1. Call to Order
The meeting was called to order at 7:34 p.m.
2. Roll Call

3. Approval of Minutes
Mr. Oxian suggested a change under -#9 Hearing of Visitors for the October 18,
1982 minutes. He, rather than Mr. Wasielewski, stated that the HPC has no control
over land/UAF : Nimtz moved.to accept the report with the suggested change; Mr.
Hayes seconded; motion carried.
4. Treasurer's Report
Ms. Kiemnec explained the transfer of funds from Line Item 241 to 263 to pay the
Commission's Secretary, Ms. Fackelman. She further reported that the Project
Small Town Survey Balance should be $4,048.83 instead of $3,448.83. Mr. Oxian
made a motion to accept the report; Mr. Nimtz seconded; motion carried.
5. Correspondence

b. Historic Districts
Ms. Kiemnec read a letter from Paul Crowley, President of .the Edgewater Place
Neighborhood Association, regarding replacement of the third member of the
Edgewater Place Historic District .Li;ason Committee. (See Appendix A.) Mr..
Oxian made a motion to refer the matter to the Historic District Committee;
Mrs. DeLaruelle seconded;motion carried; Mrs. Sporleder voted nay.
c. Historic Landmarks
1) Report on Oliver School
Mr. Oxian reported that Oliver School has been declared a landmark by the
Common Council.
2) 615 W. Colfax
Mr. John Ford, representing Christopher Batalis, explained his client's
intention to purchase the property at 615 W. Colfax, have it certified as
a historic structure contributing to the West Washington National Register
Historic District, and donate a facade easement on the building. He
requested on behalf of his client that the Historic Preservation Commission
write a letter to the Area Plan Commission stating ';a. -favorable position
on the proposed zoning change from B residential to C-1 commercial. Mr.
Nimtz moved that the action of the Commission concerning the premises at
615 W. Colfax on October 181 1982 be rescinded and expunged from the record.
Mr. Hayes seconded, and the motion carried unanimously. Mr. Hayes made
a motion that the Historic Preservation Commission send a letter to Area
Plan.stating that the Historic Preservation Commission has no objections
to the zoning change; Mr. Nimtz seconded; motion carried; Mrs. Sporleder
abstained.
d. Legal
1) Preservation Law Reporter
Mr. Butler, the Commission's attorney, recommended that, the Commission
continue its subscription to the Preservation Law Reporter. Mr. Oxian made a
motion that the HPC purchase the PLR: Mr. Nimtz seconded; motion passed.

e. Public Relations & Community Education
1) County Maps the
Mr. Hayes reported that/Public Relations & Community Education Committee
had met with Southhold Restoration's Committee to discuss the possible
reprinting of the County Auto Tour Maps. The Committee agreed to keep
the same format -:..and ask Crumlish/Sporleder & Associates to do the revisions
for us if Southhold can fund the project. Southhold will discuss the
printing costs, which are expected to be about $550, at its November 18th
board meeting and let the Commission know its decision.
2) Camera
Ms. Kiemnec reported that the best price on a 35mm camera was at Gene's
Camera Store for an Olympus OMIOFC for $189.95 minus a $30 rebate. They
also have a sale on the case which is normally $24.95 and is now selling
for $19.95. Mr. Oxian made a motion that the Commission purchase the
Olympus; Mrs. DeLaruelle seconded; motion carried.
f. Environmental Impact Statement
1) Certificate of Appropriateness
Ms. Kiemnec reported that Mike Vaerewyck of 524 River Avenue, who was
given a Certificate of Appropriateness for a new .garage in July, would like
to make some changes in the plan. Rather than an.L-shaped structure, he
wants to make it almost square with a gable roof. The other features will
remain the same as in the Certificate of Appropriateness (i.e. clapboard
siding, wooden door).. Ms. Kiemnec approved the plan and put an addendum
on his Certificate of Appropriateness. Mr. Oxian made a motion that the
Certificate of Appropriateness be accepted; Mrs. Sporleder seconded;motion
carried.
2) Violation of Standards Notification
Ms. Kiemnec read Mrs. Choitz' suggestion for a Violation of Standards Noti-
fication letter.(see Appendix B). Mr. Oxian made a motion to send Mrs.
Choitz! letter to the Commission's attorney for his suggestions and then
send it to future... violators; Mr. Hayes seconded; motion carried; Mrs. Spor-
leder voted nay.
g. Staff Report
1) Small Town Survey
Ms. Kiemnec reported that she has only nine buildings left to survey at
Notre Dame.
2) City Survey Update
Ms. Kiemnec reported that she had added two buildings to the entry:
201 N. Ironwood - S/11 Austin & Shambleau
16977 Adams Rd. bank barn - S/11
and changed the rating on .1133 N. Allen from C/9 to S/11 because it is an
Ernest Young designed house.
7. Old Business
a. Downtown Buildings
Mr. Oxian reported that the Common Council has tabled the Ordinance for the
Demolition Ban of Downtown Buildings and requested that the Redevelopment
Staff help the HPC notify the owners of the benefits of national or local
designation.

8. New Business
a. Northern Indiana Historical Society Publication
Ms. Kiemnec reported that the Northern Indiana Historical Society will be
reprinting the Pictorial & Biographical Memoirs of Elkhart & St. Joseph County,
Indiana, originally printed in 1893. The cost will be $39.95. Mr. Hayes made
a motion that the HPC purchase the book; Mrs. Sporleder seconded; motion
carried.
b. Technical Assistance
Mr. Oxian made a motion that the remaining monies in the HPC budget be trans-
ferred to the technical assistance line item and -that the 10 -hour per week
contract with Margaret Fackelman be -increased commensurate with said monies
until the end of the year; Mrs. DeLaruelle seconded; motion carried.
c. Maintenance of Landmarks
1) Union Station
Mr. Oxian made a motion that the HPC send a letter to the owners of Union
Station informing them that they are violating the standards of the land-
mark designation by lack of.maintenance and that the building should be
properly secured. He further stated that copies of the letter should go
to the Building Department, -the Neighborhood Code Enforcement Department,
and the City Legal Department. Mrs. DeLaruelle seconded; motion carried;
Mrs..Sporleder voted nay; Mr. Hayes abstained.
9. Hearing of Visitors
No report.
10. Announcements & Miscellaneous Matters
a. December Meeting Date
The regular monthly meeting of the Commission was changed from December 20th
to December 13th at 7:30 p.m.
11. Adjournment
Mrs. DeLaruelle made a motion to adjourn; Mr. Hayes seconded; the meeting was ad-
journed at 9:21 p.m....
Appendix A
Amendment to the Election Procedures
Section 7a. Upon the resignation of a member of the Liaison Committee during
the three-year term of office, a replacement will be appointed
by the Historic Preservation Commission on the recommendation of
the Historic District Committee_ This person shall serve on the
Liaison Committee until the next general or special election.
Appropriate information shall be distributed by the Liaison Com-
mittee to all resident property owners concerning the filling of
the vacancy. From the names suggested by property owners, the
Liaison Committee will make a selection and then a recommendation
to the Historic Preservation Commission District Committee.
7b. The resignation of two or more members of the Liaison Committee
within the first two years of the three-year term shall be reason
for that committee to call a special election. The election pro-
cedures shall be the same as stated in the original document.
Appendix B
* - SAMPLE VIOLATION OF STANDARDS NOTIFICATION
The Historic Preservation Commission has been alerted to the fact that
you have made an alteration to the exterior of your home at
in the Edgewater Place Historic District without obtaining a Certificate of
Appropriateness in advance.
You are therefore in violation of Section 21-117.2 of the Municipal Code
of the City of South Bend. An approved certificate is mandatory before commencing
any construction, reconstruction, alteration, demolition or moving of any exterior
features of any building within a local historic district.
The alteration has been observed and evaluated and the report of the vio-
lation has been placed on file with the proper city departments and is duly
noted in our commission files.
It is the decision of the commission to refrain from proceeding with due
process in this violation because we desire to encourage voluntary compliance.
However, any future violations will be prosecuted to the full extent of the law.
Please note that the penalty for violation is a maximum of $100 per day.
Please contact the Historic Preservation office for details on filing
correct application for any future exterior changes. In fairness to all residents
of the Historic District we cannot ignore violations, and will not in the future.
