GAMMON l Approved and signed by me 1 9 Mayor • ORDINANCE NUMBER 2 3 6 6-9.3 An ordinance to vacate the following described property: the first north-south alley west of North LaPorte Avenue from the north right-of-way line of West Washington Street to the south right-of-way line of the first intersecting alley north of West Washington Street, for a distance of approximately 172 feet and a width of approximately 14 feet. Part situated in Rockafeller's Third Addition to the city of South Bend, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indian Code Section 36-7-3- 12, the Common Council is charge with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. Now, therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I_ The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: the first north-south alley west of North LaPorte Avenue from the north right-of-way line of West Washington Street to the south right-of-way line of the first intersecting alley north of West Washington Street, for a distance of approximately 172 feet and a width of approximately 14 feet. Part situated in Rockafeller's Third Addition to the city of South Bend, Indiana. Section II_ The City of South Bend hereby reserves the rights a easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. Section III. The following property may be injuriously or beneficially affected by such vacating: a. lot 18-1042-1825 (also known as 925 West Washington) b. lot 18-1042-1824 (also known as 921 West Washington) c. lot 18-1042-1820 (also known as 119 LaPorte Avenue) Section IV_ The purpose of the vacation of the real property is to: a. eliminate thru automobile traffic between 921 and 925 West Washington, thereby reducing night noise levels and headlight glare. b. improve property security by restricting automobile access to a private common drive with private garages located on abutting property. c. improved aesthetics from Washington Street with a paved shared drive and/or landscaping.
