JONES, CITY LERK REGULAR MEETING March 23, 2020 Be it remembered that the Common Council of the City of South Bend,Indiana met in the Council Chambers of the County-City Building on Monday, March 23, 2020 at 7:00 p.m. The meeting was called to order by Council President Tim Scott. Jones City Clerk Bianca Tirado Chief Deputy Clerk Graham Sparks Deputy Clerk Bob Palmer Council Attorney REPORT FROM THE SUB-COMMITTEE ON MINUTES There was no report from the Sub-Committee on Minutes SPECIAL BUSINESS Council President Tim Scott announced that due to the recent development of the COVID-19 Pandemic, this Council Meeting would be considered as an emergency Council Meeting. As a result, the overall format and rules would be different from that of a regular standing Council Meeting. Councilmember Karen L. White made a motion to suspend the rules in order to have all three (3) readings of the following bills to be held at the same meeting. Councilmember Sharon L. McBride seconded this motion which carried by a roll call vote of nine(9) ayes. Councilmember Sheila Niezgodski then made a motion to suspend the rules in order to advance First Readings on the Agenda. Councilmember Sharon L. McBride seconded this motion which carried by a roll call vote of nine (9) ayes. BILLS ON FIRST READING BILL NO. 13-20 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING ADDITIONAL FUNDS FOR CERTAIN DEPARTMENTAL AND CITY SERVICES OPERATIONS IN 2020 OF $500,000 FROM REGULAR MEETING March 23, 2020 ECONOMIC DEVELOPMENT INCOME TAX (#408) Councilmember Jake Teshka made a motion to send Bill No. 13-20 to the full Council for Second Reading and Public Hearing for tonight's meeting. Councilmember Sheila Niezgodski seconded this motion which carried by a voice vote of nine (9) ayes. 15-20 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING ORDINANCE NO. 10685-19, WHICH FIXED MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON-BARAINING EMPLOYEES OF THE CITY OF SOUTH BEND FOR CALENDAR YEAR 2020, TO ADDRESS USE OF SICK LEAVE, PAY, AND TELEWORKING DURING DECLARED EMERGENCY SITUATIONS Councilmember Jake Teshka made a motion to send Bill No. 15-20 to the full Council for Second Reading and Public Hearing for tonight's meeting. Councilmember Sheila Niezgodski seconded this motion which carried by a voice vote of nine (9) ayes. RESOLVE INTO THE COMMITTEE OF THE WHOLE At 7:06 p.m. Councilmember Karen L. White made a motion to resolve into the Committee of the Whole. Councilmember Jake Teshka seconded the motion which carried by a voice vote of nine (9) ayes. Councilmember Sharon L. McBride, Chairperson, presiding. Councilmember Sharon L. McBride explained the procedures to be followed for tonight's meeting in accordance with Article 1, Section 2-11 of the South Bend Municipal Code. PUBLIC HEARINGS BILL NO. 13-20 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING ADDITIONAL FUNDS FOR CERTAIN DEPARTMENTAL AND CITY SERVICES OPERATIONS IN 2020 OF $500,000 FROM ECONOMIC DEVELOPMENT INCOME TAX (#408) Councilmember Karen L. White, chair of the Personnel and Finance Committee,reported that they met this afternoon and send this bill to the full Council with a favorable recommendation. Dan Parker, City Controller for the City of South Bend with offices located on the 12th floor of the County-City Building, South Bend, IN, served as the presenter for this bill. Mr. Parker went over the key points of this bill,highlighting the fact that this money is to be used for unforeseen events due to the recent COVID-19 outbreak.. This being the time heretofore for Public Hearing on the above bill, proponents and opponents to this bill were given an opportunity to be heard. There were none. Councilmember Tim Scott made a motion to send Bill No. 13-20 to the full Council with a favorable recommendation. Councilmember Jake Teshka seconded this motion which carried unanimously by a roll call vote of nine(9) ayes. 2 REGULAR MEETING March 23, 2020 15-20 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING ORDINANCE NO. 10685-19, WHICH FIXED MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON- BARAINING EMPLOYEES OF THE CITY OF SOUTH BEND FOR CALENDAR YEAR 2020,TO ADDRESS USE OF SICK LEAVE, PAY, AND TELEWORKING DURING DECLARED EMERGENCY SITUATIONS Councilmember Karen L. White, chair of the Personnel and Finance Committee,reported that they met this afternoon and send this bill to the full Council with a favorable recommendation. Councilmember Rachel Tomas Morgan, offices located on the 4th floor of the County-City Building, South Bend, IN, served as a presenter for this bill. Councilmember Rachel Tomas Morgan summarized the main points behind the importance of this bill's passage. She referenced best practices of other communities as well as the direction given to municipalities by the Indiana State Government as guidinthe importance for this legislation. Mayor James Mueller, offices located on the 14th floor of the County-City Building, South Bend, IN, served as a presenter for this bill. Mayor Mueller gave remarks on the impetus for the need of the passage of this legislation. Councilmember Henry Davis Jr. asked Mayor Mueller if the City will be conducting testing for the COVID-19 pandemic. Mayor Mueller responded that the City will not be providing testing and that responsibility is with the local medical providers. This being the time heretofore for Public Hearing on the above bill, proponents and opponents to this bill were given an opportunity to be heard. There were none. Councilmember Troy Warner commended Mayor Mueller and his Administration for their response to this recent health crisis. Councilmember Karen L. White commended Councilmember Rachel Tomas Morgan for her work with the Administration on this Ordinance and the press release. She also thanked the Administration and the first(1St)responders amid this crisis. Councilmember Rachel Tomas Morgan commended everyone for their efforts on this legislation and stated that this legislation, and the Resolution to come, serve as great examples of government and its responsiveness to the needs of today and the unknown of tomorrow. Councilmember Sharon L. McBride stated that she would like to echo what everyone has said. Councilmember Sheila Niezgodski commended Councilmember Tomas Morgan for her work on this bill. Councilmember Henry Davis Jr. commended Councilmember Tomas Morgan and commented on his desire to have a plan and a direction to helping more than just the employees of the City of South Bend. Councilmember Tim Scott made a motion to send Bill No. 15-20 to the full Council with a favorable recommendation. Councilmember Jake Teshka seconded this motion which carried unanimously by a roll call vote of nine(9) ayes. RISE AND REPORT Councilmember Sheila Niezgodski made a motion to rise and report to full Council. Councilmember Troy Warner seconded the motion which carried by a voice vote of nine(9) ayes. 3 REGULAR MEETING March 23, 2020 REGULAR MEETING RECONVENED Be it remembered that the Common Council of the City of South Bend reconvened in the Council Chambers on the fourth floor of the County-City building at 7:20 p.m. Council President Tim Scott presided with nine (9)members present. BILLS —THIRD READING BILL NO. 13-20 THIRD READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING ADDITIONAL FUNDS FOR CERTAIN DEPARTMENTAL AND CITY SERVICES OPERATIONS IN 2020 OF $500,000 FROM ECONOMIC DEVELOPMENT INCOME TAX (#408) Councilmember Karen L. White made a motion to adopt Bill No. 13-20. RESOLUTIONS BILL NO. 20-05 A RESOLUTION ON BEHALF OF THE SOUTH BEND COMMON COUNCIL CONSENTING TO THE RENEWAL OR CONTINUANCE OF A DECLARATION OF A LOCAL DISASTER EMERGECY UNTIL THE NEXT REGULAR OR SPECIAL COMMON COUNCIL MEETING Councilmember Troy Warner, chair of the Health and Public Safety Committee,reported that they met this afternoon and send this bill to the full Council with a favorable recommendation. Councilmember Rachel Tomas Morgan, offices located on the 4ch floor of the County-City Building, South Bend, IN, served as a presenter for this bill. Councilmember Tomas Morgan summarized the main points behind the importance of this bill's passage. She referenced Indiana Code §10-14-3-29 regarding the rules and guidelines of local disaster emergencies. This being the time heretofore for Public Hearing on the above bill, proponents and opponents to this bill were given an opportunity to be heard. There were none. Councilmember Tim Scott commended Councilmember Tomas Morgan on her work on this legislation. 4 REGULAR MEETING March 23, 2020 Councilmember Karen L. White made a motion to adopt Bill No. 20-05. Councilmember Sharon L. McBride seconded this motion which carried by a roll call vote of nine (9) ayes.
