Pleasant St. , from the west right-of-way line of S. Thirty-First Street to the eastright-of way line of the first north-south alley west of S.Thirty-First Street, for a distance of approximately 165ft. and a width of approximately 14ft. Part located in Egglestof s First Addition in the city of South Bend, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, theCommon Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows SECTION ! . THE COMMON COUNCIL of the City of South Bend having held a public hearing on the petition to vacate the following property; The first east-west alley north of E. Pleasant St. , from the west right-of-way line ofS. Thirty-First Street to the east right-of-way line of the first north-south alley west of S. Thirty-First Street, for a distance of approximately 165ft. and a width of approximately 14ft. . Part located in Eggelestons First Addition in the city of South Bend, Indiana. hereby deternines that it is desireable to vacate said property. SECTION 2. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, tele- phone, gas, water, sewer, surface water control structures and ditches within the vacated right-of-wat, unless such rights are released by the individual utilities. SECTION 3. The following property may be injuriously or beneficially affected by such vacating: Lots 44/1530-01 and 45/1529 SECTION 4 . The purpose of the real property is to: To provide our children a safer place to play. SECTION 5. PLEASANT STREET Dear Members of the Council: In accordance with Municipal Code Section 18-53 .8, a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition as submitted by Mr. Mark Banfy, 1101 South 31st Street, South Bend, Indiana and Mr. David Knight, 1023 South 31st Street, South Bend, Indiana, to vacate the following alley: The first east/west alley north of E. Pleasant Street, from the west right-of-way line of S. Thirty-First Street to the east right-of-way line of the first north/south alley west of S. Thirty-First Street, for a distance of approximately 165 feet and a width of approximately 14 feet. Part located in Eggelestons First Addition in the City of South Bend, Indiana. For your information, the Board of Public Works received favorable recommendations from the Legal Department, Police Department, Engineering Department, Fire Department, Sanitation Department, Department of Economic Development and the Area Plan Commission concerning this vacation. Copies of the recommendations received by the Board are attached. Therefore, the Board submits to the Council a favorable recommendation concerning this alley vacation.
