time the house was inherited by his sot., Albert Kahn.
Albert was the owner of the Electro -Voice _Manufacturing Company. He and his
wife, Ann, resided there until 1951 when they sold the house to Lawrence E.
Schmidt, a sales engineer. Mr. Schmidt lived in the house until 1955 when it
was sold to Charles & Emily Ross. Mr. Ross was the chief engineer at.the South
Bend Tov Manufacturing Company. He lived in the house with his wife until his
accidental death in 1963 at age 48. Mrs.. Ross continued to reside in the house
until 1973 when she sold it to Norman: J. Girardot, a professor at Notre Dame
University. M.r. Girardot*and his wife, Kaye,. owned the house until 1980 when
they sold it-to.Martin J. Murphy, an architect. Mr. -Murphy lived in the house
until 1994 when the house was sold.to David Clark and Arthur Grauman. Mr.
Clark and Mr. Grauman only owned the house for two years, selling it to ,the
current owners, Richard Napoli and Judith .Johns, ir.' 1998.
PROPOSED CHANGE
Applicant proposes to remove two large yetas located in the front of the house
on either side of the steps. The applicant is proposing to replace the yew on
the right witha spruce and,the yew on the left with holly.

RECOM-?ENDATION
The applicant proposes to remove overgrown yews and replace with a spruce
tree and holly bushes. Staff 'concur with the necessity of removing -the
overgrown materials. The proposed replacement species were available when the.
•home was constructed a are generally 'consistent with decorative foundation
planting for an urban lot. Staff.recommends approval while noting that the
spruce may rapidly outgrow this•locatiofi, requiring subsequent replacement,
and might better be replaced with a cedar or juniper variety.

There are two Yew bushes located in the front of the dwelling that obstruct the view of the house
from the street and also the view from the house to the yard. These bushes have not been
adequately cared for or pruned, which has led to the present situation that can be seen in the
accompanying pictures.
The front view of the property shows the size of the bushes which are approximately six feet high,
seven feet wide. The bush to the right of the doorway (facing the street) is approximately five
feet deep, the one to the left is approximately seven feet deep. Both bushes are woody with little
foliage if viewed from the side, please refer to photo two and three. The yews have grown with a
lean away from the house creating an overhang ( this is especially evident on the right) which is
affecting the lawn beneath the overhang and foreshortens the yard.
The plan would include the retention of the Crab Tree located at the east corner of the house, the
removal of the two Yews and the planting of a Spruce on the west corner to balance the Crab
Tree.Two holly bushes will be planted to the right of the doorway. Lilies, Impatiens and Moss
Roses will fill in from the house to the lawn between the crab tree and the holly.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTE_XT..
This house was built in 1912 by Gustav and.Anna Lindahl. Mr. Lindahl, was -a
blacksmith, he and his iaife lived in the house until their deaths in 1919 and
1924. The house was inherited by Mr. & Mrs. Lindahl's children, Hannah Lindahl
and Mrs. Esther Minkler: Hannah was.a teacher and eventually -became the
principal of Mishawaka Schools. -Mrs. Minkler co -owned and operated the Minkler
Hardware Store with her husband,.Robert Minkler: They.all lived in this house
together until their deaths. Ms-.-Lindahl passed away in 1977 and Mr. Minkler
died in 1980 followed by Mrs. Minkler- in 1983. The house was sold a year later
by James Wdlfe,•executor of the Minkler estate, to the current -owners James
and Carolvn Pinter.
PROPOSED CHANGE
Applicant proposes to install a six foot.high French Gothic Panel.wood privacy
fence around the back yard.

RECOMMENDATION
The applicant proposes to construct a nominal six foot privacy fence with
Gothic style caps to -enclose the majority. of the rear yard as shown on the -
submitted site plan. This fence lies entirely along or behind the extension of,;
the house's rear wall. The stated' intention of the proposed fence is to
provide restraint for two domestic dogs (retriever) and to screen parking
ureas at the alley. Although the fence will have -,a significant visual impact
on the property due to its having an oversized (1 1/2) lot, it is consistent.
with other rear yard fences in the neighborhood.. Staff therefore finds the
proposal consistent with the guidelines and'recommends approval.
CERTIFICATE OF APPROPRIATENESS STAFF REPORT
Staff does have -reservations regarding the impact of this proposal on adjacent
property owners and general security concerns. Property line hedgerows with
shrub planting are established at both sides. Especially on the west line, the _
proposed fence may interfere with maintenance of these established..landscaping
features. The applicant has assured me that -she has consulted with this owner.'
and that the fencing will be sufficiently set off of these plantings to allow
growth and maintenance. Secondly Staff has expressed concern that the height
of.the proposed fence will effectively reduce sightlines across- the property
and from the house to its perimeters which may be counterproductive for the
security of the property. The applicant has indicated that in-situ a standing .
adult will -be capable of seeing over the.proposed fence.

Dear Historic Preservation Commission,
I would like to request permission to install a fence around a back
portion of my yard.
I need a fence for two reasons, my dogs and the five vehicles I have to
park at my residence.
The fence has become a necessity for my two retrievers. They both are
tied up on a separate run and they are constantly getting tangled. Warm
weather isn't a problem, but going out late at night and early in the
morning in January is becoming very difficult and ruining -'my health.
Additionally I would like to hide the fact that I have to park two
vehicles at the back of the yard. I have tried concealing them, but my
arbor vitae isn't growing fast enough.
The fence will have three gates, one facing Riverside, one facing the
alley and one on the South* side. The fence itself will only be in the area
highlighted in orange on the graph.

John Oxian, president of the commission, brought the meeting .to order at 7:30
.p.m. ass -a committee of the whole in the`absence.of a quorum:

Talley, Jerry Weiner, Joann Sporleder, Janeanne Petrass & John Oxian.

1) 1998-0526 .- 619 Riverside Drive,_Lawn terraces
Mr. Duvall presented the staff report and circulated photographs, noting that
the' applicant, Michele Gelfman, was present.. Mr. Oxian asked if Ms. Gelfman
had anything to add to the discussion. Ms. Gelfman reiterated that the over
all design of the existing terraces will remain the same and as much of the
existing flora as possible will _be.re"tained. Mrs. Choitz, asked if Ms. Gelfman
'had chosen, to install the gray colored cement blocks. Ms. Gelfman stated.that
she. -had s'electe'd the gray color, because it matched her house. Mrs. Hostetler,,
moved to approve the 'Application as recommended bythestaff: Mrs. Petrass
seconded the motion. The motion•passed unanimously.
2). 1998-0527-2 = 535 Riverside Drive, Aluminum storm windows -.
Mr. Duvall presented the staff report and circulated photographs, noting that
the applicant was not -present. Mr. Oxian stated that this house should'notbe
rated a contributing 10, because of;its aluminum siding. He further noted that
the -9taff should, go to the site and re -grade the house. There was some
discussion over what type of siding the house had and if it had this siding
when it was first rated. Mrs. Hostetler moved to- approve the -application as
recommended by staff. Mr. Talley seconded the motion. Mrs. Sporleder asked
-
if the motion meant that the owner` -,could choose between - a white finish or the
mill gray finish.for- the-storm..windows. Mr. -Duvall stated that because. -either_
-color would- work in this situation, the owner should have the final choice.
Mrs. Choitz asked if the rest of the aluminum storm windows on the house. had:
•the mill gray finish. Mr. 'Duvall ..stated that' they did. The motion passed
unanimously.

3). 1998-0605 -_ 1631 Lincolnway West, Restore rear, porch, move and restore
rear steps, and replace all windows.
Mr. Duvall presented the staff report and circulated photographs, noting that,
the- applicant, Mr.- Trevino, was, present. Mr. Oxian stated. that the house.
should be re -rated, - from a contributing 10 to a' -significant 11. Mr. Duval
replied that a re -rating for this house was approved by the Commission at an
earlier date, and that the, reference to the house as. a C/10 on, the Staff
Report.was an error.'
Mr. Trevino submitted information concerning the replacement windows.
Mr. Talley. asked for clarification. on which door off of the rear porch was
going to be closed off. Mr. Duvall noted that the rear porch cu-rrently has two
doors, one.exiting directly off the rear and one located'on the east wall. ,He
further'noted'.that the door located on the east wall appears to have been the
..original door. He went on to describe that when the rear door is-removed•the
original window placement would then be restored. There was some discussion.
over the original window placement and design of the wall. Mrs. Sporleder_
asked how the wall wasgoing to be restored and how the two lower windows were
going to be put back in their original spots. Mr.. Trevino stated that the same
material used in the existing walls would also, be used to -fill in the hole `
created when the door is removed. . He further noted that the two windows,
located on either side -of the door, would'be placed,back into the original row
of windows located at the top of, the wall. Mr. Oxian asked if the 'existing
east 'side' door was an interior door and if Mr. Trevino was planning on
replacing it., Mr. Trevino stated that he had no plans'on'replacing that door.
Mrs. Sporleder asked if- Mr. Trevino was going to install a storm/screen .door
..combination over the original wood door to give .it some protection. Mr,.,
Trevino stated that he had not planned on installing one, but, to do.so would
not pose a problem.
Mr. .Talley asked if the window situated in the front gable was one -of the
windows that would be replaced. Mr. Duvall•stated that he had not looked, at
each individual window nor had he inspected the vents in -the attic gables. Mr._
Trevino stated that all of the windows would be replaced do to their poor
condition and difficult operation. He went on to state that the windows were
very, large, heavy, simply designed and badly deteriorated. . Mr. ,Talley,
again, asked if the windows being replaced would include= the windows in the -
attic gable's that are currently being used as vents. Mr. Trevino 'stated that
he had not planned on doing anything to those windows. Mrs. Sporleder asked
what type of windows Mr._ Trevino was planning on installing. Mr. Trevino -
stated that he wanted to replace the existing' windows with modern, metal -
windows, of the same size -and design' which are lighter and easier to opera-te..
Mr.'Oxian asked if the,two windows located in the front of the house under the
porch roof would also be replaced: Mr. Trevino reiterated that he'want'ed to .
replace all of the windows. Mr. Talley asked if it -would be a problem if the
attic window was .added to .those being replaced. Mr.. Trevino stated. that it
_ would not be problem. Mrs. Hostetler stated that it would be.better to retain
the attic window as a source of ventilation to deter the, build up of heat in
the attic.

Mr. Oxian'stated that since the windows located under the front porch roof are .
structural sound -then they should' be retained. Mrs. Sporleder'stated that if
they were,retained then storm windows 'shouldbe placed over them because.their
inefficiency."Mr. Oxian asked if Mrs:. Sporleder, was recommending that those
windows be "replaced too. Mrs. Sporleder stated that.the best thing to do

house more energy efficient and livable: There was some discussion over how_ .
the new windows would"make the house more livable.
There was -some discussion over the process of moving the rear porch steps from
the .-rear door ",to --the east 'side door- with out breaking. them. It was also
discussed that if the steps should fall apart .in the move that a new set -of
poured concrete steps should be allowed.to replace them.
Mr. Oxian stated that he agreed with Mrs. Sporleder that ,a- screen/storm door
should be placed 'over the east side rear porch door to help preserve it. Mrs.
Sporleder moved -to approve the, application as submitted with the additional ,
recommendation that a screen/storm door be installed over the east side door
of the enclosed back porch. Mrs. Choitz seconded the motion. The motion
passed unanimously.
Mr. Oxian" stated -'that when Mr. Trevino was ready to install -the storm .door
that he should 'show Mr. Duvall its design.
4). 1998-0605-2 - 1029 Riverside Drive, Skylight/vent
Mr.=Duvall presented the staff report and, circulated photographs, noting that
the -applicants, Joseph"Taschetta and Rolanda Hughes, were present. Mr. Talley
asked the owners, if the end objection was to provide ventilation then why did .
they want to install 'a skylight vent instead -of just' a vent. Ms: Hughes
stated that'the objective was two fold: first to create more ventilation,_and
second to gi-ve more light to a space they -hope to"make livable. Mr..Talley
moved. to approve the application as recommended by.staff. Mrs.. Hostetler
seconded the motion: Mr. Oxian asked for clarification as to where on the
roof the skylight would go. He then noted that in .his own house he made the
attic windows operable to allow more ventilation. Mr. Taschetta stated their
attic windows are operable and that the attic still gets extremely hot. The
motion passed unanimously.
Mrs.'Sporleder noted that, in regards.to.1631 Lincolnway West, the recommended
,storm door may not -meet todays codes. Mr. Duvall concurred that it may be a
problem and should be brought to the owners attention.
5). 1998-0608-2.-- 735 Bronson, Privacy fence
Mr. Duvall presented the staff report, circulated photographs, "and noted that
the owner; Mr.,Farr and the tenant, Mr. Jones, were present. Mr. Duvall also
noted that'the fence was already under construction.with out a Certificate of
Appropriate. .
Mr. Farr asked if a window could be installed in the front side wall There a
window had originally been, but, was covered over by the siding. Mr. Duvall
stated that Mr. Farr would have to apply for the new window on a separate
application. Mrs Hostetler moved to approve the application as recommended by
staff:/ Mr. Weiner seconded the motion.

Mrs. Sporleder asked if the height of the fence, 6 feet, meets code
requirements: Mr. Duvall stated that it did. Mr. Oxian asked when Mr. Farr
wanted'to install the new window. Mr. Farr stated that he would..like to do it'
sometime this year. Mr. Duvall stated that the Commission -could not place the
window. issue on.this application because it, had not been. advertised for the
public hearing. Mr. Oxian asked if the Commission could give the window issue
tentative approval now so that it�could be sent.to Committee for final review
later. Mrs. DeRose-stated that the Commission could not act - on this issue
.until a separate"application is filled out, submitted and publicly -advertised. -
Mr. Talley.noted that for the -Commission to -legally act on an application that
application would have 'to be publicly advertised first. The motion passed,
unanimously:
B. Historic Districts
a. Taylor's Field - second reading
Mr. Oxian stated that the second reading would be postponed until nest month
because"staff failed,to notify the property owners of the public heari:ng.•Mr.
Duvall stated that the Commission is required to haye the. public hearing
within 90 days of its first reading, which was on April 13th. He asked Mrs.
DeRose if a special meeting would have to be scheduled to meet this 90 day"
requirement. Mrs. DeRose- stated that a special meeting would have to be
scheduled to meet that. 'requirement. Mrs. Choitz asked if the normal "monthly
meeting could be moved 'up a week to the second week in July. Mrs. DeRose .
stated that the Commission could move the meeting, however,- the press 'would
have to be notified immediately of the change. Mrs. Hostetler moved that the
Commission meeting be moved to Monday, July 13. Mrs. Choitz seconded the
motion. The motion passed unanimously.
IV. Regular, Business „
A. Approval of Minutes
1.May .18, 1998 - Mr. Oxian noted a correction on page one under III.A.l.,
where the word' "lot" was omitted. Mrs. Hostetler'noted that there were some
grammatical errors. Mr. Oxian stated that if there are -any grammatical errors, ,
circle" -them 'and give„ your. minutes to' Mrs. Saunders so she can correct them.
Mr. "Talley moved to approve the minutes as'corrected. Mrs. Hostetler seconded
the mot -ion. The motion.passed'unanimously.

C. Correspondence
Mr. Duvall stated that Linda Riley has sent the Staff "a ,list of,eight liaison
members for East Wayne.Streets new Liaison Committee. Mr.,Oxian stated that he
wanted all the'Commissi.on members to have "a list- of all the liaison members;'
from all the districts.,
Mr. Duvall noted that a uniform fee policy for photocopies and faxes has been
setup "by St. Joseph County. -There was.some discussion over the amount of the
charges, what, the fees would be used for, how the fees would be collected and
fees in general-. Mr. -Oxian noted that other government offices are unhappy -
with how low the Certificate of Appropriateness -.application fee is, they feel
that it is way too low and should be changed. Mr. Oxian.went on to state that
-the Budget -'and Finance Committee should to meet.to discuss changing the $3.00,
application fee.'

Mr. Duvall reported that a set of questions designed to assist the consultant
working .on the-Lincolnway West corridor study, have been roceived.'•Mr. Oxian
_stated that if Commissioners wanted to,see'the-questions they should request a
copy from the Staff, fill .it out 'and give it,back to them so it can,,be taken
to the next Lincolnway hest meeting.
Mr. Duvall stated that a notice was .received' from the Historic Landmarks
Foundation stating that the National Commission Forum would be held July 31st'
and --August 2nd in Denver,. Colorado. He further - noted -that a scholarship is
available. Mr. Duvall -.also noted. that the Historic Landmarks Foundation has.
-created a, program where Commissions' can join the Foundation as a group ,for.
$10.00 a Commission member.
-D. Committee Reports
1. Budget & Finance
Mr. Oxian stated that the $30,000.00 supplemental fund was granted.
2. Historic Districts
Mr.,-Oxian ,stated.that North St. -Joseph Street proposed district is before the
Common Council and should come up on their agenda in the.near•future.
Mrs. Choitz reported that the Historic Districts Committee met ,to answer the
questions posed by owners regarding the changing of: the Riverside Drive,
guidelines, where it was decided that the suggestions were inappropriate. She
also noted that the'e'lections for the new liaison members is finished.
3. Historic Landmarks
Mr. Oxian stated that the JMS Building will be.up for'landmarking riext Monday.
Mr. Talley stated that his investigation of the Natatorium situation is still',
on going and that he will have a report ready for July's meeting.
4. Standards and Maintenance
Nothing to report.
5. Legal
Mrs. DeRose stated that she has prepared a letter to go out 'tomorrow to Mr.
Crumlish concerning changing the Riverside Drive: Guidelines. The letter.
basically, states that, his interpretation is not correct and that the
Commission has to be involved in the changing of any guidelines. There was
some discussion over the situation with Mr'. Crumlish. �.

-Mrs: DeRose, reported that she has sent a violation letter twice to Mr.; Albers
regarding the illegal removallof a tree and .every time the letter'. has been
returned. Mr. Duvall noted that he' had written a letter previously notifying ,
the owner of the violation and requesting that he apply for a .Certificate of
Appropriateness. He .further noted ,that- the letter did not come back and no
application was filed. At this time the matter -was turned over to'Mrs. DeRose
who has since had the letter returned stamped attempted not.known.
Mrs' DeRose stated that she has sent 'a letter to AEP regarding the light
fixture on East --Jefferson Street that was replaced with an inappropriate
fixture, however, they have not responded. Mr. .Oxian asked how long .of a time
frame did Mrs. DeRose give AEP to.,respond.- Mrs. DeRose stated that she had
given them two weeks to respond.

Mr.. Talley noted" that the Commission has had the same" problem with the''
northern most light in _the North -Shore Drive District. There was•'some
discussion over the exact location of the light in question.
3.DHPA'Grant Status
a.•1997-98'
I. Leeper Park.
Mr..Duvall-reported that" the Westerly, Group still has not submitted the
draft -for Leeper Park. He also noted that he spoke with them at -which time
they stated that a draft should be submitted .shortly after June's meeting. -
Mr. Duvall reported that'he-had'also spoken with DHPA requesting an
extension until August 30st.
2. District Guidelines
a) Mr. Duvall reported that the staff was working hard on the guidelines
and that they were progressing, however, the staff still does not.have -
a printer that is compatible with the Staff's software.
b) Mr: Duvall stated that' the Portage Manor National Register _Nomination'.
has been received and should -be on the July.agenda for approval.
b. 1998-99
Me. Duvall, reported that the $30,000.00 supplemental' funding was"approved -and"
the agreements have been signed with_the State.
4. Proposed Local Historic Districts
a. Cushing Street
Mr. Duvall stated that 'no new work has been done on the Cushing Street
Proposed Historic District. Mr. Oxian- remarked that -a Councilman had asked
about the progress of the Cushing Street proposed .'district. Mr. Duvall
responded that as soon as -the republishing of the guidelines is finished then
the staff will turn its"attentions'.to new projects.' -
5. Liaison -Committee Elections
Mr. Duvall, reported that the elections have .been completed and there are
liaison committees in every district. He noted that a meeting should be setup
with the new liaison members to -walk them through their duties.'
6. DHPA,Bridge Workshop
Mr-. Duvall noted that the workshop _had. been -associated, with a convention' of.
Industrial archaeologists, which made it a very interesting and refreshing
workshop. He also noted that there were many different demonstrations.

Mr. Sporleder-stated that he had gone to a status conference in Indianapolis, -
concerning Blake Gardens, at which nothing new was presented except a rumor

rumor did not impress ,the, judge. and he set up another telephone status.
conference for July 7. Mr. Duvall asked if the meeting would beheld in MACOG's.

Mr. Sporleder reported that -the role of Historic•Resources,.is not being looked
at in, the development of -the City's Comprehensive Plan. Mr. Oxian if ---Area,
Plan was writing this plan. "Mr; Sporleder stated that _they were.. Mr. Oxian
asked if Mr. Duvall was participating. 'Mr. Duvall stated that he. has not been
x notified or invited to participate.. Mr. Oxian stated that Mr. Duvall, should
ask why the Commission.was,being'left out and if'the answer-isnot good.•enough
then write a letter -to the County Commissioners asking why the .Historic
Preservation Commission was being ,left out. Mr. Oxian discussed the zoning
problems along Lincolnwav West as an example, of what. happens when plans are
written and. decisions are made with out consulting the Historic Preservation
Commission.
Mr. Sporleder noted that Congress passed the TDA -21 equity act, which has
major dollars; with it, of which -preservation is a benefactor.
