STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
The house at 615/617 Riverside Drive is an American Foursquare. It is rated
C/10, contributing, on the Indiana Historic Sites and Structures Inventory.
The house was built in 1914 by Seth Hammond and Leslie Whitcomb, of Whitcomb
and Keller, as a real estate venture. William H. and Sarah J. Kryder bought
the property in 1915. Between 1941 and 1947 the house was converted to a double
residence.
PROPOSED CHANGE
The applicant's proposal calls for the removal of all stucco from the second
story exterior surfaces. Those areas will be covered with vinyl siding. In
addition, All fasciae and soffits will be sided. The applicant also wishes
to fully side the garage.
Concerning the front porch; the applicant intends to install four (4) sections
of wooden railing. He intends to remove one front door and replace it with a
window, the installation of which would use brick that matches the existing
brick in both dimensions and color. The applicant intends to replace the
existing porch columns with those of a "similar type" and to cover the porch
ceiling with aluminum bead board.
The applicant intends to "build out" the gables and install a half -round louver.
Concerning the windows; the applicant plans to install thirty-one (31) vinyl
replacement windows, all of which will be wrapped in vinyl.
Concerning the doors; the applicant intends to install three (3) 24 gauge, wood
textured, steel entry doors.
The applicant proposes the replacement of the garage pad and the installation
of 31 inch sidewalks leading from and around the house. He also intends to
remove and replace the street sidewalk and install new front steps. The applicant
plans to install a six (6) foot privacy fence.
STANDARDS
Concerning the removal of stucco and the application of siding the standards
state: "Masonry including... stucco shall be maintained." page 3 II.A.1. and
"The existing architectural detail around windows, porches, doors and eaves
should be retained..." page 3 II.A.1.
Concerning the front porch the standards state: 2Existing or original porches...
shall be retained or replaced by replicas of the same design and materials..."
page 5 II.D191. and "Original porch details should not be replaced with materials
representing a different period or style from the original." page 5 II.D.4.
Concerning the gables the standards state: "The existing or original architectural
detail around windows... shall be retained or replaced by replicas of the same
design and materials..." page 3 II.A.1.
STANDARDS; continued
Concerning windows the standards state; "Original windows... shall be retained
or when deteriorated beyond repair, replaced with units and trim resembling
the original." page 4 II.C.1. and "Original doors, windows and hardware shall
not be discarded when they can be restored and reused in place. New window or;
door openings that would alter the scale and proportion of the building may not
be introduced." page 5 II.C.3.
Concerning doors the standards state: "Original...doors... shall be retained or
when deteriorated beyond repair, replaced with units and trim resembling the
original." page 4 II.C.1. and "Original doors ... shall not be discarded when
they can be restored and reused in place." page 5 II.C.3.
Concerning sidewalks the standards state: "Distinctive existing features such
as ... walkways ... shall be retained." page 1 I.A.1. and "...walkways ... which
reflect the property's history and development shall be retained." page 2 I.B.I.
RECOMMENDATION
The HPC staff recommends against this proposal. As offered it clearly conflicts
with the standards of the Riverbend LHD.

As you are aware, your property located at 617 Riverside Drive is in the River Bend
Local Historic District. The purpose of local historic designation is to protect and enhance
the historic integrity of the properties included within it. This is done on the basis of a set of
standards created through the cooperation of district residents and the Historic Preservation
Commission. In order to create these standards for our district, property owners have been
meeting with the Historic Preservation Commission and its staff for the last several months.
As a result of these meetings, a draft of standards has been completed (see attached).
The next step is for these standards to be discussed at a public meeting. This meeting
will be held on Monday, June 14, at 5:30 p.m. on the 7th floor of the County/City Building
• in downtown South Bend. We strongly encourage you to attend this important meeting and

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
The city of South Bend purchased the land which became Shetterley Park from
two families, the Millers and the Shetterleys in 1911 for the sum total of
twenty dollars. Development of the park began in 1913 and was completed in
1917. Two rogue (form of croquet) courts occupied the southern part of the
park from 1917 until 1923. There was a drinking fountain in close proximity
to those recreational areas.
PROPOSED CHANGE
The Park Department intends to install a drinking fountain in Shetterley Park.
The precise location is in the 1000 block of Riverside Drive across the street
from the residence at 1035 Riverside Drive. The fountain's dimensions are as
follows; 3' high, 10" deep and 8" wide. The design is produced in house by the
department and the construction is done in house as well. This project is also
• undertaken in conjunction with neighborhood advocacy.
STANDARDS
The standards for the Riverside Drive LHD do not specifically mention fountains
of any kind. However they do make reference to site amenities such as streetlights,
fences, signs and benches; regarding these the standards state: "New ... shall be
compatible with the character of the neighborhood in size, scale, material and
color." page 16 I.A.I.
RECOMMENDATION
The HPC staff supports the proposal to place a drinking fountain in Shetterley
Park. However it is the opinion of the staff that the city's choice of this
particular fountain is inappropriate.While cognizant of complicating factors
ie. availability and cost etc.; HPC staff believes that the residents of the
Riverside Drive LHD who have aggressively and responsively pursued the installation
of historic streetlights and park benches are justified in their desire for an
appropriate drinking fountain.

Mrs. Petrass moved to reposition 615/617 Riverside Drive as the last C of A
on the agenda. Mrs. Choitz seconded the motion. There was no discussion.
Motion approved unanimously.
1. Shetterley Park Fountain -Riverside Drive-LHD
Mr. Frederick read the staff report. Mr. Oxian introduced several other
photographs of the proposed fountain. Mr. Talley spoke against the proposal. He
detailed the effort to bring water back to the park and the general history of
drinking fountains in Shetterley Park. He then requested that the HPC deny the
proposal. Mrs. Choitz asked about Health Dept. restrictions concerning fountain
design. Mr. Talley replied that he had not considered the matter. Mr. Oxian then
asked about the originality of the Leeper Park fountains. Mr. Talley replied that they
were original to the park but had been moved several times previously. Mr. Oxian
stated that part of Leeper Park was in a LHD. Mr. Talley responded that the fountains
in question were not in a LHD. Mrs. Choitz asked that the HPC be in compliance
with other City departments. Discussion ensued about vandalism. Mr. Oxian then asked
counsel about approving the COA but requesting a different fountain. Ms. DeRose
stated that was not possible. Mrs. Choitz asked whether the COA could be tabled.
Ms. DeRose indicated that a signed waiver must accompany a motion to table and that
the city was unrepresented at the meeting. Further she stated that as a practical
matter the HPC had all of the information necessary to decide the issue. Mr. Wiener
moved to reject the COA. Mrs. Hostetler seconded the motion. No further discussion.
The motion to reject the COA application on the grounds of inappropriateness to the
Riverside Drive-LHD was approved unanimously.
2. 1228 East Wayne St.—East Wayne-LHD
Mr. Frederick read the staff report. Mr. Bruno stated that he may leave
the fence unpainted. Mrs. Choitz replied that the HPC " does not deal with paint".
Mr. Oxian questioned Mr. Bruno about the relocation of a portion of the 42" high
fence to behind the garage. Mr. Oxian stated that the COA application should reflect
the moving of that fence as well as the installation of the new privacy fence.
Mrs. Choitz moved that the COA reflecting the move of the fence and the installation
of a new privacy fence be approved. Mrs. Hostetler seconded the moti..(m� No further
discussion.
The motion to approve the COA application for a new privacy fence and
the possible relocation of a portion of the existing fence was approve unanimously.
3. 615/617 Riverside Drive-Riverbend-LHD
Mr. Frederick read the staff approval COA dated July 27, 1993. He then read
the staff report and the report of the Historic Districts Committee dated August
11, 1993. Mr. Laskowski presented his proposal calling his plan a "sincere res-
torration." He indicated that he had " contracted all work before the standards
were in place." He stated that he had a letter dated May 4 stating that the stan-
dards are not yet in place and that he did not receive the letter until May 12.
Mr. Laskowski also showed . -a photocopy of a building permit issued on May 25_..for
work including siding, fasciae and soffits. He explained that on Ma 12 then HPC
Director Fred Holycross verified that the house in question had clapboard siding
originally.
Mr. Oxian pointed out that Mr. Laskowski was neither returning to original
construction nor willing to maintain the house as it stood on the date of
LHD designation. Mr. Oxian then read "Preservation of Original Landmarks and
Buildings" into the record. This document was adopted by the HPC April 20, 1992.
Mr. Laskowski asked where he stood concerning the porch. Mrs. Choitz replied that
the HDC had recommended the complete restoration of the porch. To which Mr. Laskowski
responded; "I'm not going to put that porch back the way it was."
Mr. Oxian asked Mr. Laskowski if he objected to any proposal which the HPC had
approved. Mr. Laskowski indicated no objection. Mr. Oxian then asked staff to read
those items. Mr. Frederick read the list. Mr. Oxian stated that the HPC had also
approved window changes oh the side and rear facades. Mr. Frederick pointed out
that those proposals are neither in Mr. Laskowski's proposal nor in his COA application.
They appear only in his drawings.
Mrs. Choitz then moved that the HPC approve the siding of the garage, the switchout
of the front door for a window, changes in the side and rear door pending HPC'desi n
approval, installation of a 6' privacy fence, window changes, as in drawings, to the
west and north elevations only, replacement of the garage pad,
seconded the motion. No further discussion. The motion passed unanimously.
Mrs. Hostet er
Mr. Oxian asked the staff for a brief report on the stucco. Mr. Frederick replied
that there appeared to be lath underneath the stucco, not finished clapboard.
Mrs. Choitz indicated that there were numerous examples of houses of this type
in the area and reported that the stucco on three facades appeared in "very good
condition". She then rei.terated the HDC's position concerning the stucco.
Discussion ensued concerning the issuance of the building permit and the next
step in the HPC's deliberations. Mrs. Choitz suggested that the HDC including
Mrs. Sporleder meet with Mr. Laskowski to work through the remaining areas of
difficulty. Mr. Oxian asked counsel if that was appropriate. Ms. DeRose replied
in the affirmative but that Mr. Laskowski would have to sign the waiver.
Mr. Laskowski then asked for a review of his proposal. Mr. Oxian cited the following
areas of dispute: stucco, fasciae and soffits, porch ceiling, porch columns...
Mr. Laskowski then asked about the doors. Mr. Oxian stated that replacement of storm
doors should be part of Mr. Laskowski's COA application.
Mr. Oxian continued the list of disputed items. Also included were building out
of gable and installation of a half -round louver, treatment of the center window
• in the front facade second story and changes in the dimensions of the sidewalks.
Ms. DeRose stated that the primary resWsibility of the HPC was to the historic
nature of the homes in each district and not an overriding concern for safety.
Mr. Oxian began a discussion of the front porch. Mr. Laskowski maintained his
safety concerns as well as matters of liability. Discussion ensued concerning
the front porch.
Mr. Oxian offered the applicant a hearing before the HDC. Ms. DeRose stated that
the HPC could also deny the petition. Mr. Oxian said he preferred for the HDC to
hear the remaining proposals. Mrs. Hostetler requested original photographs. Mr.
Frederick replied that the photos in question were Mr. Laskowski's. Mr. Laskowski
then said he would provide the HPC with the original photos if that were possible.
Mr. Oxian cited remaining areas of disagreement and asked Mr. Laskowski if he
desired a hearing with the HDC or an up/down vote tonight. Mr. Oxian made clear
the HDC meeting would depend on the applicant signing a waiver. Mr. Laskowski
responded that if the HPC did not approve his plan in total he wished to register
his disapproval. Mrs. Choitz detailed the HPC's committment to saving the house
from unwarranted damage and referred each area of disagreement to the HDC.
Mr. Oxian continued with the rest of the agenda.

Mr. Oxian asked about the code enforcement situation within LHDs.
Ms. DeRose then asked about the specific nature of the request from the Dept.
of Code Enforcement. Mrs. Choitz asked about the singling out of a substandard
property among a group of the same. Discussion ensued. Mr. Oxian read a letter
from Kathy Dempsey concerning a property on Arch Avenue in the Edgewater Place
LHD. Ms. DeRose said that properly the HPC should target substandard houses within
a LHD and send reports to Code Enforcement for further action. Ms. DeRose and Mrs.
Choitz agreed that the HPC and Code Enforcement should act in concert. Ms. DeRose
asked that the HPC upon receipt of an itemized list of repairs for a property send
Code Enforcement a separate report from our Standards and Maintenance Committee.

Mr. Oxian directed the commission back to the matter of 615/617 Riverside Drive.
Mr. Laskowski exhibits letter from Jerry Gray of Wickes (Lumber) saying that
replacement windows will not effect the existing window trim. Discussion ensued.
Mrs. Petrass moved to allow replacement windows provided that all trim remain
intact painted wood. Mr. Wiener seconded the motion. Mrs. Hostetler asked about
the HPC's right to impose a time limit on the project. Ms. DeRose responded in the
negative. The motion was passed unanimously.
Discussion ensued concerning remaining areas of disagreement. Mrs. Choitz indicated
that the piers and steps of the porch should be of a piece. Mr. Laskowski stated
the porch columns would be an in-kind replacement of wood for wood. Mr. Wiener
moved to allow the replacement of the porch columns provided it was an in-kind
replacement, wood for wood. Mrs. Petrass seconded the motion. No discussion. The
motion passed unanimously.
Mr. Laskowski repeated his concerns about the front porch. Mr. Oxian responded
that the porch would be referred to the HDC. Mr. Oxian asked Mr. Laskowski to
sign the waiver. Mr. Laskowski stated that he was tired and asked if he "could
come in tommorrow and take care of this?" Mr. Oxian responded in the affirmative.
Mr. Frederick repeated the approvals granted during the meeting and stated the
remaining areas of disagreement to be heard by the HDC. These included: stucco,
fasciae and soffits, center window second story front facade, porch railing, porch
piers and steps, bead board in porch ceiling, gable build out and half -round louver,
metal front door and any change in sidewalk dimensions.
Mry.Wihncr: then moved that the HDC would hear Mr. Laskowski's final proposal
and that the HDC would make a final ruling on the matter. Mrs.,;Hos.tetler-,seednded
the motion. No further discussion. The motion passed unanimously.

• MEMORANDUM: Riverbend LHD Standards September 13, 1993
To all members of the Historic Preservation Commission
The Riverbend LHD Standards Committee mailed out Standards ballots to forty-two
(42) homeowners in the district. On September 9, 1993 Commissioners Choitz and
Petrass counted the ballots that had been received by the due date of August 13,
1993. The results were as follows: fourteen (14) in favor; four (4) opposed.
Twenty-four ballots were not returned, as stated non receipt of ballot constituted
approval. The Riverbend LHD Standards were approved.

STATEMENT OF SIGNIFICANCE/HISTORIC CONTEXT
The house at 1228 E. Wayne St. (N) is a Colonial Revival residence built in
1927. The house received a contributing rating of C/9 on the Indiana Historic
Sites and Structures Inventory. The home was in good condition at the time of
the survey and alterations were considered minor, they included the installation
of aluminum storm doors and windows.
PROPOSED CHANGE
The applicant proposes the replacement of a 42" high French Gothic Picket fence
which runs along the west lot line with a privacy fence (French Gothic Panel)
that is 6' high. The new fence will be painted white as was it's predecessor.
Each of the fences referred to are wooden.
STANDARDS
Concerning fences the standards state: ... fencing ... shall be compatible with
the character of the neighborhood in size, scale, material and color. page 18-19
I.A.I.
RECOMMENDATION
The HPC staff recommends for this proposal. The applicant's proposal calls for
the replacement of a fence with another that maintains the same stylistic elements.
The applicant wishes to provide additional privacy and security for his family
as well as their dog. The applicant's neighbor to the east has previously installed
a 6' privacy fence.
