3. Approval of Minutes
The March 15, 1982 minutes were approved as written. Mr. Oxian made the motion; Mr.
Nimtz seconded; motion passed.
4. Treasurer's Report
Ms. Kiemnec read the Treasurer's Report for March. She reported that the first
installment of the DNR grant had been received and that the grant money as well as
the balance of Southhold Restoration's grant was reflected in the $2,413.79 figure
shown. She further indicated that the Project City Survey Account- will be closed
out as that project is completed. Mr. Oxian made a motion that the report be
accepted as read; Mr. Nimtz seconded; motion carried.
5• Hearing of Visitors
a. Report by Delores Davisson's Class on the Computer Project
Mrs. Davisson's class presented an overview of the project they are working on
for the Commission and gave each of the Commissioners a packet of information
explaining the project. Mrs. Davisson suggested that the Class might return
at a later date to discuss ways that the project might be implemented.

Ms. Kiemnec reported that there has been no word from the City Building
Commissioner as to his decision on the Commission's request for a one
year delay of the demolition request of 601 Lincolnway East. There
has been no further correspondence received on 605 or 617 either.
b) Edgewater Letter
Ms. Kiemnec read a letter (Appendix A) composed by the Edgewater Place
Historic District Liaison Committee. She requested permission to have
it printed and distributed to all Edgewater owners. The cost to the
Commission would be approximately $7.00 for duplicating and postage to
non - resident owners. Ms. Sporleder made a motion that the Commission pay
for duplicating and postage (only_ living "in the district)
and that these letters be distributed; Mr. Oxian seconded; motion approved.
c) Historic Landmarks
1. Second Reading on 314 West LaSalle & 233 North Lafayette
Ms.._DeLaruelle made a motion that these buildings be declared land-
marks by ordinance and sent to the Common Council; Mr. Oxian seconded;
motion carried.
2. Second Reading on 518 North Lafayette
Ms. Kiemnec read correspondence on this matter from the South Bend
Medical Annex' Attorney, Edward N. Kalamaros (Appendix B) and from
Jeff Gibney of Southold Heritage (Appendix C). Mrs. Sporleder made a
motion that the building be declared a landmark by ordinance and.
to the Common Council; Mr. Oxian seconded; Mr. Nimtz voted nay; motion
carried.

3. First reading on 644 Monroe
Mr. Oxian presented the house for first reading and related that
he had received a letter of consent from the owner.
d. Legal
1) Ordinance Amendment
Ms. Kiemnec reported on the Legal Committee Meeting and the changes made
to the Ordinance Amendment (Appendix D). Mr. Oxian moved that the corrections
be made and presented to the Common Council; Mrs. Sporleder seconded; motion
carried.
e. Public Relations & Community Education
1) Preservation Week Activities
Ms. Kiemnec reported that Southhold Restorations would like to have Don
Sporleder or one of the Commissioners speak for the Awards Breakfast to
explain the process of the South Bend City Survey. Mr. Nimtz made a motion
to accept Southhold Restorations suggestion; Mr. Hayes seconded; motion
passed.
f. Environmental Impact Statement
1) 611 Edgewater Drive
Mr. Strandhagen at 611 Edgewater wants to reroof his house. Mr. Oxian
made a motion to approve the Certificate of Appropriateness; Mr. Nimtz
seconded; motion passed. Mr. Oxian made a motion that with reroofing
projects involving original roofs of asbestos or asphalt, the Commission
allow the Preservation Planner to approve Certificates of Appropriateness;
Mr. Nimtz seconded; motion passed.
2) 619 Edgewater
Mr. Kevin Smith wished to extend a concrete wall along the riverbank from
_the Pumping Station to the first large tree and then landscape the area
between the trees with fieldstone. Mr. Oxian made a motion to put this
request off till In the mean time, the Commission asked Mr. Smith to
check to make sure he owns the riverfront property, to check on the riparian
rights"to see if he is allowed to make any changes near the Pumping Station,
to consult with other riverfront owners along the street to come up with a
neighborhood plan for the whole riverfront in that area, and finally to
re- design his plan (if he does, in fact, own the property and can develop it)
in keeping with the Standards and a general neighborhood plan. Mrs. Sporleder
seconded; motion carried.
3) 651 River Avenue
Mr. Ron Farr wishes to replace the current balcony which is approximately
3' x 8' with an ornate wrought iron railing with a 10' x 10' balcony. Mr.
Hayes made a motion to reject the proposal because it would drastically alter
the facade and is not in keeping with the standards. Mr. Nimtz seconded;
the motion carried. The Commission asked that Mr. Farr re- design his plan to
be more in keeping with the Edgewater Place Historic District Standards and
present it at the next regular Commission Meeting.

4) Pierce Road Improvements
Ms. Kiemnec reported on a request from McDonough Associates for a statement
on historic buildings which would be affected by the Pierce Road Improvements.
She A ndicated that the two structures most affected would be the Madison Union
Chapel and the house at 10128. She read the reply (Appendix E) she had
written. Mrs. Sporleder made a motion to accept the report; Mr. Nimtz
seconded; motion carried.
g. Staff Report
1 ) Report on Summary Report
Ms. Kiemnec reported that 82 books had been sold, 50 had been distributed to
other government agencies, local organizations, etc. and approximately 64
remain. She gave printing costs of $1179 for 100 and $1557 for 200 for a
second printing at Schillings which was the best estimate of the five companies
consulted. She had spoken to Mr. Jasinski, the President of the County
Commissioners, and Mr. John - Lentz, the Chief Deputy Auditor, and they.
will allow the Commission to use the money put in the County General Fund
from the sale of the Summary Report. Mr. Oxian made a motion that the
Summary Report be taken to Schillings for a second printing�&fr200 copies;
,Mr. Nimtz seconded;, =motion carried.
2) Report on Progress of Small Town Survey
Ms. Kiemnec- reported that field work on St. Mary's Campus has begun and the
St. Mary's Intern is progressing well with her research.
3) Report on Preservation Tax Incentives Conference - held off till next meeting.

8. Old Business
a. Historic Preservation Commission Photographs
Ms. Kiemnec requested the use of Commission photographs -for the Architectural
Guidebook she is working on with Mr. Stamper, Ms. Choitz, and Mr. Mullins.
Mr. Hayes made a motion to allow Ms. Kiemnec to use the photographs provided
the Historic Preservation Commission is credited under each photo used; Mr.
Nimtz seconded; motion carried.

Dear Neighbor,
Now that spring and warm weather have again returned, thoughts will
turn to chores of fix -up and clean -up. As you know, the city ordinance
which granted us historic status also contains standards which must be
maintained. These standards were developed and approved by all of us.
It falls to us now, in our second year as an historic district, to abide
by these self- imposed standards.
The standards are not intended to be restrictive - they are guide-
lines intended to assist all of us to maintain the historical integrity
of our homes and neighborhood.
Although our area has been designated as an historic preservation area,
meaning maintaining the materials and structure of our homes in their
present condition, restoration or rehabilitation is allowable. Definitions
of these terms can be found in your copy of the Edgewater Place Historic
District Standards.
If you intend to make any type of change to the external appearance
of your home or property, we urge you to review the Standards book to
see which are the preferred, allowable and prohibited types of changes
and materials. If you are uncertain or have any questions, feel free to
ask any one of the committee members named below or contact Ms. Karen L. Kiemnec,
the Historic Preservation Commission Planner.
The support of the neighborhood which was vital to securing adoption
of the Historic District designation must be continued. Together we can
make our neighborhood a source of individual and community pride.
Attached is a list of procedures to follow before beginning your project.

Steps to Follow to Obtain a Certificate of Appropriateness
1. For any major exterior changes, consult with the Liaison Committee
(Don Keim, chairman, Gina DeLaruelle, or Chuck Martin).
2. Call the Historic Preservation Commission office (284 -9798) for a
Certificate of Appropriateness.
3. The Planner will set up an appointment with you to review the project.
4. If, upon making an assessment of the project, it is determined that
the EPHD Standards adopted by the neighborhood were followed, the pro-
ject will be approved. You may then sign the Certificate of Appro-
priateness and submit the $3.00 fee. The following day, you may pick
up your copy of the Certificate of Appropriateness from the Historic
Preservation Office, 11th floor, County /City Building and take it
to the Building Department (12th floor, County /City Building) to
obtain your Building Permit. If your project does not require a
Building Permit, you may begin construction upon receipt of the
Certificate of Appropriateness.
OR
5. If there is a question as to the design, the Planner will invite you
to attend the next regularly scheduled Historic Preservation Commission
meeting (third Monday of every month) to explain before the Commission
the details of your project. Bring with you drawings, floor plans,
diagrams, samples of materials, etc., anything that will help to de-
scribe your project in detail. (If you are unable to attend the meet-
ing, the Planner can present these materials to the Commission for
you - make sure the drawings are descriptive enough to answer any
questions about the undertaking.) If the Commission feels that the
project is in keeping with the Neighborhood Standards, it will approve
your project, you may sign the Certificate of Appropriateness and
submit the $3.00 fee. The following day, you may pick up your copy
of the Certificate of Appropriateness (or have it mailed to you), and
take it to the Building Dept. (12th floor, County /City Building) to
obtain your Building Permit. If your project does not require a
Building Permit, you may begin construction upon receipt of the
Certificate of Appropriateness.

6. If the Commission feels that the project violates the EPHD Standards,
it will reject the plan and ask you to redesign the project to adhere
to the Standards and maintain the historic and architectural integrity
of your building and the neighborhood. You may then resubmit the
plans for your project at the next regularly scheduled Historic Pre-
servation Commission meeting. The Commission or its Planner will be
happy to work with you on your design and make suggestions on how
you can comply with the Standards and yet make the desired changes
to your home.

This letter will advise you that I am general counsel
for the South Bend Medical Foundation. On behalf of the
Foundation I wish to thank you for your invitation extended
to Mr. Markey to attend the Historic Preservation Commission
meeting to be held on April 19, 1982 regarding the home at
518 North Lafayette Boulevard, South Bend, Indiana. Dir.
Markey will,be unable to attend; however, please let this
letter express his sentiment and that of the Foundation.
The house existing at 518 N. Lafayette Boulevard was
purchased by the South Bend Medical Foundation several years
ago in order that they might expand their building facilities
in the future and acquire ample parking areas for their
patients and personnel.
Our client has always felt that this house should not
be sacrificed but should be moved in order to preserve its
historical value. In accordance with this thinking our
client made a conditional donation of the house itself to
Southold Heritage on or about March 19, 1980, i.e., the house
would belong to them providing it was removed within certain
time perimeters. That date of removal deadline has now been
set for on or about April 30, 1982. It is our understanding
that Southold Heritage is very near to implementing their
desire to remove the house and relocate the same.
It must be emphasized that our client's site plan, which
included this area, was approved by the Area Plan Commission
as well as the City Council for purposes of a parking lot.
A clear understanding with all interested parties, as well as
the Plan Commission and the City Council when this property
was rezoned, was that the house would be removed and the
land upon which it stool be used for parking spaces needed
as a prerequisite to rezoning. Our building expansion in

accordance with tie plans submitted at the time of razoninc
nas now been completed and our client needs to move on to
its requisite committment with regard to the parking area.
Additionally, the Foundation has fulfilled its promise at
this point of landscaping tie area adjacent to its expandea
:uilding facility, and will likewise keep its committment
to landscape the area in and about the proposed parking lot.
It is the Foundation's hope that Southold Heritage will
accomplish the desired move and it would be with the greatest
regret if the biome was not removed and demolishment of the -
same proceeds. However, let there be no question about the
fact that such demolition must proceed if the home is not
removed from the site and the parking spaces developed as
a part of the terms of the rezoning granted the Foundation.

I received a copy of the letter, dated 15 April 1982, sent to you
from Edward N. Kalamaros concerning the house at 518 N. Lafayette.
I thought the Commission might wish to have current information on
the status of the proposed house move before they make their final
vote on the Landmark status at its present location.
At the moment we are working with a group of businessmen who
desire to move this building and who have their entire house move
package together with the exception of the final negotiations on the
purchase of the land. We can not guarantee that the move will take
place but we are optimistic.
The Medical Foundation has been most co- operative with all our
endeavors to move the annex. It is clear that they wish, as we do,
to save this architecturally and historically outstanding building
through removal.

ORDINANCE NO.
AN ORDINANCE AMENDING SOUTH BEND MUNICIPAL CODE
CHAPTER 21, ARTICLE 6.5,.ENTITLED
HISTORIC PRESERVATION COMMISSION
STATEMENT OF PURPOSE AND INTENT:
In the operation of the Historic Preservation Commission,
pursuant to the current code provisions for that operation,
certain changes and additional provisions have become necessary
for the effective and efficient operation of that Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
SOUTH BEND, THAT:
SECTION I. Article 6.5 of the Municipal Code of the City
of South Bend, Indiana, shall be'amended as follows:
A. Section 21- 117.1(b) shall be amended by the addition
thereto of the following new sub - section (4):
(4) Whenever a Commissioner fails to attend
four (4) consecutive, regularly scheduled meetings,
the Historic Preservation Commission may certify to'
the appropriate appointing body that the position i's
determined to be vacant and the appropriate appointing
body shall, within thirty (30) days, appoint another
and different Commissioner for the remainder of the
term.
B. Section 21- 117.2(b) shall be amended to read as
follows:
(b) Reserved. Prepare and submit for approval
an annual budget which the Common Council must approve
or deny.
All personnel hired by the Commission on a full -
time or part -time basis shall be approved by the Common
Council.

Where the Historic Preservation Commission deems
it necessary, the Commission may petition the Common Coun-
cil for a temporary delay on proposed construction, recon-
struction, alteration, demolition or moving of a designated
Historic Landmark for the purpose of preparing a preserva-
tion plan for said Landmark. Such request shall be for a
specified period of time, and in no case shall the request
exceed one (1) year. The Common Council shall grant the
Commission's request when it finds:
1. That such action will not cause the owner
of the subject property to suffer hard-
ship; and
2. That such delay will not be injurious to
the public health, safety or welfare; and
3. That in keeping with the intent of Ordinance
No. 5565 -73, such action is necessary and
appropriate.
3. An application for a building permit, demo-
lition permit, sign permit or moving permit shall also be
deemed to be an application for a certificate of appro-
priateness. Within five (5) working days of receipt of
such application relative to a building, structure or use
in said district, the Building Commissioner shall forward
the application to the Historic Preservation Commission
for review and approval prior to the issuance of a permit.
4. Where no other permit is required, an appli-
cation for a certificate of appropriateness shall be filed
with the Historic Preservation Commission on the form pre-
scribed by the Commission. Said application shall include
the following information:
a. Name, address and telephone number of
the applicant;
b. Location of the subject building, struc-
ture or use;
C. Structural drawings and specifications,
floor plans, elevations, cross - sectional
plans, renderings, diagrams or other
such plans;
d. Samples of materials to be used, in-
cluding colors;
f. Where the proposed change includes a
sign, a scale drawing showing the lo-
cation of the sign on the structure or
property, the type of lettering, and
the method of illumination; and
g. Other such information as the Historic
Preservation Commission may require
under the provisions of this article.

the reason(s) for such denial. Upon such
denial, the applicant may appeal said de-
nial to the Common Council which shall
make a final determination of the appli-
cation. Failure of the Historic Preser-

within forty -five (45) days shall con-
stitute approval of the application.
In making such determination, the His -
Historic Preservation Commission shall
consider the following:
1. Appropriateness of the proposed con-
struction, reconstruction, altera-
tion, demolition or moving to the
preservation of the historic land-
mark, specifically, and/or-the His-
toric Preservation District, gener-
ally;
2. The detriment of the public welfare
if the proposed construction, recon-
struction, alteration, demolition
or moving is permitted even though
it is not deemed appropriate; and
3. The potential hardship that the denial
of a certificate of appropriateness
would cause the applicant.
6. Reserved.
7. The Historic Preservation Commission may
petition the Building Commissioner to use the legal means
available to him to cause the maintenance and /or repair
of any historic landmark in accordance with the intent of

(2) Such standards shall be applicable only to the
exterior features of Historic Landmarks and of
buildings or structures within Historic Preser-
vation Districts.
E. Section 21 -117.2 shall be amended by the deletion in
its entirety of existing sub - section (j) and by the addition
thereto of the following new sub - sections (j) and (k):
(j) Acquire or accept throuah gift, grant, legacy,
bequest, or endowment, monies and preservation easements
in real property for the purpose of historic preservation.
Expenditures of such money, regardless of the source, must
be deposited in a special Historic Preservation Commission
account, and receive prior approval from the Common Council
before expenditures may be made.
(k) The Historic Preservation Commission may bring
legal action to enforce the provisions of this article.
Section II. Article 9 of the Municipal Code of the City of South
Bend, Indiana, shall be amended as follows:
A. Section 21- 16.6(a) shall be amended to read as
follows:
(a) Any person or anyone acting in behalf thereof
who violates or fails to comply with any of the provisions
of this chapter with the exception of the provisions of
Article 8, Subdivisions, shall be guilty of a misdemeanor
and upon conviction there of shall be fined not less than
Ten Dollars ($10.00) and not more than One Thousand Dollars
($1,000.00), except that a violation of or a failure to
comply with any of the provisions of Article 6.5, Historic
Preservation Commission, shall be subject to a fine of not
less than Fifty ($50.00) Dollars and not more than Two
Thousand, Five Hundred ($2,500.00) Dollars. Each day that
a violation is permitted to exist shall constitute a sep-
arate offense. Any building erected, raised, converted,
or land or premises used in violation of any provisions of
this chapter or the requirements thereof, is hereby declared
to be a nuisance and such nuisance may be abated in such
manner that nuisances are now or may hereafter be abated
under existing law.
B. Section 21- 166(c) shall be amended to read as
follows:
(c) The City Attorney shall immediately upon any
such violation having been called to his attention, in-
stitute injuction, abatement or any other appropriate
action to prevent, enjoin, abate or remove such violation,
except that in the case of any such violation of anv pro-
vision of Article 6.5, Historic Preservation Commission,
in which the City Attorney does not institute such action,
then such action to prevent, enjoin, abate or remove such
violation may be instituted by and on behalf of the His-
toric Pres Commission by a attorney employed b

Dear Ms. Cameron:
I am writing in regard to your request of April 19, 1982 concerning
the buildings along Pierce Road which would be affected by the proposed
improvements. I refer to previous correspondence -::hick listed the fol-
!owing structures from the St. Joseph County Survey of Historic Sites
and Structures:

Store Building at southwest corner of Pierce and Dogwood
Southeast corner Pierce and Cedar, Madison Union Chapel
10910 Pierce, House and Barn
10899 Pie ' rce, House and Barn
10126 Pierce, House and Barn, Two Houses and Barn
As indicated in correspondence dated August 10, 1980, the Madison
Union Chapel is close to the road and would be affected by a road widen-
ing project. The Chapel was built in 1908 and is one of only a few his-
toric churches surviving in Madison Township. It has retained its original
character over the years with only one minor alteration, the entrance
addition on the west side. The structure is significant for its patterned,
slate roof, hip- roofed bell tower, and original window molding.
In addition to the church, the house at 10128 Pierce Road (part of
the complex at 10126) is also significant and is situated fairly close
to the road. It is a nice example of a Basic Box or American Foursquare
style with Prairie influences, a style not often found in rural St. Joseph
'_ounty. I have encloseda copy of the survey card on both the Chapel and
.he house.
The Commission would appreciate further detailed information on the
impact of the Pierce Road improvements on these two structures. If you
