GAMMON Approved and signed by me • l 13 19 • Mayor ORDINANCE NO. 2398-93 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING SECTION 2-13 OF ARTICLE 4 OF THE SOUTH BEND MUNICIPAL CODE ESTABLISHING DEPARTMENTS TO PERFORM ADMINISTRATIVE FUNCTIONS OF THE CITY OF SOUTH BEND STATEMENT OF PURPOSE AND INTENT Section 2-13 of Article 4 of the South Bend Municipal Code enumerates the departments within the executive branch of the City of South Bend. Among the departments enumerated is the Economic Development Department. Despite its name, however, the Economic Development Department focuses a significant amount of its time and resources on not only economic development activities, but also on a wide-ranging variety of community support and development efforts. It is the position of the Economic Development Department that its departmental designation should convey more fully the multi-faceted purposes and work of the department. It is similarly the determination of the Common Council of the City of South Bend that the name of the Department of Economic Development should be changed to convey properly the work of the department. Section 2-13 identifies as among the administrative functions of the Department of Economic Development the Youth Services Bureau and the Human Rights Commission. However, the Youth Service Bureau does and has for some time stood as a not-for-profit corporation separate and apart from the City and its Department of Economic Development. In addition, the City administration has determined that the administration of the Human Rights Commission more properly rests with the Administration and Finance Department. The Common Council has determined that Section 2-13 should be amended to identify, correctly, the administrative functions of the Department of Economic Development and the administrative functions of the Administration and Finance Department. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I . Section 2-13 , of Article 4 of the South Bend Municipal Code shall be and hereby is amended to read as follows: Sec. 2-13 . Departments Established. (A) The following executive departments are established to form administrative functions required to fulfill the needs of the City' s citizens: • ( 1) Administration and Finance Department; ( 2) Law Department; (3) Public Works Department; (4) Police Department; (5) Fire Department; ( 6) Public Parks Department; (7) Community and Economic Development Department; (8) Code Enforcement Department; (9) Building Department. (B) In addition to the statutorily provided, the administrative functions of the departments of the City shall be as follows: (1) Administration and Finance Department: (a) Administrative matters; (b) Fiscal matters; (c) Purchasing (d) Personnel; (e) License issuance; (f) City parking garages and parking lots/; (g) Human Rights Commission. ( 2) Law Department: (a) Collection of overdue accounts receivable; (b) Self Insurance. ( 3) Public Works Department: (a) Engineering; (b) Management of streets, including municipal services, parking, traffic control, and street lighting; (c) Sanitation; (d) Sewers; (e) Waste water treatment; (f) Waterworks; (g) Vehicle maintenance. (4) Police Department ( 5) Fire Department ( 6) Public Parks Department: (a) Parks; (b) Zoos; (c) Greenhouses; (d) Playgrounds; (e) Cemeteries; (f) Recreation programs and centers. ( 8) Code Enforcement Department: (a) Substandard buildings; (b) License inspection and enforcement; (c) Environmental code enforcement; (d) Weights and measures; (e) Citizen service center. (9) Building Department: (a) Building inspections and permits; (b) Enforcement of building codes; (c) Zoning inspection and enforcement; (d) Board of Zoning Appeals administrative support; (e) Building trade licensing/registration testing and enforcement. (C) A department head may establish, abolish or consolidate offices, divisions and bureaus within his department to permit the proper and efficient administration of that department, subject to the availability of appropriated funds within the department and the approval lot of the Mayor. (D) A department head may supervise and coordinate the boards, commissions, authorities, offices, divisions and bureaus within his department except where prohibited by State law. (E) No department head may delegate his duty to administer and supervise his department, to issue rules or regulations as prescribed by law, or to have the ultimate responsibility for the proper performance of the duties and functions vested in his department. (F) Each department shall exercise such powers to perform such duties and functions as are prescribed by law and as are directed by the Mayor. Section II. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
