Assistant City Engineer SUBJECT: Agenda Request — Amendment No.1 to Prof. Services Agreement 117-132 WWTP Electrical Improvements DATE: May 5, 2020 The Division of Engineering and Division of Utilities request the Board of Public Works approval of Amendment No. 1 to a Professional Services Agreement with Black & Veatch for additional engineering design and construction administration services for Project No. 117-132 WWTP Electrical Improvements. Additional services performed are described in Exhibit K, Amendment to Owner - Engineer Agreement Amendment No. 1, attached. The additional services result in an overall increase to the Design and Construction Administration Services Contract. Original Contract: $602,919.00 Amendment No. 1: $ 55,785.00 New Contract Total: $658,704.00 The funding source for this project is the Division of Utilities, Sewage Works Operations Account (641-06-605-514-431002). This is EXHIBIT K, consisting of 2 pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated May 26, 2020 AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. 1. Background Data: a. Effective Date of Owner -Engineer Agreement: b. Owner: Board of Public Works, City of South Bend, Indiana C. Engineer: Black & Veatch Corporation d. Project: Wastewater Treatment Plant Electrical Improvements Design and Construction Phase Services 2. Description of Modifications: a. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: Task 104 — Design and Contract Document Preparation Engineer shall prepare Contract Documents for the addition of drainage piping and grading from the depression south of the Reuse Building to the manhole near the previous Nitrification Towers. Task 202 — Construction Administration As is indicated in Paragraph 7.05 from the General Conditions for the Construction Contract, Engineer shall be reimbursed for costs associated with evaluating the Contractor's proposed substitution requests. Engineer reviewed the below requests submitted by the Contractor: 1. Deviation 2 — Alternative Routing and Installation of Conduits for SESWGR-1 2. Deviation 3 — Alternative Routing and Installation of Conduits for NESWGR-5 & 6 3. Value Engineering Ideas for the Generator and Switchgear (nine in total) submitted via email on April 29, 2019. Additional responses to Requests for Information (RFIs) submitted by the Owner or Contractor. The original scope included 30 RFIs. An additional 20 RFIs are expected to be submitted by the Contractor resulting in a total number of 50 RFIs. Task 204 — Shop Drawing and Submittal Review As is indicated in Paragraph 7.16 from the General Conditions for the Construction Contract, Engineer shall be reimbursed for costs associated with reviewing a fourth or subsequent submittal of a Shop Drawing, sample or oher item requiring approval. The Engineer reviewed the following shop drawings submitted by the Contractor: 1. 033053-OO1C and 00113— Cast -in -Place Concrete 2. 263213-OO1C —Engine Generators 3. 262423-002C and 002D — MCC Miscellaneous Buckets b. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: For professional services described under item 2a, Owner agrees to pay Engineer in accordance with the Agreement for Professional Services on a lump sum basis. The total compensation for Amendment 1 shall increase the lump sum amount by $55,785 and shall not be revised without written authorization. 5. Agreement Summary (Reference only) a. Original Agreement amount: $602,919 b. Net change for prior amendments: $0 c. This amendment amount: $55,785 d. Adjusted Agreement amount: $658,704 The foregoing Agreement Summary is for reference only and does not alter the terms of the Agreement, including those set forth in Exhibit C. Owner and Engineer hereby agree to modify the above -referenced Agreement as set forth in this Amendment. All provisions of the Agreement not modified by this or previous Amendments remain in effect.
