I.C. 9-22-3-15 requires an inspection of a vehicle by a police officer for the issuance of a title for a rebuilt salvage motor vehicle. Because the uniform application of charges for such services will allow the City to recover some or all of its costs of providing these services, it is in the best interest of the City to adopt the following fee schedule for title inspections. This Ordinance also amends subpart (d), of Section 2-210. That Section presently requires that all fees collected for records and services furnished by the South Bend Police Department be deposited to The South Bend Regional Police Academy Fund. (Fund 294). However, the fees collected would have greater impact and effect if they could be used for general and ongoing police training, which is the purpose and scope of the Law Enforcement Continuing Education Fund. (Fund 220). This Ordinance makes such a change in the use of funds derived by the Police Department from Section 2-210(a) of the South Bend Municipal Code. NOW, THEREFORE, BE Tf ORDAINED, by the Common Council of the City of South Bend as follows: Section I. Section 2-210(a) of the Municipal Code of the City of South Bend is hereby amended to read in its entirety as follows: (a) The following reasonable fees are established, to be paid by the requesting party not later than the time of delivery of each of these services or each of these documents described: Each page of any document which is a Public Record under I.C. 5-14-3-2 which is not excepted from disclosure. $0.10 2. Motor vehicle accident reports. $3.00 3. Police Summary Report (a form of report which does not exist as a record prior to public request) $5.00 4. Police Department Crime Statistic Compilation (A form of report which does exist as a public record prior to public request) $5.00 5. Audio Tapes, per tapes $10.00 6. Photographs: a. Those reproduced by the City of South Bend from its negatives. $1.00 b. Enlargement of Polaroid or reproductions requiring Outside resources (plus outside cost) $2.00 7. Copies of Fingerprints. $3.00 8. Arson Reports. $25.00 9. Blueprints, per page $6.00 I0. Videotapes, per tape $10.00 11. Computer Discs, per disc $3.00 12. Maps, per square foot of paper $1.00 13. Section 2-210(d) of the Municipal Code of the City of South Bend is hereby amended to read as follows: (d) Any fees collected pursuant to this section by the South Bend Police Department shall be deposited into the €ttrtd Law Enforcement Continuing Education Fund for training supplies and equipment - .1 with all interest earned on the monies deposited in said Fund be retained therein. Section III. This Ordinance shall be in full force and effect from and after the date of its passage by the Common Council, approved by the Mayor and legal publication within the effective date July 1, 2004. This bill as originally submitted set fees for motor vehicle inspections performed at the South Bend Police Station and at other locations. The substitute version of this Bill revises subpart (d) of Section 2-210 to provide that all funds generated by photocopies, reports, and services of the Police Department be deposited into the South Bend Police Department's Law Enforcement Continuing Education Fund rather than the South Bend Regional Police Academy Fund. The Statement of Purpose and Intent has been modified to make that change as well. The purpose for proposing this change in subpart (d) is so that the monies collected for Police Department reports, photocopies and other services have the broadest possible impact on Police Department personnel. This objective can best be achieved by depositing funds into the Continuing Education Fund rather than the Regional Police Academy Fund. Either Controller Rick Ollett or a ranking member of the Police Department will present this substitute bill to the Common Council, and we hope it will receive favorable Council consideration.
