GAMMON Approved and signed by me a— (V '99.3 Mayor ORDINANCE NO. 2371- AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY 1st East-West alley South of Bartlett Street East of Lafayette Boulevard and 1st North-South alley East of Lafayette Boulevard South of Bartlett Street to the South line of Lot 19 in Reynold's Addition. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: The 1st East-West alley South of Bartlett Street running East from Lafayette Boulevard to the West right-of-way line of the 1st North-South alley East of Lafayette Boulevard and South of Bartlett Street. A distance of approximately 165 feet; and The 1st North-South alley East of Lafayette Boulevard from the South right-of-way line of Bartlett Street to the South boundary of Lot 19 as shown on the recorded plat of Reynold's Addition to the City of South Bend, Indiana, which is also the South end of that alley which is vacated South to Navarre Street. A distance of approximately 239 feet. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The follow property may be injuriously or beneficially affected by such vacating: Lots 183, 184, 195, 178, 365, 366 and 367 in the Original Town now the City of South Bend; Lots 4-10; Lot "B", Lots 12, 13, 14, 1, 2, 3, and Lots 15-19 in Reynold's Addition to the City of South Bend. SECTION IV. The purpose of the vacation of the real property is to: Permit development of adjacent property for use in conjunction with Memorial Hospital expansion. SECTION V.
