Ms. Kopezynski mentioned that she had - spoken to members of the Trust at the conference she had re- cently attended and they were very pleased at the quality of the application. Mr. Oxian then mentioned that he had received a letter from the president of the National Trust referring to a possible tour of South Bend during the 1978 convention in Chicago. He read this letter to the Commission. He stated that South - hold is likewise interested in having such a tour and felt this matter should be pursued further. 6. Committee Reports City Survey Mr. Ted Wasielewski reported that there essentially were no problems. He has been trying to get a report from Brian Crumlish but was informed that he was out-of-town. He said he would request a written report, and possibly his presence, at the next monthly meeting. Budget and Finance Mr. Oxian reported that there was no report from this committee. Ms. Davisson asked. about the submission of the budget for next year and was told that it is usually sub- mitted around June. Mr. Oxian then spoke about the $8,000 and said it was up before the County Council and referred to committee. He likewise said that he was also sure that the Commission will get C.D. funds for the continuation of the City Survey. Historic Districts Mr. Ted Wasielewski informed the commission that he had spoken the previous week with Mrs. Charlotte Whittaker 5►, oft, of the West NorthgDrive of the possiblity of establishing the groundwork for the possibility of designating the North Shore Triangle as an historic district. He suggested that a meeting be set up with some of the interested parties in that neighborhood and directed the Planner to formulate the necessary action. Mr. Crumlish should be instructed to work with the Commission on the matter. Mrs. Whittaker, who was in the audience, spoke about the location and Mr. Wasielewski stated that the area encom- passed Michigan to Lafayette to Wakewa. Ms. Deloris March 21, 1977 Page 3 Davisson informed the Commission that Brian and Don and some students had done some preparatory material on this area. Mr. Wasielewski suggested that a neighborhood meeting be set up. Mr. Nimtz asked what possible opposition would there be and Mrs. Whittaker answered that it was principally a lack of interest but that there might be a couple of people who were opposed to it. Mr. Kline then said they were concerned about the very early historic district and landmark ordinances. He was told that these problems had now been resolved. Mr. Oxian stated that the Commission and/or the committee should give leadership in the district. Mr. Oxian then mentioned that he had been in touch with - Mrs. Rumpf who wanted to know the advantages and disadvant- ages of having her home declared a landmark. Mr. Oxian then informed the Commission that Mr. Galen Alsop had given a greatly detailed presentation of Facade Easements at the last caucus meeting. Mr. Oxian said the Commission was advised of the process of the property owner getting a facade easement and felt the Commission should go ahead with setting a sample case. Ms. Kopczynski asked who would pur- chase such a facade easement and was told the facade easement would be donated to the County Council or the City Council. She was also told, when she asked if it would be in perpetu- ity, that such an action would be "forever". Mr. Oxian de- clared that if such an easement would be donated to the County or City Council, it would be up to the Commission to enforce this easement. Ms. Kopczynski then asked about the assessment of the property facade. Mr. Oxian said an indi- - vidual would have to be hired to assess the value of the ease- ment. Ms. Kopczynski then declared that she thinks the entire procedure is too ambitious and too sophisticated for the Com- mission to embark upon at this time. There was quite a bit of discussion on this matter. Mr. Wasielewski added that, - according to Galen Alsop, there were three types of tax ad- vantages: property tax deduction; income tax reduction, and rehabilitation tax reduction. He said there were already scenic area facade easements and there is no reason why a facade easement could not be granted in the courts. It was stated that the easement would go with the land and not with the person. It is not an easy procedure but that a test case should be run and the Commission should get a property owner to "go along with it". There was further discussion and M.S. Kopczynski again voiced her opinion that it was too ambitious. Mr. Ted Wasielewski then made a motion to explore the possi- bility of pursuing a facade easement within the framework of its legal aspects and the limits of the budget. Mr. Nimtz remarked treat perhaps the Commission should wait until the facade institute was scheduled which is under a grant from the National Trust. Ms. Davisson declared that the City March 21, 1977 Page 4 Survey should be finished first, as well as the standards and Certificate of Appropriateness. Mr. Nimtz seconded the former motion and it .passed unanimously. . Ms.. Jeanne Derbeck had some questions on this matter which were then -- clarified by Mr. Wasielewski. Mr. Stivers asked how bind- ing such an easement would be and was told it was "very binding". Public Relations and Community Education Ms. Davisson informed the Commission that yet another seg- ment of historic preservation will be aired at 3:30 p.m - on Thursday, April 7, on Channel 34, and it will concen- trate on the Greek Revival style of architecture. She likewise said a $13,000 grant from the Committee of the Humanities was applied for by IUSB to produce three video-tapes for the game, Architecture - American Style -- and then going out in the community and interviewing per- sons. The game would be the vehicle. The first talk - would be about ageing people and ageing houses. The sec- ond on public policy and the third talk on the future and relationship of architecture. She stressed that these tapes would be available to the public. Also, they would be aired on Channel 2 - cable television. Standards and. Historic Plan Mr. Oxian reported that he and Joann Sporleder had had a meeting and drafted an application for a Certificate -of Appropriateness. He distributed copies of this draft. He said it could be used for either landmarks or districts. He advised the Commission members to look it over and bring their comments and suggestions to the next caucus. Mr. Oxian then said that he and Ms. Sporleder also went over the guidelines for the Review Board and suggested that mem- bers of the Commission and some outside individuals serve on it. Ms. Kopczynski said that possibly an architectural his- torian or certified engineer should be on this Board. Mr.- Oxian stated that possibly members of the Landmarks Commit- tee or the Districts Committee, as well as some other out- side person should serve. Ms. Deloris Davisson asked about compensation for such work and was toldthat it would either be voluntary or paid. Mr. Oxian then said that Ms. Sporleder suggested that the Standards as well as the Certificate of Appropriateness or other legal papers should be placed in the County Recorder's office. Ms. Davisson then discussed the standards which applied to landmarked. structures and who would police such structures. - She was told by Mr. Oxian, that, for the most part, the land, marked structures fell under_ "B" standards and that the Build- ing Department was -the policing -body. -Ms. Davisson voiced her March 21, 1977 Page 5 opinion that she thought things were being done in a "piecemeal" way and she felt the Commission should get the survey done first and do the Historic Plan. Mr. Oxian stated that a "Plan" or standards had already been set for the county and the survey there was completed .... thereforea these plans would apply to county structures. Ms. Kopczyn- ski inquired if this meant that "landmarking" of city structures would not occur until after the city survey was completed. Mr. Oxian said, yes, no city homes would be so - designated until the completion of the survey and the crea- tion of a city plan. Presidential Report Mr. Oxian then informed the Commission of the new committee appointments (see attached). These were duly noted by the Commission. Mr. Nimtz moved that the Commission formally invite Ms. -- Joann Sporleder to serve on the Commission again as archi- tectural historian. A letter, signed by Mr. Oxian, should be drafted in this matter. Mr. Stivers seconded this mo- tion and it passed unanimously. Mr. Oxian then brought up the matter of the mailing list for the monthly meeting minutes. He felt that a note should accompany the next mailing, asking the individuals to return a call to the office if they desire to continue receiving the minutes. He said not everyone receiving the minutes is really interested in them. He said according to state law, as long as the minutes are available to the public in the office, this is all that is required. Mr. Oxian then mentioned that last year a weekly calendar was sent to Commission members from the office which in- cluded.dates of committee meetings as well as other pertin- ent affairs. He would like this calendar resumed. Staff Report Ms. Kopczynski informed the Commission that she had again been in contact with CETA regarding the hiring of the 13 -week person and the 9 -month person for a research assistant. Btt :7she had not heard anything definite. Mr. Oxian said he would call Mr. Kelsenberg on this matter. Ms. Kopczynski then spoke about her participation at the Commuini.ty Preservation Conference in Marshall, Michigan - the previous week.- She said she had submitted her applica- tion for this on a "whim" and was pleasantly surprised to be one of 30 persons nationally chosen for this Conference. She informed the Commission that a detailed report of all facets -of this conference would be forthcoming. March 21, 1977 Page 6 Ms. Kopczynski then distributed copies of her resignation, effective April 8th, but her last working day would be - April 1st. She informed' -the Commission that she had ac- cepted a position as Associate Librarian in the Civil Rights Center of the Law Library of Notre Dame University. There was discussion about the matter of filling the position of Planner, and Mr. Oxian said that perhaps Ms. Kopczynski could give some input. Mr. Oxian then appointed a search - committee consisting of Mr. Rothermel and.Ms. Deloris Davis - son to look into this matter of Ms. Kopczynski's replacement. Ms. Kopczynski then informed the Commission that the term --of Tom Catanzarite had expired in March. Mr. Oxian then sug- gested that a letter be sent out to see if Mr. Catanzarite be re -appointed to the Commission. Legal Committee Mr. F. Jay Nimtz reported that he had drafted a reply to the brief regarding the Walter Rinderle law suit and had submitted.it to court. He said it was now under advisement under Judge Miller. 7. Old Business There was no report 8. New Business Mr. Oxian stated that this mention should have been brought up under Budget and Finance and said that he had talked to Tom Catanzarite about the $5,000 grant and if there are any requests for the expenditure of this amount, they should be put together and submitted to Mr. Catanzarite and request the amount of money for these purposes. Mr. Rothermel informed the Commission that since he was already on the Area Plan Commission he would.be willing to serve as the H.P. Commission's representative on the Ci#zen's Advisory Committee, as discussed in Item 8 in the February Minutes. Mr. Oxian wanted to know the status of the pending enabling legislation. Ms. Kopezynski said she felt it was still in Committee and Mr. Nimtz likewise said he did not know its status. Ms. Davisson remarked that perhaps Jim Bellis, who is an arch- eologist on the Notre Dame faculty, and.works with the Depart- ment of Natural Resources could come to a meeting of the Com- mission and bring it up-to-date on relevant matters. 9. Hearing of Visitors Both Mrs. Whittaker and Mr. Kline were heard.from previously. March 21, 1977 Page 7 10. Announcements and Miscellaneous Matters Mr. Oxian mentioned.that hiveport of the National -Trust Convention in Philadelphia last year should be discussed at some future time. 11. Adjournment Mr. Al Stivers made a motion to adjourn the Maich'meeting. Mr. Ted Wasielewski seconded this and the motion passed unanimously.
