Call to Order The meeting was called to order at 7:30 p,m. 7th Floor, County Commissioner's Conference Room, County -City Building II. Roll Call Members Present: Mrs. Martha Choitz, Mr. Jed Eide, Ms. Catherine Hostetler, Mr. John Oxian, Ms, Jewel Van Dalsen, Mrs. Joann Sporleder, Members Absent: Mrs, Janeanne Petrass. Certificates of Appropriateness. 1. 740 Bronson -- Edgewater Place LHD Mr. Holycross read the staff report describing the proposed project: installation of a 36" x 48" fixed pane window of 1" insulated glass in south corner of the east facade of house. Staff recommended that the HPC approve the application as submitted; the proposal does not violate district standards and proposes a renovation that would match the existing window in the addition. Mr. Farr, the owner of the property, stated that there was a window in this location when he began renovating this addition to the house; he closed the opening at that time. Mr. Eide moved that therp oposal be approved as submitted. Ms_ Van Dalsen seconded the motion. No further discussion. Motion approved unanimously. 2. 1422 Leer -- Lincolnway East LHD Mr. Holycross read the staff report describing the proposed project: erect a six foot (6') wood privacy fence (stockade type) around the perimeter of the rear yard: to extend twenty-five feet (25') between house and garage on north side of yard and; to extend forty-six feet (46') from house to garage on the south side of yard with an access gate in front of garage; the fence to wrap around driveway and end at southeast corner of garage. A gate is proposed to access the northeast corner of the yard and a double gate (two S' sections) to access the driveway. Both gates to match fencing. Staff recommended that the HPC approve the proposal as submitted; no historic materials will be removed; the fencing would surround the rear yard along the alley side of the property and would be neither out of scale nor unsightly. • Mrs. Choitz moved to approve the proposal as submitted. Ms. Hostetler seconded the motion. No further discussion. Motion passed unanimously. 6. 644 East Monroe -- Edgewater Place LHD Mr. Holycross read the staff report concerning the proposal: the installation of a wood picket fence from the southeast corner of house east to sidewalk, then southeast along sidewalk to edge of property; a matching gate will be located at northwest edge of the section running along Edgewater Drive. Fence will be thirty-six inches (36") in height and will match the existing fence in style, materials and color. Staff recommended that the HPC approve the proposal as submitted; the proposal meets district requirements and is appropriate in size, scale and materials. Mrs. Sporleder asked about the location of the fence relative to the street and about zoning. Mr. Holycross replied that it ran along the sidewalk and was within city code. Mrs. Choitz moved to approve the COA as submitted. Mrs.. Sporleder seconded the motion. No further discussion. Motion passed unanimously. Mrs. Sporleder asked whether the owners had chosen a color; Mr. Holycross replied that they intended to paint the fence white. IV. Regular Business A. Approval of Minutes -- April, 1993. Mr. Holycross asked that the April minutes be approved as submitted. Mr. Oxian asked for several changes on page eight; he asked that language about historic district implementation procedures be included; Mr. Holycross replied that he would include that language. Mrs. Sporleder moved to approve the April, 1993 minutes as corrected. Mrs. Choitz seconded the motion. No discussion. Motion passed unanimously. B. Treasurer's Report Mr. Holycross asked that the April Treasurer's Report be approved as submitted. Mrs. Sporleder moved that the April, 1993 Treasurer's Report be approved as submitted. Ms. Van Dalsen seconded the motion. No discussion. Motion passed unanimously. C. Correspondence No correspondence submitted this month. D. Committee Reports 1. C of A (Staff Approvals) A. 1154 Lincolnway East -- Lincolnway East LHD B. Monroe -Edgewater Pumping Station -- Edgewater Place LHD Mr. Oxian asked whether the staff was compiling new Staff Approval procedures; Mr. Holycross answered that he was working on a draft of new procedures. Mrs. Sporleder stated that she understood that staff was already approving noncontroversial COAs. Mr. Oxian answered that a list of such items that could be approved by staff would be in order. Mr. Holycross stated that HPC legal counsel had suggested such a policy to get rid of ambiguity and also to be clear about a policy that was not allowed in the rest of the state; state preservation legislation did not allow such a policy; South Bend could enact such policy only because of its enabling legislation that predated the state ordinance. Mrs. Choitt stated that there were many cases, even with roofing matters, that the HPC would want to hear; she would like the opportunity to assess the policy before it is enacted. Mr. Holycross replied that he intended to draft the policy and submit it to the appropriate committee for assessment; it would then come before the HPC for approval or denial. 2. Historic Districts A. liaison Committee Appointment: Riverside Drive LHD Mr. Oxian announced that it was necessary to appoint Liaison representatives to the district due to the vacancy left by the resignation of Dwight King and Mary Hendrikson. Upon such resignations, he explained, the HPC was to make an appointment after asking the Liaison Committee for a recommendation to fill the term of office. The Liaison Committee recommended Martin and Jane Murphy of 1121 Riverside Drive as replacements. Mrs. Sporleder asked about the recommendation process; Mr. Holycross replied that in such a case, district standards required the Liaison Committee to inform the neighborhood of the vacancy and then to make a recommendation; this had been done. Mr. Eide asked if any others had shown interest; Mr. Oxian answered "no" and stated that it was fortunate that there was interest at all; often there were no residents in districts interested in serving on the committee. Mrs. Sporleder moved to approve the appointment of Jane and Martin Murphy to fill the Riverside Drive LHD Liaison Committee terms left vacant by the resignation of Mary Hendrickson and Dwight King. Mrs. Sporleder asked about the length of the remaining term; Mr. Holycross replied that the term remaining was two -and -a-half years. Ms. Van Dalsen seconded the motion. 3 No further discussion. The motion passed unanimously. • 5. Historic Landmarks Mr. Oxian announced that 710 N. Cushing had been approved for designation as a local Historic Landmark by the Common Council on May 10, 1993. Mr. Holycross distributed plans recently compiled by the planning committee working on the renovation of Madison Elementary School. He explained that staff had attended two such meetings. He explained that the submitted drawings were preliminary plans submitted by their architects, Hebard and Hebard. Mr. Holycross stated that he wanted to allow NPC members an opportunity to comment on the pians before he attended the next meeting on the following day. He explained that he thought the plan was appropriate because it did not affect the historic facade of the structure on the north, west and south sides; the east side consists of 1950s additions that also would only be affected in a minor way. The interior of the structure would be changed dramatically. Discussion ensued as to the specifics of the plan. Mrs. Sporleder asked if a motion was necessary. Mr. Holycross replied that he was merely allowing the opportunity for comment; he thought the plan as submitted was probably as good as could be expected; with present requirements placed on the school board, it was unrealistic to expect that the building could be saved and utilized while retaining historic features of the interior. He further explained that school employees saw this plan as inadequate for their needs; it seemed that most would prefer a new building; the architects told the committee that the building was well-built and worth saving but would require compromise on the part of all in order to accomplish that. He also stated that Mr. Ron Farrand repeatedly spoke about the "sixty percent formula" wherein the school Corporation would be "forced" to consider a new building if renovation plans exceeded sixty percent of the cost of new construction. Mr. Oxian stated that they could not build a new structure on this space; Mr. Holycross answered that they would then abandon the building for another site. Ms. Hostetler asked if the landmark designation had been approved; Mr. Holycross answered that the measure had been tabled at the Common Council. Ms. Hostetler stated that there were many local families that depended on the school. Mr. Oxian answered that there were many teachers "who wanted the Taj Mahal." He then described the problems at Clay Middle School, including leaks. Ms, Hostetler replied that everything possible should be done to keep schools such as this in the neighborhoods; this area contained three historic districts and was heavily populated by young families with children who needed the schools adjacent to their homes. Mrs. Choitz stated that Cathy Thompson, a teacher at the school, was very much in favor of saving the building, it was evident that not all of the teachers were in favor of losing this building. Mrs. Sporleder stated that the plan "looked good" as it presently stood; it "looked like a good way to ga." There was general agreement among HPC members. Mr. Oxian directed staff to take that message to the committee. 6. Standards and Maintenance No Report. 1. Personnel Mr. Holycross introduced the new staff Administrative Assistant, Mr. Chip Frederick. 8. Staff Reports No Report. V. Old Business Mr. Oxian announced new HPC committee assignments: 1. Ms. Hostetler to the Historic District and Legal committees; 2. Ms. Van Dalsen as cochairperson of Standards and Maintenance (with Mrs. Sporleder) committee. VI. New Business VII. Hearing of Visitors Mr. Ed Talley asked that all HPC members be given a copy of the district newsletter. He asked when the city would begin work on the streetlights on Riverside Drive; and stated that there was "no coordination" on "getting the lights waterproofed and painted" and asked about "grant money." Mr. Oxian replied that he had given him information about Indiana Humanities grants that might be used for their newsletter. Mr. Talley then asked that the neighborhood be informed about the "school thing." Mr. Holycross stated that the neighborhood would be informed as the Madison renovation plans continued. VIII. Announcements/Miscellaneous Matters Mrs. Sporleder asked for an update on the vacant NPC positions. Mr. Oxian replied that there were two: mayoral and city council, Democratic, appointments. . Mr. Oxian announced that an ordinance had been sent to the County Council that sought to amend HPC ordinance to require that the HPC be involved in any landmark or historic district petition and be required to make a recommendation on any proposed change. IX. Adjournment The meeting was adjourned at 9:05 p.m. CERTIFICATE OF APPROPRIATENESS STAFF REPOeT PROPERTY-- 740 Bronson Court South Bend, IN 46601 OWNER -- Ron and Elizabeth Farr DESIGNATION -- Edgewater Place LHD STATEMENT OF SIGNIFICANCEMISTORIC CONTEXT The house at 740 Bronson is located in the Edgewater Place LHD and has been assigned a non-contributing status (NC). The property has been altered significantly, including the application of stucco and "timber" panels, aluminum storm windows and doors, a deck off of the garage in the rear and a railroad tie fence as well as a metal fence. PROPOSED CHANGE Installation of a 36" by 48" fixed pane window of 1" insulated glass in the south corner of the east facade of the house. STANDARDS "New windows ... that would alter the scale and proportion of the building may not be introduced." (II C 3) RECOMMENDATION The applicant's proposal does not violate the standards of the LHD. The proposed window is in kind with the existing window in the addition. The building was built circa 1920 and has been given a Non -Contributing (NC) rating on the Indiana Historic Sites and Structures Inventory due to numerous alterations that compromise its architectural integrity. PROPOSED CHANGE The proposal is to erect a six foot (6') tall wood privacy fence (stockade type, see photo) around the perimeter of the rear yard: to extend twenty-five feet (25') between house and garage on north side of yard and; to extend forty-six feet (46') from house to garage on the south side of yard with an access gate in front of garage, the fence to wrap around driveway and end at southeast corner of garage. A gate is proposed to access the northeast corner of the yard and a double gate (two 5' sections) to access the driveway. Both gates to resemble the fencing. STANDARDS District standards (1,A,3) state that "...fencing... out of scale or inappropriate to the neighborhood may not be used." RECOMMENDATIONS It is the staff's recommendation that this proposal be approved as submitted. No historic materials or significant landscaping elements (trees) are being removed from the property. The proposed fencing would surround the rear yard area only, running mainly along the alley side of the property; it would not be out of scale to the neighborhood as proposed nor would it be unsightly. Monroe is located in the Edgewater Place LHD, has been rated as Significant (S-12) on the Indiana Historic Sites and Structures Inventory and is a designated Local Historic Landmark. The structure was built in 1926 by developers Whitcomb and Keller. It is a fine example of Tudor Revival/English Cottage architecture. PROPOSED CHANGE Installation of a wood picket fence from southeast corner of house east to sidewalk, then southeast along sidewalk to edge of property; a matching .gate will be located at northwest edge of the section running along Edgewater Drive. Fence will be thirty-six inches (36") in height and will match the existing fence in style, materials and color. STANDARDS "New ... fencing ... shall be compatible with the character of the neighborhood in size, scale, material and color." Historic Preservation Districts and for properties designated as Group B Local Historic Landmarks. Staff approval and the subsequent issuance of a certificate of appropriateness is limited to the specific instances described below and shall not include the reconstruction, alteration, demolition or moving of any exterior feature of any building, structure or use in a Local Historic District or for a Local Historic Landmark. Material changes that may receive a staff -approved certificate of appropriateness include: 1. "in kind" changes, i.e. replacement of existing materials with materials of the same fabrication, size, color and texture that will not alter the style or original form in any way; 2. replacement of existing materials with materials that substantially duplicate the original in size, color and texture and that will not alter the style or original form in any way, particularly as follows; A. in kind replacement of nonhistoric roofing materials, i.e. asphalt shingles or similar materials, not including tile, slate, wood shingles or other historic roofing materials; B. in kind replacement of nonhistoric eave troughs (gutters) and downspouts; C. in kind replacement of nonhistoric doors, windows, storm doors and storm windows; • D. in kind replacement of minor landscaping elements and the removal of dead trees; E. repair or in kind replacement of nonhistoric sidewalks, steps and driveways. 3. the addition of electrical and/or mechanical devices, such as electrical meters and boxes, free-standing air-conditioning units, etc. that are not visible from the public right-of-way, and that do not alter the original. style or original form in any way; 4. the renewal of previously -approved certificates of appropriateness that have expired. The applicant will be responsible for providing the HPC with documentation of both the existing materials being proposed for change and for the materials being proposed for replacement. Documentation information and filing fees, as applicable to the particular case and standards of the property, shall be the same as for any other certificate of appropriateness application. HPC staff will make a determination at the time of application whether or not the proposal fits within these criteria and will issue or deny a certificate of appropriateness when the application is complete, i.e. when all documentation materials have been received. Staff will report each Staff Approval to the HPC at the next regular monthly meeting. Property owners may present their application to the HPC in the usual manner if any question arises as to the applicability of their proposal tinder this policy or if they disagree with the staffs determination. Oxian, President Historic Preservation Commission of South Bend and St. Joseph County County -City Bldg. South Bend, IN 46601 Dear Mr. Oxian: have accepted another position and am formally resigning as Director of the Historic Preservation Commission of South Bend and St. Joseph County. I will continue in the position for three full weeks; my final day of employment will be July 9, 1993. I have informed the County Commissioners of this decision; I am sure they will contact you in order to find a replacement for the position. I will make every effort to make the transition as easy as possible for the HPC and staff. I want to thank you for this opportunity to work with you and the commission on the important task of preservation in South Bend and St. Joseph County. I have learned a great deal during the last two and half years and am fortunate to come away from this experience with new skills and an enhanced view of the possibilities of the historic preservation field.
