July meeting, Mr. Frank Gilbert, Assistant General Counsel for the National Trust, in South Bend for the day on August 17th.` ,I have arranged for him to have lunch with the Historic Preservation Commission and our attorney, Kevin Butler from 12:30 until 2:00 at Tippecanoe Place. Please let me know at our regular August meeting (on the 15th) if you will be attending'so I can.make reservations. Budget & Finance Page 2 August 15, 1983 Ms. Kiemnec reported that she would attend the Community Development Public Hearing on 1984 Funding. b. Historic Districts 1 ) Seebi rt Court Ms. Kiemnec reported that she had been called by property owners on Seebirt Court. The city will remove the east sidewalk and the grassy island and blacktop the entire court after replacing sewers. Mr. Newburn made a _motion that the HPC write to the Board of Public Works to inquire what exactly the project entails and if the lamppost and island can be retained. The letter would also offer the Commission's review: of and _advi.ce'on. -find a solution which would keep the Court's historic and aesthetic qualities intact. Mrs. DeLaruelle seconded; motion passed. c. Historic Landmarks 1) 52228 Gumwood The Commission again informed Mr. Whitaker that the porch on his landmark house is inappropriate because the scale and style do not correspond to his federal style house. Since Mr. Whitaker did not agree to tear the porch, - down, the Commission reaffirmed its earlier position. Mrs. Sporleder made a motion to rescind the landmark status if the two -story porch remains on the house; Mrs. Choitz seconded; motion passed. The Commission discussed whether or not the barn would still remain a landmark and agreed that the motion included only the house and not the barn. d. Legal 1) County Ordinance Ms. Kiemnec distributed a draft of the County Ordinance (see Appendix A) and indicated the additions (underlined) and the deletions (crossed out). Mr. Newburn made a motion to accept the ordinance draft; Mr. Oxian seconded; motion passed. e. Public Relations & Community Education 1) County Maps Mr. Oxian reported that the revisions of the county maps have gone to the printer. The Commission will receive 1000 copies. f. Environmental Impact Statement 1) Baugo Creek Site Ms. Kiemnec reported that nothing was surveyed in the area of the proposed park_ site. Mr. Oxian suggested that he remembered a farmhouse in the area and proposed that the planner review the site. g. Staff Report 1) Small Town Survey Ms. Kiemnec distributed the history of Lakeville to the Small Town Survey Committee. 7. Old Business a. Reappointment of Architectural Historian Mrs.Sporleder tendered her resignation. 'Mrs. " - Choitz made a motion to reject Mrs. Sporleder's resignation and reappoint her for a term of three years; Mr. Newburn seconded; motion passed. 8. New Business a. Multiple Resource Area Page 3 August 15, 1983 1) Contract of Elizabeth A. Straw Mr. Newburn moved that the Commission approve Ms. Straw's contract; Mrs. DeLaruelle seconded; motion passed. 2) New Buildings Ms. Kiemnec proposed to add seven buildings to the Multiple Resource Area (see Appendix B): Mr. Oxian moved to accept the additions; Mr. Newburn seconded; motion passed. b. Certificates of Appropriateness Mrs.'DeLaruelle suggested that the Liaison Committee of Edgewater Place Historic District be notified of Certificates of Appropriateness. Ms. Kiemnec proposed to do a form that would be mailed twice monthly to" the Chairperson of the Com- mittee with the current Certificates of Appropriateness. c. Barns. Mrs. Sporleder suggested that at some point in the future the HPC do a study of barns and possible ways of saving them. 9. Hearing of Visitors - no report 10. Announcements & Miscellaneous Matters a. Visit from Mr. Frank Gilbert Ms. Kiemnec reminded everyone of Mr. of the day's activities. 11. Adjournment Gilbert's visit and passed out a schedule Mrs. Sporleder made a motion to adjourn; Mr. Newburn seconded. Section 26.42.020 of the St. Joseph County Code is hereby amended by the addition thereto of the following new Subsection B: B. Whenever a Commissioner fails to attend four (4) consecutive, regularly scheduled meetings, the Historic Preservation Commission may determine the position to be vacant and certify to the appropriate appointing body that the position is vacant and the appropriate appointing body shall, within thirty (30) days after receipt of notice from the Commission, appoint another and different Commissioner for the remainder of the term. Section 2. Subsection A of Section 26.78.060 of the St. Joseph County Code is hereby amended to read as follows: A. The Historic Preservation Commission shall survey, identify, plan for, and advise the County @emm4:ssiemers Council and the Area Plan Commission concerning the desig- nation of historic landmarks and the establishment of Historic Preservation Districts. The Historic Preservation Commission shall recommend the designation of historic landmarks and the establishment of Historic Preservation Districts on the basis of historical and cultural signifi- cance, educational value, and suitability for preservation. Section 3. Subsection B of Section 26.78.060 of the St. Joseph County Code is hereby amended to read as follows: B. Historic landmarks shall be designated and Historic Preservation Districts established by the Beard e Eex�x►ssieners Countv Council through the passage of an ordinance. Said ordin- ance shall be initiated in the usual manner: 1. By a member of the Beare- ef- Eei99ieaers County Council; 2. By a petition of the owners of fifty percent or more of the subject area; or 3. By the Area Plan Commission. Cl) Section 4. Subsection B of Section 26.78.070 of the St. Joseph County Code is hereby amended to read as follows: B. Nothing in this chapter shall be construed to prevent the ordinary maintenance and repair of any building, structure, or use which will not involve a change in any exterior features or to prevent the con- struction, reconstruction, alteration, demolition, or moving of any building, structure, or use which the Building Commissioner or other official having such power may certify as required by the public safety because of an unsafe or dangerous condition. Section 5. Paragraph 1 of Subsection E of Section 26.78.070 of the St. Joseph County Code is hereby amended to read as follows: E. 1. The Historic Preservation Commission shall consider the application within thirty (30) days following its receipt of the application for a certificate of appro- priateness, and shall either: a. Issue a certificate of appropikateness stating that the proposed construction, reconstruction, alteration, demolition, or moving is in conformance with the provisions of this chapter and authorizing the Building Commissioner to issue a building permit, demolition permit, sign permit, or moving permit if required; or b. Deny the application stating in writing the reason(s) for such denial. Upon such denial, the applicant may appeal said denial to the County Eemmissioners Council which shall make a final determination of the application. Failure of the Historic Preservation Commission to take action within Forty -five (45) days after receipt of the Application by the Commission shall constitute approval of the application. Section 6. Section 26.78.080 of the St. Joseph County Code is hereby amended by changing the period at the end thereof to a comma and adding the following language: (2) APPENDIX A "of Historic Landmarks and of buildings or structures within Historic Preservation Districts." Section 7. Section 26.78.120 of the St. Joseph County Code is hereby amended to read as follows: 26.78.120 Requests to County Council to delay alteration of historic landmarks. A. Where the Historic Preservation Commis- sion deems it necessary, the Commission may petition the legislative -body County Council for a temporary delay in the issuance of the required permit(s) for proposed construction, reconstruction, alteration, demolition, or moving of a desig- nated historic landmark for the purpose of preparing a preservation plan for said landmark. Such request petition shall be for a specified period of time, and in no case shall the request exceed one (1) year. B. The legislative -beefy County Council shall grant the Commission's request petition when it finds that: 1. Such action will not cause the owner of the subject property to suffer hardship; and 2. Such delay will not be injurious to the public health, safety, or welfare; and 3. In keeping with the intent of this chapter, such action is necessary and appropriate. In no case may the delay granted by the County Council exceed one (1) year, but the Commission may petition the County Council for a continuance of any such delay granted by the County Council in accordance with the same procedures set forth above for,the initial petition. Section 8. The St. Jospeh County Code is hereby amended by the addition thereto by the following new section: 26.78.130 Gifts, grants, legacies, bequests, and endowments. The Historic Preservation Commission may accept throgh gift, grant, legacy, bequest, or endowment, monies and preservation easements in real property for the purpose of the preservation of historic landmarks and Historic Preservation Districts. Expenditures of such money, regardless of the source, must be deposited in a special Historic Preservation Commission account, and receive prior approval from the County Council before expenditures may be made.
