Thank you. 6ZI i MINUTES OF THE HISTORIC PRESERVATION COMMISSION County Council Caucus Room (411) County/City Building July 15; 1991 7:30 p.m. I. Call to Order The meeting was called to order at 7:35 p.m. II. Roll Call Members Present: John Oxian, Bill Welsheimer, Odell Newburn, Jed Eide, Joanne Sporleder, Janeanne Petrass, Jean Dennen, Aladean DeRose - City Attorney, Jim Pastor - Survey Manager, Lori Dixon - Director. Members Absent: Martha Choitz, Herb.Herendeen. Others Present: Barbara Steele - Southhold Restorations. III. Public Hearing A. Certificate of Appropriateness 1. Mr. Pastor reported that the owners of the property had revised their plans from those submitted at the June 1991 meeting. The contractor for the project presented a revised plan for the rear addition originally proposed to the Commission. The revision moved the west wall of the addition to a line even with the west side of the existing home, rather than extending behind the side porch. Mrs. Sporleder moved to accept the revised Plans as appropriate: Mr. Welsheimer seconded. Motion approved. IV. Regular Business A. Approval of Minutes - June 17, 1991 Mr. Oxian requested that all additions and correction to the minutes by listed in the minutes of the meeting when corrected. Mr. Newburn moved to accept the minutes as corrected: Mrs. Sporleder seconded. Motion approved. (Director's Note: listing of corrections will begin with minutes of August 1991 meeting, or next meeting where corrections are requested.) B. Treasurer's Report - June 1991 Mr. Newburn moved to accept the treasurer's report as submitted: Mr. Welsheimer seconded. Motion approved. C. Correspondence Mrs. Dixon submitted the correspondence for review by the Commission. July 1991, p.2 D. Committee Reports 1. Certificates of Appropriateness Mr. Pastor reported on staff -approved C. of A.s: a. 1154 Lincolnway East Two certificates were approved for this property. (1) Pour a concrete slab drive with a drywell underneath to replace a dirt drive. (2) Trim trees encroaching on the carriage house and main house. b. 1341 E. Wayne Owner proposes to replace his old asbestos and asphalt shingles (mixed) on the roof with uniform 3 -in -1 tab asphalt shingles on main roof and garage roof. C. 1417 E. Wayne (Rockne House) Replacement of steel casement windows. Commission requested that Mr. Pastor provide a list of manufacturers that make steel casement windows and inquire if the new windows are similar to the old. d. Disclaimer Ms. DeRose stated that she would review the current standard C. of A. application form and add a written disclaimer which will state "homeowners may need additional permits to make improvements to home structure". 2. Budget & Finance a. Mrs. Dixon elaborated on the budget and graph included in the Commission members' packets. The Commission requested that Mrs. Dixon contact John Lentz, Deputy County Auditor, about the county budget and contact Mr. Larrison, President of Board of County Commissioners, about budget notices. 3. Legal a. Mrs. DeRose spoke on the difference between HPC and Code Enforcement standards which would present a conflict in writing maintenance standards for the Commission. 1. The HPC standards are too lenient and do not include health risks, therefore, the standards would take low priority in the offices of Code Enforcement. July 1991, p.3 2. The standards need to show that an inspection has been done to support violation. Code does not have the manpower to inspect historical sites, nor are the inspectors trained for architectural inspection. 3. Code Enforcement cannot enforce the "civil forfeiture" in maintenance violations as previously stated, because their civil forfeiture penalties constitute a "taking of property" without due process. Code Enforcement's remedies cannot be used to enforce maintenance standards imposed by HPC. Mrs. DeRose suggested that the Commission adopt maintenance standards and use internal processes to enforce them. Standards should be made concrete, specific, and as clear as possible. 4. Historic Districts a. Monroe Park - Potential LHD Mr. Pastor mailed out the requested maps of the area covered under the potential historic district. The Commission discussed the types of districts available and feasible for the area. Mrs. Sporleder suggested that it cover as large an area as possible and then make the appropriate standards to accommodate the various building and zoning applications. b. Chapin Park National Register District Mr. Pastor reported that residents have called and expressed their concern about Memorial Hospital's proposed expansion and what effects, if any, it will have on the neighborhood. Mr. Pastor and Mr. Oxian led a discussion of the situation and, in turn, Mr. Oxian stated that he had spoken with Mr. Ted Foti, Vice President of Corporate Development at Memorial at a recent public meeting on the topic. Mr. Foti, according to Mr. Oxian, stated that Memorial would be responsible for all moving expenses incurred by the residents. If the residents choose not to sell, the process of eminent domain (governmental rights to take private property for public use) can July 1991, p.4 be used by the hospital. Mr. Oxian requested that Mr. Pastor talk to the residents individually about their interest in an historic district. If they are interested, then Mr. Pastor should start immediate proceedings to include the YWCA and Madison School in the district proposal. 5. Historic Landmarks a. Colfax Theatre Mrs. Dixon reported that the HPC received correspondence from Southhold Restorations regarding the Colfax Theatre and the Southern Hotel. Barbara Steele, Director of Southhold, was present to elaborate. Mr. Oxian suggested that Mrs. Dixon put together a financial redevelopment package in support of the Colfax Theatre and Southern Hotel, as well as for general use. 6. Public Relations & Community Education No Response 7. Personnel a. Resignation of Secretary Mrs. Comer submitted resignation to the Commission and will terminate her services on July 31, 1991. b. Restructuring of Staff In light of current grant situation, Mr. Pastor made several proposals regarding the restructuring of positions for efficient operation with reduced staff. The Commission determined that the current research assistants would assist in surveying, while the present surveyor would combine her work efforts in the field with clerical and data entry work. Mr. Pastor also noted that the Commission had received an automobile as promised by the City. 8. Staff Reports Mrs. Dixon attended a meeting in Indianapolis in the month of June concerning grants and certified local governments. V. Old Business A. West Washington Historic District Nomination July 1991, p.5 The West Washington Historic District nomination is on hold until the State Review Board meets again in October. On Thursday, July 18, 1991, Mrs. Dixon met with residents of the district to discuss the nomination. In the latter part of the summer Mrs. Dixon will mail out a letter of legal description to all persons living within the boundaries of the extension. VI. New Business No Response. VII. JUNE 9-220 1991 (70.HRS. @ $6.25/HR.) 48925 437.50 7919.31 To clarify our funding sources for any and all of you who might be a bit confused or concerned, I have produced two pie charts; one for 1991 and one for 1992 (based on estimated grant receipts and expenditures). A note of explanation regarding the charts and their labels: "DHPA" is the Division of Historic Preservation and Archaeology ("the State Office") which administers our federal grants. "CDBG" is Community Development Block Grant, administered by South Bend's Redevelopment Commission --this is the only money we receive from the City. The dollar amounts corresponding with these portions of the graphs are as follows: 1991 Budget 1992 Budget DHPA $35,168 total DHPA $25,800 estimated CDBG $13,650 CDBG $13,650 estimated County $ 4. 00-0* _ County $_ 4.,_000 estimated* Total $52,818 Total $43,450 estimated *The County budget actually shows $38,1b0 in our line item, but only $4,000 of that is for non -grant operating expenses (memberships, travel, office supplies, etc.). The remainder is to be used for grant expenditures until the reimbursement is received from the City or the State. 1991 expenditures are as follows: That money which has already been expended (as of 6/30/91): DHPA 3rd Quarter $ 7,913 federal ($13,223 total) DHPA 4th Quarter $14,055 federal ($24,515 total)estimate CDBG $ 2,822 County $27,735* *of this amount, $1,198 was used for non -grant expenditures. The remaining $26,537 is for personnel and grant supplies which have been claimed or will be claimed before July 31, 1991. The MPC has returned to the County, since January 1, 1991, $14,651.19 in reimbursement checks from our grants. of that, $11,828.71 was originally expended in 1990 and $2,822.48 is reimbursement for 1991 expenses. All of this money has been quietused into the County General Account, but not specifically into our line item. This is the manner in which I was instructed to make the quietus for reimbursement checks. Estimated expenses, July 1 -December 31, 1991 DHPA $13,300 (half of federal grant for 1991- 1992) CDBG $10,828 (remainder of allocation for 1991 ) The County has agreed to appropriate an additional 26,600 to our account to cover the federal portion of our new grant until it is reimbursed (13,300 to be appropriated this year) Estimates for funding for the 1992 budget. DHPA January -June, 1992 $13,300 (finish 1991-92 grant) DHPA July -December 1992 $12,500 (based on maximum possible federal allocation for 1992-93 of $25,000, assuming that half would be expended in the first six months.) CDBG $13,650 based on conversation with Redevelopment. They estimate that the current funding level is likely and, if reduced, it would probably be no greater than a 3%-5a reduction ($410-$683). County $38,100 Again, from this, $4,000 is expected to cover non -grant operating expenses. The remainder is to cover grant expenditures (with the CDBG funds serving as match for the DHPA funds) until we are reimbursed. Reimbursement checks return to the County. i A. B. C. D. E. F. G. H. I.
