Historic Districts 1) Lincolnway East Ms. Kiemnec reported that the Lincolnway East Historic District Designation is on hold at this time in order that some of the neighbors with further questions may meet with members of the HPC. A meeting will be held on January 24, 1984 at 7:00 p.m. at 1164 Lincolnway East, the home of Tina Martin, a member of the neighborhood committee. Ms. Kiemnec and Mrs. Choitz will attend. c. Historic Landmarks No Report d. Legal No Report e. Public Relations & Community Education Ms. Kiemnec reported that she, Mr. James Conley, and Ms. Leslie Choitz had a meeting on the 1984 Mayor's Conference. It will be held during Historic Preservation Week, May 13 through 19, probably the Tuesday of that week. The subject will be, "Following the Secretary of Interior's Standards." Ms. Kiemnec spoke with the Redevelopment Department and both their office and the office of the Mayor will participate and cooperate. f. Environmental Impact Statement 1) 405 W. Wayne Street Ms. Kiemnec reported that she had okayed a Certificate of Appropriateness for 405 W. Wayne Street. Mr. Kevin Butler, the owner, had applied to have roof repairs made and a sealant put on. Since she was not familiar with the effects of the sealant, she told him to seek advice from the architect at the State Division of Historic Preservation, Bob Dinsmore. She approved the application with the stipulations required by Mr. Dinsmore. 2) Certificate of Appropriateness At the November HPC meeting, members had questioned whether the Certificate of Appropriateness Application should have a disclaimer cautioning the applicant that other ordinances and state laws needed to be followed. Ms. Kiemnec sought the advice of the Commission's Attorney, Mr. Kevin Butler who prepared a statement (see Appendix A). Mr. Newburn moved that the Commission adopt the statement recommended by its attorney; Mrs. Petrass seconded; motion passed. g. Staff Report 1) Multiple Resource Area Ms. Kiemnec reported that in conjunction with Ms. Leslie Choitz of Southhold Restorations, Inc., she had completed a National Register Nomination for the Fredrickson House and Candy Store which was sent to the State Division of Historic Preservation on December 21, 1983. She further reported that the nomination for the Multiple Resource Area for the forty-nine buildings in downtown South Bend will be mailed to the State Division of Historic Preservation on January 17, 1984. • h. Personnel Committee Ms. Kiemnec reported that the Personnel Committee met on January 6, 1984. They interviewed Ms. Elizabeth Straw who had applied for the administrative assistant position. They also reviewed the resume and application of Mr. Randal Wallar, who had applied for either the administrative assistant's position or the research assistant's position (on the Industrial Building's Project). Mr. Wallar has completed the Ball State Historic Preservation Master's Program except for his thesis and has extensive National Register experience. The Committee recommended that Ms. Straw be hired for the administrative assistant's position and Mr. Wallar for the research assistant position. Mr. Newburn made a motion to that effect; Mrs. DeLaruelle seconded; motion passed. i. Nominating Committee Mr. Newburn reported that the Nominating Committee had nominated: Joann Sporleder as President, John Oxian as Vice -President, Odell Newburn as Treasurer, and Charles Hayes as Secretary. He indicated that all four had accepted the nomination. The nominations were opened to the floor and when none were suggested, Mr. Nimtz moved that the nominations be closed and the secretary be instructed to cast a unanimous ballot for the nominees; Mr. Newburn seconded; motion passed. Mr. Nimtz instructed the secretary to cast a unanimous ballot and declared the nominees duly elected. 7. Old Business a. Union Station Ms. Kiemnec reported -that she had received a copy of a letter from the Department of Code Enforcement regarding Union Station. Code Enforcement has had the building secured for a cost of $2,685.00 and will bill the owners for that amount. 8. New Business a. Annual Report Ms. Kiemnec distributed a fact sheet (see Appendix B) on the Annual Report and asked that additions or corrections be called in by Friday, January 20, 1984. b. Plaques Mr. Oxian suggested that the Commission look into signs for local historic districts. It was also brought up that perhaps local organizations and industries would be willing to donate or make is plaques for local landmarks. Commission members will check into the various possibilities. 9. Hearing of Visitors Mrs. Carol Sheetz, a visitor and resident of Park Avenue, concurred with the Commission's suggestion to see if plaques can be donated by local organizations and industries. 10. Announcements & Miscellaneous Matters Ms. Kiemnec announced that Mrs. Martha Choitz was reappointed on January 10, 1984. Kiemnec ANNUAL REPORT - 1983 ROOM 1123 COUNTY CITY BUILDING south bend, indiana 46601 1219 284-97981 The Historic Preservation Commission, in 1983, continued its update of the identifi- cation of historic resources in South Bend and St. Joseph County. In addition, preser- vation of several of those resources was facilitated through the implementation of various programs. As in the past, the Commission has continued to advise the public on the benefits of preservation, give technical advice on restoration techniques and sources and research methods, and provide historical data on local architecture to private individuals and public agencies. I. CITY SURVEY In its efforts to keep the City Survey as up to date as possible, two buildings were added to the survey with a rating of S/11. They are: 521 Bronson and 521 E. South Street. The rating of four additional buildings was upgraded: 117 W. Colfax, C/9 to S/11; 702 S. Michigan, C/10 to S/I1; 607 Park Ave., C/10 to S/11; and 221 N. Michigan, C/9 to S/11. These ratings were changed because either the structure had been recently(,restored or add4tional historical data was found. II. COUNTY SURVEY The County Survey was also updated. Each township was thoroughly studied for building which had been missed when the survey was originally done and to update the survey maps. Twenty-five buildings were added to the inventory. Unfortunately, forty-one buildings were found to have been demolished since the survey was first completed. Three buildings had to be deleted because of unsympathetic physical changes. III. SMALL TOWN SURVEY In 1983, the Small Town Survey was completed. This year, the Commission plans to publish a Summary Report with the results. IV. LANDMARKS The following structures were designated City Historic Landmarks: 702 S. Michigan 40 1133 N. Allen V. ENVIRONMENTAL REVIEW The Commission reviewed plans with the City Engineering Department, area residents, and a representative of the mayor for Seebirt Court and with the South Bend School Administration for new windows at Muessel School. VII. CONFERENCES & MEETINGS The planner and commission members participated in various conferences throughout the year. They included: -the Indianapolis Mayor's Conference on Incentives & Standards for Development in Historic Areas, April 8, attended by the Planner and Commission Attorney; -Historic Landmarks Foundation Conference on the Promises and Pitfalls of Historic District Commissions, April 23, attended by the Planner, Mr. Wasielewski, Mrs. Sporleder, Mr. Nimtz, Mrs. Choitz, and Mrs. Petrass; -South Bend Mayor's Conference on Tax Incentives for Rehabilitation of Historic Commercial Buildings, May 9, attended by the Planner, Mr. Wasielewski, Mr. Oxian, Mrs. Sporleder, Mrs. Choitz, and Mrs. Petrass; -IUSB Computer Workshop, October 14, attended by the Planner; -37th Annual National Preservation Conference in San Antonio, Texas; October 27-30, attended by the Planner and Mrs. Choitz. VIII.STAFF Ms. Karen Kiemnec continued her position as Preservation Planner with the Commission. She was assisted by a part-time (only eight hours per week) secretary, a Notre Dame student intern (worked for credit during the winter semester), and a research assistant who worked from August to December on the Multiple Resource Area (see part IX Special Projects for a further explanation). In addition, Mr. Kevin Butler continued to serve as the Commission's Attorney. IX. SPECIAL PROJECTS On May 9, 1983, in conjunction with Southhold Restorations, South Bend Heritage, Historic Landmarks Foundation, and the Redevelopment Department for the City of South Bend, the Historic Preservation Commission sponsored the Mayor's Conference on Tax Incentives for Rehabilitation of Historic Commercial Buildings. The Conference which featured preservation experts from Chicago, Indianapolis, Evansville, South Bend, and Gloucester, Massachusetts was very successful with over 110 participants. 0 In cooperation with the staff of Southhold Restorations, the Historic Preservation Commission staff completed and sent to Indianapolis a nomination to the National Register of Historic Places for the Fredrickson House and Candy Store. This designation will enable the owners to apply for matching federal grants as they are available. The Commission applied for and was awarded a $2,700 Department of Interior grant to do a Multiple Resource Area nomination to the National Register of Historic Places for forty-nine downtown South Bend Historic structures. Ms. Elizabeth Straw was hired to work on the project and she and Ms. Kiemnec met individually or corresponded with most of the property owners to explain the benefits of the nomination. The designation will allow buildings owners to take advantage of an Investment Tax Credit on money spent on rehabilitation. The project was completed on January 17, 1984 and mailed to the State Division of Historic Preservation for first review. The Commission applied for and was awarded a $4,000 Department of Interior grant to do an in-depth study of South Bend's Industrial Buildings to determine eligibility for the National Register of Historic Places. The grant will also be used to do a National Register nomination for the Studebaker Clubhouse and stand of trees which spell out S -T -U -D -E -B -A -K -E -R, now part of the Bendix Woods County Park. The Commission applied for and was awarded a $5,350 Department of Interior grant and $7,000 in H.U.D. Community Development Block Grant monies to fund an admini- strative assistant in 1984. X. OTHER ACCOMPLISHMENTS Other accomplishments for 1983 were: an amended county ordinance was passed; a list of all Studebaker -related buildings which were included in the Historic Sites and Structures Inventory was compiled for the Studebaker Driver's Club Annual Meet held here in July, 1983; and a day -long visit by Frank Gilbert, Counsel for the National Trust for Historic Preservation was sponsored by the Historic Preservation Commission. Committee Reports a. Budget & Finance No Report b. Historic Districts 1) Lincolnway East Ms. Kiemnec reported that the Lincolnway East Historic District Designation is still on hold. The neighborhood is in the process of gathering all the owners' names and addresses. When finished, they will prepare their ballots and take a vote. 2) 601 Lincolnway East Mrs. Sporleder reported that she and Ms. Kiemnec had met with Code Enforcement Director, Kathy Barnard, to discuss 601 Lincolnway East. Ms. Barnard wished to begin consideration of legal action against the owners for HPC and Code Enforcement violations. Mrs. Sporleder wanted to make one last effort to work with the owners and to that end, a meeting will be held on February 15, at 1:00 p.m. in the Code Enforcement Office. Mrs. Sporleder had the HPU attorney, Mr. Butler draw up a Resolution for the Commission to instruct the Director, Ms. Kiemnec, to petition the Building Commissioner to use the legal means availble to him to cause the maintenance and/or repair of the building (see Appendix A). Mr. Oxian made a motion to adopt said resolution with the condition that the Commission make one final attempt to work with the owners and to get the conditions in writing; Mrs. Petrass seconded; motion passed. c. Historic Landmarks 1) First Reading for Landmark Designation of 1840 Kessler Blvd. Mr. Oxian presented landmark status to Kiemnec had gotten 2) 803 Cottage Grove 1840 Kessler Blvd. for first reading for the Commission. He indicated that Ms. the owner's consent. • Mr. Oxian requested of 803 Cottage Grove upgraded. d. Legal No Report that Ms. Kiemnec make a site inspection to determine if the rating should be e. Staff Report 1) Multiple Resource Area Ms. Kiemnec reported that the Multiple Resource Area • nomination for downtown South Bend had been sent in on January 17, 1984. It should be before the Review Board in Indianapolis in July of this year. 2) Small Town Survey — County Summary Report Ms. Kiemnec reported that progress on the County Summary Report is good. She is working with an intern from Notre Dame who will do the history of St. Marys College which is the only small town history yet to be done. 3) Industrial Buildings Project Ms. Kiemnec introduced Mr. Randy Wallar who has been hired as a Research Assistant to work on the Industrial Buildings Project. She also distributed a list of the Industrial Buildings which will be considered for the study (see Appendix B). Ms. Kiemnec requested permission to apply for an extension to the grant for the project because more buildings will need to be looked at than was originally thought. She wished to apply for a $560 grant from the Department of the Interior (through the State Historic Preservation Office) which will be matched with $420 from the Redevelopment Department and $140 from the Commission. Mr. Oxian made a motion to that eftect; Mrs. Choitz seconded; motion passed. Mrs. Sporleder indicated that she and Ms. • Kiemnec had met with Mr. Jon Hunt and that she wished to see our Industrial Buildings Project coordinated with the Urban 11 Enterprise Zone that the City has worked on. 7. Old Business a. Mayor's Conference Ms. Kiemnec reported that because expenses for speakers for the upcoming Mayor's Conference are higher than last year, she would like permission to apply for a grant from the Department of the Interior (through the State Historic Preservation Oftice) for approximately $1500. She indicated that the Commission would be more likely to obtain funding than one of the non- profit groups working on the project and that the grant would be matched by the registration monies., a cash contribution from each participating organization, and from in-kind services. Mr. Nimtz made a motion that the Commission direct Ms. Kiemnec to apply for the grant to cover expenses for the Mayor's Conference; Mr. Beatty seconded; motion passed. b. County Maps Ms. Kiemnec asked if the Commission Wished to have a distribution policy on the County Maps. It was the general consensus that distribution would be left to her discretion. 8. New Business a. Goals for 1984 The Commission reviewed and discussed possible goals for 1984 (see Appendix C). There was a general consensus that the items on the sheet would be the projects for this year. The District's Committee will meet to propose priorities for districts for 1984. b. Announcements & Miscellaneous Matters Ms. Kiemnec announced that she has copies of the Historic American Buildings Survey in Indiana in the office for $4.80 each. JOSEPH COUNTY INDIANA HISTORICr PRESERVATION COMMISSION RESOLUTION Statement of Purposes and Intent The St. Joseph County Historic Preservation Commission ("Commission") in July*, 1979, conducted an historical survey of the residence located at 601 Lincolnway East in South Bend, Indiana ("601 LWE"). Said survey resulted in an overall opinion rating of 12. A copy of said sur- vey is attached to this Resolution. In 1978, the South Bend Division -of -("Code Code Enforcement Enforcement") has noted code violations onother residences i I mme- diately south of 601 LWE and owned by the s I am,e owners. Three of said other residences have been demolished by Code Enforcement,, and on November 16, 1981 the owners applied for a demolition permit for 601 LWE. Since July of 1981, the Commission and its staff has been actively involved with the South Bend Building Commissioner ("Building Commissioner"), Code Enforcement and the owners to maintain and preserve 601 LWE. The Building Commissioner on April 29, 1982, determined that no demolition permit would be issued on 601 LWE until approved by I the Commission. On April 29, 1983, the Commission received a copy of a letter from one of the owners to Code Enforcement stating his intent to restore 601 LWE. On June 21, 1583, a hearing before Code Enforcement on 601 LWE resulted in an order for completion of repairs on exterior code violations by August 6, 1983, and on interior code violations.by August 30, 1983. No action has been taken by the owners to either restore 601 LWE or to comply with the repair order of Code Enforcement. The Commission considers 601 LWE to be of significant histori- cal value and deems it necessary to take whatever action is neces- sary to maintain and preserve 601 LWE. NOW, THEREFORE, BE IT RESOLVED by the St. Joseph County historic Preservation Commission as follows: 1. The Commission and its staff shall make one final attempt to have the owners make the code violation repairs and restore 601 LWE. 2. Budget & Finance • Ms. Kiemnec explained the grant request to the State Division of Historic Preservation for continuation of funding in 1985 for the administrative assistant (see Appendix A). With approval from the Executive Committee, she sent in the application on its due date, March 16, 1984. Mr. Hayes made a motion that the Commission continue to pursue the grant; Mr. Newburn seconded; motion passed. b. Historic Districts 1) Lincolnway East The Lincolnway East neighborhood committee reported that they had taken a vote in their neighborhood for a historic district. Of 17 votes returned (of a total of 35), 10 had voted for and 7 against. Since a 51% majority of the neighborhood had not been obtained in favor of the designation, the Commission advised the group that in order to proceed, they would need to have their councilperson initiate the ordinance. The Commission suggested that a meeting to decide how to proceed would be helpful and promised to support the ordinance if and when it came before the council. Mrs. DeLaruelle made a motion to accept the • ballots from the neighborhood committee; Mr. Oxian seconded; motion passed. 2) 601 Lincolnway East Ms. Kiemnec reported that she, Mrs. Sporleder, Mrs. Kathy Barnard, Mrs. Ann Kolata, Ms. Leslie Choitz, and Mr. John Freidline had met to discuss 601 Lincolnway East. Mr. Freidline presented figures on what it would cost him to move and rehabilitate the house and asked if low interest financing was available from the city. Mrs. Kolata from the Redevelopment Department said she would check to see what the city had available and get back to him. In the mean time, Mrs. Kolata has sent a letter with that information to Mr. Freidline (see Appendix B). Mr. Oxian made a motion that if a firm commitment had not been made by the owners by March 29, 1984 to maintain the house that the Commission appeal to the Building Commissioner to use the legal means available to him to require maintenance of the house; Mrs. DeLaruelle seconded; motion passed. 3) Historic District Committee Meeting Report Mrs. Choitz reported that the Committee agreed to get feedback from some of the areas where districts had been proposed and then work with some of the neighborhood associations through their newsletters to get information to them. The Committee felt that one of the most important areas to concentrate on was the Near Northwest. *Mr. Oxion and Ms. Kiemnec had met with J. Hunt, Executive Director of the Economic Development Dept. c. Historic Landmarks 1) Second Reading for Landmark Designation of 1840 Kessler Blvd. Mr. Oxian made a motion that the Commission recommend 1840 Kessler Blvd. to the Common Council for landmark status; Mr. Hayes seconded; motion passed. 2) 1204 Lincolnway West Ms. Straw presented historical evidence that the house at 1204 Lincolnway West was a Sears House which was originally owned by George Casaday, the president of South Bend Chilled Plow. The house has not been changed inside or out and she recommended that the rating be upgraded to S/11. Mr. Oxian made a motion that the rating be upgraded to S/11 and first reading for landmark status be held; Mr. Newburn seconded; motion passed. 3) Union Station • Ms. Straw reported that the National Register nomination for ADDITIONAL INFORMATION ADDED TO HISTORIC LANDMARKS (c) *to discuss local historic districts in the Near East, Northwest, and the St. Joseph Street area. Mr. Hunt said the city had no problem with districts being designated in these areas and would cooperate in every way possible. • Union Station had been completed and was submitted to the State Division of Historic Preservation on March 9, 1984. 4) Landmark Committee Meeting Mr. Oxian announced that the Landmark Committee of which he is chairman would meet on March 29, 1984 at 7:30 p.m. at the Tribune Building. d. Staff Report i1) Small Town Survey - No report • 2) Industrial Buildings Project Ms. Kiemnec reported that 14 buildings have been completely researched, 3 have been partially researched, and research has been done on the overall industrial history of South Bend. Mr. Wallar, the Commission's Research Assistant, will attend April's Meeting to give a full report. She further reported that the grant request from the State Division of Historic Preservation and the Community Development Department to extend the project has been approved. 3) Preservation Pian Ms. Straw distributed an outline of the Preservation Plan as well as a draft of the Objectives (see Appendix C). Mrs. Sporleder reported that as part of the Plan, the Commission wished to integrate programs with other governmental departments. To that end, she, Ms. Straw, and Ms. Kiemnec met with Janet'Holston of the Bureau of Housing and Pam Meyer of Community Development and will continue to meet with other departments. 4) Studebaker Clubhouse and Trees • Ms. Straw announced that the National Register nomination for • • the Studebaker Clubhouse and Trees had been submitted to the State Division of Historic Preservation on February 23, 1984 and should be before the July Review Board Meeting. h. Executive Committee Report 1) Personnel Contracts Mrs. Sporleder indicated that the Executive Committee had reviewed contracts for Ms. Kiemnec, Ms. Straw, and Mr. Wallar. Mr. Oxian made a motion to change Ms. Kiemnec's title from Preservation Planner to Director; Mr'. Beatty seconded; motion passed. The Commission discussed whether the Director's position can be made a county position. Mr. Hayes made a motion that the Commission direct its attorney, Mr. Butler, to discuss with the Board of County Commissioners whether or not the Director's position can be made a county position and report back to the Commission as to his findings and as to whether or not the current arrangement is in violation of any IRS regulations; Mr. Newburn seconded; motion carried; Mr. Oxian voted nay. • 7. Old Business a. Mayor's Conference Ms. Kiemnec reported that the grant requested for the Mayor's Conference has been awarded. b. School Field Ms. Kiemnec read a request from the School Administration to have the Commission help them to research School Field. Michael Donoho Present at that meeting were you, me, Joann Sporleder, Member • Leslie Choitz, Karen Kiemnic, and Kathy Barnard. During the meeting you indicated an interest in moving the house from its present location if funds could be found to cover the estimated $65,000 necessary to cover the project. I was asked to see if the City of South Bend, through it's Community Development program could make funds available for this project. At the time I explained that there were several constraints on any Community Development participation in the project. First, the City has a limited amount of money available for housing rehabilitation. Any funds set aside for this project would reduce the amount of money available in our targeted areas for housing rehabilitation. Second, there is no program currently available for house moving activities. If the City was to participate in the project, a new program would have to be designed or an existing one would have to be modified to allow this activity. Third, the City would not be willing to fund 100% of the project. Private resources would have to be identified to cover approximately 80% of the project. Fourth, even if the program and private financing are available, the project would have to be financially feasible and would need to be evaluated on its pro forma. This last item is of particular concern when using Community Development dollars since all projects using these funds must benefit low and moderate income persons or eliminate slum and blight. At the conclusion of the meeting I agreed to pursue this matter further by looking at the CD regulations to see how the project could meet the benefit test. Since you were uncertain where the house would be moved or what use it would ultimately have, I have looked at three possible uses. They are, (1) owner occupied house, (2) rental property, and (3) commercial use. If the house were to be sold to an owner who would reside in the house, it would either need to be sold to an individual who is considered to be low or moderate income or the house would need to be moved to an area declared to have slum and blight. An individual of low or moderate income is defined as at or below 80% of the City's median income for the number of people in'the household. The Monroe Park area would meet the requirement of being an area declared to have slum and blight. If the house were to be used as rental property, the landlord does not have to be of low or moderate income but the landlord must agree to rent at least 51% of the units to low and moderate income households at affordable rents.' This restriction applies to the first tenants renting the units after rehab and all first tenants must be given a one year lease. If the property is to be used for commercial purposes, 51% of the jobs must be available to low or moderate income individuals. This can be demonstrated by showing that 510 of the • available jobs pay at a salary level at or below 80% of median for a family size of one, or that 51% of the jobs will not require skills which are not easily attained by low or moderate income individuals (i.e., college education, technical training, etc.). If this option is pursued we would need to have firm commitments, in advance of the move, from the businesses who would be in the building. Also, if the house is to be used for commercial purposes, any loan for this project would need to be handled by the Business Development Corporation of South Bend, Mishawaka, St. Joseph County, Indiana (BDC) as the City cannot make direct loans for business purposes. In order to help you sort through this project I have enclosed some information that may be of assistance. First, a map of the Monroe Park residential area showing vacant lots. If you want to move the house to that area I would recommend placing the house on lot 4-13 since it is currently owned by the Board of Public Works and the adjacent lot, 4-12, is owned by the Department of Redevelopment. Second, I have included the current definitions of low and moderate income individuals by family size. Third, a copy of the "Guide for Determining Benefit" is enclosed. In conclusion I believe it is now time for you to answer the following questions: - How is the house to be used after it is moved? - Is the house to be moved into a slum and blight area? - What private financing is available for the project? - What is the role of Southhold Restorations and the Historic Preservation Commission in the project? The City is willing to work with you on this project but cannot assume total responsibility for it. You as owner, have a responsibility to the property and its associated problems. Approval of Minutes Mr. Oxian suggested that a note be added to page 3, #3 Historic District Committee Meeting Report to indicate that he and Ms. Kiemnec had met with Jon Hunt, Executive Director of the Economic Development Department, to discuss local historic districts in the Near East, Northwest, and the St. Joseph Street area. Mr. Hunt said the city had no problem with districts being designated in these areas and would cooperate in every way possible. Mr. Beatty made a motion to approve the March 19, 1984 minutes with the above correction; Mrs. Choitz seconded; motion passed. 4. Treasurer's Report Ms. Kiemnec reported that she had met with Mr. John Lentz to review the Commission's books for any irregularities. He found none and only suggested a minor change in the format of the monthly treasurer's report which will be implemented in April's report. Committee Reports a. Budget & Finance 1) Report Ms. Kiemnec reported that Mr. Kevin Butler, the Commission's Attorney, had spoken to the County Commissioners and their attorney, Mr. Terry Crone, about making the Director's position a County position. He suggested that the Commission meet with the County Commissioners when the 1985 budget is ready to be prepared to have a final discussion on the matter. Mr. Butler agreed to be present at the meeting if necessary. The matter was referred to the Budget & Finance Committee. It was suggested that the Committee meet soon to begin preparing the 1985 budget. Ms. Kiemnec further reported that she had turned in a request to the city for a part-time secretary for 1985. City Budget requests were due April 6, 1984. b. Historic Districts K E 1) Lincolnway East Mrs. Choitz reported that a meeting, sponsored by the HPu, will be held on Thursday, April 19, 1984 at 7:30 p.m. for the residents of Lincolnway East to answer any further questions they might have about the district. Due to an error in researching property owners, not all of the owners had been contacted previously. These owners have been sent notices of the meeting. First reading was held on the district ordinance by the Common Council on April 9, 1984. There was a question as to whether or not land contract owners should be contacted as the legal owners and the Commission asked Ms. Kiemnec to seek a legal opinion from Mr. Butler. 2) 601 Lincolnway East Ms. Kiemnec read the letter from Ms. Kathy Barnard of the Code Enforcement Department (see Appendix A) which was a response to the Commission's request that the Building Commissioner use the legal means available to him to require the maintenance of 601 Lincolnway East. The letter outlined two options: #1 to have the city order the repair of the building and charge the owner and #2 to place the building in a receivership. Mrs. Choitz made a motion to have Ms. Kiemnec call a meeting with Ms. Leslie Choitz of Southhold Restorations, Mr. Jeft Gibney of South Bend Heritage, and Ms. Barnard to discuss the receivership program and it that does not work that option #1 should be put into effect; Mr. Nimtz seconded; motion passed, Mr. Hayes voted nay. 3) Historic District Committee Meeting Mrs. Choitz reported that she would like to have an Historic District Committee Meeting on April 24, 1984 at her home at 6:00 p.m. to discuss district procedures. 4) Riverside Drive District Mr. Oxian reported that residents of the Riverside Drive area had approached him about local historic district designation for that area. The matter was referred to the Historic District Committee. c. Historic Landmarks 1) Second Reading for Landmark Designation of 1204 Lincolnway West • 3 • Mr. Oxian made a motion that the Commission recommend 1204 Lincolnway West to the Common Council for landmark status; Mr. Beatty seconded; motion passed. 2) Updated Landmark Lists Ms. Straw distributed updated landmark lists that she had prepared (see Appendix B). They were also distributed to all the appropriate city and county agencies. Mrs. Sporleder suggested that some efforts might be made to contact all the owners to remind them of their landmark status, thank them for their continued preservation efforts, etc. The matter was referred to Mr. Hayes' committee on Public Relations & Community Education. 3) Facade Easement Report Mr. Oxian reported that the landmark committee had reviewed the facade easement proposal and recommended its passage by the Commission. Because there were some questions on the • proposal, Mr. Nimtz made a motion that the matter be referred to the Legal Committee and put on the agenda for May's meeting; Mrs. Choitz seconded; the motion passed. 4) Darden Bridge Ms. Straw reported that she is working on the National Register nomination for the bridge and she will be in touch with Mr. Lauer from Notre Dame to see what their progress has been on the project. 5) Former Central High School Mr. Oxian suggested that the Commission get in touch with the Area Plan Commission who will be reviewing preliminary sight plans for the former Central High School to remind them that the building is a landmark and will need to have plans reviewed by the Commission. d. Staff Report 1) Small Town Survey Ms. Kiemnec reported that the Notre Dame intern working for the Commission has completed his history of St. Mary's College, the last of the histories for the Small Town Survey. She will review it and get it to the Small Town Survey Committee for comments. 2) Industrial Buildings Project Ms. Kiemnec reported that Mr. Wallar has completed research on all but the Oliver and Studebaker complexes which he is scheduled to complete by the end of the week. She • distributed Criteria Sheets (see Appendix C) which are the criteria on which National Register eligibility will be based. Mr. Wallar will begin filling them out, the staff will review them and then they will be reviewed by the Landmarks Committee. 3) Preservation Plan The chapter on re-evaluation of buildings and landmark procedures was discussed in caucus and revisions were suggested. These changes will be made and reviewed by the Landmark Committee who will then make recommendations to the Commission. 7. Old Business a. Mayor's Conference Ms. Kiemnec distributed brochures for the upcoming Mayor's Conference. The legal means available to the Department of Code Enforcement to repair the structure are as follows: 1. The Department of Code Enforcement can hire a contractor to make the exterior repairs on the structure and charge the property owner for the cost of the repairs. 2. A receiver can be appointed to rehabilitate the property and manage the property until the costs of the rehabilitation are recovered. The receiver must be a not-for-profit agency or individual who would appointed by the Court to make the repairs on the property and be responsible for renting the property, thus generating income to pay the rehabilitation. After the property has been rehabilitated, and the cost of the repairs have been repaid, the property would then be returned to the property owners. It is reasonable to assume that a property could be involved in a receivership for several years. Budget & Finance 1) Mrs. Sporleder asked if any of the Commissioners had any items they wished to have addressed in the 1985 budget. Mrs. Choitz suggested that more funding would be needed for postage for historic districts to notify residents. She also indicated that funding would be needed to prepare brochures and informational material for historic district residents. b. Historic Districts 1) Lincolnway East Historic District - Report Mrs. Choltz reported that the Lincolnway East Historic District passed the Area Plan Commission with a favorable recommendation on May 15, 1984. It will be before the Common Council for a public hearing on June 11, 1984. 0 2) 601 Lincolnway East • 3 Ms. Kiemnec read a letter from the Department of Code Enforcement requesting a demolition permit for 601 Lincolnway East (see Appendix A). Mr. Oxian made a motion to deny the request based on five reasons which he enumerated (see Appendix B); Mrs. Choitz seconded; motion carried. 3) Historic District Committee Meeting Mrs. Choitz reported that the Historic District Committee met and reviewed a draft prepared by the staff on the procedures for districts. When those procedures are finished, she will begin meeting with residents of the Riverside Drive area who are interested in a district. c. Historic Landmarks 1) Facade Easement Report Mr. Oxian requested that the discussion on the Facade Easement Program be tabled until the June meeting. 2) Darden Bridge Ms. Straw reported that she is working on the National Register nomination for the bridge. She indicated that the Engineering Department at Notre Dame was not able to work on the bridge study so she will contact Purdue University to see if they might be interested. 3) Central High School - report Ms. Kiemnec reported that she and Mrs. Sporleder met on May 15 with Mr. Dick Gantz of the State Historic Preservation Office, Ms. Martha Raymond of the Philadelphia National Park Service Office, and Mr. James Childs, the project architect to review the preliminary plans. No decisions were made. Ms. Kiemnec stressed that the plans are still in the preliminary phase. Mrs. Petrass indicated that her research on the vocational building resulted in finding only the date and architect of the building. She further indicated that the building is in poor structural condition. Mrs. Sporleder asked each Commissioner to forward their comments on the project to the office for compilation by the staff. 4) First Reading for Landmark Designation for 227 Scott Mr. Oxian presented 227 Scott St. for first reading for landmark designation. U1 d. Legal No Report e. Public Relations $ Community Education No Report f. Environmental Impact Statement 1) 107 West North Shore Drive Ms. Kiemnec reported that she had approved a Certificate of Appropriateness for 107 West North Shore Drive for replacement of three feet of soffit on the second floor porch architrave which have been damaged by water. 2) 552 River Avenue Ms. Kiemnec reported that she had approved a Certificate of Appropriateness for 552 River Avenue to replace 10 second • floor and 2 main floor storm windows with Fiberlux vinyl double hung storms of the same configuration. 3) 619 Edgewater Place Mr. Kevin Smith and his architect Mr. Tom Kenrick presented plans for a boat launch on the property along the river in front of his house. The Commission reviewed the project in May of 1982 and did not approve the project because of a confusion as to ownership. The Commission told Mr. Smith at the 1982 review, however, that it did not object to the aesthetics of the proposal. Mr. Smith was asked to bring in his plans for the project because they included some variations from the original. Mr. Oxian made a motion to approve the project pending compliance with all other state and local laws and pending final approval by Ms. Kiemnec and Mrs. Sporleder with the handrail which will be required by the Building Department; Mrs. Choitz seconded; motion passed; Mrs. DeLaruelle voted nay. g. Staff Report 1) Small Town Survey No Report 40 5 2) Industrial Buildings Project Ms. Kiemnec reported that Mr. Wallar has completed research on all but the Studebaker complex, is writing up drafts of the criteria sheets on all the factories, and is working on the overall history and methodology. Mr. Wallar's time and funding will run out on June 8, 1984. Since the project will not be completed at that time and because she and Mrs. Sporleder feel that a slide/tape presentation to promote the project to the community would be appropriate, Ms. Kiemnec asked permission to apply for additional funding for a 10 to 12 week period over the summer. She has gotten a verbal commitment from two funding sources and will approach another. Mr. Newburn made a motion that Ms. Kiemnec continue to pursue the additional grant funding; Mr. Nimtz seconded; motion passed. 3) Preservation Plan Ms. Straw reported that the Landmarks Procedure Chapter is ready to receive a final review by the Landmarks Committee and the Districts Procedure Chapter is almost ready for final review. She is also working on the Endangered and Scarce Buildings Chapter. 7. Old Business a. Mayor's Conference Ms. Kiemnec reported that the conference was quite successful; 70 people participated and the conference was kicked off by the mayor who delivered a resolution declaring Preservation Week locally. b. 1985 Grant for Administrative Assistant Ms. Kiemnec reported that on April 18 the Commission was awarded a grant from the State Historic Preservation Office for $9,500 to continue funding in 1985 for the Administrative Assistant Position. 8. New Business a. Grant application Ms. Kiemnec reported that she had been approachditf by Ms. Leslie Choitz of Southhold Restorations to be a part of a grant application to the Apple Computer Company. The company is taking applications from groups of 3 to 5 non-profit organizations which U C:1 will use their computers to network on a project. The company provides each organization with the necessary equipment and requires that the project meet certain guidelines and take place within a two year period. Mr. Newburn made a motion that Ms. Kiemnec pursue the grant; Mr. Nimtz seconded; motion passed. b. Memorandum of Agreement Mrs. Sporleder read a report on the Memorandum of Agreement being considered by the city (see Appendix C). Mr. Nimtz made a motion that the Commission staff should participate in the review process required by the Memorandum of Agreement; Mrs. Choltz seconded; motion carried. c. Chamber of Commerce Leadership Development Program Mrs. Sporleder read Development Program Commission would be participation on the Kiemnec should apply passed, Mrs. Choitz d. The property is owned by John Freidline and Anthony Panzica. The reasons for rejection are as follows: 1. the building is rated twelve (12) on the Indiana Historic Sites and Structures • Inventory (out of a possible 13) as to its historical and architectural merits 2. it is within the Edgewater Place Historic District and because of its high rating it is a significant part of the district 3• the owners have not attempted to come before the Commission to demonstrate the financial reasons for demolition of the structure 4. although the Commission has allowed three other Freidland/Panzica structures in the district (605, 609, and 617) to be victims of demolition by neglect and ultimately actual demolition, it cannot allow the same to occur with this building because of its importance to the district and to the city of South Bend 5. negotiations are currently in progress to move the building from the site. Vance, City Controller, which indicated that the city will not be able to fund our request for 1985 (see Appendix B). Ms. Kiemnec requested a meeting with the Budget Committee to discuss the County Budget for 1985. b. Historic Districts 1) Lincolnway East Historic District - Report Mrs. Choitz reported that the Lincolnway East Historic District passed the Common Council unanimously on June 11, 1984. 2) 601 Lincolnway East Ms. Kiemnec reported that South Bend Heritage is working with the owners and the city to arrange moving of the house. A request for official permission to do so will be presented in July. c. Historic Landmarks 1) Second Reading for Landmark Designation for 227 Scott Street Mrs. Choitz made a motion that the Commission recommend 227 Scott Street to the Common Council for landmark designation; Mr. Newburn seconded; motion passed. 2) Facade Easement Report Mr. Oxian read a letter from the Commission's attorney, Mr. Kevin Butler, concerning the Commission's accepting of facade E 3 easements (see Appendix C). The Commission agreed that Southhold Restorations has initiated a fine program to accept easements and for the Commission to do so would be a duplication of efforts. 3) Darden Bridge No Report 4) Central High School Ms. Kiemnec indicated that although the Commission had not been formally asked for a review of the project yet, she needed to have the Commisioner's comments on the demolition of the vocational building. d. Legal No Report e. Public Relations & Community Education No Report 100 f. Environmental Impact Statement 1) 802 Arch Ms. Kiemnec reported that she had approved a Certificate of Appropriateness for 802 Arch to reopen an original door and window opening on the river side of the garage. The window will be a double hung, wood frame and the door will be of steel; a flush door to be painted the color of the siding. 2) 619 Edgewater Place Ms. Kiemnec reported that she and Mrs. Sporleder had reviewed and approved the final plans for the construction of a boat launch by Mr. Kevin Smith. The revised plans included a railing and a four foot setback from the street. Ms. Kiemnec further approved the door to the kayak storage container which will be constructed of sheet metal. g. Staff Report 1) Preservation Plan Ms. Kiemnec reported that a final draft of the chapter on C4 • Landmark Procedures and on District Procedures has gone to committee chairpersons. Ms. Straw is currently working on a chapter on Endangered Buildings. Ms. Kiemnec further reported that questions regarding the Studebaker Clubhouse and Trees National Register nomination had been received from the State Historic Preservation Office. These were answered and the nomination was resubmitted and will be before the review board on August 1, 1984. 2) Industrial Buildings Project Ms. Kiemnec reported that Mr. Wallar has left. Funding has been secured from the State Division for Historic Preservation, Historic Landmarks Foundation, and the Chamber of Commerce to finish the project and to do a slide/tape presentation. She further reported that the Personnel Committee had reviewed the possibility of hiring Mr. Dave Barrett for the position and recommended that action to the Commission. Mr. Newburn made a motion to hire Mr. Barrett; Mr. Hayes seconded; motion passed; Mrs. Choitz abstained. 7. Old Business - No Report 8. New Business a. 1985 C.D. Funding Ms. Kiemnec reported that the 1985 Budget process for Community Development funds has begun. She will prepare a proposal and have it reviewed by the Budget Committee. b. Riverside Drive Mrs. Choitz reported that she will be initiating meetings with residents along Riverside about the possibility of establishing an historic district there. c. St. Joseph County Cemeteries Mr. Oxian suggested that the Commission through the Landmark's Committee study county cemeteries in regard to location, condition, and funding for restoration. 9. As you know, this amendment was part of a compromise which reduced a Senate Finance Committee proposal for a 20 year ACRS proposal depreciation period for real property. On June 6, Members of the House Ways and Means Committee and Senate Finance Committee began meeting to resolve the differences between the Senate bill and the House bill which does not change the 15 year depreciation period. At this point it is impossible to predict with certainty the outcome of the conference. There is virtually no limitation on the Conference Committee as it considers the issues and no requirement that the final compromise legislation must bear much similarity to the original bills. However, I remain committed to a pro -investment tax code and will continue to work toward maintaining a positive approach toward real estate investment.. When the Conference Committee reports a final bill, it will be very difficult to amend the bill or to vote against the bill. This situation exists because the tax bill is combined with the various spending reductions, revenue increases, and overall budget ceilings which will be our "downpayment on the deficit." Thus the legislation which will contain the new restrictions on IDB's will be within a huge budget bill which has been the result of months of difficult negotiations, much work, and hundreds of votes on various amendments. I am interested in your views, and I am basically sympathetic with your position. I will be alert to ways of altering the 0 John H. The proposed amendment will change the ITC by requiring the following: a full adjustment of a building's depreciable base by the amount of the ITC instead of one half basis adjustment; a reduction for the 202, and 1551 ITC to 75% and |O% respectively; and extension of ACRS depreciation from 15 years to a longer time period (18-20 years)' The Commission is currently involved in a National Register nomination for several buildings in downtown South Bend. The purpose of the nomination is to stimulate reinvestment in our Centra) Business District, create jobs, revitalize our tax base, and preserve irreplaceable elements of our heritage' Radical changes to the rehab credits will undermine all of the aforementioned benefits and bring a slowdown, or total stop, to commercial urban development by private investors. VANCE CITY CONTROLLER SUBJECT: 1985 BUDGET REQUEST DATE: MAY 17, 1984 I am currently putting together the 1985 budget along with 1985 projected revenue levels. It appears the City will have to trim approximately $4 1/2 million dollars from its budget requests in order to be anywhere in the ballpark as to what we will be able • to fund. I might add that these budget requests do not include any salary increase for 1985. I realize that you have heard this story before, but I am afraid that in light of our current financial situation and the nonrecognition of our problems by the County Council, we will not be able to fund your request for 1985. I might suggest that you contact Jon Hunt to ask if there are any monies available from the Community Development Program. I do not hold much hope for that source either as we have had to absorb expenses normally paid by Community Development in our 1985 budget. I believe that the Commission has done good work in the past and provided a needed service to the City, its businesses and resources and with that in mind, I feel particularly sad that we will not be able to grant your request. I might add that we have in the past taken care of some of our part-time positions through the Older Adults Program sponsored through Real Services. I might suggest that you contact Dan Munk at Real Services and see if there is any possibility of providing help for you. If I may be of further help, please feel free to contact my office. For the Commission to involve itself in areas and programs which are effectively covered by other entities I believe, is counterproductive because such involvement can only dilute the effectiveness of existing Commission programs due to limited staff. Historic Districts 1) 601 Lincolnway East Ms. Kiemnec read a letter from South Bend Heritage (see Appendix C) requesting permission to move the house at 601 Lincoinway East into Monroe Park. Mrs. Choltz made a motion that the Commission respond to South Bend Heritage's letter by indicating that our first priority is to have the house at 601 Lincolnway East restored in place, made a local landmark, and left as the cornerstone to the Edgewater Place Historic District. if, however, that solution is impossible, we would approve moving the house with &U of its architectural features intact. The letter will further point out to the owners that any new buildings constructed In the district are subject to the Edgewater Place Historic District Standards and a Certificate of Appropriateness must be obtained before a Building Permit will be issued. Mr. Hayes seconded the motion; motion passed, Mr. Nimtz abstained. Copies will be forwarded to: Ann Kolata, the Mayor's Office, John Freidline, the Panzicas, Southhold Restorations, HLFI, Kathy 2 • Barnard, and Jeanne Derbeck. Historic Landmarks Ms. Kiemnec inquired as to whether the Commission would give a landmark plaque to the Neighborhood Housing Service for 803 N. Notre Dame Avenue. Mr. Oxian indicated that the Commission had established a policy to give landmark plaques to any city owned landmarks. Environmental Impact Statement 1) 110-112 Franklin Ms. Kiemnec reported on a Certificate of Appropriateness which was issued by the President, Mrs. Sporleder, and the COA Committee whereby the owners of the house will replace the entire roof within 18 months with black asphalt shingles. The metal crest strips must be restored or replaced. Mr. Hayes made a motion to approve the Certificate of Appropriateness; Mrs. Choitz seconded; motion passed. g. Staff Report 1) Preservation Plan Ms. Straw reported that she is continuing work on the Preservation Plan. She further reported that the Multiple Resource Area -nomination was reviewed by the State Division of Historic Preservation's staff and returned with several requests for additional information. She has spent most of 3 C the last two weeks completing that Information so that the application can be resubmitted. 2) Industrial Buildings Project Ms. Klemnec reported that an award letter regarding our grant from the State Division of Historic Preservation for the Industrial Buildings Study has been received. She introduced Mr. David Barrett who is currently working on the project and he reported that he has almost completed the work on the Studebaker Complex and Is currently researching and writing the Industrial History of South Bend. 7. Edgewater Place Historic District Mrs. DeLaruelle asked Ms. Kiemnec to check out a report that a garage behind 739 Bronson St. has been demolished and a new structure put up, both without Building Permits or Certificates of Appropriateness. 9. The Commission discussed the 1984 National Preservation Conference to be held in Baltimore, Maryland from October 24-28, 1984. Mrs. Choitz made a motion to allot $150 from the Travel line item in the budget for Ms. Kiemnec to attend the conference; Mr. Nimtz seconded; motion carried. 6. Committee Reports • a. Budget 8 Finance 1) 1985 Community Development Budget Ms. Kiemnec explained the budget she had turned in to Community Development on August 10. The total request was for $9,055, $6,455 for salary for the Administrative Assistant and $2,600 for secretarial services. She also explained the County Commissioners recommendation concerning the HPC County Budget for 1985 (see Appendix A). Mr. Nimtz made a motion that both the County and the Community Development Budget proposals be approved; Mrs. Petrass seconded; motion passed. b. Historic Districts 1) 601 Lincolnway East Ms. Kiemnec explained that the City Legal Department is researching the possibility of bringing legal action against the owners of 601 L.W.E. She will notify the committee which was appointed at the last meeting as soon as she receives word from City Legal. Ms. Sporieder suggested contacting Mr. Jeff Gibney of South Bend Heritage to determine if their proposal to move the house has a deadline. 2 2) Riverside Drive Mrs. Choitz reported that a preliminary meeting had been held with Riverside Drive residents to determine interest in a district there. She indicated that another meeting will be held within three weeks to begin to organize the district. c. Historic Landmarks 1) Fredrickson House Mr. Oxian and Mrs. Choitz reported on the meeting called by Mrs. Beverlie Beck, President of the Common Council, to discuss the Fredrickson House. They indicated that Southhold Restorations will attempt to work with the Trustees of the bank to open up the house for tours to the community. d. Legal No Report e. Public Relations & Community Education No Report f. Environmental Impact Statement 1) 129 W. North Shore Ms. Kiemnec reported on a Certificate of Appropriateness for this property. The owners will remove the present asphalt shingle roof and replace it with an Owens Corning, 3 in 1, 225 Ib., asphalt shingle roof. The garage roof will be covered with the same material. Ms. Kiemnec approved the work. 2) 557 Edgewater Drive Ms. Kiemnec reported that the owners will replace wooden frame foundation windows with Fiberlux solid vinyl frame windows. The windows to be replaced are on the side and rear facades of the house. She approved the work. 3) Certificates of Appropriateness Mrs. Sporleder expressed her concern at the Commission's handling of C. of A.'s when work has begun either without a Certificate and/or without a Building Permit. She referred 3 • the issue to the Certificate of Appropriateness Committee and suggested they address issues such as: work without a Certificate, education of the district homeowners as to the requirements of the standards, and the Liaison Committees - if they are working or if another solution should be devised. The Commission requested that Ms. Kiemnec contact Kevin Smith at 619 Edgewater Place regarding his boat launch which was approved in June. They asked that she discuss a completion date on the project with Mr. Smith. g. Staff Report 1) Preservation Plan Ms. Kiemnec reported that Ms. Straw is working on the Endangered and Scarce Resources Chapter and the Adaptive Use Chapter which should be finished by the end of the week and will be ready for Landmarks Committee review by that time. The entire Preservation Plan will be available in the office for review by the Commissioners in early September; Ms. • Kiemnec will send out a memo when It is ready. 2) Industrial Buildings Project 11 Ms. Kiemnec reported that a script has been written and slides gathered for the multi -media presentation on the Industrial Buildings Project. In addition, the history of South Bend's industry has been completed. Both the history and script will be ready next week for review by the Executive Committee. The entire project which will include a report on the staff's recommendations for eligibility will be ready for review by the Commissioners in early September. Ms. Kiemnec will send out a memo to that effect. 3) In-service Workshop for Teachers On July 31, 1984, Ms. Straw presented a workshop for teachers of the South Bend School Corporation on what the HPC Is about and what services we can offer. Other groups participating were: the Northern Indiana Historical Society, Discovery Hall, Southhold Restorations, ALSA, and the South Bend Public Library. 4) Downtown Technical Advisory Committee Ms. Kiemnec reported that she was invited to be a member of a 4 C Downtown Technical Advisory Committee. The Committee was organized to develop a plan for the enhancement and. revitalization of the Central Business District. 7. Old Business Mrs. Sporleder reported that Ms. Kiemnec has been selected to participate in the South Bend/Mishawaka Area Chamber of Commerce Leadership Training Program. She has received scholarships for a portion of the tuition fee. Mrs. Sporleder suggested that the Commission pay for $50 toward the tuition. Mrs. Choitz made a motion to that effect; Mr. Nimtz seconded; motion passed. 8. New Business a. Main Street VideoConference Ms. Kiemnec reported on the Videoconference which will be brought Into South Bend by Southhold Restorations and HLFI. It will be presented by the National Trust on September 18 at the Continuing Education Center at Notre Dame. The registration is $25. Mr. Nimtz made a motion that the HPC pay for Ms. Kiemnec's registration for the conference; Mrs. Choitz seconded; motion 10 passed. b. Registration of Landmark Ordinances Mr. Oxian reported that he had Inquired into recording our landmark ordinances with the Recorder's Office. The cost will most likely be $4 each,* The Commission asked that Mr. Oxian inquire into the matter further, investigate funding possibilities,. and then report back to the Commission for action. *'$1.50 for each separate sheet thereafter." c. Time Limit on Certificates of Appropriateness Mr. Oxian suggested that the Commission adopt a policy on time limits for Certificates of Appropriateness. Committee Reports a. Budget 8 Finance Ms. Kiemnec reported that she had received a letter from the County Commissioners on the 1985 County Budget. As of January of 1985, Ms. Kiemnec will become a county employee, the office budget wild remain the same, and $2,000.00 will be available to match the Department of Interior grant. She further reported that Community Development staff have recommended funding in the amount of $7,000 for 1985 instead of the $9.055 requested. The first of the public hearings will be held October 17, 1984 at 7:00 p.m. b. Historic Districts 1) Riverside Drive District (A motion was made by Mr. Newburn to change the order of the agenda to hear this item first; Mrs. Petrass seconded; motion passed.) Mrs. Choltz read the application for district designation submitted by the Riverside Drive neighborhood (see Appendix A), explained the suggested boundaries, and reported the 2 • • • progress of the meetings made a motion to accept motion passed. c. Historic Landmarks 1) 322 West Marion with the neighborhood. Mrs. Petrass the application; Mrs. Choitz seconded; Mr. Oxian made a motion that the Commission recommend 322 W. Marion to the Common Council for landmark designation; Mr. Hayes seconded; motion passed. d. Legal No Report e. Public Relations & Community Education No Report f. Environmental Impact Statement 1) 739 Bronson Ms. Kiemnec reported that the shed behind the house at 739 Bronson was reviewed by the Certificate of Appropriateness Committee and found not to be violating the standards. It also did not require a Building Permit so a letter was sent from the Department of Code Enforcement requesting that in the future, the owners comply with local ordinances and obtain both a Building Permit and a Certificate of Appropriateness before beginning any work. 2) 1608 Devon Circle Ms. Kiemnec reported that she and Mrs. Sporleder reviewed and approved plans to construct an addition on the rear of the house at 1608 Devon Circle. It will be made of materials like those on the main house except for the roof which will be asphalt shingles instead of slate. The addition will not be visible from the street. 3) 767-1/2 Lincolnway East Ms. Kiemnec reported that prospective owners wish to tear down the house at 767-1/2 LWE which is in the Edgewater Place Historic District. The house has had several unsympathetic additions and is in poor condition. Mr. Nimtz made a motion to allow the prospective owner, Mr. Dan Horine, to tear down J 11 the house at 767-112 LWE on the condition that he renovate according to the Edgewater Place Historic District Standards the other house on the lot, 767 LWE; Mr. Newburn seconded; motion passed. g. Staff Report 1) Preservation Plan The Commission discussed the changes suggested for the Preservation Plan. Mr. Newburn made a motion to accept the Plan as drafted; Mr. Nimtz seconded. Mr. Newburn then amended the motion to include the changes suggested at the meeting (see Appendix B); Mr. Nimtz seconded; the amendment passed; the motion passed. 2) Certified Local Governments Ms. Kiemnec distributed a sheet explaining the CLG program (see Appendix C), Mrs. Sporleder referred the matter to the Legal Committee for study. 3) Ypsilanti Conference Report Ms. Kiemnec distributed a report on the conference she attended in Ypsilanti (see Appendix D). 4) Multiple Resource Area Nomination Ms. Straw distributed a report on the buildings which passed the Review Board In Indianapolis at the October 10 meeting (see Appendix E). 7. Old Business a. Apple Computer Grant Ms. Klemnec reported that the Commission had dropped out of the application for a computer from Apple for networking because only one governmental agency was allowed in each network (Discovery Hall is also a governmental agency). She further reported that all three other organizations agreed that the Commission was stili an integral and necessary part of the network and all three would assist the Commission In its efforts to find funding for a computer. 4 :7 b. Industrial Buildings Study Ms. Kiemnec reported that most of the changes were made to the Industrial Buildings Slide Presentation as suggested by the Commission. The Presentation is now operational with the dissolve unit and Ms. Kiemnec has prepared a second copy which can be used with Southhold's projector. Ms. Kiemnec reported the groups which have seen the Presentation thus far: the County Council and Commissioners, the Redevelopment Commission, the Urban Enterprise Association, and the Chamber of Commerce. c. Recording of Landmark and District Ordinances Mr. Oxian requested that this item be put on the November Meeting agenda. d. 619 Edgewater Place Mr. Oxian directed the staff to check with the Department of Code Enforcement on the house at 619 Edgewater to see if the Building Permit issued has expired. 8. Reasons for Historic District Designation (Include reasons for boundaries): Preservation of a cohesive, turn -of -the century, upper -middle class neighborhood. The majority of the residences are rated on the Historic Sites and Structures Inventory of South Bend and are owner occupied. Prevention of negative impact on the area. The area is situated between natural and man-made boundaries which provide an easily recognizable neighborhood. Submit to: Historic Preservation Commission of South Bend and St. Joseph County Room 1123 County/City Building • South Bend, Indiana 46601 Appendix C CERTIFIED LOCAL GOVERNMENT PROGRAM On 1980, an amendment to the National Historic Preservation Act was passed which included a provision to delegate certain program responsibilities to local governments. Final regul.ations for the Certified Local Government Program, as it was called, came out in April of this year. The regs required each state to submit their own procedures to the National Park Service. The State Historic Preservation Office has drafted these procedures and sent them out to local governments for comment. The deadline for comments is Novemb-er 27, 1984. If you would like a copy for review, let the staff know and then please submit any comments to the office. We will compile them and send them on to Indianapolis. The procedures establish standards for Section 106 review (which we already do), the composition of the Commission and its procedures, the process for updating the survey, and the professional staff. The Certified Local Government Program involves two basic concepts: 1. local review of all National Register applications within HPC jurisdiction 2. eligibility for 10% of Indiana's annual Historic Preservation fund (along with the other CLGs) The local review of N.R. applications will involve staff revision of inadequate nominations and notification of property owners, holding a public hearing for comment on the applications, review by the Commission and chief elected local official of the applications, and notification of the SHPO as to our decision. The program will also update on the survey, • C] require an annual report indicating all nominations reviewed, any any changes in procedures or Commission members, etc. historic preservation commission,, Appendix D "Commission Issues of the Eighties" • ,Report on Regional Conference in Ypsilanti, Michigan Keynote Address by Frank Gilbert, Senior Field Representative for the National Trust for Historic Preservation Mr. Gilbert dealt with the legality of.landmark ordinances by quoting the opinion of Justice Brennan in the Penn Central case. He reported there were three prevalent issues discussed in the case. Following are the quotes and Mr. Gilbert's comments. 1. State and cities may enact land use restrictions or controls to enhance quality of life by preserving the character and desirable aesthetic features of a city. This was a declaration by the Supreme Court that aesthetics are important to cities. 2. NYC's objective of preserving structures and areas with special historic, architectural, or cultural significance is an entirely permissable governmental goal. This was at a time when over 500 U.S. cities had established district commissions and Justice Brennan was recognizing and validating them. Mr. Gilbert also indicated that various groups such as the Sierra Club had given supporting testament in the case. He stressed the importance of alliances with other governmental and non profit groups. 3. The restrictions imposed on its parcel (Penn Central) are appropriate means of securing the purposes of the NYC law. appropriate means" indicates that all necessary procedures should be followed such as notice property owners, accurate records, fair and public hearings, an appeal procedure, hard- ship relief, etc. He stressed the importance of technicalities and fair treatment of property owners. These points are also important to the reputation of the Commission in the community. Mr. Gilbert also stressed the importance of documentation for local landmarks and districts on their architectural and historical significance so that when they go before the Common or County Council, there will be adequate evidence for they designation. 4. The application of NYC's landmark law is not "a taking" of appellant's property. The restr'iactions imposed are substantially related to the promotion of the general welfare Police powers related to the health, safety, and general welfare. 5. The NYC law permits its owner not only to profit from the terminal but to retain a reasonable return on its investment 6. The owners must be able to make reasonable beneficial use of the landmark site. The state or local government can ask the owner to show hardship or a burden. 7. If appellants can demonstrate at some point in the future that circumstances have so changed that the terminal ceases to be economically viable, appellants may obtain relief. 4tru In contrast to discriminatory zoning which is the antithesis of land use control as rt of some comprehensive plan, the NYC law embodies a comprehensive plan to preserve ctures of historic or aesthetic interest wherever they might be found in the city. Mr. Gilbert stressed the importance of being part of a master plan for the city and working with city planners. Page 2 9. The Supreme Court accepts the judgment of the NYC council that the preservation of landmarks benefits all New York citizens. Other ideas from some of the sessions: The local preservation non-profit in Ypsilanti awards plaques to landmark owners who have done a good restoration and maintenance job on their landmark home. If the owners then do something unsympathetic, fall behind in maintenance, or sell the house, the plaque is revoked. Other commissions are dealing with video discs by requiring some sort of screening around them, having them put in the rear of the yard, or having them placed at the rear of the roof if it is a flat -roofed commercial building. The National Alliance for Preservation Commissions will be coming out with a video and a slide program on Design Review. It will be available through the State Historic Preservation Office. Maryland has approved a 10% Investment Tax Credit on rehabilitation of historic buildings. The Investment Tax Credit can be used as a credit against real estate taxes. It is important to place more emphasis on non-reversible changes in historic districts. Be sure to ask for good, clear architectural drawings (plans and elevations) when • getting documentation for Certificates of Appropriateness. Historic Districts 1) Riverside Drive Historic District Mrs. Choitz reported that the Riverside Drive Historic District Steering Committee continues to -meet weekly. They have almost completed a draft of their standards. c. Historic Landmarks 1) Recording of Landmarks Mr. Oxian reported that Mr. Kevin Butler, the Commission's Attorney, had drawn up a document to be used to record designated landmarks In the Recorder's Office (see Appendix A). He further reported that the cost will be approximately $4 for the first page and $1 for every page thereafter. Mrs. Choitz made a motion that Mr. Oxian proceed with the recording project and attempt to find funding for it if the costs are as he indicated; Mr. Newburn seconded; motion carried. 2. d. Legal No Report e. Public Relations & Community Education No Report f. Environmental Impact Statement 1) 553 Edgewater Place Ms. Kiemnec reported that she had approved a new fiberglass roof for 553 Edgewater Place to replace the old asphalt shingle roof. 2) 757 Lincolnway East Ms. Klemnec reported that a Certificate of Appropriateness had been approved for a retaining wall, wooden stairway, and fence at the rear of the property at 757 Lincolnway East. 3) 517 Edgewater • Ms. Kiemnec reported that a new wooden stairway had been built along the riverfront property at 517 Edgewater Place. The Commissioners indicated that the stairway was built to replace an old deteriorated one and no action was necessary. • 4) 619 Edgewater Ms. Kiemnec reported that a Certificate of Appropriateness had been approved for a porch balustrade at 619 Edgewater Place. She also indicated that Mr. Smith has completed the landscaping and retaining wall on his riverfront project. He will complete the railing and fieldstone on the wall next spring. 5) Union Station Mr. Oxian reported that the Certificate of Appropriateness Committee, Mr. John Stamper, an architect and former preservation planner for the Commission, and Ms. Kiemnec met with Mr. Kevin Smith and his architect, Mr. Tom Kenrick, for preliminary review of Union Station. The Committee agreed with Mr. Smith's plans for the station but asked for more specific details on several items (see Appendix B). 3 • g. Staff Report 1) Preservation Plan Ms. Straw distributed the bound copies of the Preservation Plan. She indicated that one page was missing which she will hand out at the next meeting. 2) Certified Local Governments Ms. Kiemnec indicated that Mr. Nimtz had reviewed the proposed state regulations for the Certified Local Governments program. She asked If any of the commissioners had additional comments or questions and if not, she will draft a letter to the State Division of Historic Preservation with our comments. She indicated that she had sent a brief synopsis of the program to the County Commissioners and the Mayor and offered to answer any questions they might have. 3) Industrial Buildings Project . Ms. Kiemnec indicated that she had done a mailing to several local fraternal groups, bank presidents, the School Corporation, and the South Bend Library to explain the Industrial Building Slide Project and offer it as a program for their meetings. • 4) Darden Bridge Ms. Straw reported that an application to the National Register of Historic Places for the Darden Bridge was submitted on October 29, 1984. It will most likely be before the Review Board at their January meeting. 7. Old Business No Report 8. New Business a. Nominating Committee Mr. Oxian reported that Mrs. Sporleder appointed Mr. Nimtz as chairperson of the Nominating Committee. Mr. Nimtz appointed Mrs. Choitz and Mr. Newburn as members of his committee. They will meet and give their report for the January meeting. 4 • • • b. Evaluation Forms Ms. Kiemnec reported that the Personnel Committee will meet with staff members in December for an employee evaluation. She Indicated that Mrs. Sporleder requested that any commissioners who want to make comments give those comments to a member of the Personnel Committee. c. Statue of Liberty Ms. Straw reported that a St. Anthony's class is working with the County Commissioners and Southhold Restorations to restore the small Statue of Liberty in front of the St. Joseph County Courthouse. The Commission recommended that we send a letter to the class commending their action and also write a letter to the editor indicating our support and approval of their project. d. 519 North Michigan Mr. Oxian reported that South Bend Heritage is working to move and save the house located at 519 North Michigan. He suggested that the Commission offer its help and support for the project and report back at the December meeting. e. Historic Districts 1) Riverside Drive Historic District Ms. Kiemnec reported that the steering committee for Riverside Drive has completed the first draft of their standards. Ms. Kiemnec and Mrs. Choitz have reviewed the standards which will be ready for review by Commission members in January. A public hearing will be held on the Riverside Drive Historic District designation at the regular monthly meeting of the Commission In January. 2) Lincolnway East Standards Ms. Straw reported that the Standards booklet for Lincolnway East is almost ready to go to the printers. It should be completed in January. c. Historic Landmarks Mr. Oxian reported that 322 W. Marion was designated a landmark by the Common Council on December 3, 1984. ... 1 0 No Report 2 Ll e. Public Relations & Community Education Mrs. Sporleder asked that the Public Relations & Community Education Committee look Into publishing a brochure on the Industrial Buildings Project. f. Environmental Impact Statement 1) 740 Bronson Ms. Kiemnec reported that a Certificate of Appropriateness was approved for 740 Bronson on Friday, December 7, 1984 when the owner, Mr. Ron Farr met with'the C. of A. Committee. The owner will construct a screened -in porch In the south corner of his rear yard. 2) 757 Lincolnway East Mrs. Sporleder read a letter from Mr. Bili McCarthy, the owner of 757 Lincolnway East (see Appendix D) in which he requested the Commission's support for his proposal to vacate the alley next to his property. The Commission directed Ms. Klemnec to write a letter to Mr. McCarthy Indicating that it opposes vacation of the alley until provisions can be made for access by the neighbors and emergency vehicles. A copy will be sent to the Board of Public Works. g. Staff Report 1) Preservation Plan Ms. Straw distributed the revised bound copies of the Preservation Plan. h. Personnel Committee Mrs. Sporleder reported that the Personnel Committee had met and would forward comments to Ms. Kiemnec and Ms. Straw by the middle of the week of December 17, 1984. 7. Old Business a. 519 N. Michigan Ms. Kiemnec reported that she and Ms. Straw had inspected the house at 519 N. Michigan Street and found It to be In very good condition with all of its Interior architecture Intact. South Bend Heritage has 75 days to try to market the building to be N moved. Ms. Kiemnec indicated that she offered the Commission's support and help for the project. b. Water Landmarks Program Mr. Oxian asked the staff to obtain more information on the Water Landmarks Program. 8. New Business Ms. Klemnec indicated that the State Historic Preservation Oftice was asking for grant requests for 1985186 funds to be turned in by December 17, 1984. Myers, 821 Forest Ave. SBIN 46616 ' Pres., PANA To confirm my conversations with various and sundry individuals, in or around government and historical preservation, I am writing to detail to YOU our dedication here in PANA to preserving Fire House #6 and the South Bend Civic Theater group that uses it. We concurred in our PANA Board Meeting this past week that we will do all that it takes to repair the Fire House. We, also, concurred that we would ask the City to consider deeding the property to us so that we could preserve and enhance its historical significance in the neighborhood and the community. We believe it can continue to serve as a focus for the arts; but, also, particularly, with our long-term interest in acquiring the vacant lot across Portage, can become the central structure in a Neighborhood Center ae that could serve our area and the larger Near NW Neighborhood' We suggest that the City would be able to retain a full measure of control over the fitness of our use of the site through the Historical Preservation Commission rules and procedures. We, al so, submit that we consider ourselves to -be experts in renovation, preservation and use of older structures. Gene DeFauw, PANA V -P, and I would like to inspect the damage (as soon as Dir. Barnard advises the Insurance Adjusters have completed their inspection) so we can begin planning for repairs. Please schedule a meeting to discuss all ramifications of such a transfer. Sporleder: After considering our metting of T,?ovember 7th, T was left . with the impression that you would not opr)ose my attempt to have the alley that adjoins the 757 Tincolnway ast property vacated. As I indicated at our meeting, I am completely flexible, to the point where I would "donate" my rear parking area at 757 to the neighbors for extra manueverability(for large trucks, etc) in that alley intersection. I would also landscape the rear area to make it more practical. As I stated at our meeting I am only interested in closing the front 1/2 to 2/3 of the alley. This would allow the one neighbor to be able to park in his back yard. After the alley was vacated i would then purchase the "car lot" where I would be interested in building more office space of a design that would be approriate for a historic area. I am writing to you to appeal for your help in this matter. As I stated at our meeting I have run into somewhat irrational opposition for my plans from one or two of the neighbors who fear City Services (i.e. police & fire) would somehow be hindered by the vacation of the alley.
