1. Call to Order
The meeting was called to order at 7:30 p.m.
2. Roll Call

3. Riverside Drive Liaison Committee
Ms. Kiemnec read a letter from Mr. J. Edward Talley (see Appendix A) requesting
a change in rules to allow a renter to serve on the Liaison Committee. The
Commission discussed the matter and referred it to the Legal Committee.
Mrs. Sporleder recommended that the neighborhood could go.ahead with their vote
for the Liaison Committee if they wished to.
4. Environmental Impact Statement
a. 16479 Brick Road
The Commission reviewed Mr. & Mrs. Marty Kleva's plans to develop the property
north of their landmark home at 16479 Brick Road. Mr. Newburn made a motion
to approve the plans for the new construction as presented provided that
neither the new house or the driveway for it come within eight feet of the
proposed property line for Lot 2. Considering that the legal description of
the property will be changed to exclude Lot 1, 3 & 4, the Commission did
not require specifications on the construction of the house. Mr. Oxian seconded,
motion passed.

Ms. Kiemnec distributed the new Historic District brochures.
Mr. Oxian made a motion to adjourn; Mr. Newburn seconded. The meeting was

..This letter shall place into writing, a request for change, regarding the
qualifications for membership, on'a Historic District Liaison Coxtmittee. The
specific area for which I am requesting a change concerns a member being a
property owner.

Due to the fact that the present election proceedures require a person to
be ,a property owner, I am'excluded from taking an active role in this local
historic district. Even though I have been nominated for the Liaison Committee,
I have been informed that because i am not an owner, I am ineligible to run.
Because I am not familier with the reasons for the restriction concerning
ownership, and in the event those reasons suggest a possible lank of interest on
the part of a 'renter', I submit a list of projects initiated and/or currently
in progress due to the interest and energy of this 'renter';

1 Based upon cx►nversations with south .Bend'Park officials, MAOOG and
South Bend Hoard of Public Works, a meeting was convened with
Riverside Drive. residents which resulted in our two ,petitions
concerning the fishing and park maintenance.
This meeting was attended by Historic Commission members
Mrs. Choitz, and Mr. Oxiam; Rebecca Carey of MAMG; Liz from the
office of Historic Preservation, and members of the Riverside Drive
Steering Committee.
2. Meeting with supervisors of the street lightingdepartment of Indiana
and Michigan which resulted in the correction of all outages of
street lamps on 'Riverside Drive.
3. Currently establishing a meeting with I &`M and Public Works, to
address the 'swapping' of street lamps from non -historic
areas, to specific historic areas, so as to make all lighting
conform within said historic districts.
This meeting is slated to include John Oxian, Mrs. Choitz,
Karen Kiemnec, Brian Crumlish and residents of this and other
local historic districts.
The same meeting will also address the establishment of a 'stockpile'
of older fixtures and parts so that replacements can be assured
in future years.,
4. Reporting our first violation of the guidelines. on Golden Avenue.,,,
5e initiating the re -erection of stop signs, etc., along Riverside
Drive.
6. Conducting a general clean-up of the historic district in,
co-operation with South Bend Code Enforcement, Salvation Army
and residents.
7. Monitoring the affects of these and other factors on the residents
of the district', and acting as information person with the ,
Near Northwest Neighborhood Association, as a member of their board,
for progress and activity reports from the new historic district.
it is obviously my desire to be eligible for the Liaison Ccmnittee, so I
respectfully submit this request to you.

6. Committee Reports
Mrs. Choitz made a motion to rearrange the order of the agenda in order to
accommodate visitors; Mr. Hayes seconded; motion passed.
a. Budget & Finance
Ms. Kiemnec reported that the Division of Community Development
has recommended funding in the amount of $7,000 for 1986 for the
HPC. The Commission's request was for $9,600.
b. Historic Districts
1) Riverside Drive
a. Review of Ratings
V'� The Commission discussed the reevaluation of ratings in
a, Riverside Drive. Mr. Nimtz made a motion to send the list
of ratings to the Liaison Committee for comment and to
complete the standards booklet without the list of
ratings; Mr. Hayes seconded; motion passed. The matter of
whether or not to notify owners in districts of rating
changes was sent to the Historic District Committee.
b. Liaison Committee
Mrs. Choitz announced the results of the Liaison Committee
Election in the Riverside Drive Historic District. The
residents who received the highest number of votes were
Mr. Richard Bennett, Ms. Violet Rohrer, and Mr. Brian
Crumlish.

Ms. Kiemnec read the Memo from Mrs. Schwartz regarding her
interpretation of the Riverside District Standards (see
Appendix A).
c. Riverside Standards Books
The Commission discussed the cost of the Riverside
Standards books. Mrs. Schwartz advised the Commission
that the charge must reflect the cost of producing the
publication and no more. Mr. Nimtz made a motion to
,Fwfigure the cost of printing the Standards book and round
it off to the nearest quarter to determine the price; Mr.
Oxian seconded; motion passed; Mr. Hayes voted nay.
2) Edgewater Place
a. Review of Standards
The Commission asked Ms. Kiemnec and the members of the
Commission from Edgewater Place to review the standards
and make a recommendation to the Historic District
0 Committee.
c. Historic Landmarks
1) Darden Bridge
Ms. Kiemnec reported that a grant to partially fund an
engineering study for the Darden Bridge was applied for. It
was the Preservation Services Fund of the National Trust for
Historic Preservation and a response should be received within
the week.
2) 504-508 East LaSalle - Second Reading
Ms. Kiemnec reported that the owner of J.C. Lauber was
contacted to see if he would agree to including the corner
building (502 E. LaSalle) in the landmark designation. He
consented. Mr. Oxian made a motion that the Commission
recommend 502, 504-508 East LaSalle to the Common Council for
landmark status; Mrs. Choitz seconded; motion passed.
3) 16479 Brick Road - Report and First Reading
Ms. Straw gave a report on 16479 Brick Road indicating that
the owners would like to have the legal description changed to
include only the property immediately surrounding the landmark

house and outbuildings (approximately one and a half acres,
see Appendix B). Mr. Oxian made a motion to accept the report
and to hold first reading on the amendment to the ordinance;
Mrs. Choitz seconded; motion passed.
4) (52060) Quince Road - Report
Ms. Straw gave a report on (52060) Quince Road (see Appendix
C). Mr. Oxian made a motion to refer possible landmark
designation to the Landmark Committee; Mrs. Choitz seconded;
motion passed; Mr. Hayes voted nay.
d. Legal
Mr. Nimtz read the minutes from the October 14 Legal Committee
(see Appendix D). Ms. Kiemnec reported on the Certified Local
Government Program. She asked permission to pursue funding which
is available for CLG Program and to have the final draft of the
grant, which is due November 15, reviewed by the Executive
Committee. Mr. Nimtz so moved; Mr. Hayes seconded; motion passed.
e. Public Relations & Community Education
• Ms. Kiemnec distributed copies of the Historic District Brochure.
She also requested permission to pursue funding for a downtown
brochure which will include buildings in the Multiple Resource
Area and public art and sculpture. Mr. Nimtz so moved; Mr. Hayes
seconded; motion passed.

f. Environmental Impact Statement
1) 815 Arch
Ms. Kiemnec reported that a Certificate of Appropriateness had
been issued for 815 Arch for two new casement windows in the
second floor dormer.
2) 60717 Locust
The owner of 60717 Locust Road, Mrs. Margaret Wickizer,
requested permission to have the two piers at the end of the
driveway of her landmark house rebuilt. Mr. Oxian made a
motion that the Commission recommend the rebuilding of both
piers. They required that the mortar be matched to that of
the house; the mortar be a soft mortar according to a formula
indicated by the Commission; the piers be cleaned with a mild
solution with no acid content; that no sealer be used; and
that the joints be well sealed but not raked. Mrs. Petrass

seconded; motion passed.
3) 1346 Lincolnway East
Mrs. Sporleder explained the items applied for in a
Certificate of Appropriateness by Mr. John Bourthoumieu, the
owner of 1346 L.W.E. They include: paving the rear parking
lot with asphalt, constructing a pent roof on the rear facade,
and erecting a 4' x 5' sign in the front yard. She
recommended that these items be approved. She also
recommended that the steps which were constructed without a
Certificate of Appropriateness be allowed to stand with the
following conditions: the tops of the handrails would be
changed to meet the porch handrails, the lattice work on
either side and under the steps be framed, and the steps be
painted a dark blue. Mr. Hayes so moved; Mr. Nimtz seconded;
motion passed.
4) 1216 Lincolnway East
Mr. Hubner, the owner of 1216 Lincolnway East, asked
permission to erect turned balusters on the front porch
• instead of square balusters as suggested by the State Historic
Preservation Office. He also asked that the Commission draft
a letter to the state office indicating its support of the
turned balusters. Mr. Oxian so moved; Mrs. Choitz seconded;
motion passed.

5) 605 Edgewater Drive
Ms. Kiemnec received an application for a Certificate of
Appropriateness to install an anodized aluminum storm door on
the front of 605 Edgewater which had previously had a silver
aluminum door. Mr. Oxian made a motion to approve the door;
Mrs. Choitz seconded; motion passed.
Mrs. Choitz made a motion to return to the original order of the agenda; Mr.
Nimtz seconded; motion passed.
g. Staff Report
1) Small Town Survey
Ms. Kiemnec reported that the County Summary Report should be
returned from the printer by next week. She further reported
that the printing of the book came to $17.18 per copy. The
Commission made the decision to charge $18.00 per book.

2) Survey Update
Ms. Straw presented a proposal for the next areas to be
updated for the survey. They include Harter Heights, the
Northeast neighborhood, and the Near East. The Commission
agreed with her proposal.
3) Computer Workshop
Ms. Kiemnec asked permission for Ms. Straw to attend a
November 9 & 10 Apple Computer workshop in Chicago. Costs
will be minimal, only gas and food, not to exceed $30. The
Commission agreed.
7. Old Business
Mr. Oxian requested that the staff inspect 736 Bronson in the
Edgewater Historic District for work without a Certificate of
Appropriateness.
8. New Business
Mrs. Choitz expressed her concern for continued absenteeism of some
Commission members. Mrs. Sporleder indicated that she would contact
those members who had missed frequently.
Ms. Kiemnec reported that she had gotten a report that work had been
done without a Certificate of Appropriateness at 1232 L.W.E. She
reported the matter to the Building Department who informed her that
deteriorated portions of the steps were replaced to match the
original. She indicated that a Certificate of Appropriateness was not
needed for such work.
9. Hearing of Visitors
No report.
10. Announcements & Miscellaneous Matters
Ms. Kiemnec reported that a new book has been received entitled,
Facade Stories, Changing Faces of Main Street Storefronts and How to
Care for Them. Mr. Nimtz made a motion to adjourn; the meeting was
adjourned at 9:35.

SUBJECT: INTERPRETATION OF RIVERSIDE DISTRICT STANDARDS
This is to confirm our conversation October 14, 1985,
concerning the legal interpretation of the current Riverside
Historic District standards pertaining to voting and serving on the
neighborhood liaison committee for that district.
The standards require both voters and liaison committee
members to be homeowners. There is a provision for a land contract
buyer to be a voter, provided that the homeowner gives a written
proxy to that land contract buyer. There is no mention in the
standards of renters, either as voters or as members of the liaison
committee.
Due to the above silence in the official documents of the
district, it is the opinion of Kevin Butler and myself that renters
may not vote and may not serve on the liaison committee under the
current standards for that district. There is no ability under the
current standards for a property owner to give his proxy to a
renter in order to enable him to vote, nor is there any provision
for a power of attorney to be given to a renter to enable him to
vote.
Changes in procedures and standards currently in place,
which have previously been adopted by the Historic Preservation
Commission, may be changed by the Commission by following the same
procedures used by the Commission to adopt those procedures or
standards originally. A requirement in the standards that they be
reviewed by the Commission "at least every five years" does not
prevent the Commission from reviewing, and, if they wish, changing
those procedures before five years. The Commission can make that
review and make any changes at any time, as long as that action
occurs within the five year period.
The question was asked whether a power of attorney could
be required instead of a proxy from the property owner to enable
his renter to take part in an historic district election, whether
as voter or as candidate. That decision would be up to the
Commission, and would not require any authorization by any other
• body, such as a bank.

In summary, there is now no provision which would allow a
renter to participate in the Riverside Historic District as voter
or committee member. Any change enabling a renter to participate
would require the Commission to amend its standards in the same way
it originally adopted them, and the decision.is a policy decision
for the Commission to make.

Marty Q Sue K\eva' owners of 16479 Brick Road have requested that the legal des-
cription of the Landmark property be amended to include only a 1.5 acre tract
immediately surrounding the residence. The 1.5 acre tract includes the house and
all outbuildings and follows fence lines on the property' The tracts of land that
the owners are requesting be deleted from the Landmarks designation contain no
structures and are heavily covered with small trees and underbrush.
The Landmark Committee recommends that the legal description for 16479 Brick Road
be amended to include only the 1.5 acre tract surrounding the house (as per
attached plans).

Address
(52101) Quince Road
A brick Italianate farmhouse located on Quince Road adjacent to the Toll Road.
Only the east and south facades are visible from Quince Road (north facade
is obscured by trees).
Remarks
This house is continuing to deteriorate. The roofs are in very poor condition and
several of the windows are broken.
The roof over the main portion of the house has a large hole on the south side that
has been covered by corrugated sheet metal. A chimney near this section has
completely fallen down. The roof over the one story porch on the east facade is
beginning to collapse. Although the roofs are in bad condition, the cornice and
brackets, which appear to be of pressed tin, are in good condition.
Many of the windows have closed wooden shutters which are in a variety of stages of
deterioration. There are several broken windows and some appear to be boarded up
on the interior. The entrance on the east side has been barricaded by corrugated
sheet metal.
Although the roofs are in very bad condition, the house does appear to be sound.
The brick walls appear to be in very good condition with only a few areas requiring
tuck -pointing.

1. Liaison Committee,Membership
The attorneys indicated that as it now stands, a liaison committee member must be a
homeowner. To change that, each set of standards would need to be changed according
to its own procedures. In Riverside, a review must be done "at least every five
years" so that any time between now and five years, a review can be held. The
results must then be voted on by the neighborhood. The attorneys pointed out that
unless the current Preservation Plan were changed, a renter could then serve on the
liaison committee but not vote with the neighborhood.
0 2. Advertisement of Meetings
Ms. Schwartz recommended that notification of committee meetings be posted and sent
h..' to the media. A form letter with the appropriate information could be devised and
sent.
,". Small Town Jurisdiction
�V'kr. Butler suggested that a list of options for small towns wanting a historic land-
mark ordinance be drawn up. Services contracted for or offered by the Historic
�\ Preservation Commission would be included. Mr. Butler will meet with Ms. Kiemnec
to devise the list to be presented to the small towns.
4. 16479 Brick Road
In order to change the legal description on the landmark at 16479 Brick Road,
Mr. Butler suggested that the Commission needs to go through the regular ordinance
process, i.e., a report from the staff, 1st and 2nd reading, and a recommendation to
the council.
5• 52060 Quince Road
To bring 52060 Quince Road before the County Council for landmark status again,
Mr. Butler suggested we go through our entire landmark procedure again (for poorly
maintained and endangered buildings). He also recommended checking with the county
attorney, Mr. Terry Crone, on the status of the receivership program for the county
and to check the County Council minutes for the meeting at which landmark status was
denied.

7. Certified Local Governments
Ms. Kiemnec explained that there is money available in grants to help local governments
become certified. The funding must be allocated by 12/31/85. She suggested that
the Commission request a proposal from Mr. Butler to research the issue of becoming
a CLG & give us a recommendation. The committee agreed.
