Adjournment administrative assistant has submitted his resignation, CERTIFICATE OF APPROPRIATENESS STAFF nr ruru PROPERTY -- 735 Lincolnway East South Bend, Indiana OWNER -- Jack Hodurek & Pete Jarosak C/O'Centry Pipe Supply, Valparaiso DESIGNATION -- Edgewater Place Local Historic Preservation District STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT This Modern commercial structure was constructed circa 1960. Due to its age, it is rated as non-contributing in the Indiana Historic Sites and Structures Inventory. It is a high quality structure constructed with stone facade and brick sidewalls. The site not covered by the building is paved and striped for parking. Portions of the paved area are currently being utilized for outside storage of pipe material. PROPOSED CHANGE The applicant proposes enclosure of an irregularly shaped area along the south wall of the structure where pipe is presently stored. The enclosure is to be accomplished with six foot high chain-link fence on metal posts and capped with eighteen inch high section of barbed wire. STANDARDS The Preservation Standards for Edgewater Place state: "New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings, and newspapers. New site work should also be appropriate to existing surrounding site elements in scale, type, and appearance . " RECOMMENDATION Staff is very pleased that this structure is in use, as it appears to have been vacant at the time of the survey. However, the current use has generated a messy vitality which may be offensive to some occupants of adjoining residential properties. Since the outside storage of materials is allowable under the zoning of this property, the character of the District may be enhanced by screening areas where materials are so stored. CERTIFICATE OF APPROPRIATENESS STAFF icr nkcr As stated above, this structure is not a contributing historical resource, but it must also be noted that historical precedent for this enclosure does not exist as is recommended in the Preservation Guidelines. For these reasons, staff makes no recommendation regarding approval, but suggests that if it is permitted, the fencing should provide greater visual screening than will be afforded by the open chain link. (Pending amendment to the Zoning Code will require such screening for outside storage at C -Commercial locations.) David B. The architect was W.W. Schneider. The structure is rated C/10 in the Indiana Historic Sites and Structures Inventory. An accessory garage sits at the rear of the lot along the alley but is accessed by a driveway from Riverside Drive. The rear yard is enclosed on the west side with a recent unpainted fence composed of dog-ear pickets in shadow-box configuration. The -separation along the alley is an older 6 foot. fence caffposed of tightly spaced 6 inch painted pickets with a pointed top. PROPOSED CHANGE The applicant proposes to replace the fencing along the alley with new material. The pickets are to be dog-eared to match the more recent material along the west property line but are to be of the same height and spacing as the existing material. STANDARDS The Preservation Standards for Building Site and Landscaping state that: "No changes may be made to the appearance of the site by removing old plants, trees, fencing, -walkways, outbuildings and other elements before evaluating their importance to the property's history and development." (I.B.3) and New Site work should be based upon actual knowledge of the past.... New site work should also be appropriate to existing surrounding site elements in scale, type and appearance. (I.B.2) CERNFICATE OF APPROPRIATENESS STAFF nrtlnrr. REiDATION The existing wood fence along the alley is in a state of deterioration which would indicate extensive repair or replacement. The proposed replacement conforms with the standards stated above. A conflict exists between the historical accuracy of the pointed pickets and the matching of existing surrounding elements with dog-eared pickets. Staff would prefer pointed pickets which would maintain greater historical accuracy and character. However the Owner has a legitimate interest in maintaining aesthetic continuity among his fencing. For this reason, Staff makes no recommendation. David B. Duvall, Director 6/14/94 �c�cY—j PROPERTY -- 1345 East Wayne Street (S) South Bend, Indiana OWNER -- Mary Am Matthews DESIGNATION -- East Wayne Local Historic District STATEMENT OF SIGNIFICANCEMISTORIC CONTEXT This residence which was constructed in 1956 was rated Non -Contributing in the Indiana Historic Sites and Structures Inventory due to its age. The structure is a two story Ranch Style with Renaissance Revival details. It was considered unaltered at the time of the survey although careful examination of photographs from the survey indicate some changed out windows and a skylight which was probably added. PROPOSED CHANGE Owner proposes to remove single glazed mill finish metal casement and picture windows and replace them with new metal clad wood casement windows similar to those which have been previously altered. STANDARDS The Preservation Guidelines state: 1) Guidelines for East Wayne Street Historic District follow the Rehabilitation Guidelines Model. 2) REHABILITATION - Maintaining the existing character ... whenever possible, returning it to it's original condition ... contemporary methods and materials would also be acceptable in appropriate situations. 3) (C-1) original windows and doors .... shall be retained or when deteriorated beyond repair, replaced with units and trim resembling the original. 4) (C-2) ...If new sash and doors are used, the existing design and hardware should be used.... If steel casement windows have to be replaced or removed, windows of similar size and style should be used. U CERTIFICATE OF APPROPRIATENESS STAFF nrrrunt RECCHMEVDATION The existing single glazed windows are thermally inefficient by current standards leading to unacceptable heat loss and condensation. The standards specifically -address-the issue of steel windows in .this District indicating that if they are removed their replacements should resemble the original, even to the extent - of returning to the original condition. Although the proposed replacement windows are casement windows, -their frames and sashes are wood. Installation, including the required "frame expanders" specified by the manufacturer to fit the standard wood window sizes to the existing openings will yield a slightly heavier appearance in the frame & sash. Although the structure is technically not considered to = contribute to the district, the high quality of its design and construction make it an important part of the District context.- Staff ontextStaff is disturbed by the loss of character in the mullion pattern and especially the replacement of the picture window with three casements. However Staff recognizes the need for thermal efficiency and the increased emergency egress capacity represented by the proposed alterations. For the reasons above, Staff makes no recommendation. I. Call to Order The meeting was called to order at 7:36 p.m. II. Roll Call Members present: Mrs. Martha Choitz, Mrs. Catherine Hostetler, Mr. John H. Certificates of Appropriateness 1. 621 Lincolnway East - EP-LHD Mr. Duvall read'the staff report. Discussion ensued concerning masonry repointing and its inclusion as part of the Staff Approval policy. Commissioner Sporleder asked about the'list of code violations. Mr. Duvall presented the Department of Code Enforcement report. Mr. Smith responded to several questions concerning code violations on the exterior of the structure. Commissioner Sporleder asked if the property was for sale. Mr. Smith answered in the affirmative. Commissioner Sporleder read the list of code violations. Discussion ensued concerning these violations and the current condition of the house. Commissioner Choitz asked who was responsible for the rebuilding of the porch if the current owner demolished it and subsequently sold the property. Commissioner Sporleder asked what would serve as an entry if the present porch was demolished. Counsel stated the legal question: whether a transferee is liable for a C of A order effecting a prior owner. Counsel stated her uncertainty regarding the question. Counsel then stated that at a minimum the HPC should, if the C of A is approved, order the owner to notify any purchaser that replacement of the porch as detailed in the C of A is a requirement in order to complete the sale of -the property. Counsel then further explained the situation to the owner. Dr. Klopfer stated that the C of A would not be binding on the new owner. Counsel responded that if that were found to .be the case she would urge the HPC to deny the application. Discussion ensued. Mr. Smith stated that he did not wish to rebuild the porch at this time. Commissioner Sporleder and Mr. Smith conversed about the safety of the porch. Commissioner Choitz stated her opposition to the demolition of the porch and the continued neglect of the same. Commissioner Oxian asked if the HPC should await a legal opinion on the question that counsel had raised. Commissioner Sporleder and Mr. Smith reviewed the list of code violations. Commissioner Sporleder suggested tabling the application pending a review with Code Enforcement. Commissioner Oxian suggested placing the application with the Standards and Maintenance Committee. Commissioner Choitz moved to place the C of A application with the Standards and Maintenance Committee. Commissioner Sporleder seconded. No discussion. The motion passed unanimously. The Standards and Maintenance Committee will hear from the Department of Code Enforcement, the Legal Department and will make a site visit. Mr. Smith and Ms. Pummill will be invited to appear before the committee. The Standards and Maintenance Committee will make the final decision regarding the C of A application for the property at 621 Lincolnway East. 2. 520 River Avenue - EP-LHD Mr. Duvall -read the staff report.- Commissioner Sporleder asked for clarification of the staff recommendation. Commissioner Sporleder asked about the prevalence of such driveways in the Edgewater Place Local Historic District. Mr. Turnock- replied that there were 2 asphalt -driveways, 7 split track driveways and 20 driveways of solid concrete. Discussion ensued concerning the parking arrangements in the district. Commissioner Oxian asked about drainage problems. Mr. Turnock responded that while he had not "shot it with a transom" he estimated a 3" fall from the back of the drive to the sidewalk. Commissioner Sporleder asked about the disposal of broken concrete and the placement of a proper foundation. Mr. Turnock replied that the old concrete would be recycled and a proper foundation laid. Commissioner Choitz asked if the new concrete would be laid up to the foundation of the house. Mr. Turnock replied in the negative. Commissioner Oxian and Mr. Turnock, discussed the possibility of drainage problems. Commissioner Sporleder asked for a second clarification of the staff recommendation. Mr. Duvall responded concerning the standards and the removal of vegetation from front yard areas. Commissioner Oxian asked what staff would have recommended if the language concerning the removal of vegetation was not present in the standards. Mr. Duvall replied that he would have suggested the same treatment rather than requiring same. Discussion ensued about the replacement of driveways in the district. Commissioner Sporleder moved to suggest that the applicant re -install a two track drive from sidewalk to the, setback line and pour a slab drive from that point to the rear line. Commissioner Hostetler seconded the motion. Discussion ensued. Mr. Turnock said that he would speak to the contractor about Commissioner Sporleder's -suggestion. The motion passed unanimously. Mr. Turnock then indicated his opposition to the re-locatioii of the Studebaker National Museum in Howard Park. Discussion ensued. 3. 123 West Northshore Drive - WNS-LHD Mr. Duvall read the staff report. Mr. Doran cited the security of his young children as a factor in his proposal. Commissioner Sporleder asked for a clarification of the site plan. -Commissioner Choitz moved to approve the application for a C of A for -a new, open, rear porch and the installation of a course of fence at the rear of the property. Commissioner Petrass seconded the motion. The.motion Passed unanimously. 4. 1244 Lincolnway East - LWE-LHD Mr. Duvall read the staff report. Dr. Klopfer addressed the commission on a number of different points. He stated that he would pay off the mortgage on the property in June. He also stated that; " I could've torched the house seven years ago if I'd wanted to and it would've been a simple solution to the problem. Five propane tanks in the basement leaking gas . . . boom, up like that Commissioner Oxian said the HPC opposed the demolition of the house. He then clarified the HPC procedures regarding the property. Ms. Dempsey addressed the commission on the history of the relationship between her department and the owner of 1244 Lincolnway East. She also spoke about the efforts of interested parties to purchase the property. Ms. Dempsey requested a 30 day continuance pending Dr. Klopfer's filing of an application for a C of A. Commissioner Oxian asked for a response from Dr. Klopfer. Dr. Klopfer stated that he told Ms. Dempsey that his intention was to " re -do the house." Commissioner Oxian told Dr. Klopfer that the HPC wanted an application for a C of A that reflected a preservation plan for the house. Commissioner Sporleder moved to continue the Department of Code Enforcement's application for a C of A to demolish 1244 Lincolnway East for 30 days pending the receipt of Dr. Klopfer's application for a C of A which reflects a preservation plan for 1244 Lincolnway East. Commissioner Choitz seconded the motion. Ms. Dempsey indicated no objection. The motion passed unanimously. 5. 1203 East Wayne Street (S) - EW-LHD Mr. Daily expressed interest in learning more about the HPC. Discussion ensued between Mr. Daily and various commissioners on the topic of masonry repair procedures. Mr. Duvall read the staff recommendation. Commissioner Sporleder moved to approve the staff recommendation. Commissioner Hostetler seconded the motion. The motion passed unanimously. IV. Regular Business A. Approval of Minutes - April 18, 1994 Commissioner Oxian asked questions about 1029 East Wayne and 344 S. Sunnyside. Commissioner Choitz moved to approve the minutes as corrected. Commissioner Sporleder seconded the motion. The motion passed unanimously. B. Treasurer's Report - none submitted C. Correspondence Mr. Duvall reviewed correspondence from Mr. Talley regarding the cleaning of the plaques on the Leeper Bridge. Discussion ensued. Commissioner Oxian requested copies of all letters. Commissioner Oxian asked the staff to write Mr. Talley with complete instructions for his proposed actions. Mr. Duvall reviewed correspondence to Ms. Lederer of 318 Lamonte Terrace and Ms. Wendy Page of 1917 Cedar St. There was also correspondence to the following RD-LHD-LC, the Alexander Company concerning the fire at 505 W. Washington, Mayor Kernan on the proposed location for the Studebaker National Museum and to Betsy Harriman ( Parks Dept.) concerning the Navarre Cabin in Leeper Park. D. Committee Reports 1. C of A staff approvals - none submitted 2. Budget and Finance - no report submitted 3. Legal Counsel sent letter to owner of 344 S. Sunnyside concerning work without C of A. Counsel brought commission up to date on the staff person's contract. Commissioner Choitz asked the reason for the delay. Discussion ensued. 4. Discussion ensued. 5. Historic Landmarks Committee First reading for 520 East Colfax; the Dille -Probst House Second readings for 219/221 N. Michigan; Northern Indiana Gas Co. 237 N. Michigan; Lasalle Hotel and 3418 Mishawaka Avenue. Commissioner Choitz moved to send a favorable recommendation to the Common Council for local Historic Landmark status for 219/221 N. Michigan, 237 N. Michigan and 3418 Mishawaka Avenue., Commissioner Petrass seconded the motion. Commissioner Oxian noted that the owner of -3418 Mishawaka Avenue had requested in writing -the removal of his -property from the evening's agenda. Discussion ensued. The motion passed unanimously. Commissioner Oxian described local Historic Landmark Standards for the benefit of the audience. 6. Standards and Maintenance Committee Commissioner Sporleder described the tentative agreement between the Hickeys, owners of 1314 East Wayne, regarding the replacement of the steel casement windows in their home. Mr. Duvall described the proposed maintenance of the Walker Field shelter and the Sedtion 106 review process. 2. Mr. Duvall described the proposed renovation of the Potowatomie Park shelter. 3. Mr. Duvall described the condition of the Navarre Cabin in Leeper Park. 4. Mr. Duvall noted the existence of a citation for code violations at 701-E. Pennsylvania. The property is a local Historic Landmark. V. Old Business Commissioner Hostetler asked about the RB-LHD Standards booklet. Discussion ensued. The HPC directed staff to assemble prototype booklet and get an estimate for printing costs. Commissioner Sporleder asked about the progress of the Darden Road Bridge project. VI. New Business Commissioner Sporleder asked about digitizing the HPC mapwork. Discussion ensued concerning digitized mapping, the landscape survey report and computer networking with other city agencies. Commissioner Oxian relayed a suggestion from a county councilman concerning the application for grants to conduct a study of pioneer cemeteries in the county. .' . ^' j, VIII. Hearing of Visitors Dr. Klopfer suggested the exploration of possible funding sources, ie. banks, public utilities, etc. for the purpose of providing low interest loans for the restoration of private residences. Discussion ensued. Commissioner Sporleder spoke about the Community Investment Act. Commissioner Hostetler spoke about the advantages of using the Equiline to rehabilitate properties. Commissioner Sporleder and Commissioner Choitz cited South Bend Heritage as a group which uses multiple source, creative financing for their projects. Commissioner Sporleder requested that staff put together a checklist of sources for financing rehabs which are locally available. Mr. Talley asked about the removal of trees at the North Pumping Station. He also commented on the RD-LHD streetlight setback plan proposed by the city engineer. Commissioner Sporleder asked about the WPA reservoir house and the Beiger Heritage plan to move it to a new location.
