PROPERTY - 615-617 Riverside Drive
South Bend, Indiana

DESIGNATION - River Bend Local Historic Preservation District
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
This dwelling was constructed in the American Foursquare style in 1914. It is
rated C/10 in the Indiana Historic Sites & Structures Survey. At the time of
the survey in 1987, it was described as being in good condition. The River
Bend LHD was created in November 1992. The structure was resurveyed in June
1993, and found to be in altered condition, with the removal of porch features
and second story stucco.
PROPOSED CHANGE
The Owner proposes to install vinyl soffit running in direction perpendicular
to walls.
STANDARDS
The treatment level for River Bend LHD is "rehabilitation". The Guidelines
state that it is:
1) Recommended - "Whenever possible, the original building materials should be
restored. Metal or vinyl siding may be used as an alternative to maintaining
or replacing the original surface material when it resembles the original
surface material.`
RECOMMENDATION
This proposal has been received as an addendum to COA approved August 23, 1993
which permitted vinyl soffit material running parallel to the walls. Although
this was not the original material, the HPC allowed this material exchange as
having the appearance of a common characteristic of the era in which this
structure was built. The HPC was exhibiting considerable latitude with this
allowance to accommodate a difficult problem in the transitional period of the
creation of a Local Historic District. The proposed change in specifications
does not meet the same criteria for similarity of appearance. Staff recommends
that the addendum be denied.

STATEMENT OF SIGNIFICANCE HISTORIC CONTEXT
This dwelling was constructed in the American Foursquare style in 1914. It is
rated C/10 in the Indiana Historic Sites & Structures Survey. At the time of

Bend LHD was created in November 1992. The structure was resurveyed in June
1993, and found to be in altered condition, with the removal.of porch features

PROPOSED CHANGE
The Owner proposes to:
1) Install aluminum wrap around window trim at second story windows.
2) Increase width of sidewalks around side of house and garage to 31 inches.
3) Install vinyl "Bead Board" to porch ceiling.
4) Install wood railing on front porch and wood handrail at front steps.
STANDARDS
The treatment level for River Bend LHD is "rehabilitation". The Guidelines
state that it is:
1) "No approval shall be necessary for changes in lawns, shrubs, walkways, or
semi-permanent surface changes in the rear of houses."
2) Required - "The existing or original architectural detail around windows,
porches doors, and eaves should be retained or replaced by replicas of the
same design and materials when deteriorated beyond repair.p
3) Recommended_- "Whenever possible, the original building materials should be
restored. Metal or vinyl siding may be used as an alternative to maintaining
or replacing the original surface material when it resembles the original
surface material.'
4) Required - "Existing and original porches and steps, including handrails
balusters, ..... shall be retained or replaced by replicas of the same design
and materials when deteriorated beyond repair. 41
RECOMMENDATION
All items of this proposal represent a reapplication for items which were
requested and denied in 1993 after designation of the LHD and before the
adoption of the final Design Guidelines. Staff will comment on each item
listed in the order shown above.
1) Aluminum window trim wrap - Existing trim is not deteriorated and would
require alteration/simplification to accomplish proposal. Staff recommends
denial.
2) Increase width of sidewalks - Backyard (& sideyard in this case) surface
alterations are shown special dispensation in the standards. COA may be issued
without approval.

3) Vinyl Porch Ceiling - The existing porch ceiling does not exhibit
deterioration which is beyond repair. Staff recommends denial.
4) Porch & Stair railings - The applicant has never provided design
information necessary for handrails at the steps. The standards call for
replacement of deteriorated material (removed without COA in this case) with
similar material. The proposed materials do not meet this criteria. Staff
recommends denial.

DESIGNATION - Riverside Drive Local Historic Preservation District
STATEMENT OF SIGNIFICANCE HISTORIC CONTEXT
This dwelling was constructed in the American Foursquare style in
approximately 1908. It is rated C/9 in the Indiana Historic Sites and
Structures Summary Report for South Bend. The structure is well maintained and
essentially unaltered with the exception of the front porch which has been
enclosed. The detached Garage is sided with aluminum and a carport has been
added to its front.
PROPOSED CHANGE
The Owner proposes to remove the two riser set of concrete steps at the rear
of the structure and replace them with a new forty inch by sixty inch landing
platform just below floor level with a three riser set of steps. The new
landing and steps are to be constructed of concrete. A metal railing is to be
provided.
STANDARDS
The treatment level for Riveride Drive LHD is "rehabilitation". The
Guidelines state that it is:
1) Required - Existing or original porches and steps, including handrails,
balusters, columns, brackets, tiles, and roof decorations shall be retained or
replaced by replicas of the same design and materials when deteriorated beyond
repair....."
2) Prohibited 2'Front porches and steps that are important to the buildings
style and development may not be altered or removed."
RECOMMENDATION
The owner is proposing this discreet alteration at the rear of the structure
to facilitate ease of access for his elderly mother who is resident at this
dwelling. Although the standards state that it is required to retain steps, it
would appear that this requirement was intended to apply to front facade
conditions an/or other significant features such as covered porches. By
inference, rear steps like those existing may be altered. In this particular
case, life -safety, handicapped- accessibility and code compliance would each
give cause for replacement of the steps. Staff recommends approval of this
application. As of this date, Staff has not received plans and or sketches
indicating the design of the railing. Staff recommends that the design of the
proposed metal railing be submitted to staff or committee for approval when it
becomes available.

PROPERTY -- 61191 US 31 South
South Bend, Indiana
OWNER -- Charles & Deborah Nyers
DESIGNATION -- Local Landmark
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
This dwelling is rated S/12 in the Indiana Historic Sites and Structures
Inventory. It was constructed in the Italianate style circa 1866. The main
portion of the house visible from the road is a rectangular block with hip
roof. There are appendages and additions at the rear.
PROPOSED CHANGE
The Owner proposes to install an earth berm across the frontage of the
property to act as a sound buffer from the highway. The berm is described as
seven feet high. The application states that the berm is to be landscaped with
grass and shrubs.
In discussion with the Owner, further description of the intended condition
clarified that the existing driveways including the existing masonry posts
were to remain and that the berm would be broken at those passage points.
Furthermore, The existing spruce tree shall remain and the berm shall be
routed around it. The existing magnolia tree is to be removed.
STANDARDS
For purposes of the Standards for Local Landmarks,the site development is
considered as a feature of the Landmark. The treatment level for this Local
Landmark is the "B" standard.
Landmark guidelines indicate that:
1) " Renovation is the modification of a structure which does not alter the
general massing while an addition is a change in mass."
2) "Additions to Landmarks should not detract from the original form and unity
of the Landmark...."
RECOMMENDATION
The staff believes that the owner has a legitimate interest in attempting to
mediate the effect of road and traffic noise on this residence. Landscaping
can be an effective strategy for providing such noise mediation. The mediation
of noise is accomplished through deflection and/or absorption.
Staff does, however, have some reservations with regard to this proposal:
1) Since this landmark structure has been visually accessible to the public in
the past, it would be unfortunate to create a situation which obscured public
view of the structure totally. Although the character of US 31 has obviously
changed since the days of horse drawn transit, the relationship of the road,
the lawn and this prosperous farmer's house constitutes a historical context.
2) There are structural limitations to the slope of a berm past which the form
cannot maintain itself without reinforcement. It is not clear that there is
sufficient yard depth between the edge of the highway right of way and the
functioning driveway/parking-court to allow the seven foot height proposed.
3) The lawn presently drains consistently toward the road and into a roadside
drainage ditch. The placement of mounding will redirect this surface drainage
causing concentration of water which could result in erosion if not properly
directed and controlled.

Staff recommends that the owner be permitted to alter the form of the lawn to
a form which will deflect as much road noise as possible without totally
obscuring view of the main structure from the passing motorist. This would be
best accomplished by plateauing the lawn at a slightly raised elevation and
increasing the slope at the ditch. If necessary, The lawn could be sloped
somewhat back toward the parking court and house, but this will require more
extensive planning to alleviate erosion due to concentrated runoff. "French
drains" of subgrade gravel may be desirable to deliver surface drainage which
is deflected back toward the house into the ditch.
Staff further recommends that the commission approve installation of low lying
shrubbery (not to exceed 24" in height) on the sides of the berm to increase
the sound absorptive surface area of that slope with the reservation that
planting not be made at the ridge of the berm which would obscure the public
view of the main structure. If the slope is to be steep and located at the
ditch, a dense ground cover such as vetch might be more appropriate.

PROPERTY - 1220 East Wayne Street
South Bend, Indiana
OWNER - Graham and Alice Henry
DESIGNATION - East Wayne Local Historic Preservation District
STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
This dwelling was constructed in the Contemporary style, deriving elements
from the Prairie and Usonian styles in 1957. It is rated non-contributing in
the Indiana Historic Sites and Structures Summary Report for South Bend due to
its recent vintage. The structure is well maintained and unaltered.
PROPOSED CHANGE
The Owner proposes to install vinyl soffit over existing plywood soffit to
alleviate the necessity of future painting.
STANDARDS
The treatment level for East Wayne LHD is "rehabilitation". The Guidelines
state that it is:
1) Recommended - "Metal or vinyl siding may be used when it the only feasible
alternative to maintaining or replacing the original surface material.`
RECOMMENDATION
The owner represents that there has been a persistent peeling problem on the
soffits causing painting to be required "every couple of years". At the time
of Staff site visit, the house had been newly painted, and no peeling was
evident. This recent repainting was performed using an opaque stain in lieu of
paint which is a procedure commonly recommended by staff in paint failure
situations. If peeling does recur within the one year period for which a
Certificate of Appropriateness is in effect, this would clearly indicate some
unusual adhesion problem. The Owner indicated that even though the structure
had been painted, they would like to move ahead with the COA process.
The addition of this vinyl soffit will require additional alteration of some
details, most notably, the removal of cove molding where the soffit meets the
wall. It is likely that the bottom of soffit will drop below the edge of
gutter board, making the material quite obvious.
Even though the structure is of high quality and integrity, Staff recommends
approval of this proposal because the structure is technically
non-contributing and the alteration is reversible. Staff hopes that the owner
will find that the previous adhesion problem has been remedied and that this
additional measure is found to be unnecessary.

The meeting was called to order at 7:38 p.m.
II. Roll Call -

1. 735 Lincolnway East -- EP-LHD
Mr. Duvall read the staff report. Commissioner Sporleder asked for a clarification
of the applicant's site plan. Mr. Duvall responded. Commissioner Oxian asked
if the applicants were present. They were not in attendance. Commissioner Oxian
asked Ms. Dempsey whether a 6' chain link fence could be topped with 18" of
barbed wire. Ms. Dempsey replied that the question should be directed to the
Building Dept. Commissioner Oxian asked about the allowable height and the
presence of barbed wire between commercial and residential spaces. Commissioner
Hostetler supported Mr. Duvall's suggestion of a screening device. Commissioner
Sporleder asked if there was barbed wire present elsewhere in the immediate
area. Mr. Frederick replied in the affirmative. Commissioner Choitz suggested
the use of a roofed storage structure rather than barbed wire for security.
Commissioner Sporleder asked about a general fencing code for the city.
Commissioner Sporleder moved to approve the application for a C of A with
the following stipulations 1) visual screening element added to fence,
2) no barbed wire be used, 3) height complyr•vith City Code. Commissioner
Petrass seconded the motion. Discussion ensued concerning the pending
amendment to the Zoning Code which would require visual screening of outside
storage areas in C -Commercial locations. The motion passed 6 in favor; 1 opposed.
2. 1115 Riverside Drive -- RD-LHD
Mr. Duvall read the staff report. Commissioner Sporleder asked about the variety
of fence types in the immediate area. Mr. Duvall replied that there were no other
board fences in the immediate area. Commissioner Hostetler moved to approve the
application for a C of A as submitted; replacing the deteriorated, pointed
picket fence with a dog-eared picket fence. Commissioner Choitz seconded the
motion. No discussion. The motion passed unanimously.
3. 1345 East Wayne Street (S) -- EW-LHD
Mr. Duvall read the staff report. Discussion ensued concerning Pella window
mechanics, the egress code, previous window replacement at the property and
the architectural style of the residence. Ms. Matthews stated that a complete
replacement of the windows would yield complete conformity in the window stock.
Commissioner Oxian asked the reason for the replacement of the entire picture
window. Ms. Matthews replied that although the picture window was original to
the house it was not appropriate in style. Commissioner Choitz moved to annrove
the application for a C of A as submitted; replacement of all sincle Qlazed
mill finish metal casement and picture windows. Commissioner Sporleder
seconded the motion. No discussion. The motion passed unanimously.

IV. Regular Business
Commissioner Choitz moves to place 1244 Lincolnway East on the agenda following
the Certificates of Appropriateness as a courtesy to Ms. Dempsey. Commissioner
Sporleder seconded the motion. No discussion. The motion passed unanimously.
Mr. Duvall read the C of A application received that morning from Dr. Ulrich
Klopfer, owner of the property at 1244 Lincolnway East. Discussion ensued
concerning the application. Among the items discussed were; the nature of a
completed application, establishment of a deadline for same, the legal ramifications
of the word "restore" on the application: Also discussed were the minimum
requirements for a completed C of A application. Commissioner Sporleder moved to
place Dr. Klopfer's application on the August agenda of the HPC. Commissioner
Hostetler seconded the motion. Counsel asked that the Department of Code Enforcement
continue its application for a C of A in order to demolish the property at 1244
Lincolnway East until the August meeting. Ms. Dempsey agreed to the continuance.
The motion passed unanimously. Commissioner Choitz asked -if Dr. Klopfer had received-'
materials concerning the receivership program. Commissioner Oxian replied in the
affrimative.
A. Approval of Minutes - May 16, 1994
Commissioner Choitz moved to approve the minutes as submitted. Commissioner
Sporleder seconded the motion. No discussion. The motion passed unanimously.
B. Treasurer's Report
Commissioner Oxian requested that Commissioner Wiener provide the HPC with
an audit and financial report within two weeks.
C. Correspondence
Mr. Duvall noted correspondence from TransAmerica Financial Services about
739 Bronson. He also noted the solicitation of public input from the DNR
concerning the coming years SHPO grants. Mr. Duvall also noted the formation
of the Housing and Community Development Plan.

Commissioner Sporleder asked about the budget. Commissioner Oxian referred
to his request of Commissioner Wiener. Mr. Duvall commented on the speculative
nature of the SHPO grants.
3. Legal
Counsel researched and wrote an opinion regarding the holding of a subsequent
owner to the obligations of a previously issued C of A. Discussion ensued.
Counsel was asked to prepare a form that enables notification of subsequent
owners in LHDs and of LLs. Counsel stated that the staff position employment
situation had been finalized.

Commissioner Petrass moved to send a favorable recommendation to the Common
Council concerning the designation of this property as a Local Landmark.
Commissioner Hostetler seconded the motion. No discussion. The motion passed
unanimously.
B. 310 W. Monroe, first reading; Commissioner Oxian requested copies of the
survey card for the property for each commissioner at the next meeting.
Counsel and Mr. Duvall spoke briefly about interaction with Charismatic
Renewal Services, Inc.
6. Standards and Maintenance
A. 621 Lincolnway East - EP-LHD
The committee denied the C of A application for the demolition of the
front porch.
B. 1417 East Wayne - EW-LHD
No final determination has been submitted by the Hickeys concerning their
proposed window replacement.
7. Personnel
A. The staff employment agreement has been finalized.
B. Mr. Frederick, HPC staff, announced his resignation.
8. Staff Reports

Mr. Duvall reported on the progress toward an application for the new
LWW-LHD.
B. 701 E. Pennsylvania - Local Landmark
Mr. Duvall reported on the ongoing conflict between the owners and the
Department of Code Enforcement.
C. River Bend Local Historic District standards booklet to be printed in house.
D. RD-LHD bank erosion; Discussion ensued concerning the bank examination by
HPC, MACOG, USGS and the Army Corps of Engineers. Commissioner Hostetler
moved to direct staff to write MACOG formally requesting their input and
involvement in the erosion problem in all river side LHDs.
E. 505/507 W. Washington
Mr. Duvall reported on his research into casualty losses and historic
preservation tax credits.
F. Bendix Estate
Mr. Duvall reported that he accopmanied Ms. Karen Kiemnec and Mr. Stanley
Gilbert on a tour of the estate. Mr. Gilbert has expressed some interest in
a national and/or local designation for the property.
G. Central High School and Stephenson Mill/Opelika
Staff and HLFI staff viewed window mock up and general progress with Tom
Meredith, State Architect. Staff was also made aware of the problems concerning
an abandoned fuel oil storage tank which straddles the property line between
Captain Alexander's Wharf and the Stephenson Mill project. MACOG has been
made aware of the situation as well.
H. Section 106/Environmental Review
Staff has requested assistance from the SHPO as regards the development
of a consistent approach to these processes by the two CLGs with programmatic
agreements in Indiana. (South Bend and Ft. Wayne)
Commissioner Choitz asked about the progress on the Central High School windows.
Discussion ensued.
V. Old Business
Commissioner Oxian expressed his concern over the removal.of the trees without
a C of A at the North Pumping Station - LL
VI. New Business
Commissioner Hostetler explained the resolution for the HPC checking account.
Commissioner Hostetler moved to accept the resolution as written. Commissioner
Petrass seconded the motion. No discussion. The motion passed unanimously.
Commissioner Sporleder asked about progress on Darden Road Bridge. Mr. Talley
asked about the streetlight at Niles and Leeper. Commissioner Sporleder asked
about the streetlights at the Cleveland Road Fire Station.
VII. Adjournment
The meeting was adjourned at 9:43 p.m.
