Honorable Board Members:
It has been brought to our attention that the Board of Zoning Appeals will
review an appeal by John Friedline for the property at 319 N. William/
406 W. Madison which requests subdivision of the parcel into two distinct
lots of 8mallo-et-,th6Lii4(Averagei size. It was the Commission's belief that the
lot had already beensubdivided in 1989. I am enclosing a letter written by
our past president, Joann Sporleder, which discusses this subdivision and
the continuing landmark status on both buidings and their grounds.
The commission is not in favor of subdividing the property because such a
division may alter the integrity of the parcel as a local landmark. If the
property is subdivided, the Commission will need to review any requests for
zoning variances on either property prior to approval from the BZA. Otherwise,
local landmark standards (Group B) apply to both parcels for any exterior
or landscape changes.

Honorable Board Members:
It has been brought to our attention that the Board of Zoning Appeals will
review Appeal #3404 for the property at 319 N. William/406 W. Madison which
requests subdivision of the parcel. This letter presents information to
clarify the historic status of the property.
'This property was designated as a local landmark by the Common Council on
November 4, 1975. The house, built in 1855, is extremely significant as
one of the oldest extant houses in South Bend and as one of the few houses
designed in the Federal Style. The original band -hewn beams are still
visible in the basement. 'The commnercial building, built in the Late lath
century, is historically an integral part of the property.
The landmark status in which exterior changes to the buildings and grounds
are reviewed through the Certificate of Appropriateness process will continue
on both buildings and their grounds pursuant to the original designating
ordinance.

Dear Board Members:
Regarding our letter of September 6, it was our impression from the petition
filed by Mr. Friedline that the property had yet to be subdivided. We
have since been informed that the property in question at 319 N. William/
406 W. Madison was subdivided a year or so ago and that the petitioner
is simply filing for separate key numbers. The Historic Preservation
Commission has no objection to separate key numbers, providing that both
parties abide by the landmark standards. While the Commission does not
favor the subdivision of historic properties, it is sometimes necessary
in the course of land management to do so. Since this property has already
been subdivided in all but legal key number, the Historic Preservation
Commission will not stand in the way of designating these properties two
distinct entities and will adjust its landmark files to accommodate such
a division upon approval of the petitioner's request by the BZA.
I hope this letter clears up any confusion from our September 6th correspondence.

The meeting was called to order at 7:37 p.m.

III. Public Hearing
A. Certificates of Appropriateness
1. 1216 E. Wayne St. North --EW
Mrs. Dixon reported that the owner proposed
to install a picket fence of red cedar, 42"
tall, in the back yard by the garage area.
The fence would not come up to the setback
of the house. After some discussion
regarding the exact location of the fence,
Mr. Newburn moved to approve the fence as
indicated on the C. of A.; Mrs. Petrass
seconded. Motion approved.
2. 63907 Bremen Highway --LL
(Tabled from August meeting)
Mrs. Dixon introduced Mr. Gochenaur
(owner). Mr. Gochenaur submitted revised
drawings indicating the details and
dimensions of the new porch. The plan
followed recommendations made by the
commission (via drawings from Mr. Eide)
with the exception of the post style. The
posts are to be square at top and bottom
r with a turned section in the center. The
railing was set at 30".
Mr. Eide questioned the lack of opening in
the railing at the front entrance. Mr.
Gochenaur explained that the front door is

not used for entry to the house, as most
persons use the side door off of the
driveway (where the entrance is located on
the porch plan).
Mr. Gochenaur further stated that the
original porch wrapped around the front to
the south, but that remodeling done since
that porch was removed placed a chimney on
the south side, thus preventing the
construction of such a porch now.
Gochenaurs plan"oto install rectangular
lattice below the porch floor in front of
the foundation. Mr. Eide recommended that
Gochenaurs seek roofing shingles made
especially for flat or low-pitched roofs.
Mr. Eide further stated that he would
rather see the front opened to permit entry
from that direction. Mrs. Dennen asked if
there were steps leading up to the front
door. Mr. Gochenaur stated that brick
steps had been placed in front of the door
by a previous owner, but that they had been
replaced.
Mrs. Dennen asked if the shutters would be
hinged. Mr. Gochenaur replied that they
would not.
Mrs. Petrass stated that she would like to
see an entry onto the porch in the front.
Mr. Eide asked if the owners felt strongly
about keeping the porch enclosed across the
front, stating that the Commission was
thinking of the appearance from the street
and not the function of the front door as
the main entry. Mr. Gochenaur stated that
he did not feel that strongly about it.
Mr. Eide stated that it would look better
to have an opening in front.
Mr. Eide moved that the plan be approved,
recommending that the steps be retained in

IV. Regular Business
A. Minutes - August 20, 1990
Mr. Oxian made two corrections to the minutes.
Mr. Newburn moved to approve the minutes as
corrected; Mr. Eide seconded. Motion approved.

B. Treasurer's Report - August 1990
Mrs. Petrass moved to file the treasurer's report
for audit; Mrs. Dennen seconded; motion approved.
C. Correspondence
Mrs. Dixon submitted the correspondence for
review by the Commission.
D. Committee Reports
1. Certificates of Appropriateness
a. Mrs. Dixon submitted a draft of a new
Certificate of Appropriateness policy
to the Commission for their review.
The policy would be of greater detail
than existing policy. Mr. Oxian stated
that the adoption of this procedure
would be as an amendment to the
original procedure as stated in the
preservation plan book. He further
stated that we would want to look at
court cases which have been won or lost
because of a commission's adherence to
set policies and procedures. He stated
that he felt that this procedure was
better because it was more detailed
than the existing policy.
Mr. Eide stated that he would put his
comments in writing. Mrs. Dixon stated
that the Commission should review the
proposal and provide the staff with any
comments they wish to make before the
next meeting.
Ms. DeRose requested a copy of the
draft. Mrs. Dixon stated that she
would provide her with such.
Mrs. Petrass asked if the Commission
had a time frame on the current policy.
Mrs. Dixon stated that the Commission
is required to act within thirty days
from the application for a C. of A.
but the applicant did not have a
deadline for submitting an application
in order to be included on the agenda
of the next meeting.
Mr. Eide asked if the proposed policy
corresponded with the building permit
requirements in any way. Mrs. Dixon
stated that she believed the policy was
similar, but would check to be certain.

The proposal was tabled until the
October meeting to allow further input
from the Commission members.
2. Budget & Finance
No Report.
3. Legal
Ms. DeRose reported on a letter sent to
Commission members regarding the
Commission's liability for unsafe
structures. She stated that the Commission
is not liable for anything covered by
another agency of the city government
unless the Commission specifically makes
safety factors a condition.
She suggested that the Certificate of
Appropriateness contain a disclaimer to
back up this policy. If safety is made a
condition of the Certificate, then the
Commission is liable. The Commission must
make its decisions based on historic
authenticity, whether safety is a concern;
or not.
Mr. Herendeen moved to add a disclaimer to
the Certificates of Appropriateness stating
that the decision of the Commission in no
way indicates the project's compliance with
safety and code standards; Mrs. Dennen
seconded. Motion approved.
4. Historic Districts
a) East Wayne Trees
Mrs. Dennen and Mr. Eide stated that
the district would be getting
approximately forty trees through the
city's neighborhood grant. The trees
are to be planted in the treelawn.
5. Historic Landmarks
a) 723 Park Avenue
Mr. Oxian gave second reading on 723
Park Avenue. Mrs. Petrass moved to
approve granting landmark status; Mr.
Eide seconded. Motion approved.
6. Public Relations & Community Education

7. Personnel
a) Personnel Committee Meeting
Mrs. Dixon announced that the Personnel

Committee would be meeting the next
afternoon (9/18/90) and stated that she
would welcome the attendance of any
commission members.
b) Computer Training
Mrs. Dixon requested permission for Mr.
Pastor and herself to attend a training
session on the Q&A Database, which is
the software system purchased by the
Commission for its data filing system.
The price of the training is $129.95
per person, which Mrs. Dixon stated was
a bit steep, but worth the expense if
it allowed the staff to get more use
from the computer more quickly.
Mr. Newburn reminded the staff that
such an expenditure would be an in-line
transfer. Mr. Herendeen moved that the
staff be allowed to make that
expenditure and to attend the
conference; Mrs. Petrass seconded.
Motion approved.
8. Staff Reports
a. Permission to attend IU Conference
Mrs. Dixon requested permission to send
Mr. Pastor to the IU Preservation
Conference in Porter County on October
12 and 13. Mr. Oxian stated that if
approval was given, he wanted a written
report of the conference from Mr.
Pastor.
Mr. Newburn moved to approve sending
Mr. Pastor to the conference; Mr.
Herendeen seconded. Motion approved.
b. Magnetic Signs
Mr. Pastor requested permission to
purchase two sets of magnetic signs for
use on staff cars when performing their
duties for the Commission. He stated
that ID cards do not help much because
most people do not wish to ask the
staff what they are doing, or do not
believe the answer they get. Mrs.
Dixon stated that the Commission should
get two pairs of signs, to accommodate
both sides of two cars.
Mr. Pastor showed sample materials from
the company with the low bid. He
stated that the Commission name is too
long for use. It was suggested that
Historic Preservation Commission be
used, along with the phone number.
Mr. Herendeen recommended that the
Commission go with silk screening,
perhaps with the city and/or county
seal. Mr. Oxian suggested that the
staff check with the city sign
department to see if they have a silk
screen of the seal already on file.

a) Photo Processing
Mr. Pastor presented options on how the Commission
might handle its photo processing in the future.
He suggested that the Commission send the film to
Dill's Camera Shop for the processing of the film
to negatives, then contracting with Leigh Booker
(separately contracted from her current contract as
surveyor) to prepare the negatives and develop the
contact prints.
Mr. Herendeen asked about the archival stability of
the photo processing. Mr. Pastor stated that it
would be similar to those which have been processed
in the past, but that none of these is up to the
State standards, which recommend the use of fiber
paper for developing archivally stable prints. Mr.
Pastor stated that it would be more expensive to
have the prints made on fiber paper due to the
method of processing (roll drum).
Mr. Newburn suggested that the records be placed on
microfilm.
Mr. Pastor stated that he could check with camera
stores and other professionals to discern what
difference exists between the archival stability of
resin coated paper and that of fiber paper. If
there is little difference, the savings of the
proposed plan 3 (to have dills develop the film and
have Leigh Booker develop the prints from the
negatives) would be significant.

This proposal, when accepted

by written agreement of both Schuell Fence and the Purchaser. It is contingent upon delays due to strikes, fire, accidents and/or other causes beyond the control of the Seller.

2. This contract is payable in full upon invoice after substantial completion of this work to be performed by Schuell Fence Company pursuant to this contract. This is a cash sale and Purchaser has
no right to defer payment past the due date. The parties agree that, in the event Purchaser does not pay the balance to Seller when specified above. the delinquent amount shall BEAR INTEREST
OF 1112% PER MONTH (which is an annual percentage rate of 18%). Purchaser agrees he shall be liable for all court costs, Attorney's fees, and other expenses incurred by Schuell Fence Company
in the collection of any amount due it for work performed or material supplied persuant to this contract.
3. All proposals, including installation by the Seller. are made on the condition that the entire work be completed without interruption by the Purchaser. Any changes initiated by the Purchaser are
subject to additional charges.
4. Priorto commencement of performance by Seller pursuant to this contract. Purchaser shall furnish Seller with sufficient evidence as to the exact locations upon Purchaser's real property of all property
line stakes and grade stakes, as well as all underground lines and pipes including but not limited to all television cable lines, gas lines for grilling, barbecuing or other like purposes and such pipes or
lineswhich are used as part of an underground sprinkling system- Seller shall not be responsible or liable to Purchaser or anyone else for damages resulting from inaccurate information given Seller
by Purchaser as to the exact locations of such lines and pipes. Purchaser shall also indemnity and save Seller harmless from any liability of Seller resulting from such inaccurate information. Excepted
from this required information due Seller from Purchaser, is that information which is readily given by the various utility companies concerning the locations of ordinary and usual public utility lines such
as public telephone and public electric lines. Purchaser shall also be responsible for obtaining any public permits which may be applicable and hold Seller harmless for failure to obtain such.
5. Should it become necessary to drill rock, concrete or asphalt for the proper selling posts, to remove existing fence or buildings. to grade, to fill, or -to furni$hrextra lorge or deep footings for posts,
or if additional labor is required not covered in the above contract. the Purchaser agrees to pay for such extra expense involved. ,

PROPOSAL,.
The owner proposes to build a porch which would wrap around the
east (front) and north sides of the house. This petition was
tabled at the August 1990 meeting because the style of porch in
the drawings submitted by the owners was not in keeping with the
simple Italianate style of the house.
STANDARDS.
Additions to landmarks should not detract from the original form
and unity of the landmark and should not cover singular examples
of architectural detail. Additions to landmarks should be added
in a manner that does not disrupt the visible unity or overall
appearance of the site. The proportions, materials and rations
of the existing structures should be carried through i the
additions.
• All work should be done in the architectural style and in a
technique compatible with that of the origianl sturcture. Change
that alters, removes, or covers existing significant stylistic
detail shall not be permitted. A change which adds detail of
another style will not be permitted.
RECOMMENDAT_I.ONS_
Since the August meeting, the owners have been provided with
pictures, drawings, and written explanations of the
characteristic Italianate porch. The owners have expressed an
interest in utilizing the suggestions made by Mr. Eide, with a
few alterations in the post style. They are to submit drawings
in plan and elevation to the Commission for approval. The staff=
recommends that, if the posts and other architectural details
meet the criteria for the Italianate style, the project be
approved.

Comments on the Italianate house porch design:
COLUMNS
Square columns would be more in keeping with the Italianate style
than the turned Colonial style columns selected. The square columns
however, must have some ornamentation including capital brackets,
mouldings, routed (chamfered) corners, base, etc.
ENTABLATURE AND BRACKETING
The submitted design shows no beam or frieze area below the facia
board which gives a overly thin or flimsy appearance to the porch.
The lack of an entablature does not allow a place for brackets -
which are an essential element of the Italianate style.
In keeping with the simple detailing of the original house, we
recommend that the bracket design be kept simple.
RAILING
The railing shown is too high and disturbs the scale of the porch and
house. Subject to compliance with the building code, we recommend
that the overall height of the rail be no more than 2'-4" to 2'-6".
SHUTTERS
Most Italianate houses do not have shutters, and consideration should
be given to not installing shutters unless the original house had them.
If shutters are to be used, they must be sized and positioned so that
they have the appearance of original functioning shutters. The
shutters shown on the submitted elevation are too tall (they would
conflict with the hood moulding above the window), too narrow (they
would not cover the glass), and positioned too far from the -window
(resulting in a "pasted -on" appearance).

Computer Training
• Our new software is more complicated than anticipated. The
manuals are helpful, but do not answer some of our job -specific
questions. I have contacted the Tandy Business Center, which
sold us the software. They provide one -day training seminars
which last from 10AM to spm. Unfortunately, these seminars cost
$130.00 per person. We have significant funds in our budget to
cover the cost of such training for two staff members, as we have
not attended many conferences this year (nor do I see us
attending more than one or two).
While we are capable of reading the manual and implementing the
Processes described therein, we believe that hands on training
would speed up the process and allow us to utilize the full
capacity of the software sooner.

PHOTOGRAPHY Proposals for processing

1) Dills Camera
$9.37 per roll: $2.43 for negative development with a
processing time of one day, $5.95 for contact print with a
processing time of five days. An extra $.99 is added to sum
($9.37) for the extra contact print need per every six rolls
(a contact sheet is 8x10 and accomodates only 30 shots of a
typically 36 shot roll of film). Intermediate editing Job
by HPC staff required.
Resin -coated paper used: state guidelines require a more
archivally stable fiber base paper. However, all HPC
photographic records for the last five years appear to be on
resin -coated paper.
Payment will be by one purchase order.
2) Leigh Booker
0 $10.00 per roll
Contract to be separate from survey services contract, photo
processing work will not interfere with scheduled hours of
9:30 AM to 4:30 PM.
It is recommended that Ms. Booker- submit. a bi-monthly to
monthly report to update rest of HPC staff on progress Of
processing and other details associated with photographic
records. Amount for services rendered should also appear on
this report.
3) Negative processing: Dills @ a bid of 2.43/roll
Contact prints; Leigh Booker C a bid of $5.00%sheet: a
combined total of $7.43. It is recommended that Ms. Booker
submit a report as mentioned above.

MAGNETIC SIGNS for surveyors' autos

Purpose=
1) Safety for surveyors. Signs will affiliate surveyors with
organization; property owners in the neighborhoods being
resurveyed will be less likely to become suspicious; such
affiliation could also deter individuals with intentions of
harassing surveyors.
2)Public Relations. Signage will serve as a sort of
advertising mechanism, introducing the organization name into
public discourse.
