A. f ORDINANCE NO. 8.3-V9-9S AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LAND IN PENN TOWNSHIP CONTIGUOUS THEREWITH; Northeast Corner of Ironwood Road and Killington Way STATEMENT OF PURPOSE AND INTENT A petition for voluntary annexation of 1.837 acres located in Penn Township, St. Joseph County, Indiana, has been filed by the owners of Seventy five (75) percent of the total assessed value of the land in the territory sought to be annexed. It is the intent and purpose of this Ordinance to annex this territory to the City of South Bend, Indiana. THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: SECTION I. That the following described real estate situated in St. Joseph County, Indiana, being contiguous by more than one-eight (1/8) of its aggregate external boundaries with the present boundaries of the City of South Bend, Indiana, shall be and hereby is annexed to and brought within the City of South Bend: A parcel of land located in the Northwest Quarter (NW*) of Section Thirty-Two (32) , Township Thirty-Seven (37) North, Range Three (3) East and all being in Penn Township, St. Joseph County, Indiana and being more particularly described as follows: Commencing at a monument, found, at the southwest corner of the Northwest Quarter (NW*) of Section Thirty-Two (32) , Township Thirty-Seven (37) North, Range Three (3) East; thence North 00°-00'-00" East (this and all subsequent bearings being assumed) , along the West Line of said Northwest Quarter (NW*) of Section Thirty-Two (32) and also being along the centerline of a public road now known as Ironwood Road, a distance of 662.88 feet; thence South 89°-52'-28" East a distance of 200.00 feet to the northeast corner of "Outlot-A" of Stonehedge Subdivision - Section I and as shown on recorded Document No. 8721016 dated July 6, 1987 and also being a point on the current City of South Bend Corporate Limits and also being the Point of Beginning of this description; continuing South 89°-52'-28" East a distance of 140.00 feet; thence South 00°-00'-00" East a distance of 376.68 feet to a point on the north line of Lot No. 26 of said recorded plat of Stonehedge Subdivision - Section I ; thence South 77°-00'-00" East, along the north line of said Lot No. 26, a distance of 73.94 feet to the northeast corner of said Lot No. 26 and also being a point on the west right-of-way of a public street now known as Bromley Chase; thence South 30°-OO'-OO" West, along the west right-of-way line of said Bromley Chase, a distance of 161.69 feet to a point of curvature of a tangent curve; thence southwesterly along a curve to the right, said curve having a radius of 30.00 feet and being subtended by a long chord having a bearing of South 72°-04'-50" West and a length of 40.21 feet an arc distance of 44.07 feet to a point of reverse curve, said point also being on the north right-of-way line of a public road now known as Killington Way; thence northwesterly along a curve to the left, said curve having a radius of 245.00 feet and being subtended by a long chord having a bearing of North 77°-03'-38" West and a length of 95.36 feet an arc distance of 95.97 feet; thence North 00°-00'-00" West, along the current City of South Bend Corporate Limit, a distance of 524.67 feet to the Point of Beginning of this description and containing 1.837 acres, more or less. SECTION II. That the boundaries of the City of South Bend, Indiana, SECTION III. That the above described real estate shall be and hereby is assigned to the 5th Councilmanic District of the City of South Bend, Indiana. SECTION IV. This Ordinance shall be in full force and effect from and after its enactment, approval by the Mayor, and legal publication. M MBER W THE COMMON COUNCIL PETITION FOR VOLUNTARY ANNEXATION TO: COMMON COUNCIL CITY OF SOUTH BEND, INDIANA Pursuant to Indiana Code 36-4-3-5, the undersigned hereby petition(s) the Common Council of the City of South Bend, Indiana for voluntary annexation to the City of South Bend, Indiana, of a certain parcel of real estate situated in Penn Township, St. Joseph County, Indiana, and in support of which petition allege(s) and affirm(s) as follows: 1.) They are the owner(s) (hereinafter "petitioner" or "petitioners") of a parcel of land more particularly described in Exhibit "A", which is incorporated herein by this reference as if fully set forth herein (hereinafter "the parcel") . 2.) Petitioner(s) desire that the parcel be annexed to the City of South Bend, Indiana by proper ordinance. 3.) The parcel is located in Penn Township, St. Joseph County, Indiana. Said parcel is outside of but contiguous with the City of South Bend, Indiana. 4.) The parcel is 1.837 acres in size and currently has the following use(s) on it: Vacant 5.) That this Petition is signed by at least (Check One) : a. Fifty-one (51%) of the owners of the land in the territory sought to be annexed; OR Y b. The owners of seventy-five percent (75%) of the total assessed value of the land for property tax purposes.
