'��(� � L, �, � }'��� `tea S © � j CERTIFICATE OF APPROPRIATENESS STAFF REPORT PROPERTY -- 1029 East Wayne South Bend, IN 46617 OWNER -- Philip Schatz DESIGNATION -- Local Landmark; C /10 STATEMENT OF SIGNIFICANCE /HISTORIC CONTEXT 1029 East Wayne is a Dutch Colonial Revival structure that was built as a garage for William C. Sibley's residence (231 S. Eddy) in 1922. In 1985 it was converted into a residence. The two story structure has a concrete foundation and stucco walls. The roof is gabled with a cross gable. It has shed dormers, a slate roof and copper flashing. The windows are 6 over 1 double hung sashes with wood surrounds. There are two wood paneled fold -out garage doors. PROPOSED CHANGE The owner proposes the following landscape treatment. Three (3) Hornbeam trees are to be planted at the north edge of the property. Interspersed among the trees will be four (4) 8" by 8" pillars. Two (2) of the pillars will have lamps to provide security for the parking area. The pillars are to match the one seen in photo. The lamps to match lamp in photo. The combination of trees and pillars will provide a screen for the north edge of the property. STANDARDS The Standards state that (Group B; B. Treatment page 3) "Treatment shall be defined as any change of surface materials that will not alter the style or original form. Such improvements include . . . landscaping . . . and may enhance or detract from the character of the landmark." and (Group B Standards paragraph 1 page 3) "The Commission has the authority to determine the architectural merits and the extent of any proposed treatment . . . to a historic landmark." RECOMMENDATION The staff recommends the approval of the applicant's proposal. The pillars and the lamps as proposed duplicate features currently found at the site. The applicant's proposal amounts to a significant upgrade of a site amenity, the parking area for the structure at 1029 East Wayne. C. DESIGNATION -- East Wayne Local Historic District STATEMENT__. OF_ S_ IGN _I_FICANCE /H.ISTORIC__CONTEXT, The house at 1314 East Wayne (N) is located in the East Wayne Local Historic District. It was rated C /10 on the Indiana Historic Sites and Structures Inventory. The house is a Colonial Revival designed by H.R. Strapp and built in 1926 by whitcomb & Keller. At the time of the survey (1986) it was considered in excellent condition with minor alterations. The alterations included aluminum storm windows on the second floor and an aluminum storm door. There is also a one story hipped addition at the rear. PROPOSED CHANGE The applicant proposes alterations as follow: 1) Remove existing wood panel front door and replace it with new slid wood door. Existing door is six panel pattern with the middle panels filled with diamond paned glass divided by wood mullions. The proposed replacement door is of 9 panel design with the center panel glazed with a leaded glass pattern. 2) Install new full view screen door in lieu of former storm door which appearantly was removed before sale. 3) Install new inoperable shutters at all windows of front facade. Shutters are intended to replace wood two panel shutters which were removed by previous owner (phto documentation provided). New two raised panel shutters are of moulded synthetic material with embossed wood grain. STANDARDS The Preservation Guidelines state: 1) Guidelines for East Wayne Street Historic Districst follow the Rehabilitation Model Guidelines. 2) (b2) REHABILITATION - Maintaining the existing character.... whenever possible, returning it to its original condition..... contemporary methods and materials would also be acceptable in appropriate situations. 3) (C -1) Original windows and doors, including sash, lintels, sills, shutters, decorative glass, pediments, hoods, and hardware shall be retained or when deteriorated beyond repair, replaced with units and trim resembling the original.. 4) (C -2) Wood frame storm windows and doors should be used but should not damage existing frames. If new sash and doors are used, the existing design and hardware should be used. CERTIFICATE OF APPROPRIATENESS STAFF REPORT RECOMMENDATION. Staff makes various recommendations with regard to the items of the proposal as follows: 1) The existing front door was found to be in sound condition with no visible reason for replacement. Staff recommends denial of this item. Furthermore, the standards indicate that if the existing door is replaced that the existing hardware should be retained. 2) The standards clearly support installation of a wood screen (or storm) door. The full view aspect of the design allows maximum visual exposure of the entry door. Staff recommends approval of this item. 3) Although it is not possible to ascertain the originality of the shutters which have been removed, fixed decorative shutters would clearly have been appropriate to the original design of this house. Staff would prefer that replacement shutters be of unraised wood panel design to replicate the material previously removed. The structure which was rated S/11 in the Indiana Historic Sites and Structures Inventory was occupied by Knute Rockne and his wife Bonnie from 1930 until their deaths. Rockne a team member and then head coach of the football team of Notre Dame University and was the subject of the film, " Knute Rockne - All American ". The facade and portions of the interior of the house were reproduced for the film which featured future president of the United States, Ronald Reagan. The structure is Tudor Revival frame construction with brick & stucco with half timber falsework exterior finishes. The plan is irregular with several cross - gables & dormers at the roof. Windows are typically paired six lite steel casement sash with four lite transom although there is some variation. Four windows have been altered to accommodate window air conditioners. PROPOSED CHANGE Owner proposes to remove 11 second story windows and replace them with new metal clad wood casement windows. If steel casement windows have to be replaced or removed, windows of similar size and style should be used. CERTIFICATE OF APPROPRIATENESS STAFF REPORT RECOMMENDATION The existing steel sash windows are clearly a state of advanced deterioration. Furthermore, the existing single glazed windows are thermally inefficient by current standards leading to condensation which contributes to continuing decay. Present conditions are exacerbated by intrusive alteration at the location of the window air conditioners. The standards specifically address the issue of steel windows indicating that if they are removed their replacements should resemble the original, even to the extent of returning to the original condition. Although the proposed replacement windows are casement windows, their frames and sashes are wood. Installation, including the required "frame expanders" specified by the manufacturer to fit the standard wood window sizes to the existing openings will yield a much heavier appearance in the frame & sash and net considerably reduced glass area. The transom panels above the casements have been eliminated entirely in the proposed alteration. For the reasons above, Staff recommends denial of the proposal. The documentation submitted included four options for utilizing the stock wood window sizes proposed by the manufacturer of the replacement windows. Of these, the "option #1" is the most acceptable proposal, as it at least maintains the appearance of having the correct number of window panes when the muntin inserts are utilized, and "frame expanders" are not required. The two windows which presently have window air conditioners are especially problematic as they are butchered in their present form and as far as Staff can tell, will continue a butchered appearance after the proposed replacements. These windows have not been specifically addressed in the proposals submitted. It seems very unfortunate that such extensive rehabilitation should be undertaken while still yielding an unsatisfactory condition. With regard to the above concerns, Staff recommends that if the window replacement is allowed that it be in conjunction with the elimination of the window air conditioners or that the contractor or manufacturer be required to provide drawings detailing these conditions to the satisfaction of the Staff before these windows may be installed. IV CERTIFICATE OF APPROPRIATENESS STAFF REPORT There has been some discussion with respect to relative cost of the manufacturer's "stock" or "standard size" windows versus custom fabricated replacement windows which could better reflect the original design. Although the applicant believes that the lower price of stock windows will yield a more affordable cost, Staff maintains that in the absence of comprehensive cost estimates including the considerable cost of installation and related carpentry, real cost savings are not verifiable. The house has two stories plus an attic. The foundation is brick. The first story is clapboard, the second is of wood shingles. The house has an open porch of brick and wood. The rear of the house faces the St. Joseph River. PROPOSED CHANGE The applicant proposes the installation of a run of 42" high wood picket fence at the north property line. The style of the fence is to be French Gothic as seen in the advertisement. In addition the owner wishes to enlarge the flower beds in front of the house. Also the owner proposes the replacement of rotting floor boards in the front porch. STANDARDS The Standards state (page 16, I.A.I.) " New plant materials, fencing . . . shall be compatible with the character of the neighborhood in size, scale material and color." and (page 23, II.D.4.) "Original porch details should not be replaced with materials representing a different period or style from the original." RECOMMENDATION The staff recommends the approval of the proposal as regards the fence and the flower beds. The proposed fence in effect creates an enclosed yard for the owner. The neighbors on either side of 934 Riverside Drive have fences that run the length of their backyards. Many of the properties in the District have enclosed rear yards. Concerning the repair of the front porch the staff suggests approval the replacement in -kind of the entire front porch floor. The staff made a site visit on 4 -11 -94 and found the porch floor in poor condition. C. Miller DESIGNATION -- EW -LHD ` STATEMENT OF SIGNIFICANCE /HISTORIC CONTEXT The property at 344 South Sunnyside was rated as non - contributing on the Indiana Historic Sites and Structures Inventory. PROPOSED CHANGE The applicant has constructed a small kennel abutting the'garage. kennel is 'a chain link'fence enclosure( 10'byl2' and"5' in height) ' which has three sides. The floor of the enclosure is made of concrete patio brick. The owner has planted shrubbery to screen the kennel from street view. STANDARDS The Standards state; (page 19 I.A.1.) ". . . fencing shall be compatible with the character of the neighborhood in size, scale, material and color." and (page 20 I.B.1.) "Structures such as: gazebos, patio decks, . . . new walls . . . trellises . . . and other similar structures shall be compatible to the historic character of the site and the neighborhood and inconspicuous when viewed from a public way." RECOMMENDATION The owner has constructed this kennel without the prior approval of the HPC. The house is,as noted,a non - contributing structure in the East Wayne Local Historic District. The kennel is free standing and does not permanently alter the fabric of the residence. The landscape elements (columnar Junipers) intended to screen the kennel currently exceed the height of the fence. The continued unchecked growth of the shrubbery threatens to create an out of scale vegetative addition to the garage thereby altering the mass. The staff reluctantly recommends approval of the project. C. March 21, 1994 I. Call to Order The meeting was called to at 7:43 p.m. David B. Duvall was introduced as the new director of the HPC. II. Roll Call Members present: Mr. Jed Eide, Mrs. Catherine Hostetler, Mrs. Martha' Mr. John Oxian, Mrs. Joann Sporleder, Ms. Lora Spaulding, Mrs. Janeanne Petrass ; staff present David Duvall, director; Chip Frederick, staff Members absent: Mr. Jerry Wiener, Ms. Jewel Van Dalsen Also present: Ms. Aladean DeRose, Mr. David Betson, Mr. Scott Peacock, Mr. and Mrs. Charles Spiher, Ms. Marsha Stevenson III. Public Hearing A. Certificates of Appropriateness 1. 24888 Old Cleveland Road - Local Landmark Mr. Frederick read the staff report. Commissioner Sporleder moved to approve the application for a C of A in order to install a paving brick driveway and walkway from house,and as further detailed in the application. Commissioner Hostetler seconded the motion. The motion passed unanimously. Mr. Spiher engaged the Commission in a brief discussion of several antique streetlights. He is considering the purchase of these lights for installation on his property. Commissioner Sporleder stated that most farms had little light. Commissioner Eide said he had no objection. Mr. Duvall asked the location of the lights on the site plan. Mr. Spiher responded that they would be on the east side of the drive. Commissioner Choitz had no objection. Commissioner Oxian asked for any objections, there were none. Mr. Spiher stated he would apply for a C of A at the appropriate time. 2. 635 S. Main - Local Landmark Mr. Duvall read the staff report. Commissioner Eide agreed with the staff report. Commissioner Oxian suggested the proposal of an alternative plan to be submitted by the HPC. Commissioner Hostetler suggested the C of A go to committee. Mr. Duvall addressed issues of building alteration. Commissioner Eide and Commissioner Hostetler suggested the development of a permanent structure which satisfied ADA requirements. Mr. Duvall doubted that the current proposal met ADA standards as did Commissioner Sporleder. Commissioner Eide advised against the HPC taking on the burden of design for the School Corp. Commissioner Choitz advised a detailed explanation of any possible denial of the application. Commissioner Sporleder viewed this proposal as a " sop to ADA requirements." Mr. Frederick stated the HPC procedures for notification following a meeting. Counsel advised the Commission that their concern is architectural, that the HPC is not a body of safety experts. Commissioner Sporleder questioned whether the HPC could restrict alterations to the building if compliance with ADA demanded those alterations. Commissioner Eide moved to deny the C of A as proposed. Commissioner Choitz suggested alternatives that would comply with ADA. Commissioner Spaulding seconded the motion. The motion to deny the C of A passed unanimously. Counsel asked to review follow -up letter to School Corp. 3. 944 Riverside Drive - RD -LHD; CP -NRHD Mr. Frederick read the staff report. Mr. Duvall discussed the specific similarity of the replacement window. Commissioner Sporleder asked the size and location of the replacement window. Commissioner Choitz moved to approve the application for the C of A replacing a non - historic, non - original window on the rear east facade. Commissioner Sporleder seconded the motion. Commissioner Oxian asked about the size of the original windows. Mr. Peacock did not know the sizes. The motion passed unanimously. 4. 12670 State Road 23 - Local Landmark Mr. Frederick read the contents of a letter sent to Mr. Selsor: IV. Regular Business A. Approval of Minutes 1. Mr. Frederick spoke about the contents of the spring letter. Commissioner Choitz asked about HPC obligation to inform homeowners of the new law. Commissioner Oxian moved to nominate Commissioner Hostetler for secretary. Commissioner Sporleder seconded. Counsel advised the HPC on the process for electing officers. The slate was unanimously accepted as it was presented. VII. Hearing of Visitors Marsha Stevenson spoke about vandalism to her car. VIII.
