MINUTES OF THE REGULAR MONTHLY MEETING
OF THE
HISTORIC PRESERVATION COMMISSION

I. Call to Order
The meeting was called to order at 7:30 p.m.
II. Roll Call

III. Public Hearing
A. Certificates of Appropriateness.
1. 1716 E. Wayne--LHD
Mr. Pastor reported that a C of A committee had met
August 29. The owner, Susan Metzger, had submitted
an application for installing a Schuell San Fernando
style fence. Mr. Pastor passed around photos of
the fence. The committee's recommendation, he said,
was to approve the fence pending removal of the two
front -most bays; the gate was to be moved back to
the rear corner of the east facade.
Ms. Metzger then stated her case. She said she had
reviewed the guidelines carefully and noted a
reference which allowed fences to be constructed
provided they didn't extend beyond the front line
of the house. She cited p. 43 of the guidelines,
saying the opening paragraph omitted mention of
structures as minor as fences. She had concluded
that building the fence was therefore permissible
without applying for a C of A. She further stated
that the reason the fence was so positioned was so
that she could let her dogs in and out without
going outside herself.
Mr. Oxian asked Mrs. DeRose for a legal opinion.
She said the fence was, indeed, a major exterior
change and said the real question now was whether
or not removing the fence would be a hardship to
the owner.
Mr. Oxian said the HPC interpreted a fence as a
major exterior change. Further discussion
established that, while the fence did not violate
setback standards, it was still objectionable on
the general grounds that it was visible from the
street and not compatible with the neighborhood.
Mrs. Choitz emphasized that her objection was to
the gate, not the fence. The gate, she said, is
visible from the street and changes the character
of the neighborhood.
Mrs. DeRose advised the HPC that the position of the
fence was legal and the owner could not be compelled
to move it. The job of the commission, then, was to
determine whether or not the fence was compatible.
Mr. Herendeen moved to give the owner the authoritv
to put up the fence as -is. provided she aqreed to
replace the qate.
Mrs. Sporleder moved to table the issue of the qate
and have the owner brinq in proposals for a new
stvle of qate.
Ms. Metzger expressed satisfaction with the decision
and asked commissioners for the names of suppliers
of gates.
2. 1421 E. Wayne--LHD
Mr. Pastor reported that the owner, Mrs. Toal,
wished to replace the deteriorated casement
windows in her sunporch with larger Pella 8/12
double hung sashes. He cited standards 3-C 1-3
and said he considered the windows inappropriate.
Sill levels would have to be dropped 11", and the
large window would require in -filling.
Mr. Pastor distributed drawings of the proposal.
Mrs. Toal stated that she'd researched the problem
of window replacement and was acting on the advice
of a contractor, Bob Dunfee, whom she trusted.
Her goals were to let more light filter into the
house and to try to echo the long, narrow style of
the windows on the main facade.
Some question arose as to whether the sunporch was
original. Mr. Pastor said research had revealed
that the sunporch was original and was typical of
E. Wayne sunporches of the 1920's.
Mr. Herendeen asked the owner if she was opposed
to using casement windows. Mrs. Toal said she
wanted double hung sashes because they could be
shuttered and casements could not. She needed
shutters to protect her furniture from sun damage.
Mr. Herendeen named alternate suppliers of windows
and cast doubt on whether Pella was the best
supplier. Mrs. Toal said she liked Pella windows
because she'd used them on the house already and
liked the way they looked.
Mrs. Sporleder suggested going back to the
drawing -board to try to fit new windows into
the existing openings. She argues that keeping
the original openings was cheaper, simpler, and
less destructive.
Mr. Herendeen suggested forming a committee.
Mr. Oxian appointed Mrs. Sporleder,
Mr. Herendeen, Mrs. Choitz, and Mr. Eide to
review alternatives and make a decision.
Mr. Pastor said he'd already contacted
Colby & Colby, a firm with a good record for
supplying historically appropriate windows.
Mr. Herendeen moved to approve a committee
meeting, adding that it should take place
that week. Mrs. Choitz seconded.
Mrs. Toal invited the committee to come view
her house so they could more clearly
understand the problem. Mr. Herendeen
agreed to do so. Mr. Oxian asked Mrs. Toal
to attend next month's meeting to hear the
committee's recommendation.
3. 1231 E. Wayne North--LHD.
Mr. Pastor reported that the owner wished to put a
rear addition on the house. He said
new plans, superior to the plans previously
submitted, had arrived that day. These he
distributed.
Contractor Terry Beaver was present to answer
questions and to represent the owner,
Mr. Randy Claywell. Mr. Pastor said the new
plans had more discernible architectural
style. Mrs. Choitz noted that the addition
would not be visible from the street.
Mr. Beaver said cedar siding had been chosen
instead of vinyl.
Mrs. Sporleder questioned the compatibility of
the addition's large banks of windows, and
suggested further study. Mr. Herendeen
moved to table the motion and turn the problem
over to the C of A committee. Mrs. Petrass
seconded the motion.
IV. Regular Business.
A. Approval of Minutes --Aug. 19, 1991 and Sept 16, 1991.
Mr. Oxian cited two corrections for the September
minutes and two for the August minutes. To the
September minutes he wanted to add the appointment
of Mr. Fred Holycross to the Directorship and the
rehiring of Surveyor Suzanne Booker. In the August
minutes, he wanted it clarified that Todd Zeiger did
not initiate the formation of the proposed Monroe Park
Historic District, but merely proposed to expand the
district's borders. Mr. Oxian also said that Center
City Associates and Redevelopment, not Area Plan, were
supporting the HPC in this venture.
B. Treasurer's Report --September 1991.
Mrs. Choitz moved to approve the Treasurer's Report
as sent; Mr. Newburn seconded.
C. Correspondence
To the list of correspondence Mr. Holycross added a
new item --an Indianapolis conference on preservation
law --which he felt to be of particular interest.
The cost of the conference was $95/person. Several
Commission members expressed interest in attending;
Mr. Holycross said he'd like to attend, but cautioned
that the conference budget was getting low.
Mr. Herendeen suggested leaving the decision
to Mr. Oxian.
D. Committee Reports.
1. Certificates of Appropriateness.
a. 1205 E. Wayne--LHD.
Mr. Pastor reported that the owners were doing
only in-kind repair; the owner planned to
replace existing windows with the original
windows. He said he felt a Certificate of
Appropriateness was not needed, especially
since it was the owners' expressed intention
to restore and preserve the historical
character of the house.
b. 1341 E. Wayne--LHD.
Mr. Pastor reported that the owner wished
to link the house to the garage. This was
approved provided it did not become a
precedent in the neighborhood. The owner
had agreed to use natural building materials.
c. 1346 Lincolnway East--LHD.
Mr. Pastor reported that the committee had
reviewed a proposal to vinyl -side the rear of
the house and to replace the back doors with
compatible metal doors. The Committee
recommended searching for doors that matched
the original doors as closely as possible.
Mr. Eide had visited the site two weeks before
to consult with the contractor about the trim
profile.
2. Budget and Finance.
No report.
3. Legal.
Mrs. DeRose updated the commissioners on the
status of the maintenance standards ordinance.
She said the standards themselves were good,
but possibly unenforceable. She questioned the
feasibility of giving the HPC the same powers
as the Building Department. She further stated
that without enforcement, maintenance standards
are not much use.
4. Historic Districts.
a. Monroe Park--PLHD
Mr. Holycross distributed maps of, and a list
of his opinions about, the proposed district
and voiced some doubts about feasibility.
He cited the prevalence of absentee owners,
saying it would be hard to gain support from
such owners.
Mr. Oxian explained that, due to a 1989
amendment to the ordinance (see Appendix C)
a 51% majority was not required. He urged
quick action to save the district.
Mr. Holycross requested a copy of the
amended ordinance, and asked what the staff
might do to expedite matters. Mr. Oxian
suggested contacting owners and inviting
them to HPC meetings.
Mr. Holycross asked for 2 months to conduct
basic research. Mr. Oxian agreed, and set
the first reading for December. There were
no objections.
5. Historic Landmarks
a. Darden Bridge
Mr. Holycross described a Department of the
Interior program he was investigating,
"the Highway and Bridge Replacement and
Rehabilitation Program," whereby the Federal
Government paid 80% of rehabilitation costs.
At present, he said, he was trying to contact
the appropriate persons.
6. Public Relations and Community Education
No report.
7. Personnel
Mr. Holycross said he had found a candidate,
Sushmita Hodges, for the research assistant
position. She was selected from a field of
five finalists after two weeks of taking
applications and one day of interviews. Among
her credentials were four degrees in history,
including a Ph.D.
Mr. Welsheimer moved to approve the candidate;
Mr. Herendeen seconded the motion.
8. Staff Reports.
a. Bi -monthly Report.
No discussion.
V. Old Business
No report.
VI. New Business
1. Mr. Herendeen reported seeing a new fence --a very
fine one --around 11518 Adams, a county landmark. He
questioned whether a Certificate of Appropriateness had
been sought for this fence.
Mrs. DeRose advised sending a letter informing the
owner that he had violated C of A procedures. Mr.
Holycross agreed to take care of the matter.
2. Grants --1991-92, 1992-93.
See Appendix C.
3. Data Entry Project.
Mr. Pastor gave Mr. Oxian four sealed bids from data
processing companies; Mr. Oxian publicly read them.
They were:
Computer Associates: $500.00
ESAE: $1,428
On -Line Data: $805.00
S & G Business Associates: $1,100.00
Mrs. Choitz suggested consulting a computer expert to
to determine the quality of the services offered by
each company. Mr. Holycross reported that $500.00 was
the amount available for the project and that he had
justified the expense to the state office by citing
the moneys left over from the temporary absence of a
research assistant.
Mrs. Choitz moved to have the staff review these bids.
Mr. Newburn seconded the motion.
4. Plaques
Mrs. Choitz criticized the letters offering landmark
plaques for sale recently sent out to city landmark
owners. She said the letters failed to adequately
describe the plaques, or to mention the price.
Mr. Holycross explained that since only 11 plaques
were now available, the price was uncertain. The
letters were an attempt to gauge the owners' interest
in landmark plaques. He reported a total of 9
responses to date.

Mr. Newburn moved to adjourn; Mr. Herendeen seconded the
motion. The meeting was adjourned at 9:40 p.m.
As you know we are currently in the 1991-1992 Grant period. We
are working on the final part --Phase 6 --of the South Bend Sites
and Structures Inventory for the Division of Historic
Preservation and Archaeology. We were granted $26,600.00 for this
grant period with which -to finish the project of survey update
begun in 1980.
The State office.is quite adamant that we finish this final part
of the city survey. They have expended over $100,000.00 since
1976 and feel that the survey should and could have been
accomplished in much less time. In fact, we were turned down for
another grant ($11,000) -for -the -91-92 period because they feel
that finishing the survey is a priority.
We wi_l.l, finish the survey here by the end of the grant period,
June, 1992. I'am now writing a grant for the next
period --1992-1993. This grant will be to take the next expected
step in the survey process --that is to compile and publish a
Summary Report for the City of South Bend.
The Summary Report project will require the retention of the
position of Administrative Assistant and one Research Assistant.
No Surveyors will be needed. With our approximately $16,500 match
funds --$12,500 from the Community Development Block Grant and up
to $4000.00 from the County.General funds devoted to
supplies --and an estimated $8500 in Director's salary as a match
(at app. 20 hrs./week), we can ask for up to $25,000 from the
funds available through the Division of H.P%Arch.
Current estimates of the total cost of the project are around
$46,000, so we can manage with our match monies. -
Update on West Washington national Register District extension.
We have run into a problem --our application has now been turned
down twice in the first phase of.review--Technical Review. We can
only be reviewed in this phase three times before the application
has to be begun again.
There are along list of problems with the application as
submitted --including: Resource Count, Descriptions, Statement of
Significance, the bibliography, verbal boundary description, the
maps,, photographs, etc. It is in a word --muddled. Also, this
project is quite late --it was supposed to'be completed by the end
of June, 1991. We have received grant monies (1990-1991 grant
period) with which to accomplish the project --those monies have
by now been expended.
This nomination is in jeopardy. As soon as possible I will begin
the process of reviewing the application and trying to remedy the
problems. As the application must later pass through historical
review --I will also make an effort to identify and remedy any
potential problems there. I am in close touch with the State
office on this. I will update the Commission at the next meeting.
Our financial reality in relation to grants is that we have only
approximately $16,500 in matching monies with which to.apply for
grants. We can also match any of the Directors time spent on the
project, according to the "hourly" rate paid by the County. Since
the Summary Report project can only be funded by a 50/50 match
between federal monies and local monies, we -are only able to
pursue this single .project in that fiscal year.

• Monroe Park Area studied for historic district designation.
• Bids sought for data entry of original survey manual.
• Preliminary survey complete for Phase 6 of the city resurvey
(last phase of the city resurvey). Basic information entered
into data base to generate address lists.
• Intensive fieldwork for Phase 6 well underway.
• Certificate of Appropriateness information entered into
computer database.
• On going correction and sorting of information from Phases IV
and V of city resurvey.
• Residual typing and site plan drawing of Phase III survey
* Lori Dixon resigned as director.

* C/10 research on quadrants from Phase V of city resurvey.
• Attendance of I.U. Cornelius O'brien Conference on Historic
Preservation, October 4-5, 1991, in Richmond, Indiana.

• Meeting with PTO board for Jefferson Elementary School to make
presentation on Local Landmark and National Register status,
available rehabilitation grants, and other possible action
needed to preserve the school.
