1. Call to Order
The meeting was called to order at 7:37 p.m.
2. Roll Call

3. Approval of Minutes
Mr. Nimtz made a motion to approve the minutes as sent; Mrs. Choitz
seconded; motion passed.
4. Treasurer's Report
Mr. Nimtz made a (notion to approve the treasurer's report as sent; 14r.
Hayes seconded; notion passed.

b. Historic Districts
1) Riverside Drive Update
Mrs. Choitz reported that the Riverside Drive Historic
District Designation will be up for Public Hearing before the
Area Plan Commission on May 21, 1985 at 7:00 p.m.
2) Lincolnway East Historic District
a) Dedication
Mrs. Choitz reported that the Press Conference to dedicate
Lincoinway East as a Historic District was successful.

representatives, and neighborhood residents were present
as well as two of the television stations, the South Bend
Tribune photographer, and one radio station. leis. Kiemnec
reported that she had also taped the "Kaliescope" radio
program which is a talk show aired on Sunday mornings.
She discussed our historic landmarks and districts and
their implications.
c. Historic Landmarks

1) Plaques
Mr. Oxian reported that he has spoken with someone from a
foundry, the George C. Clark Metal Last Co., Inc., who would
be willing to produce plaques for historic landmarks at
approximately $10 per plaque. They would be made of aluminum
with only one type of lettering and we would need to use the
same plaque for both county and city landmarks. The only
additional cost would be for making a pattern which Mr. Oxian
will check into.
d. Legal
Mr. Nimtz reported that he had gotten information on a meeting to
be held on June 3 in Indianapolis sponsored by FILFI for attorneys
interested in preservation. He will inform Assistant City
Attorney, Eugenia Schwartz, and the Commission's attorney, Kevin
Butler. He suggested and the Commission agreed that the
Commission pay their mileage to Indianapolis if they are
interested in going.

f. Environmental Impact Statement
1) 710 Arch
Ms. Kiemnec reported that an Edgewater resident had called
Mrs. DeLaruelle regarding the house at 710 Arch and work being
done without a Certificate of Appropriateness. tAls. Kiemnec
called Code Enforcement to check on the situation. She read a
memo from that department (see Appendix 6) indicating that
they did not find any evidence of work being undertaken.
2) 1222 Lincolnway East
Ms. Kiemnec reported that she had approved a Certificate of
Appropriateness for 1222 Lincolnway East to demolish a shed
addition to the rear of the carriage house on the property.
The shed is In very poor condition and is not original to the
carriage house.

1) Small Town Survey
i,is. Kiemnec reported that a check for the Small Town Survey
Grant has been received from HLFI. She has interviewed four
people for the position and asked the Comnfl ssioners if they
were aware of anyone else who would be interested in the
internship. She and Mrs. Sporieder will review the
applications and make a decision by the last week of May.
Regarding publication of the County Summary Report, Hs.
Kiemnec asked if it was necessary to include the current names
of owners of houses surveyed which would make the Report be
out of date very quickly. The Commission agreed that it was
not necessary.
Ms. Kiemnec asked if it was necessary to publish a model
ordinance in the Summary Report. The Commission agreed that
it was not but that one should be available in the office if
any of the Small Towns inquire about coming under our
jurisdiction. The matter was referred to the Legal Committe
who will meet with Mr. Butler to discuss it.
3) Survey Update and Reevaluation
a) Potawatomi Park Shelter House
Ms. Straw presented a Reevaluation Recommendation for the
Potawatomi Park Shelter House (see Appendix C) with a
recommended rating of S/11. 'r1r. Oxian made a motion that
the shelter which was not previously rated be given a
rating of S/11; 11r. Beatty seconded; motion passed.
4) Industrial Building 1%leeting - Report
Ms. Kiemnec reported that 20 people attended the April 25
hileet i ng for Industrial Eauilding Owners. f1ost were building
owners but a few realtors also attended. The Industrial
Buildings Slide Presentation was shown, Mr. Jaynes Conley from
HLFI explained the National Register and the Tax Act, and
there was a question and answer period.
ias. Kiemnec inquired if the Commissioners could suggest anyone
else who might be interested in the presentation. They
suggested the South Bend Library and the Social Studies
Program at the South Bend School Corporation as well as the
television stations.

7. Old Business
a) Fredrickson House
Ms. Kiemnec reported that she had a copy of the Inspection Report
from the Department of Code Enforcement. She further indicated
that Mr. Braasch, the Trust Officer from the 1st Sourch Bank for
the Estate, called the office shortly after the last Commission
meeting requesting names of contractors familiar with historic
buildings. She gave him names and suggested that he have
specifications drawn up which could then be reviewed by the
Commission staff and Mrs. Sporleder. 11r. Braasch has 50 days to
comply with the Code Enforcement's order (approximately June 5).
b. Lighting in Historic Districts
Pair. Oxian suggested that a letter be written to the electric
company indicating that they must store all historic light
fixtures that they take down so the fixtures can be used in
historic districts to replace damaged ones. The Commission agreed
that the matter should be investigated by the staff to find
solutions to the problem. Ms. Kiemnec will check with Fort Wayne
who is also serviced by I & tAi to see how they solved the problem
• and she will check to see if there are historic streetlights in
areas that are not districts or where owners are not concerned
about having them removed.
c. Computer Project
hits. Kiemnec reported that she had submitted a grant application to
the Michiana Arts and Sciences Council for funding for the
computer. She will not hear about the results for about three
weeks.
8. New Business
a. Fort Wayne Vlorkshop for Historic District Commissions
Pis. Kiemnec reported that the workshop went very well, 35 people
attended representing 8 communities. She indicated that the event
was attended by Mrs. SporIoder, Mrs. Choitz, Mr. Newburn, PIrs.
Eugenia Schwartz, Ms. Straw and herself. The topics included a
discussion of the history of commissions, procedures, standards,
and setting up a historic district.

i4s. Kiemnec reported that the Mayor's Conference was well -attended
(51 people) and was quite successful.
c. NAPC Representative
Ms. Kiemnec indicated that she had received a letter from the
National Alliance of Preservation Commissions which was founded in
1982. The NAPC is beginning a new program whereby each state will
have a representative to the Alliance in order to funnel
information from the local groups to it and vice versa. They have
asked iris. Kiemnec to be the Indiana representative. Mr. Nimtz
made a motion that I`1s. Kiemnec be authorized to accept the
position of state representative from Indiana to the National
Alliance of Preservation Commissions; Mir. Beatty seconded; motion
passed.
9. Nearing of Visitors
No report.
10. Announcements & Miscellaneous Matters
Mr. Nimtz made a motion to adjourn; the meeting was adjourned at 8:47

SUBJECT: ISSUANCE OF STOP WORK ORDERS BY BUILDING COMMISSIONER
I have consulted the Indiana Construction Rules, 1980
edition, and the South Bend Municipal Code Section 6-4, to determine
whether the Building Commissioner has the authority to issue stop
work orders where work on a building or structure is occurring in
violation of Section 21-117.2, where no violation of Chapter 6,
entitled Buildings, of the South Bend Municipal Code, or any of the
codes incorporated therein, can be determined to have occurred. It
is the opinion of this office that the Building Commissioner does
not have power to issue a stop work order unless a violation of the
provisions of Chapter 6 of the South Bend Municipal Code, or the
Indiana Construction Rules, 1980 edition, is involved.

Our residential inspector visited 710 Arch Ave and talked to the owner who said
he has not put on any new roofs, house or garage.
Our inspector said the roof on the house might have been recently reroofed (one or
two years ago) but the garage did not appear to be new.

Potawatomi Park Shelter House

The Potawatomi Park Shelter house was commissioned by Post K of the Travelers
Protective Association in 1921. The shelter house was designed by the
South Bend architectural firm of Freymuth and Maurer.
The Potawatomi Park Shelter house is an excellent example of a period
revival park structure from the early twentieth century. The structure
also represents and important period in the history of the park, a time
when travelers were allowed to camp free in the city park.

The Rmtewatomi park Shelter House was built in 1921 with funds provided by Post K
of the Travelers Protective Association. The Shelter House was designed by the local
arzhitectura\firm of Freyermuth and Maurer. It is reportedly designed after the
Shelter House in Cherokee Park Louisville, Kentucky. 0
The wney for the shelter hoose was raised through several socials and voluntary
subscriptions. The Studebaker Corporation donated a Light -Six to the fund raising
campaign.
The cornerstone was put into place on October 24, 1921 and the shelter house opened
in late November of the same year. The total cost of the structure was $15,000.
In 1932 a $6,200 addition was added to the structure increasing the sanitary facilities.
The shelter house was used by tourists who camped in the free camp sites' The camping
facilities included electric lights, running water, and outdoor fireplaces as well as
the shelter house. The campgrounds were reportedly used by tourist traveling on the
Lincoln Highway and the Dixie Highway,
