President, Historic
Preservation Commission

Dear Mr. Oxian:
At the last meeting of the South Bend Historic Preservation
Commission, you gave me a draft of "Certificate of Appropriateness
Procedures." I have had a chance to review them carefully, and I have
also reviewed carefully general law concerning historic preservation.
I have expanded the procedures considerably as you will notice
from the enclosed draft.
Although most of these things are not mentioned in the current
preservation plan for the City of South Bend, they are typical of
procedures governing historic commissions in other areas, and they do
conform to the purpose, intent, and statutory authority for local
historic preservation commissions in the State of Indiana.
To adopt these procedures would be, I think, a substantial
undertaking on the part of the Commission. For this reason, they
should be reviewed quite carefully by you and by all members of the
Commission before they are enacted.
You will note that in Section VI(D), I have not inserted any
notice requirements for public hearings. I do not know what your
procedure has been in the past. However, that past procedure can be
used and codified on this particular section.
Please feel free to call if you have any questions about this.
