Call to Order The meeting was called to order at 7:37 p.m. II. Roll Call Members Present: Mr. Jed Eide, Mr. Herb Herendeen, Mrs. Martha Choitz, Mr. John Oxian, Mr. F. Jay Nimtz, Mr. James Pastor - Survey Manager, Mrs. Lori Dixon -Director, Ms. Aladeen DeRose-City Attorney's Representative. Others Present: Mr. Michael Blair, Ms. Cynthia Maravolo, Mr. Dean Maravolo, Mr. David R. Vaugh, Mr. Kevin Boughal- South Bend Tribune. Members Absent: Mr. Odell Newburn, Mrs. Jean Dennen, Mrs. Janeanne Petrass, Mrs. Joann Sporleder. III. Public Hearing A. Certificates of Appropriateness 1. 619 Edgewater Mrs. Dixon reported that the owner had been provided forms from the DNR for their permission -to install a pier. The resident requested some form of guideline for what type of structure would be permissible. Mr. Oxian recommended that the owner develop a plan for the structure, then present it to the Commission or a committee thereof. Then, the Commission would be backing the plan that he would submit to the DNR. Mrs. Choitz asked about the size intended by the resident. The resident stated that he would like to get into deeper water, and construct a pier and deck -like structure which would have a drawbridge so that uninvited persons could not obtain access to his boat and equipment, but he needs to find out how far into the waterway before he can design the pier. 10 Mrs. Dixon requested that the resident find out from the • DNR what dimensions they will permit, draft up a plan, and present it to the committee. The resident asked if he could have any size or materials approved by the DNR which would not be approved by the HPC. Mr. Oxian stated that we needed a plan to approve. Mr. Herendeen stated that no reasonable plan would be denied, but the- HPC: must, review it(,under the guidelines of the District. Mr. Blair (the resident) mentioned that he had requested that the owner (Kevin Smith) not proceed with the plans, approved by the HPC, to install a pipe railing along the top of the boat launch. Mr. Oxian stated that the reason a pipe railing was decided upon was that Mr. Smith originally did not want to install any type of barrier between the street level and the launch. He further stated that the Commission did not want a possible law suit if someone fell over the edge and hurt themselves on the launch which was approved by the HPC. A citizen asked what was to stop a citizen from falling anywhere along the shoreline. Mr. Oxian pointed out that the HPC has had nothing to do with any other shoreline in the district except for those which had b EP"'brought before the Commission for Certificates of Appropriateness. • Mr. Blair asked that if he planted a hedge or shrub of approximately 3ft., would that be acceptable. Mr. Oxian stated that the Commission had suggested shrubbery originally but the owner did not approve that suggestion. Mr. Herendeen suggested that the owner make a written proposal, complete with drawings, and the Commission will review it. 2. 615 Edgewater The owner requests permission to install a deck along the river bank, constructed of landscaping timbers, as per the drawings submitted. The plans include a retaining wall of the same material. The plan would fall with the lay of the land. Mr. Oxian discussed the plan with the owner, reviewing the drawing submitted. The shoreline would not change, according to the owner, but the retaining wall would be built up against the slope of the shore. Mr. Eide reviewed the drawing while Mrs. Choitz asked about protective barriers similar to those required of 619 Edgewater (see 1. above). The owner stated that they would be happy to continue whatever 619 Edgewater installs as a barrier. 0 tj Mr. Eide stated that if the drop is more than 30 inches, • some barrier must be installed of at least 42 inches. Ms. DeRose stated that the HPC's purpose is not to determine safety. Mr. Herendeen asked if the HPC could make a disclaimer regarding the safety of the project. Mr. Oxian stated that it is within the Commission's ordinance, it is stated that the Commission must take into account public safety and welfare. Mr. Eide made suggestions to the draftsman and owner of the property regarding changes to the plan which would make it more aesthetically pleasing and safer for the persons using it. These changes were incorporated into the plan. Mr. Oxian recommended that the HPC wait for DNR approval, but approve the deck in concept, with the alterations suggested by Mr. Eide. Mr. Herendeen moved that the deck be approved upod:.. the .dondTttion, . that the deck meets all safety requirements and DNR approval. Mrs. Choitz seconded Mr. Herendeen stated that if any of Mr. Eide's suggestions are varied from, the property owner is to notify the Commission. Motion approved. 3. 553 & 549 River Avenue Mrs. Dixon reported that the owners proposed to construct • a privacy fence between their two garages and recommended to the Commission that the application be approved. Mr. Nimtz moved that the application be approved as submitted. Mrs. Choitz seconded. Mr. Oxian asked how high the fence would be, and Mrs.. Dixon reported that it would be six feet tall. Motion approved. 4. 63907 Bremen Highway Mrs. Dixon reported that the owner's wanted to add a porch to the house. The porch will wrap around the north and east 'sides. Mrs. Dixon submitted the drawings of the porch, supplied by the owners, to the Commission for discussion. Mr. Oxian stated that he would like to know what the original porch looked like. Mr. Nimtz asked if the HPC had such a record. Mrs. Dixon read a former C. of A. stating that the former porch would be removed and replaced with a stoop. Realizing that the new owners were not aware of the structure's architectural past, Mr. Herendeed moved that the application be tabled and that the owners be notified of the Commission's decision (that the porch is not in keeping with the Italianate style of the house), and given guidelines, photographs, etc. from which to develop a new plan. Mrs. Choitz seconded. • Motion approved. Mrs. Dixon stated that she would explain the Commission's reasons for tabling the proposal and offer assistance in developing a new plan. IV. Regular Business A. Approval of Minutes --July 16,,1990 • Mr. Oxian asked that Part IV, D, 7, b be amended to state that Mr. Oxian was to speak with the Research Assistant and determine whether or not the letter submitted to the Executive Committee was, in fact, her letter of resignation. Mr. Nimtz moved to approve the minutes as amended. Mr. Herendeen seconded. Motion approved. B. Treasurers Report Mrs. Dixon stated that she would have a full budget report and grant projections later. Mr. Herendeen moved to approve. Mss:i(Choitz seconded. Motion approved. Mr. Nimtz asked why the HPC returned grant monies in the last year. Mrs. Dixon stated that the office was under -staffed thus leaving some of the monies allotted for personnel unexpended. C. Correspondence See Page 8 D. Committee Reports 1. Certificates of Appropriateness (Reports) .h. 405 W. Wayne Mrs. Dixon reported that the owners planned to install an air conditioning compressor along the side of • the house, toward the rear, not to be visible from the street. She spoke to Mr. Oxian about the project before approving it. b. 729 Cottage Grove The owner proposed to replace an aluminum garage door with a wooden tri -paneled door, for which staff approval was given. C. 509 Edgewater Dr. The owner proposed to replace roofing on the body of the house in-kind with 3 -in -1 shingles to match roofing on the porch. Proposals for new guttering and fencing were .tabled by the staff until further information was provided by the owner. d. 1425 E. Wayne The owner proposed to remove roofing and replace in-kind. Mr. Oxian approved the C. of A. while Mrs. Dixon was out of the office. e. 344 S. Sunnyside Mrs. Dixon reported that the owners proposed construction of a new fence behind shrubbery (at setback of house). This was also staff approved. • I,% 2. Budget & Finance • a. Community Development Block Grant Proposal Mrs. Dixon reported that, at the Commission's direction, she had turned in a proposal for $13,650 in grant funding from the city and that the Commission should hear something on it within the next two months. 3. Legal a. New City Attorney's representative. Aladean DeRose introduced herself as city attorney representative to the HPC. 4. Historic Districts No Report 5. Historic Landmarks a. 723 Park Avenue Mr. Oxian gave first reading on the landmark request. Mr. Oxian further reported -that the' -properties at 1533 Lincoln Way West and 119 LaPorte Ave. had been declared local landmarks at the last Common Council meeting. He also reported that the owners of the Cunningham House had filed forms for facade easement. Mr. Oxian met with the Auditor of the County and they sent the forms on to the state tax review board. 6. Public Relations and Community Education No Report 7. Personnel a. Report of Committee Meeting The Commission will be writing a proposal for an plc internship program. Mr. Oxian also stated that he would like to see better guidelines for writing histories of structures on the survey cards. 8. Staff Report a. Bi -Monthly Report Mrs. Dixon stated that the Bi -Monthly Report (see page 10) was brief due to the large amount of time spent finishing the grant. Mr. Pastor will be providing bi-monthly reports in the future. V. Old Business 1. Trees on Lincoln Way West Mr. Oxian reported that an ordinance would be sent to the County Council seeking landmark status for the twelve or so large oak trees along Lincoln Way West. 2. Trees on Edison Mr. Oxian reported that only two trees along Edison would be removed, rather than the nine as originally reported. Mrs. is Dixon reported that she has asked the architect on the project to supply the Commission with a letter designating which trees are to be removed. 1Z 3. Bricadx Stnreetl3wi i (-(i i ) <: i i 1 ( c :; i y , ( : .: ,J 1: Mr. Oxian reported that the c1ty sent a letter the the HPC • stating that no brick street exists under Edgewater Mr. Herendeen asked if the HPC could not take some kind of action to preserve Colfax Avenue before something happens to it. Mrs. Choitz suggested that the Commission take similar action as with the trees. 4(. Streetlights Mr. Eide asked about the Streetlight committee's recommendations. Mr. Oxian stated that he had been responsible for the delay in action of that committee. The Committee proposed specific, poles, fixtures, and bulbs. There was disagreement on tyre f'o means o4 financing, so the committee decided to submit their "recommendations for fixtures, etc. first, then submit a second proposal regarding financing. VI. South Bend, IN 46601 Dear Ms. Humphreys: At the recommendation of Jon Hunt, I am again writing to request funding for the Historic Preservation Commission within the city budget. As per your letter of February 1, 1990, I realize that the city has a very tight budget structure, but I would like to place our organization into the hat in the off chance that monies should become available as the 1991 budget process is reviewed. We will continue to apply for Community Development monies until we are notified that the city will be able to offer funding from its own budget. Thank you for your consideration of this matter. South Bend, IN 46601 Dear Mr. Leszczynski: I am writing in regard to the sewer replacement project on Edgewater Drive. It is our understanding from John Fisher that, if any bricks are under the existing pavement, it would be too costly to replace them under the new roadway. The Certificate of Appropriateness granted for the project stipulates that the brick is to be re -used under the roadway, or at least salvaged. We have heard rumors that the contractors will receive the brick for their use on other projects. This was not our intent in approving the original Certificate of Appropriateness. Therefore, we request, as has been the agreement between our two offices in the past, that the brick be salvaged and retained by the city for use in the repair of existing brick streets elsewhere in the city. We would appreciate a letter from your office acknowledging such an agreement or explaining why such an agreement is not possible. Thank you for your assistance and cooperation. Sincerely, r John H. St. Louis Blvd. South Bend, IN 46617 Dear Mr. Stevens: We have received reports from residents in our historic districts that the forester for the parks department has been granting permission to remove trees from areas within historic districts. Please ask your forester to keep in mind that property owners (and the city, on public lands) must obtain a Certificate of Appropriateness for any tree removal, even those which are obviously beyond saving. The purpose of such permits is two -fold: first, to retain a record of the plantings in the area, and second, to avoid any conflict between the commission and the residents. If residents are allowed to remove trees which are believed to be dead without a permit, we may soon have residents removing trees because only one branch is dead. If we required a permit of the second, but not the first scenario, the residents could claim that our decisions were arbitrary and unfair. Therefore, please remind your forester of the Certificate of Appropriateness policy. If you have any questions regarding the boundaries of our local historic districts, please contact our office. Part II: The owner also proposes of the boat landing, rather than previously requested. planting shrubbery along the top installing a railing, as was STANDARDS Environment: Recommended• If erosion control efforts become necessary to preserve the riverbank, they should involve processes and materials consistent with the natural beauty of the banks. The development of boat landings, access points, scenic overlooks or terraces should be done in such a way as to avoid obstructing the view of the river and its banks. Prohibited: In erosion control concrete, concrete unsightly material efforts to preserve the riverbank, poured slabs, concrete building blocks or other shall not be used. RECOMMENDATION The staff recommends that the owner be permitted to install the pier, pending approval of the state Department of Natural Resources (resident will be required to show proof of approval from DNR prior to receiving signed Certificate of Appropriateness). The staff further recommends that the owner be permitted to install shrubbery along the top of the boat launch, rather than the railing approved earlier, to provide a barrier between the street and the drop-off of the boat launch. This shrubbery should be no taller than three feet and shall be installed as soon as possible. • STAFF REPORT Cynthia Maravolo 615 Edgewater Dr. South Bend, IN 46618 PROPOSAL The owner proposes to construct a deck (see plan drawing) along the edge of the riverbank, using 4x4 landscaping timbers. STANDARDS Environment: Recommended: If erosion control efforts become necessary to preserve the riverbank, they should involve processes and materials consistent with the natural beauty of the banks. The development of boat landings, access points. scenic overlooks or terraces should be done in such a way as to avoid obstructing the view of the river and its banks. The owners of the'se two properties propose to construct a 6' privacy fence between their two garages along the alley. The materials used will be 6" wolmanized lumber, squared off at the top. STANDARDS: Recommended. New site work should be based upon actual knowledge of the past appearance of the property found in photographs, drawings and newspapers. New site work should also be appropriate to existing surrounding site elements in scale, type and appearance. RECOMMENDATIONS. The staff recommends that the property owners be permitted to construct the fence, upon meeting all requirements of the building department. Upon review of standards, permission was granted. 3. 509 Edgewater Dr. -- ED Property owner requested permission to replace roofing on the body of the house with a light green 3 -in -1 shingle, to match the porch roof. This is part I of a three-part c. of a. The other two parts will go before the Commission upon receipt by the staff of the appropriate information. 4. 1425 E. Wayne St. -- EW Property owner requested permission to replace roofing on house (three -tab asphalt) and replace in-kind. Mr. Oxian approved this in the director's absence. is 5. 344 S. Sunnyside -- EW New property owner requested permission to install 3 1/2' picket fence to the south, west, and north of the house in order to contain their dogs. The fence will, for the most part, be concealed by shrubbery along the south and west, but visible to the north.
